2. In the period of not later than 45 calendar days before the aforementioned term: - The Customer has to provide the CAB with the information concerning modifications of: products, the processes of its manufacturing, Technical Construction File, legal essential elements of the declaration of conformity owner, and also one sample of the production, manufactured during the validity period of this Agreement and chosen by the selective control method on the manufacturing plant. This sample is needed for identification and control tests (if such decision will be made); - CAB has to draw up the Contract of Agreement for the works carrying out and the Customer pays for the works. 3. The refusal of fulfilment the provisions of clause 2 from the side of the Customer is the cause for cancellation the right of labelling with the CAB label and the prohibition from the side of the Surveillance Bodies on the import and selling the products in Ukraine as well as products redemption from the market (clause 31 ofTR RE&TTE).

Clause 29 of the Ukrainian Law "About Technical Regulations and conformity assessment" :

4. The rules and conditions of TR conformity label application are defined by the Technical Regulations, which make provisions for this label marking conditions. In the event that such label marking conditions are not stipulated by any TR, this is to be done by an appropriate Decree of the Cabinet of Ministers of Ukraine.

5. On the condition that this is provided by the applicable Technical Regulation, the TR conformity label should be supplemented by the involved appointed Body identification number, which is to be applied in accordance with the requirements of the applicable Technical Regulation.

Clauses 30 and 31 of Technical Regulation for radio equipment and telecommunication (terminal) equipment (TR RE&TTE) :

30. The devices, which are compliant with all the requirements, defined for them, should be marked with the conformance label, which is indicated in clause 7 of this Technical Regulation. The manufacturer, or his plenipotentiary citizen of Ukraine, or his provider are responsible for marking with the conformance label. In case of application of the conformity evaluation procedure according to the clauses 25, 26 or 27 of this Technical Regulation, the conformance label is to be supplemented with the number of the appointed Body , according to the Register of such Bodies. Al the other marks, which could be applied to the device should not impair the visibility and legibility of the conformance label.

31. In case if it was stated that the conformance label was applied with the infringement of requirements of clause 30 of this Technical Regulation, the manufacturer, or his plenipotentiary citizen of Ukraine, or his provider must assume all the possible measures to stop the infringements according to clause 8 of this Technical Regulation on the conditions, defined by State Inspection for market surveillance and consumer policy and the National Commission on State regulation of communications and information (NKRZI), to make the device compliant with the requirements, defined in clauses 9 and l 0 of this Technical Regulation, and to confirm the compliance in the defined order.

In the case of continuous infringement of the legislation, NKRZI and State Inspection for market surveillance and consumer policy, according to the active laws, assume all the necessary measures towards restriction or prohibition of the devices trade turnover or its redemption from the market.
