Summary of facts of the caseFrom at least May 2006 to November 2015, while employed at Volkswagen AG (VW), Richard DORENKAMP and others conspired to sellapproximately 585,000 diesel vehicles in the U.S. by using a defeat device, that is, a software function designed to cheat on emissions testsmandated by the Environmental Protection Agency (EPA) and the California Air Resources Board (CARB), and lying and obstructing justiceto further the scheme. DORENKAMP and others defrauded the United States and VW’s U.S. customers, and violated the Clean Air Act bylying and misleading EPA and U.S. customers about whether certain VW, Audi and Porsche branded diesel vehicles complied with U.S.emissions standards. This new engine was part of a new project to sell diesel vehiclesin the U.S. that would be marketed to buyers as “clean diesel.” When DORENKAMP and his co­conspirators realized that they could notdesign a diesel engine that would both meet the stricter U.S. nitrogen oxides (NOx) emissions standards, and attract sufficient customerdemand in the U.S. market, they decided they would use a “defeat device,” that is, a software function, to cheat standard U.S. emissionstests. VW engineers working under DORENKAMP and another co­conspirator, designed and implemented a software function defeat deviceto recognize whether a vehicle was undergoing standard U.S. emissions testing on a dynamometer or it was being driven on the road undernormal driving conditions. If the vehicle’s software detected that it was being tested, the vehicle performed in one mode, which satisfied U.S.NOx emissions standards. If the software detected that the vehicle was not being tested, it operated in a different mode, during which thevehicle’s emissions control systems were reduced substantially, causing the vehicle to emit NOx up to 35 times higher than allowable U.S.standards. DORENKAMP authorized VW engineers to use the defeat device in the development of the new diesel engine, despite concernsexpressed by certain VW employees about the propriety of designing and activating the defeat device software. On about 19 March 2007,DORENKAMP, his co­conspirators, and other VW employees, met with representatives of the EPA in Michigan. During the meeting,DORENKAMP and other VW employees described, among other things, the Auxiliary Emission Control Devices (AECDs) associated with the2.0 diesel engine. DORENKAMP and others presented an overview of the engine design and proposed operation of the emission controlsystems. Also on about 21 March 2007, DORENKAMP, his co­conspirators and other VW employees met with CARB officials in California todiscuss the AECDs associated with the emissions control systems in the diesel engine design. Throughout both meetings, DORENKAMP andother VW employees knew they planned to include a defeat device in the engine but concealed the existence of the defeat device from theEPA and the CARB. In the fall of 2007, DORENKAMP participated in a meeting with his co­conspirator and others, during whichDORENKAMP argued for the continuation of the diesel engine towards production, even while some of his colleagues were against it.Following the meeting, DORENKAMP’s co­conspirator approved the continued development of the engine with the defeat device. Starting withmodel year 2009, the first of VW’s new “clean diesel” engines, through model year 2016, DORENKAMP and his co­conspirators installed, orcaused to be installed, the defeat device software into the vehicles imported and sold in the United States. In order to sell their “clean diesel”vehicles in the United States, the co­conspirators lied to the EPA about the existence of their test­cheating software, hiding it from the EPA,CARB, VW customers, and the U.S. public. As part of the certification process for each new model year, DORENKAMP and his co­conspirators falsely and fraudulently certified, or caused to be certified, to the EPA and CARB that the vehicles met U.S. emissionsstandards and complied with standards prescribed by the Clean Air Act. DORENKAMP is specifically charged with seven counts of Clean AirAct violations due to the fact that DORENKAMP and others caused the VW Engineering and Environmental office in Eastern District ofMichigan to submit seven certificates of conformity to EPA between 22 December 2011, and 19 March 2012, to obtain authorization to sellcertain 2011, 2012, 2013, and 2014 model year vehicles in the U.S. Having obtained the necessary EPA and CARB certificates,DORENKAMP and his co­conspirators marketed, or caused to be marketed, the vehicles to the U.S. public as “clean diesel” andenvironmentally friendly, when they knew that these representations made to U.S. customers were false, that the vehicles were intentionallydesigned to evade U.S. emissions standards, and that the vehicles were polluting the environment with NOx emissions well above U.S.emission limits. Following the launch of the Gen 1 2.0 liter vehicles in the United States, DORENKAMP, his co­conspirator, and others workedon a second generation of the diesel engine, which also contained software designed to detect, evade, and defeat U.S. emissions tests. TheGen 2 2.0 liter vehicles were launched in the United States starting in about 2011. On about 03 September 2015, in a meeting with CARB andEPA in El Monte, California, a VW executive formally admitted that VW had installed a defeat device in the 2.0 liter vehicles. In aboutJanuary 2017, VW agreed to plead guilty to the scheme, and pay $4.3 billion USD in criminal and civil penalties.
