THE MINISTER OF STATE IN THE MINISTRY OF ROAD TRANSPORT AND HIGHWAYS (SHRI SARVEY SATHYANARAYANA) (a) to (c) The Government has set up National Transport Development Policy Committee (NTDPC) under the Chairmanship of Dr. Rakesh Mohan, with the main objective of recommending a long term national transport policy that would facilitate overall efficiency in the economy while minimising energy consumption and environmental pollution, to provide an integrated and sustainable transport system to encourage competitive pricing and coordination between the alternative modes of transport. The final report of the Committee is expected to be submitted by 31.03.2013. MANI Will the Minister of ROAD TRANSPORT AND HIGHWAYS be pleased to state:- (a) the details of the National Highway projects which have been awaiting environmental clearance during the last three years and the current year, State/Union-Territory (UT)-wise along with the reasons therefor and the details of cost escalations in these projects; (b) whether the National Highways Authority of India (NHAI) proposes to compensate the aforesaid projects under Public-Private Partnership (PPP) and if so, the details thereof;

(c) whether the proposed compensation will be given for a particular project under PPP and if so, the reasons therefor and the time by which a final decision is likely to be taken by the Government in this regard; (d) whether the Government is planning to approach the Apex Court for environment related issues; and (e) if so, the details thereof along with the details of the contractors who opted out of the highway projects due to delay in environmental clearance during the last three years and the current year? ANSWER THE MINISTER OF STATE IN THE MINISTRY OF ROAD TRANSPORT AND HIGHWAYS (SHRI SARVEY SATHYANARAYANA) (a) Details of the National Highway projects awaiting environmental clearance during the last three years and the current year are placed at Annexure. As per the Model Concession Agreement (MCA) for Build-Operate-Transfer (BOT) projects, Environment Clearance (EC) is a condition precedent and the appointed date for the project is declared only after receiving the EC. There is no cost escalation involved in the BOT projects. (b) and (c) National Highways Authority of India (NHAI) follows the provisions as envisaged in respective concession agreements available at the website of NHAI at the URL http://www.nhai.org/concessionagreement.htm. (d) and (e) NHAI had submitted two applications before the Hon’ble Supreme Court of India for seeking relief in the matter of no objection certificate (NOC) under the Forest Rights Act, 2006 in respect of widening of National Highway projects and in the matter of de-linking the environment clearance from forest clearance. Subsequently, NHAI has withdrawn the petition on 5.2.2013 as the Ministry of Environment & Forests (MoEF) has issued a circular in the month of February 2013 in the matter of requirement of the NOC under the Forest Rights Act, 2006 in respect of widening of National Highway projects. MoEF has also moved an application in the matter of de-linking the environment clearance from forest clearance before the Hon’ble Supreme Court of India. LAND ACQUISITION FOR ROAD PROJECTS 11th March, 2013 LSQ 2203 DR. CHARLES DIAS SHRI HAMDULLA A. B. SAYEED Will the Minister of ROAD TRANSPORT AND HIGHWAYS be pleased to state:- (a) the details of the National Highway road projects stalled for want of land during the last three years and the current year, State/UT-wise; (b) whether the Government has taken any steps in this regard and if so, the details thereof; (c) whether the Government has any plan to direct the State Governments to specify for acquisition of land for road projects to avoid congestion at junctions/toll plazas and to provide space for tree plantation; (d) if so, the details thereof; and (e) whether the acquisition of land will be made on the basis of the population of the area and if so, the details thereof?

THE MINISTER OF STATE IN THE MINISTRY OF ROAD TRANSPORT AND HIGHWAYS (SHRI SARVEY SATHYANARAYANA) (a) Land acquisition is one of the factors contributing to delay in implementation of some projects under National Highways Development Project (NHDP). Details of such projects came to standstill due to delay in land acquisition is placed at Annexure. (b) National Highways Authority of India (NHAI) has taken up the issue with the State Governments for expediting the land acquisition matters. Regular meetings have been held at higher levels for speeding up the acquisition of land. The other measures taken up includes Constitution of High Powered Committee under the Chief Secretary of the State Governments; Setting up of Regional Offices headed by Chief General Manager level officers of NHAI; Decentralisation of the financial powers; Strengthening the infrastructure and manpower resources to the Competent Authority for Land Acquisition in the respective States and Project Implementation Units of NHAI; and Setting up of Special Land Acquisition Units in some of the States. (c) and (d) Land is acquired under the provisions of National Highways (NH) Act, 1956 by the Government on the basis of Feasibility Study Report, Detailed Project Report, Detailed Alignment Study of the particular project wherein provisions of junctions and toll plazas are designed based on technical parameters including traffic projection. (e) While deciding alignments for development of National Highways, efforts are made to minimise impact on the population as much as it is practicable and possible. Moreover, bulk acquisition of land is not required in any particular area in linear projects like highways.

