At the request of some interested bidders, an alternate, non-mandatory pre-bid site walk is being offered. The new Pre-Bid Site review is being offered Tuesday, February 18, 2020 starting at 10:00 AM and ending at 12:00 PM. Additionally, please be advised, due to additional time required for the Electrical Design, the Edelman Fossil Park / Water Management System Project Bid Opening has been extended as follows;

Bidder Questions:

The following Bidder questions were received:

1) DPMC classification: as per the DPMC classification for site work the trade designation you need Is C 054 sitework and for the lift station work the classification you need is C062 pumping station. Please add these classifications to the bid documents. The classification C008 is for General Construction not Site work. (good for the Pavilion Bid).

Please see the answer to Question #2 in the attached meeting minutes from the February 11, 2020 Mandatory Pre-Bid Meeting.

2) Please confirm that the water in the pond will be lower by the owner? and what would be the minimum depth of water that will remain in the pond after the lowering.

The pond is dewatered on a daily basis by the on-site personnel to the extent practicable depending on precipitation. This may not be what the bidders require for work. The contractor will be responsible for working with the on-site personnel to keep the area dewatered. The current dewatering pumps are not able to completely drain the intake pond/fossil pit in their current state and the contractor shall assume that they are responsible for any and all additional pumps, sandbags and coffer dams they deem necessary to facilitate work in that area.

As with all other site work, the contractor will go over the plan with the Engineer and Rowan in advance to clear any potential paleontological resource issues beforehand. The contractor can work with on-site personnel to discharge water generated by dewatering activities to the on-site sprayfield.

3) Is it mandatory that the contractor supply a security guard, In accordance with specification section 01 50 00 page 4 paragraph 1.10 SECURITY.

A security guard is not mandatory for this project.

4) Please clarify the bid proposal items in relationship with drawings 002 / 02. See below questions a thru d. a) proposal conveyance piping infiltration to North pond - The North pond is not shown on

the drawing 002 / 02

This refers to the piping from the intake pond/fossil pit area to the primary pH Adjustment Cell.

b) Please clarify: At the pre bid site meeting we were standing at the fossil pit pump station.

1.07 Summary of Work, Section 01 11 13: Engineer and Owner Review of All Installations prior to excavation. After Initial Survey for all Installations including but not limited to Pipe Trenches, Hydraulic Control Structures, Lift Station and PH Adjustment Cells, the Engineer and Owner will be provided ample time by the contractor to review, inspect and approve all layouts prior to excavations. Dr. Zack Boles, resident Paleontologist, will oversee all excavations for Rowan University.

Fossil Hunting – is forbidden anywhere on the premises. If a construction employee does find a fossil, it must be immediately turned over to Dr. Zack Boles.

North Quarry Wall and the Main Fossil Layer, AKA – MFL / both of these areas are highly sensitive areas and cannot be disturbed. If for some reason, access is required, it must be scheduled in advance and supervised by Dr. Zack Boles. Coordination / Water Management contractor must coordinate with the Pole Barn Contractor for his Site Access to the Spoils Pile at the rear of the property.

Crushed Stone at Drainage Trench - A Future Addendum / will include 80 Ton of ¾ clean crushed stone to be spread in the drainage trench at the rear of the property by the Soil Stockpile.

Hold Harmless E-Waiver – All contractor employees must sign and submit the Rowan Hold-Harmless E-Waiver prior to entering the site.

1.08 Construction Facilities & Temporary Controls, Section 01 50 00: Construction Vehicle Access - will be allowed as directed by the CM and Rowan. The contractors must maintain Public and Rowan Access to the Quarry Site and Rowan Facilities at all times.

Contractor Parking - The CM and Rowan University will determine where contractor parking is permitted and only in the area where the work is being performed. No parking is permitted that will inhibit in any way, Public and Rowan Access to the Quarry and active areas of the site. Existing Electric - The Contractor may use existing electric on site and will provide whatever extension cords that are needed for his work. If power is not available, the contractor will provide Generators and fuel for the Generators that may be necessary for the performance of his work. All Temporary Electric provided by the Contractor must meet OSHA standards.

