CHANGE OF OWNER NAME – NO ASSIGNMENT Applicant has requested that the owner name be amended; however, applicant has not explained the reasonfor such request and has not provided or recorded ownership transfer documentation.  The name of the original applicant is Uncle Abies Deli Inc., a NY corporation; the request is toamend this to Jack Lebewohl, a U.S. individual.  The request to change the applicant’s name raises a question regarding whether the proper party filed theinitial application.  Therefore, applicant must clarify whether the proper party filed the originalapplication, and whether the assignee is a successor to applicant’s business.   Pending proper response, therequest to amend the owner name is denied.  An intent-to-use application is void if it was filed in the name of a party who was not entitled to use themark as of the application filing date.  37 C.F.R. §2.71(d); Am. Forests v. Sanders, 54 USPQ2d 1860(TTAB 1999), aff’d , 232 F.3d 907 (Fed. Cir. 2000); TMEP §§803.06, 1201.02(b); see 15 U.S.C.§1051(b).  In addition, an intent-to-use application is void if, prior to filing an allegation of use, theapplication is assigned to a party other than either a successor to the applicant’s business or to a portion ofthe applicant’s business to which the mark pertains, if that business is ongoing and existing.   15 U.S.C.§1060(a)(1); 37 C.F.R. §3.16; Clorox Co. v. Chem. Bank, 40 USPQ2d 1098, 1105-06 (TTAB 1996);TMEP §501.01(a).  A void application cannot be cured by amendment or assignment.  37 C.F.R. §2.71(d);TMEP §§803.06, 1201.02(b).  In such cases, the true owner must file a new application.  TMEP §803.06. If the application was filed by the owner and the original applicant has since changed its name ortransferred ownership of the mark to another entity, then the new owner must submit documentation toestablish a clear chain of title as follows: 

(1)  The new owner must record an assignment, name change or other documentation affectingtitle with the Office’s Assignment Services Branch showing a clear chain of title to the mark inthe new owner, and promptly notify the examining attorney that such documentation has beenrecorded; or

 (2)  The new owner must submit either a written statement, verified with an affidavit or signeddeclaration under 37 C.F.R. §2.20, explaining in detail the chain of title to the current owner, orsubmit documentation showing transfer of title to the new owner.  However, the registration willnot issue in the new owner name without recording chain of title documentation with the Officeand notifying the examining attorney, as specified in (1) above.

 37 C.F.R. §3.73(b)(1); TMEP §502.01; see 15 U.S.C. §1060; 37 C.F.R. §2.193(e)(1). Assignments and other documents affecting title can be filed electronically at http://etas.uspto.gov/.  Thereis a fee for recording such ownership changes.  37 C.F.R. §§2.6(b)(6), 3.41(a); TMEP §503.03(d).  Merelyrecording an assignment or other ownership transfer document does not constitute a response to an Officeaction.  See TMEP §503.01(d).  If the party applying to register the mark is in fact the owner of the mark, but there is a typographical erroror other minor mistake in the manner in which the name of the applicant is set forth in the application, themistake may be corrected by amendment.  U.S. Pioneer Elecs. Corp. v. Evans Mktg., Inc., 183 USPQ 613(Comm’r Pats. 1974); see TMEP §1201.02(c) (providing examples of correctable and non-correctableerrors).

SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION

 

Registration of the applied-for mark is refused because of a likelihood of confusion with the mark(s) inU.S. Registration No(s). 3128169.  Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP§§1207.01 et seq.  See the enclosed registration(s).

 

Trademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered markthat it is likely that a potential consumer would be confused or mistaken or deceived as to the source of thegoods and/or services of the applicant and registrant.  See 15 U.S.C. §1052(d).  The court in In re E. I. duPont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973) listed the principal factors to beconsidered when determining whether there is a likelihood of confusion under Section 2(d).  See TMEP§1207.01.  In this case, the following factors are the most relevant:  similarity of the marks, similarity of the goodsand/or services, and similarity of trade channels of the goods and/or services.  See In re Opus One, Inc., 60USPQ2d 1812 (TTAB 2001); In re Dakin’s Miniatures Inc. , 59 USPQ2d 1593 (TTAB 1999); In reAzteca Rest. Enters., Inc., 50 USPQ2d 1209 (TTAB 1999); TMEP §§1207.01 et seq. Similar Marks The question is not whether people will confuse the marks, but whether the marks will confuse people intobelieving that the goods and/or services they identify come from the same source.  In re West Point-Pepperell, Inc., 468 F.2d 200, 201, 175 USPQ 558, 558-59 (C.C.P.A. 1972); TMEP §1207.01(b).  For thatreason, the test of likelihood of confusion is not whether the marks can be distinguished when subjected toa side-by-side comparison.  The question is whether the marks create the same overall impression.  SeeRecot, Inc. v. M.C. Becton, 214 F.3d 1322, 1329-30, 54 USPQ2d 1894, 1899 (Fed. Cir. 2000); Visual Info.Inst., Inc. v. Vicon Indus. Inc., 209 USPQ 179, 189 (TTAB 1980).  The focus is on the recollection of theaverage purchaser who normally retains a general rather than specific impression of trademarks. Chemetron Corp. v. Morris Coupling & Clamp Co., 203 USPQ 537, 540-41 (TTAB 1979); Sealed AirCorp. v. Scott Paper Co., 190 USPQ 106, 108 (TTAB 1975); TMEP §1207.01(b). Applicant has applied to register “INSTANT HEART ATTACK SANDWICH”.   Registrant’s mark is“HEART ATTACK CAFE”.   Marks may be confusingly similar in appearance where there are similar terms or phrases or similarparts of terms or phrases appearing in both applicant’s and registrant’s mark.   See Crocker Nat’l Bank v.Canadian Imperial Bank of Commerce, 228 USPQ 689 (TTAB 1986), aff’d sub nom. Canadian ImperialBank of Commerce v. Wells Fargo Bank, Nat’l Ass’n , 811 F.2d 1490, 1 USPQ2d 1813 (Fed.  The mere addition of a term to a registered mark generally does not obviate the similarity between themarks nor does it overcome a likelihood of confusion under Trademark Act Section 2(d).  See In reChatam Int’l Inc. , 380 F.3d 1340, 71 USPQ2d 1944 (Fed. Cir. 2004) (GASPAR’S ALE and JOSEGASPAR GOLD); Coca-Cola Bottling Co. v. Jos. E. Seagram & Sons, Inc., 526 F.2d 556, 188 USPQ 105(C.C.P.A. 1975) (BENGAL and BENGAL LANCER); Lilly Pulitzer, Inc. v. Lilli Ann Corp., 376 F.2d324, 153 USPQ 406 (C.C.P.A. 1967) (THE LILLY and LILLI ANN); In re Toshiba Med. Sys. Corp., 91USPQ2d 1266 (TTAB 2009) (TITAN and VANTAGE TITAN); In re El Torito Rests., Inc., 9 USPQ2d2002 (TTAB 1988) (MACHO and MACHO COMBOS); In re Corning Glass Works, 229 USPQ 65(TTAB 1985) (CONFIRM and CONFIRMCELLS); In re U.S. Shoe Corp., 229 USPQ 707 (TTAB 1985)(CAREER IMAGE and CREST CAREER IMAGES); In re Riddle, 225 USPQ 630 (TTAB 1985)(ACCUTUNE and RICHARD PETTY’S ACCU TUNE); TMEP §1207.01(b)(iii). In this case, the respective marks share the identical wording “HEART ATTACK”.   The mere addition ofthe word “INSTANT” merely reinforces the shared wording, and thus does not obviate the similaritybetween the marks.  Further, the wording “SANDWICH” is descriptive and requires disclaimer, anddisclaimed matter is typically less significant or less dominant when comparing marks.  See In re DixieRests., Inc., 105 F.3d 1405, 1407, 41 USPQ2d 1531, 1533-34 (Fed. Cir. 1997); In re Nat’l Data Corp. ,753 F.2d 1056, 1060, 224 USPQ 749, 752 (Fed. Cir. 1985); TMEP §1207.01(b)(viii), (c)(ii).   If the goods and/or services of the respective parties are “similar in kind and/or closely related,” as theyare in this case, the degree of similarity between the marks required to support a finding of likelihood ofconfusion is not as great as would be required with diverse goods and/or services.  In re J.M. OriginalsInc., 6 USPQ2d 1393, 1394 (TTAB 1987); see Shen Mfg. Co. v. Ritz Hotel Ltd., 393 F.3d 1238, 1242, 73USPQ2d 1350, 1354 (Fed. Cir. 2004); TMEP §1207.01(b). Related Goods and/or Services The goods and/or services of the parties need not be identical or directly competitive to find a likelihoodof confusion.  See Safety-Kleen Corp. v. Dresser Indus., Inc., 518 F.2d 1399, 1404, 186 USPQ 476, 480(C.C.P.A. 1975); TMEP §1207.01(a)(i).  Rather, it is sufficient that the goods and/or services are related insome manner and/or the conditions surrounding their marketing are such that they would be encounteredby the same purchasers under circumstances that would give rise to the mistaken belief that the goodsand/or services come from a common source.  In re Total Quality Group, Inc., 51 USPQ2d 1474, 1476(TTAB 1999); TMEP §1207.01(a)(i); see, e.g., On-line Careline Inc. v. Am. Online Inc., 229 F.3d 1080,1086-87, 56 USPQ2d 1471, 1475-76 (Fed. Cir. 2000); In re Martin’s Famous Pastry Shoppe, Inc. , 748F.2d 1565, 1566-68, 223 USPQ 1289, 1290 (Fed. Cir. 1984). Applicant’s goods and/or services include “sandwiches .”   Registrant’s goods and/or services include“café and restaurant services .”   The respective goods and/or services are related because consumers in the market for sandwichesencounter them at cafés and restaurants.  See applicant’s specimen of record showing that sandwiches areserved as menu items at cafes and restaurants.   Conclusion Given the similarity of the marks and the goods and/or services, prospective customers are likely toconfuse the source of the respective goods and/or services.  Accordingly, registration of applicant’s markis properly refused under Section 2(d) of the Trademark Act. 

 Although applicant’s mark has been refused registration, applicant may respond to the refusal(s) bysubmitting evidence and arguments in support of registration. ADVISORY – POTENTIAL LIKELIHOOD OF CONFUSION
