Para-4: As per Concession Agreement Clause 4.1.2, 10.3.1 & 10.3.2, 80% unencumbered land to be provided to Concessionaire by NHAI. ~OO% 3D has already notified up to 09.01.2014 and till date Award Announced for 23 Ville ges out of 30 Villages and 80.50% total land available W.r.t. total law' required (Details given in Annex-I).
Para-S: Status of Condition Precedent is enclosed in Annex-I and Annex-II.
2.It is further informed that total 19 No's of meetings were called by PIU/RO/HQ in which 06 No's of meeting were not attended by the Concessionaire (Copy enclosed Annex-Ill). Its representatives which clearly reflects that the Concessicnaire was never interested to start the work. PIU/RO and I.E. made man:" correspondences (Copy enclosed Annex-tv] to the Concessionaire for setting up the site of Lee and start the work. Concessionaire representatives assured in most of the me-etings to set up the office and start the work project but it was never realized.
3. The Concessionaire never made any efforts to fulfill the condition precedent as
. prescribed in Schedule E of Concession Agreement. No efforts were made as per Article :1= of Concession Agreement for submission of detailed Design, Construction Methodology, Quality Assurance and Procurement, Engineering arv' Construcriontime schedule.
4.The Independent Engineer vide letter no. UNI/HO/C-l6/07-14/372 dated 21.07.20 has asked .reply from Concessionaire within 10 Days for status of condition precedent. The reply of Concessionaire is awaited. The Independent Engineer further commented that "there is no provision in the Concession Agreeme nt: for amicable foreclose of the Project and if the condition precedent has not been fulfilled by the Concessionaire and in absence of his non- performance, only remedy is to en cash his performance security in compliaru= to Article 9 ofthe Concession Agreement."
5. Therefor", the reply received till today is submitted which will further be updated
as comments from Concessionaire and Independent Engineer received after 10 Days.