1.09 GEI / Scope Review: Tyler Schott from GEI provided a Scope Review of the Water Management Project. Tyler then walked the Bidders through the site, reviewing the piping systems, including the pumping / lift stations and electrical tie in. JJS and Rowan University assisted in the walk thru.

Is there any contaminated soil or water in the area where excavations need to be preformed to install the Water Management System?

Answer No. 1: There are no contaminated soils or water in the areas where the Water Management System is to be installed. It should be noted that the Water and Soils have naturally occurring acidic PH levels in the range of 3-5 S. U. in places. Question No. 2: Can the Construction Manager clarify the DPMC Qualifications for (Sitework - C-054) and for (Lift Station – C-062) Answer No. 2: There are DPMC Qualifications for Sitework – C-054), for the (Lift Station – C-062) and for (Electrical – C-047).

Question No. 3: Will a second Site Visit be granted by the Owner? Answer No. 3:

Yes, a second Site Visit will be granted by the Owner for anyone that purchased Bid Documents. These Minutes including all questions and answers will be published in the Addendum and become part of the Contract Documents.

1.11 Bid Extension:

N. Pelullo mentioned to the Attendees that the due date for Bids will be extended due to more time required for Electrical Design Drawings. All Document Holders will be notified of the new date and time, via Addendum.

DIVISION 01 - GENERAL REQUIREMENTS SECTION 01 11 13– SUMMARY OF WORK / Addendum No. 2 PART 1 - GENERAL 1.01 WORK OF THIS PROJECT

The Permanent Water Management System consist of the installation of Pumps, including Electrical, Filtering Beds, Intake and Discharge Piping and a Lift Station, along with Excavation and backfill for the System’s.

1.02 CONTRACTS A. The Work will be performed under One Single prime contract as listed below.

1. Contract # C19-00015 – Sitework and Electrical Construction: Contract shall include all labor, materials, equipment and services necessary for the complete construction of all work shown on the Drawings and described in Divisions 00 through 33 of the Specifications.

2. Engineer and Owner Review of All Installations prior to excavation. After Initial Survey for all Installations including but not limited to Pipe Trenches, Hydraulic Control Structures, Lift Station and PH Adjustment Cells, the Engineer and Owner will be provided ample time by the contractor to review, inspect and approve all layouts prior to excavations. Dr. Zack Boles, resident Paleontologist, will oversee all excavations for Rowan University.

The General / Site Contractor is responsible for all respective sections of work. The contractors must make themselves familiar with the total project and all the project documents. No additions to Contract sums will be approved for any contract where work may be shown or noted for that Contract on Drawings or in Specification Sections typical for other trades. The Contractor shall provide third party underground utility location services for all utilities in addition to NJ One Call. NJ One-Call does not mark out utilities within the Rowan University property. All utility information shown on the Contract Documents are diagrammatic in nature and should not be used or considered exact.

1.03 ALTERATIONS AND COORDINATION

A. The General Contractor shall coordinate the entire work of Project, including preparation of general coordination drawings, diagrams and schedules, and control of site utilization; from the beginning of activity, through the project closeout and warranty periods.

1.04 KNOWLEDGE OF CONTRACT REQUIREMENTS A. All Contractors will be held to have examined the site of the Work prior to submitting his proposal

and informed himself, his Subcontractors, Sub-subcontractors and materialmen of all existing conditions affecting the execution of the work.

B. All Contractors will be held to have examined the Contract Documents, and Modifications thereto,

as they may affect subdivisions of the Work and informed himself, his Subcontractors, Sub-subcontractors and materialmen of all conditions thereof affecting the execution of the Work.

C. All Contractors will be held to be thoroughly familiar with all conditions affecting labor in the

neighborhood of the Project including, but not limited to, Unions, incentive pay, procurement, living and commuting conditions and to have informed his Subcontractors and Sub-subcontractors thereof.