CUTTING OF TREES FOR FOUR LANING OF NH 18th March, 2013 LSQ 3272 SHRI S. LSQ 4401 SHRI SANJAY BRIJKISHORILAL NIRUPAM Will the Minister of ROAD TRANSPORT AND HIGHWAYS be pleased to state:- (a) whether the Government has recently cleared a number of National Highways Authority of India (NHAI) projects without obtaining environmental clearance; (b) if so, the details thereof; (c) whether NHAI will now be required to get environmental clearance only for the projects falling within forest land; and (d) if so, the details thereof? THE MINISTER OF STATE IN THE MINISTRY OF ROAD TRANSPORT AND HIGHWAYS (SHRI SARVEY SATHYANARAYANA) (a) No, Madam. (b) Ministry of Environment & Forest had linked grant of environment clearance with the forest clearance vide their Circular dated 31.3.2011 in pursuance to the judgment of Hon’ble Supreme Court in the case of TN Godhavarman versus Union of India and others [LaFarge case]. Due to this linkage, formal environment clearances were held up for 24 projects. Hon’ble Supreme Court has now de-linked the environment clearance from forest clearance in case of linear road projects. A proviso was added in the said sub-rule vide notification dated 23rd February, 2012 to provide that one year after the commencement of the final notification, the validity of the certificate shall be twelve months for the vehicles manufactured as per Bharat Stage-IV norms. (d) & (f) According to sub-rule (3) of rule 116 of CMVRs, the measurement for compliance to the specified emission norms shall be done with a meter of the type approved by any agency referred to in rule 126 of CMVRs or National Environmental Engineering Research Institute, Nagpur. The measuring meters are required to conform to Type Approval Procedure (TAP) document 115/116 approved by Standing Committee on Emissions in the year 2004 and notified in CMVRS on the 10th April, 2007. THE MINISTER OF STATE IN THE MINISTRY OF ROAD TRANSPORT AND HIGHWAYS (SHRI SARVEY SATHYANARAYANA) (a) and (b) Cabinet Committee on Investment (CCI) had directed the Ministry of Environment & Forests to simplify the procedures for obtaining Environment and Forests Clearances for linear road projects and to remove identified impediments like stringent stipulation introduced by them pursuant to the judgment of Hon’ble Supreme Court in the case of TN Godhavarman versus Union of India and others [LaFarge case] by linking the Environment Clearances with Forest Clearance and imposition of provision of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 etc. As a result of the efforts made by the Government, Environment Clearances has now once again been delinked with the Forest Clearance and the Ministry of Environment & Forests has also directed all the State Governments not to invoke provision of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 in case of linear road projects. The Ministry of Environment & Forest has also decided that work on non-forest land may only be executed on either side of forest land subject to execution of the project along an alternate alignment without involving diversion of forest land. In case of the projects involving widening/ upgradation of existing roads, it will only be allowed to be executed on the entire stretch located in non- forest land, subject to width of the portion of road falling in the forest land will be maintained at its existing level, in case the necessary approval is declined. The Ministry of Tribal Affairs has also agreed that the resolution of Gram Sabhas may not be required in cases of linear projects where diversion of forest land is involved. Ministry of Environment & Forests has also agreed to exempt the widening projects on the available Right of Way from the purview of the requirement of environment clearance upto 40 meters. Accordingly, Ministry of Environment & Forests has granted Environment Clearance for 24 projects and 6 projects have also been recommended by Environmental Appraisal Committee (EAC). (c) and (d) CCI also approved enhancement of the ceiling of 4000 km of four laning in National Highways Development Programme (NHDP) Phase-IV to 8000 km, to be undertaken on Built-Operate-Transfer (BOT) (Toll)

(a) The National Highways Authority of India (NHAI) has awarded 114 National Highway (NH) projects in the country during the last three years and the current financial year. Out of these, 69 projects are under implementation, 2 projects have been terminated and in case of 43 projects, appointed date (date of start) has not been declared. State-wise details of awarded projects during the said period are annexed. (b) There are delays in 88 numbers of projects, due to problems such as land acquisition, shifting of utilities, environmental and forest clearance, approval for rail over bridges, law & order problem as well as shortage of skilled / semi-skilled manpower, poor performance of contractors and economic slowdown. In order to expedite implementation of the Projects, Regional Offices have been set up by NHAI headed by Chief General Manager. Powers have been delegated to the Chief General Managers. Special land acquisition units are also set up to expedite land acquisition. Chief Secretaries of State Government has also been nominated as Nodal officers to expedite construction of highway projects. Projects are also closely and periodically reviewed at Headquarter as well as field units. Recently, the issues of delinking environmental clearance from forest clearance and exempting linear stretches from the requirement of NOC from Gram Sabha have been resolved. Reserve Bank of India has given dispensation to treat the debt due to lenders, to the extent assured by Project Authorities in terms of concession agreement, as secured loan. Disinvestment of 100% equity to other willing buyers has been allowed after completion of the construction and also substitution of concessionaire allowed after achievement of financial closure to salvage the languishing projects. The NHAI has also constituted Negotiation / Reconciliation Settlement Committees and also High Level Expert Settlement Advisory Committee to settle the claims / disputes. (c) During the last three years and current financial year, NHAI has been provided Rs 22345.30 crores from cess funds. (d) During the last three years and current financial year, Rs 400.00 crore was received as a loan from International

