1.0 PROJECT BACKGROUND AND INTRODUCTION

Oil and Gas Development Company Limited (OGDCL) intends to undertake Installation

of LPG Recovery Plant, Compressors and Allied Facilities at Nashpa Field (the

PROJECT). NASHPA and MELA gas fields are located in KPK Province of Islamic

Republic of Pakistan. The objective of the PROJECT is to construct a gas processing

facility at NASHPA to process raw gas of NASHPA and separator gas from MELA Field.

MP separator and stabilizer gas at MELA will be compressed through existing Off-gas

compressor, and this gas will be combined with existing HP MELA separator gas for

transportation from MELA through a trunk line to NASHPA. The MELA and NASHPA

combined gas is the feed for Mol sieve and LPG plant. The NASHPA plant will produce

LPG, Sales Gas and Stabilized Condensate.

The PROJECT covers Wellhead facilities, Gas Gathering System and Gas Processing

Plant (including LPG Recovery Plant). The gas processing plant is intended to normally

process 98 MMSCFD with a design margin of 10 %.

The anticipated production capacity of the facility is as under:

i) 90 MMSCFD (sales gas & fuel gas)

ii) 16800* Barrel/day of Condensate

iii) 1120 Barrel/day of NGL

iv) 373 Tonne/day of LPG

v) 1 Tonne/day of Propane

*From NASHPA wells oil production will be 16800 Barrel/day (production forecast

provided by OGDCL) whereas 150 Barrel/day will be added from MELA trunk line in

winter operation.

For engineering, procurement, construction and commissioning of the above mentioned

facilities. OGDCL intends to engage a Contractor to execute and commission the project

on complete responsibility basis.

This document has been prepared as per Public Procurement Regularity Authority

(PPRA) requirements and provides the basis for engineering, procurement, construction

and commissioning of NASHPA Gas Processing, LPG Recovery Plant & Allied

Facilities.

OGDCL has engaged M/s. Zishan Engineers (Pvt.) Limited (ZEL) as Consultant for

providing design engineering and project management services (including procurement

assistance and supervision of EPCC Contractor activities) for execution of NASHPA Gas

Processing, LPG Recovery Plant and Allied Facilities Project.

Oil & Gas Development Company Limited (OGDCL) Islamabad is operating NASHPA

Oil Field located in Kohat District of Khyber PakhtoonKhuwa Province of Islamic

Republic of Pakistan.

The facilities to be installed at NASHPA Field include Well Head system, Gas

Treatment, LPG Recovery Plant, Compressors and Allied Facilities (including

LPG/Condensate Storage & handling etc.). For engineering, procurement, construction

and commissioning of these facilities, OGDCL intends to engage a Contractor to execute

and commission the project on complete responsibility basis.

This document has been prepared as per Public Procurement Regularity Authority

(PPRA) requirements and provides the basis for the engineering, procurement,

construction and commissioning of Nashpa Gas Processing, LPG Recovery Plant &

Allied Facilities.

The prospective bidders are required to carefully review this document and within two

(02) weeks of downloading the tender document from OGDCL website and send the

enclosed letters of Intention to Bid or Declining the Bid and Secrecy Declaration.

The Bids are invited on two stage-two envelope bidding procedure. Under this procedure

the bid to be submitted shall comprise of a single package containing two separate

envelopes. Each envelope shall contain separately the technical (proposal) bid and

financial (proposal) bid. The details of the procedure are given in Clause 7.0 of ITB

(Section-III) of Volume-I.

The bids are required to be submitted at OGDCLs Office on or before 12th March, 2013

at 14:30 HRS (PST). The bids shall be valid for 120 days from the bid submission date

and should be accompanied with a Bid Bond (Bank Guarantee) of an amount of

US $ 2,000,000/- (US$ Two Million Only) or equivalent Pakistani Rupees or in the

currency of the Bid.

The award will be made in favor of lowest evaluated responsive bidder at the sole

discretion of OGDCL.

OGDCL reserves the right to accept or reject any bid or part of a bid and or to annul the

bidding process and reject all bids at any time prior to award of contract, without thereby

incurring any liability to the affected bidder or bidders or any obligation to inform the

affected bidder or bidders of the grounds for OGDCLs action.

the OGDCL in writing, in drawing or in any other form or acquired by the Bidder

from the OGDCL, as well as all data derived from such knowledge and

information at the time of such disclosure or acquisition is not:

In the free and lawful possession of the Bidder or Part of public knowledge or literature

1.3 Confidential Report shall mean all manuals, specifications, drawings, letters,

faxes, emails and any other material containing Confidential Information. For the

purpose of Clauses 2 and 5 Confidential Information shall include Confidential

Record.