D. The Specifications and Drawings shall be considered as a whole and shall not be separated during

the bidding or construction period. Division of specifications into Divisions and Sections is solely for organization and is not intended to define trade responsibilities, unless specifically stated. Each Contractor shall be responsible for all work and, if he divides the Drawings or Specifications for use of subcontracts and material suppliers, he does so at his own risk.

1.05 CONTRACT DOCUMENTS INFORMATION

A. The Contract Documents are prepared in accordance with available information as to existing conditions and locations. If, during construction, conditions are revealed at variance with the Contract Documents, notify the Construction Manager immediately so that supplementary instructions may be issued.

B. The Specifications determine the kinds and methods of installation of the various materials, the

Drawings establish the quantities, dimensions and details of materials, the schedules on the Drawings, give the location, type and extent of the materials.

C. In case of any discrepancy between the various Drawings, or between various parts of the

Specifications or between Drawings and Specifications, the matter shall immediately be submitted to the Construction Manager and for Contractual purposes; the most expensive condition shall apply.

D. Dimensions given on the Drawings govern scale measurements and large scale drawings govern

small scale drawings, except as to anything omitted unless such omission is expressly noted on the larger scale drawings.

E. The techniques or methods of specifying to record requirements varies throughout text, and may

include "prescriptive", "open generic/descriptive", "compliance with standards", "performance", "proprietary", or a combination of these. The method used for specifying one unit of work has no bearing on requirements for another unit of work.

F. Whenever a material, article or piece of equipment is referred to in the singular number in the

Contract Documents, it shall be the same as referring to it in the plural. As many such materials, articles or pieces of equipment shall be provided as are required to complete the Work.

1.06 STANDARDS

A. Whenever a material, article, or piece of equipment is specified by reference to a governmental,

trade association or similar standard, it shall comply with the requirements of the latest publication thereof and amendments thereto in effect on the bid date.

B. Applicable standards of construction industry have same force and effect, and are made a part of

Contract Documents by reference, as if copied directly into Contract Documents, or as if published copies were bound herewith.

C. Where compliance with 2 or more industry standards or sets of requirements is specified, and

overlapping of those different standards or requirements establishes different or conflicting minimums or levels of quality, most stringent requirement, which is generally recognized to be also most costly, is intended and will be enforced, unless specifically detailed language written into the Contract Documents clearly indicates that a less stringent requirement is to be fulfilled. Refer, apparently equal but different requirements, and uncertainties as to which level of quality is more stringent, to Construction Manager for a decision before proceeding. Except for overlapping or conflicting requirements, where more than one set of requirements are specified for a particular unit of work, option is intended to be Contractor's regardless of whether specifically indicated as such.

D. Reference standards referenced directly in Contract Documents or by governing regulations have

precedence over non-referenced standards that are recognized in industry for applicability to work. 1.07 DEFINITIONS (Also refer to 01 42 00 for further references)

A. A substantial amount of specification language constitutes definitions for terms found in other contract documents, including drawings, which must be recognized as diagrammatic in nature and not completely descriptive of requirements indicated thereon. Certain terms used in contract documents are defined generally in this article. Definitions and explanations of this section are not necessarily either complete or exclusive, but are general for the work to extent not stated more ex-plicitly in another provision of contract documents.

B. General requirements apply to entire work of Contract and, where so indicated, to other elements

which are included in the project. C. The term "indicated" is a cross reference to details, notes or schedules on the Drawings, to other

paragraphs or schedules in the Specifications, and to similar means of recording requirements in the Contract Documents. Where terms such as "shown", "noted," "scheduled," and "specified" are used in lieu of "indicated," it is for purpose of helping to locate cross reference, and no limitation of location is intended, except as specifically noted.

D. Where the term "Owner, or Gloucester County Improvement Authority” is used, this shall designate

G. Where the term “General Contractor” is used this shall also mean the same as “Prime Contractor” or “Site Work Contractor” or Water Management Contractor.

