During the financi: II closure, we had committed to the Bankers led by Central Bank of India, that the authority '.vill fulfil all the condition precedent within a month. As the authority could not meet the said commitment, we sought the audience of Authority on 218t February 2014 under the Chalm.anshlp of Member Finance and in that meeting we were given full confidence about 'he advance stage of Condition Precedent and all of them will be fulfilled by 31st March 20 4. Thus in good faith and to keep the bankers on board to avoid any embarrassing situ.ttion (Bankers withdrawing) we decided to mutually waive the Condition Precedent and sr.ek the Appointed Date to which Authority readily granted it on 21st February 2014.

But even today the status of those Condition Precedents are as follows :

Right of Way is stjlf not handed over and Award for an area of 101.247 Hectares has.onlybeen passed so far against thetotal requirement of 181.057 Hectares

The said scenario was humbly informed during the review meeting .held on 23rd June 2014 under Chairmwship of Shri. NitinjiGadkari, Honourable Minister, Ministry of Road Transport and Highways and in the said meeting we were asked to convince of banker to remain with the project.

We approached the bankers with the said status of project and requested them to remain aligned but all these bankers were already racing difficulty in their other projects and citing the circular fr: im Ministry of Finance about the 100% ROW expressed 1 heir inability to remain with th project.

This development was accordingly informed to your team led by Member Finance during the review meeting called by Shri. Nitinji Gadkari, Honourable Minister, Mi:listry of Road Transport and Highways on 1st July 2014. Now realising that even today Authority is unable to commit on t'ie exact date aboutthe entire fulfilment of Condition Precedent mentioned in Clause 4.01 its becoming increasingly difficult for us to remain in the project.

Thus in light ,)f the above we humbly request your kindself to amlcablv foreclose the Concession Aueement and kindly return our Performance Bank Guarantee submitted to you on December 14, 2012. W~ also further undertake to not claim any of ine expenditure incurred by us during this last two years.

On-going through the fame, it emerges that the Ooncesslonaire has not been able to fulfill the certain conditions. Fun ner, the Concessionaire has also not able to fulfill the obligations prior to commencement of construction as per Clause 12.1 Article 12. of Volume I of the Concession Agreement. .For this, ;1 number of meetings were also held at various levels by NHAI in the presence of lndependeut Engineer.

In this regard, you ale 'equested to submit your reply within 10 days positively, otherwise it will be understood that yc u have nothing to say and view of Independent Engineer regarding fulfillment of conditions will be conveyed to NHAf for appropriate action in the matter.
