PRELIM INARY
Title
1. These regulations may be cited as the Water (Water Court)Regu lations, 1966.
Interpretation of terms
2. In these regulations-
"application" means an application made In terms of theAct:

"conservation othcer" means an oflicer in the Depanme.mof Conservation and Extension who has been appointedin terms of subsection (2) of section 142 of the Act:
"Hydrological Branch" means the Hydrological Branch ofthe Ministry;
"hydrological engineer" means an engineer of the Hydrological Branch appointed JO terms of subsection (2) ofsection l42 of the ACl:
"Ministry" means the Ministry of Water Development:
"reporting ofbcer" means any person appointed ill terms 0\subsecuon (2) of sec uon 142 ()[ the ALl,
"water engineer" means an engineer of the Ministry appointed in terms of subsection (2) of section 142 of theAu.

APPLICATIONS
Lodging of applications

section 19 of the Act shall be lodged with the water registrar.
4. An application shalt be in the appropriate form specinedIn the First Schedule Or, where no appropriate form is so specified,in such other suitable rorrn as the water registrar may specify.

5 An application shall be submitted with the number ofcopies required by {he appropriate form specified in the FirstSchedule and such additional copies as the water registrar mayrequire or, where no appropriate term IS so specined. [he numberof copies specified by the water registrar.

6, The water registrar shall not accept an application unlesshe is satisfied that it has been duly completed in accordance withthe provisions of the Act and these regulations.

Fees for application
7. (I) Subject to the provisions of subsection (2), an applicantshall when lodging an application specified in the Second Schedulepay the appropriate fee specified in the Second Schedule.
(2) No fee shall be charged for an application lodged bythe Minister or the Commissioner of Roads and Road Traffic.
PART II
PREPARATION OF CASES FOR COURT
Copies of application to Hydrological Branch
8. A copy of every application lodged in terms of subsection(l) of section 9 or sections 13, 14, 19, 21, 22,23, 45,76,79, 136,137, 149 or 151 of the Act shall be forwarded by the water registrar to the Hydrological Branch.

9. Where applicable the water registrar shall ascertain fromthe Hydrological Branch, for the purposes of a water court. t..hearea which may be affected by an application.
Notice 0/ ap plicatian
10. (1) Where uri application referred to in section 8 or interms of subsection (2) of section 102 or section III of the Act,has been lodged with the water registrar, he' shall give noticethereof-
(a) in the Gazelle for the information of persons whoserights may be affected thereby; and
(b) to the provincial commissioner and districtcommissioner of the area which may be affected; and
(c) where practicable to such other persons as may beaffected by the application.
(2) A notice required to be given by paragraph (c) of subsection (1) shall be given in such manner as the water registrarmay consider best suited to the circumstances.
(3) All notices required to be given by subsection (1) shallstate the period within which objections to the application shall belodged.

Objections to he lodged timeously and accompaniedby statement
II. Any objection to an application referred LO in subsection(1) of section 10 sha II. subject [0 the provisions of section 12, belodged with the water registrar by the date specified in terms ofsubsection (3) of section 10 and shall be accompanied by a fullsta ternent of the gro unds for the objection:
Provided that a judge may. on application by an objector.condone the late lodging of an objection.

12. Before the expiration of the period allowed for lodgingobjections 10 an application, any person who wishes to object mayapply to a judge through the water registrar for an extension oftime which may be granted subject to such conditions as thejudge may deem fit.

11 A r t he end of t he period allowed for the lodging of objections to an application, the water registrar shall-
(a) where \Lo ob jection has been lodged, inform the applican land the report ing ofricers of the HydrologicaIBranch, the Ministry and the Department of Conserval ion and Extension accord ingly:
(b) where an objection has been lodged, advise the applicant and the reponing orncers specified in paragraph(a) of the objection.

14. (I) Where a report by a reporting officer is required in,dills of section 15 the water registrar shall forward purticularsof the application to the Hydrological Brunch, the Ministry andthe Department of Conserve t ion and Extension.
(2) Where evidence in connexion with ..n application isrequired from any person not referred In 10 subsection (I) thewater registrar shall forward particulars of the application to thatperson.
Reports
15. (I) Where an application specified In Part 1 has beenlodged with the water registrar he mil)' require a signed rcponlhereon from any one Or more report ing office rs.