H. Where not otherwise explained, terms such as "directed", "requested", "authorized", "selected",

"approved", "required", "accepted", and "permitted" mean "directed by Architect", "requested by Architect", etc. However, no such implied meaning will be interpreted to extend Architect's responsibility into Contractor's area of construction supervision.

I. Where used in conjunction with Architect's / Engineers response to submittals, requests,

applications, inquiries, reports and claims by Contractor, the meaning of term "approved" will be held to limitations of Architect's responsibilities and duties as specified in General and Supplementary Conditions. In no case will "approval" by Architect be interpreted as a release of Contractor from responsibilities to fulfill requirements of the Contract Documents.

J. Whenever the words "or equivalent" are used, the product provided shall be equivalent to the noted

Basis of Design product. The Basis of Design product shall be used to establish a minimum threshold of quality and performance. The burden of proving Equality shall be borne by the contractor. Use of such "or equal" products shall require the submittal of the products with a fully executed CSI Form 13.1A and shall be governed by the same parameters set forth in section 01 63 00 Product Requirements, requiring the same review period and sign off by the Design Professionals. Equipment, products, materials, etc. will be judged on the following basis:

1. Ability to fit into space provided.

2. Quality.

3. Serviceability.

4. Esthetics.

5. Availability of finishes.

6. Workmanship.

7. Economy of operation.

8. Suitability for purpose intended.

9. Performance

K. The project site is the space available to Contractor for performance of the Work, either exclusively or in conjunction with others performing other work as part of the Project. The extent of project site is shown on the Drawings, and may or may not be identical with description of the land upon which project is to be built.

L. Except as otherwise defined in greater detail, term "furnish" is used to mean supply and deliver to

project site, ready for unloading, unpacking, assembly, installation, etc., as applicable in each instance.

M. Except as otherwise defined in greater detail, term "install" is used to describe operations at project

site including unloading, unpacking, assembly, erection, placing, anchoring, applying, working to dimension, finishing, curing, protecting, cleaning and similar operations, as applicable in each instance.

N. Except as otherwise defined in greater detail, term "provide" means furnish and install, complete

and ready for intended use, as applicable in each instance. O. An installer is the entity, person or firm, engaged by the Contractor or his subcontractor or sub-

subcontractor for the performance of a particular unit of work at the project site, including installation, erection, application and similar required operations. It is a general requirement that such installers be expert in operations they are engaged to perform.

P. The testing laboratory is an independent entity engaged to perform specific inspections or tests of

the work, either at project site or elsewhere; and to report and interpret results of those inspections or tests.

Q. Where the words such as "The Contractor shall" and similar words are omitted, the sentence

structure shall be considered to include such words since the Specifications are directional in nature, indicating work to be performed by the Contractor.

R. The term "Subcontractor" is used hereinafter only to delineate the work of the various trades. The

term "Subcontractor" shall not be construed as a firm direction to subcontract a particular Section of the Work.

S. "Piping" includes, in addition to pipe, all fittings, valves, hangers, and other accessories related to

such piping. T. "Concealed" means hidden from sight as in chases, furred spaces, shafts, hung ceilings, or

embedded in construction. U. "Exposed" means "not concealed" as defined above. Work in trenches, crawl spaces, and tunnels

shall be considered "exposed" unless otherwise specifically noted. V. Damage: Any sort of deterioration whether due to weather, normal wear and tear, accident, or

abuse, resulting in soiling, marring, breakage, corrosion, rotting, or impairment of function.

1.08 PARTIAL OCCUPANCY

A. The Contractor agrees to use and occupancy of a portion or unit of the Project before formal acceptance by the Owner under the following conditions:

1. A certificate of Substantial Completion shall be prepared and executed as provided in the

General Conditions. If, in the opinion of the Architect, the Contractor is chargeable with unwarranted delay in completing the Work or other Contract requirements, the signature of the Contractor will not be required. The certificate of Substantial Completion shall be accompanied by a written endorsement of the Contractor's insurance carrier and surety permitting occupancy by the Owner during the remaining period of Project work.

