An abortion should be performed by a medical

practitioner, but during the first twelve weeks

it may be done by a registered midwife/nurse.

There are two types of abortion procedures:

i. A medical abortion where only pills/tablets are

used (usually this can be done up to 12 weeks).

ii. A surgical abortion involves the use of surgical

procedures.

You should receive counselling before and

after your abortion but a counselor should

not try to persuade you to continue with

your pregnancy if you do not want to.

You have a right to privacy.

CHOICE ONTERMINATION OF

PREGNANCY ACT 1996

ACCESS TO SAFE ABORTION SERVICESIS YOUR RIGHT! 

Section 2 (1) A pregnancy may be terminated by afemale of any age-(a) upon request of a woman during the first 12 weeksof her pregnancy;(b) from the 13th week up to the 20th week of thepregnancy if a medical practitioner, after consultationwith the pregnant woman, is of the opinion that-(i) the continued pregnancy would pose a risk of injuryto the woman's physical or mental health; or(ii) there is a substantial risk that the foetus wouldsuffer from a severe physical or mental abnormality; or(iii) the pregnancy resulted from rape or incest(iv) the continued pregnancy would significantly affectthe social or economic circumstance of the woman(C) after the 20th week of pregnancy if a medicalpractitioner, after consultation with another medicalpractitioner or registered midwife, is of the opinion thatthe continued pregnancy-(i)would endanger the woman's life;(ii)would result in a severe malformation of the foetus; (iii)would pose a risk of injury to the foetus.

Section 27 of the Constitution affords everyone theright to access health care services, including

reproductive health care services.Section 12 of the Constitution guarantees that young

girls and women have the right to make decisionsabout their body and this includes decisions about

reproduction.Section 4 of the National Health Act requires the

State to provide pregnant and lactating women (whodo not have medical aid) with free health services.

The State has the responsibility to provide

reproductive health services including: family planningand contraception, access to abortions as well as

sexual education and counselling services. The Choiceon Termination of Pregnancy Act sets out the

conditions under which safe legal abortions should beprovided