(2) Where a report has been required in terms of subsect ion (I) t he reporting officer shall furnish the: req uir ell J eport in
the appropriate form specified in the Third Schedule or. whereno appropriate form is specified. in such 'Other form as may beapproved by a judge.
(3) Any report submitted in terms of subsection (2) shall bein quadruplicate with such additional copies as the water registrarmay require,
(4) Notwithstanding the provisions of subsections (I) and(2), an applicant or objector may submit for the consideration ofa water court reports by a consulting engineer or agriculturalconsultant.
(5) Where an application has been made to a miningcommissioner in terms of section 19 of the Act. the report required by that section from a mining engineer shall be furnishedin quadruplicate in form W.R.6 specified in the Third Schedule.

16. (I) Any report required in terms of subsection (I) ofsection 15 or referred to in subsection (5) of section 15 shall beopen to inspection and the water registrar shall serve copiesthereof on all parties to the proceedings.
(2) Copies of reports submitted in terms of subsection (4)of section 15 and made available in sufficient time before a hearingby a water court shall be served by the water registrar 011 allparries to the proceedings and any person required to report interms of subsection (I) of section 15.
Applications to be placed before Senior }w!{fe
17. After the expiration of the time allowed for the lodg1ngof any objection to an application, and on receipt of any report'submitted in terms of section 15 the water registrur shall causethe application to be placed before the Senior Judge in Chambersfor his approval of a lime und place of hearing.

(b) the last date on which appl ications for a particularsession may be accepted; and
(c) such other matters as the Senior J udge may considerreievanr !O any mailer specified in paragraph (a) or (b).

19. (I) Prior to the hea ring of any case by a water court thewater registrar shall cause the list of persons nominated by theMinister of Justice as water court assessors in terms of subsection(3) of xcctiou 28 uf the Act to be placed before the Senior JUdge

(2) The list of unofficial members selected by the SeniorJudge in terms of subsection (I) shaII then be placed before thepresiding judge who shall therefrom select as the unofficial memberof the water court a person available to act as such.

20. The water registrar shall give notice of set-down of anymatter to be heard by a water court to, all parties to the proceed.ings and any persons required to report thereon.

27. The water registrar shall cause all matters pertainingto grants made in terms of the Act which in hIS opinion need tobe investigated by- a water court, to be placed before the SeniorJudge in such mariner as may he determined from time to timeby the Senior Judge.

2R. Notice of any matter to be investigated at the request oftile Minister or {he Senior Judge or on the motion of a watercourt, or on the application of any person shall be~
(a) published in the Gazette; and
(b) served on any person whose rights are situated withinthe area affected.
PART VI
SERVICE OF NOTiCES AND OTHER DOCUMENTS
Substituted service
29. (i) A judge may aUlhorize substituted service of anynotice or any other d ccu.ment req uired under the Act to be served
on any person on an application by the water registrar or anyparty to the applica tion.
(2) When substituted ser vice has been authorized in termsof subsection (I) it shall in addition to publication in the Gazellebe given in such manner as the judge may direct.
PART VII
GENERAL
Custody Of records
30. The records of a water court shall be in the custody of[he water registrar and shJ/I not be removed from his custodywithout his aumuruy or that of a water COurt or the Senior Judge.

Appeals
33. (I) Auy party who wishes to appeal (Will a decision of awater court in terms of section 55 of the Act snall note his appealby lodging his written notice of appeal with the water registrarwithin twenty-one days of the decision being made known to him.
(2) A copy of any notice of appeal lodged in terms ofsubsection (1) shall be lodged with the Registrar of the AppellateDivision forthwith.
Repeals
]4. The Water Court Procedure Regulations, 1958, publishedin Rhodesia Government Notice No. 438 .of 1958, and [he warerCourt Procedure (Amendment) Regulations, \959 (No. I), published in Rhodesia Government Notice No. 445 of 1959, arerepealed.