2. Occupancy by the Owner shall not be construed by the Contractor as being an acceptance

of that part of the Project to be occupied. 3. The Contractor will not be held responsible for any damage to the occupied part of the

Project resulting from the Owner's occupancy. 4. Occupancy by the Owner shall not be deemed to constitute a waiver of existing claims in

behalf of the Owner or Contractor against each other.

5. Use and occupancy of any portion of the building by the Owner prior to Project acceptance

does not relieve the Contractor of his responsibility to maintain all insurance and bonds required of the Contractor under the Contract until the Project is completed and accepted by the Owner.

6. The Contractor agrees that the Owner may place and install as much material, equipment

and furnishings as is possible during construction without interfering with orderly progress of the Work and prior to use and occupancy of the various parts of the Work, and further agrees that such placing and installation shall not evidence completion of the Work or signify the Owner's acceptance of the Work or of any part thereof.

1.09 REGULATIONS AND CODES

A. Work shall be in accordance with the latest applicable requirements, regulation and codes as set forth below.

B. Where discrepancies occur, the most conservative approach shall govern. Any interpretation

required shall be made by the Design Professional. 1.10 LIMITED USE OF PREMISES

A. General: The prime contractors shall limit their use of the premises to construction activities in areas indicated; allow for Owner occupancy and use by the public.

1. Confine operations to areas within contract limits indicated. Portions of the site beyond

areas in which construction operations are indicated are not to be disturbed. 2. Keep driveways and entrances serving the premises clear and available to the Owner and

the Public at all times. Do not use these areas for parking or storage of materials and equipment on site.

3. The Contractor’s and their subcontractors’ employees are not allowed to use any of the Rowan

University (RU) facilities including parking facilities unless designated by Rowan and the Construction Manager. Violators will be subject to removal from the project. Note that the Contractor is NOT allowed to bring mobile catering services to the project site since Gourmet Dining is the exclusive food provider on the Rowan campus.

4. The Contractor recognizes that the work on the project is within a very active educational

environment and will require Contractor to use extra care in planning the work, protecting the area of work with barricades, orange snow fence and/or other means to isolate and protect the Public (students, staff, employees and visitors) from the construction zone. The Contractor will cooperate fully with RU and its representatives and address immediately all issues of concern when presented. The Fossil Park and its facilities must always remain open and not have any operations

impeded by the Construction Activities. 1.11 OWNER OCCUPANCY

A. The Owner may wish to occupy a portion of the site prior to full completion. Contractor will cooperate to maintain construction operations in this area to a minimum to avoid conflicts with Owner usage and operations.

1.12.1 PROJECT SCHEDULE

A. A project bidding schedule is included at the end of this section, which is solely for the purpose of informing the bidders of the "overall" projected schedule and milestone dates. A "Construction" Schedule will be developed by the General Contractor upon contract award per other section of this Specification.

B. The interim milestone dates included herein represent our intended interpretation of how the contract

may flow. If the contractor disagrees with an interim milestone date, he may provide justification for changing the date as part of the baseline schedule submission. If the CM and Architect agree with the interim milestone revision, the new agreed upon date becomes the new interim milestone by which Liquidated Damages shall apply. Substantial Completion and Final Completion dates are firm and not negotiable in this contract.

C. The milestone schedule for this project is as follows: 1. Notice to Proceed (NTP) May 20, 2020 (on or about) 2. Substantial Completion* 68 Calendar dys after NTP 3. Final Completion 30 Cal. Dys. after Substantial Completion

*Liquidated Damages of $1,000/day for Substantial Completion Milestone applies for each consecutive calendar day beyond the milestone and completion date(s) established above that the Contractor takes to complete the Work in accordance with the Contract Documents. See Section 00 2113 (Instructions to Bidders), Section 00 4113 (Form of Proposal) and Section 00 7213 (General Conditions).
