When Lt. Col. Vanessa Bensonreturned to Fort Campbell fromAfghanistan with the 159thCombat Aviation Brigade, 101stAirborne Division, she expectedto be reunited with her then 14-year-old son John, whom she hadprimary custody of for 10 years.

Instead, Benson came home toan email from her ex-husband stat-ing he would not be returning theirson after the deployment.

This was despite her completinga Family Care Plan in advance ofthe deployment that outlined shewould regain primary custody

when she returned.Benson had to take her custody

fight to court.Custody battles involving serv-

ice members with children from aprevious relationship were such agrowing problem that the DoDupdated DoD Instruction 1342.19,“Family Care Plans,” in May torequire all service members withcustody of a minor child from aprevious relationship to file aFamily care plan.

FCPs were already required fordual military couples and singleparents with custody.

The new policy required mili-tary parents to notify the noncus-todial parent of an impending

deployment and to outline in theFCP what arrangements would bemade to care for any minor chil-dren with whom they share cus-tody during a military separation.

This included plans to leave thechild in the custody of a thirdparty, such as a step-parent orgrandparent.

A DoD spokesman acknowl-edged that an FCP, although “anessential part of preparation formilitary duty…is not a legal docu-ment and this has limitations.”

“A service member or memberof the Civilian ExpeditionaryWorkforce cannot delegate cus-tody through a FCP or power ofattorney, the spokesman said.

“Only a court of competentjurisdiction can establish legallybinding custody.”

Mark Sullivan, Family law spe-cialist and retired JAG colonel inRaleigh, N.C., said he is hopefulthat the new FCP policy “willinvolve fewer contested casesdown the road.”

But he noted that “the best pro-tection to get your child back is acourt order.”

“No private agreement, no kiss-es over the phone, no hand-shakes,” Sullivan said. “Get itwritten in a court order if you wantit to be effective.”

Experts agree that a FCP needs

to be prepared in advance withmuch thought, preferably with thehelp of a military lawyer, andshould be updated regularly to beeffective.

Benson, who had spent a yearand $30,000 in legal and travelcosts, was awarded temporarycustody in January, and then set-tled out of court in May.

Her son currently lives with hisdad.

“I am just one of many Soldiersfacing such a blow when theyreturned from war,” Benson wrotein an email to Army Times. “Noone wants to come home fromcombat and experience a legal bat-tle.”
