BOARD OF EDUCATION SAN DIEGO UNIFIED SCHOOL DISTRICT

San Diego, California Resolution in the Matter of the Elimination of Classified Services

RECITALS

1. The SAN DIEGO UNIFIED SCHOOL DISTRICT (DISTRICT) and the CALIFORNIA SCHOOL EMPLOYEES ASSOCIATION (CSEA) executed a Collective Bargaining Agreement (AGREEMENT) for Paraeducators unit members effective July 1, 2016 through June 30, 2017.

2. Article 18 of the aforesaid AGREEMENT covers Layoff and

Reemployment and Section 1 of that Article specifically exempts members of the bargaining unit from Article VII, “Layoff and Reemployment,” of the of the Employment Regulations for the Classified Service of the San Diego Unified School District; and

3. CSEA has been apprised of the contemplated action in order to afford it

the opportunity to exercise its rights under the Educational Employment Relations Act;

4. Article 18, Section 4 of the AGREEMENT recognizes the authority of the DISTRICT to make a decision to lay off or reduce hours for reasons of lack of work or lack of funds, and;

5. California Education Code Sections 45114, 45117, 45298 and 45308

govern the layoff and reemployment of members of the classified service due to lack of work and, lack of funds; and

1. NOW, THEREFORE, due to lack of work and/or lack of funds, the Board

of Education of the DISTRICT hereby finds that it is in the best interests of this School District that as of June 30, 2017, certain services now being provided by the DISTRICT be reduced or discontinued to the following extent:

See EXHIBIT “A” attached hereto and by this reference incorporated.

2. BE IT FURTHER RESOLVED that as of June 30, 2017 and subject to the completion of any required negotiations, the positions listed in Exhibit “A” be reduced/eliminated to the extent set forth therein.