1.4 The confidential record shall be such information as may be given by OGDCL.



2.0 CONFIDENTIALITY

2.1 The Bidder

Shall preserve and cause its employees to preserve the secrecy of all Confidential Information.

Shall not use or disclose the confidential information except with the prior written consent of OGDCL and subject to the conditions contained in Clause

5, for any purpose other than the performance of the contract for the Project or

the preparation and submission of a Bid for the Project.

i- Disclose to any third party or enable any third party to note that fact that

the Bidder has been invited to submit a bid for the Project and / or, if

applicable, the fact that the Project has been entrusted to the Bidder.

ii- Reproduce, copy or use, or disclose to, place at the disposal of or use on

behalf of any third party or enable any third party to peruse, copy or use,

any Confidential Information

2.2 The undertakings under 2.1 above shall continue in so far as the Confidential

Information in question has not:

Become a part of public knowledge or literature, or

Been disclosed to the Bidder by a third party (other than one disclosing on behalf of OGDCL) whose possession of such information is lawful and who is

under no secrecy obligation with respect to the same.

3.0 COPYRIGHT

The copyright of the Confidential Record shall, in the absence of any express provision to

the contrary be vested in OGDCL.

4.0 RETURN OF CONFIDENTIAL RECORD

Upon completion of the Project, or if it is decided that the Project will not be entrusted to

the Bidder, upon notification to the Bidder of such decision, the Bidder shall return to

OGDCL all Confidential Record.



5.0 THIRD PARTY

The Bidder shall ensure that under the terms of this Secrecy Declaration any of the

Confidential Information comes to the knowledge and/or in the possession of any third

party, the Bidder shall require from such third party that it shall abide by stipulations

equivalent to those contained in this Secrecy Declaration.

For engineering, procurement, construction and commissioning of earlier

mentioned facilities. OGDCL intends to engage a Contractor to execute and

commission the project on complete responsibility basis.

The bidders are to follow the scope of work and services given in Volume-II and

specifications, data sheets and technical drawings given in Volume-III of this

document. In general, the emphasis is to maximize skid mount and modularize

wherever practical in order to reduce construction time. The bidder can provide

alternate proposal based on their standard design if it reduces the project

completion period.



1.2 Plant Description

For description of the proposed facilities at NASHPA Plant, please refer to the

following:

2.0 CONTRACTORS WORK SCOPE & RESPONSIBILITIES: AN OVERVIEW

OGDCL intends to have a complete workable, safe and operable Nashpa gas processing

and LPG Recovery plant meeting all the performance parameters, guarantees, warranties

and other requirements.

The Contractor shall be responsible for installing the plant on complete responsibility

basis and accordingly carry out all activities necessary to have in place an operational

Nashpa gas processing, LPG Recovery plant & Allied Facilities.

The Contractor shall review and validate the basic, engineering package given in tender

document, carry out detailed engineering, procure required materials, equipment

electrical items instrumentation/control and execute works related to construction,

installation and commissioning and related project management.

The Contractors scope and responsibilities shall include but not limited to the following:

Review and validation of Front End Engineering Design (FEED) Document.

Perform detailed engineering design of Nashpa Gas Processing and LPG Recovery Plant.

Provision of all construction equipment, materials, tools/tackles, consumables, manpower and all other things that are necessary for the construction, testing and

commissioning of gas processing and LPG Plant.

Arrange all approvals from the local provincial and Federal government authorities/departments, which may be required for performing the works. This also

includes supplying of all certificates (as necessary), qualifications, calculations,

reports, drawings and documentation required by governmental agencies, Certifying

Authorities, inspection institutions, surveyors.

Project management and control of the project from award to final acceptance by the Company to ensure proper, sound and timely performance of the work.



Construction, installation, fabrication, erection of equipments, electrical, instrument and safety systems of Nashpa Plant.

Preparation, fabrication, position, orientation, installation, construction, NDT, inspection, quality control & surface treatment. Dimensional control of each and

every stage to complete the plant facilities.

Carryout testing, checking, completion of detailed check lists, pre-commissioning, commissioning and start-up, supply of consumables and any incidental matters

relating to the satisfactory completion and operation of the complete plant facilities.

