Dear Mr. Gibbs:

Please be advised the undersigned represents the Honorable Dale Cohen in the above reference action. You are subpoenaed to appear for deposition before me on Wednesday, August 12, 2010 at 11:00 a.m., at 600 S. Andrews Avenue Room, 600, Fort Lauderdale, Florida. Enclosed, is a copy of the subpoena that was served to you. You must be there on time.

You told my process server that you did not want to get involved in this matter and slammed the door in his face. Nonetheless, you were legally served with the subpoena. Even though you may not want to appear, you must appear or you could be held in contempt of the State of Florida Judicial Qualifications Commission, an arm of the Florida Supreme Court. If you are held in criminal contempt, that could be construed as a law violation that would violate your felony probation. Lets please not go down that road.

You cannot get into any trouble by simply showing up for the deposition and telling the truth. Intentionally ignoring the subpoena could cause you all kinds ofproblems. Please show up on time and just answer the questions. The attorney for the other side is driving here from Clearwater Florida and if you fail to appear, we will have to have a court order you to show up and the other lawyer will have to drive hundreds of miles for that one deposition again.

Please call me, so that we may verify that you will be present. You have no duty to call but, if you do, I can tell you. all about the process and explain it all to you. I look forward to seeing you in person at the deposition.