Financial Institution. In other parts of the country, Bharat Stage III emission norms are applicable. As regards two and three wheeled vehicles, Bharat Stage III emission Norms are mandated across the country. (c) to (e) An automobile manufacturer recently reported that certain irregularities were committed by its employees during Conformity of Production (CoP) tests by testing agencies. (c) & (d) The plantation of trees along National Highways and their maintenance is generally done through Forest Department. However for plantation and maintenance of shrubs and flowering plants in the medians of four/six laning projects of National Highways, guidelines have also been issued by the Ministry for taking up this work through voluntary bodies / public sector undertakings / reputed private companies. The details in respect of Rajasthan are enclosed as Annexure-I. (c) and (d) In Build- Operate-Transfer (BOT) projects, the concessionaires are free to adopt international practices, alternative specifications, material and standards to bring in innovation in the design and construction provided they are better or comparable with the Indian standards. National Standards have also been framed for new materials and techniques such as modification of bitumen by natural and crumb rubber as well as polymers, use of waste materials, etc. Specifications have also been framed for Stone matrix asphalt, recycling of pavements, ground improvement techniques etc. A system has been established for accrediting new materials and techniques for use on experimental basis through a Committee of Indian Roads Congress (IRC). Apart from this, Ministry has also circulated guidelines for taking up pilot projects on Research & Test (ResT) reaches along the National Highways for evaluation of performance of new materials / techniques accredited by the IRC. Meerut to Muzzaffarnagar stretch of National Highway No. 58 has already been developed on

BOT(Toll) basis from 2-lane to 4-lane including bypasses at Khatauli and Muzaffarnagar. The work for Muzaffarnagar-Haridwar stretch has also been awarded on BOT(Toll) basis with scheduled completion by February, 2013. However, the progress of work is adversely affected due to delay in pre-construction activities like land acquisition, tree-cutting besides inadequate mobilization by the Concessionaire. The Concessionaire has been issued notice for expediting the work. The maintenance of the Meerut-Muzaffarnagar-Haridwar section is being done by the respective Concessionaires. Whenever complaints are received for poor maintenance, action is taken as per the provision of Concession Agreement to make the road traffic worthy

(c) to (e) An automobile manufacturer recently reported that certain irregularities were committed by its employees during Conformity of Production (CoP) tests. A 3-members Committee was set up by the Government with the following terms of reference: (i) To determine the extent of violations and responsibility/culpability thereof. (ii) Way forward for correction for protection of consumers (vehicle owners). (iii) Methods of preventing CoP violations in future. Copies of the report of the Committee have been forwarded to the concerned State Governments for investigation for further action. The recommendations made by the Committee for amending Type Approval Document with a view to preventing CoP violations for automobile manufacturers in future, have been referred to the Standing Committee on Emission (SCOE). ENVIRONMENT AND FOREST CLEARANCES FOR NH PROJECTS 16th December, 2013 LSQ 1832 SHRI JAGDISH THAKOR SHRI RAMESH BAIS SHRI NAVEEN JINDAL Will the Minister of ROAD TRANSPORT AND HIGHWAYS be pleased to state:- (a) whether a large number of National Highway projects are held up due to pending environment and forest clearances; (b) if so, the details of such projects, State-wise; (c) whether any company/developer has terminated an agreement with National Highways Authority of India due to delay in environment and forest clearance; (d) if so, the details thereof, company and project-wise; and (e) the steps taken or proposed to be taken by the Government to expedite clearances of these projects? These have already been recommended by Expert Appraisal Committee (EAC) of Ministry of Environment and Forests. There are total 16 (sixteen) projects for which Forest Clearances are at various levels of processing. Details of all these projects are placed at Annexure-I.

(c) and (d) Details of projects for which concessionaires/developers have served termination notice to National Highways Authority of India (NHAI) and projects already terminated due to delay in environment and forest clearance are placed at Annexure-II. (f) Vide their different orders, the Ministry of Environment & Forests has resolved most of the bottlenecks like requirement of special exemption or No Objection Certificate under the Forest Rights Act (FRA), 2006 in respect of strengthening and widening of the National Highways (NHs) projects specifically pertaining to diversion of protected forest land under the Forest Conservation Act, 1980. It has also de-linked the grant of Environment Clearance from the Forest Clearance for linear projects and treated the strengthening and widening of National Highways Infrastructure projects differently from the new projects and allowed the construction of the NHs in the Non-Forest areas in widening projects as expenditure does not become infructuous in such projects. Accordingly, the process for obtaining environment and forest clearances are relaxed significantly for all the existing and future road projects.