Tie-in of gas processing facilities and utilities (to be supplied by Contractor) with Companys provided infrastructure and other works.

Construction and maintenance of temporary site facilities warehouse & security arrangements.

The Contractor shall perform the work with due diligence in a professional manner and in accordance with good industry practice and standards and warrant and

guarantee the defect free and on specifications operation of Nashpa Gas Processing

Plant.

Procurement (Supply) of all equipment/material including preparation and placement of Purchase Orders, expediting, inspection, quality control, shipping, delivery, inland

transportation and offloading at port and project site.

Project management, planning and control of the whole project from contract award to final acceptance by the OGDCL.

Pre-commissioning, commissioning, performance testing and start-up of the new plant and training of staff.

QA/QC.

Health Safety and Environment (HSE)

Arrange delivery of initial fill of consumables, commissioning spares and two (2) years spares.

Preparation of all documentation (including as built drawings/documents and operations/maintenance manuals etc.) and their submission to OGDCL in both hard &

soft form. The documentation will include softcopies of PFDs, heat & material balance, P&IDs and simulation by HYSIS.

Approvals from OGDCL/Consultant for all engineering material, equipment & consumables.



Liaison and Coordination with OGDCL/Consultant & relevant local authorities and obtain approvals from the local provincial and federal government

authorities/departments which may require for executing the Project.

Training of Companys personnel for the operation and maintenance of the overall system and equipment supplied by the Contractor.

The Contractor shall perform the work in an efficient manner with due diligence, high

professional standards, and good industrys practices, internationally accepted codes/standards and in accordance with the requirement setout in the Contract

Documents.

The Contractor shall not be relieved of any of its obligations under the Contract as a

result of any inspection, examination, review, instruction, approval, consent or certificate

given/issued by OGDCL/Consultant.

The Contractor shall comply with all applicable laws including environmental

regulations, OGDCLs HSE & Security requirements in the performance of the Contract and shall ensure that the Project is fully compliant with all applicable laws.

The responsibilities and scope of Contractor are more specially described in the scope of

work and services given in Volume-II.

3.0 CONSULTANTS ROLE

OGDCL has appointed M/s. Zishan Engineers (Pvt.) Ltd. (ZEL) as Consultant for

providing consultancy services to ensure timely project completion complying with

quality specifications and performance requirements. ZEL responsibilities shall include:

Process selection & Preparation of Front End Engineering Design (FEED) document.

Preparation of tender document for execution of project on EPCC basis and required procurement support & assistance in Contract formulation & negotiations.

Review of Contractors design and timely review and approval of all documents. Procedures, prepared by Contractor.

Inspection & Testing of main equipment & material items.

Supervision during construction, fabrication, installation/erection, commissioning and performance testing of Nashpa plant.

4.0 OGDCL RESPONSIBILITIES

OGDCL shall be responsible for providing the Contractor the following:

Land for plant and temporary construction (camp).



Engineering data/documents as stipulated in the Contract Document

Issue of letters and documents, to the authorities in Pakistan, which Contractor may require for the execution of the Project Works.

Assistance in obtaining custom duty/tax concessions under relevant SRO.

Timely review and approvals of documents.

Gas production of wells.

Access of Contractor to Project site.

5.0 PROJECT COMPLETION PERIOD

The timely completion of the Nashpa Gas Processing, LPG Recovery Plant & Allied

Facilities by the contractor shall be the essence of the Contract, as OGDCL has to meet

its obligations for completion of the project and supply of Gas. Accordingly, the

Contractor (Successful Bidder) is required to complete the engineering, procurement,

construction, installation/erection, pre-commissioning, commissioning & start-up of

Nashpa Gas Processing and LPG Recovery Plant within fourteen (14) months from the

effective date of the Contract to be executed between OGDCL and the successful Bidder.

6.0 SCOPE OF BID & SOURCE OF FUNDS

The bid pertains to engineering, procurement, construction & commissioning of Nashpa

Gas Processing and LPG Recovery Plant for NASHPA Field of OGDCL. The cost to be

incurred for procurement of Nashpa Gas Processing, LPG Recovery Plant & Allied

Facilities will be financed from available internally generated funds.

7.0 BIDDING PROCESS

OGDCL is adopting the two stage-two envelope bidding procedure as outlined below:

First Stage

The bid shall comprise a single package containing two separate envelopes. Each envelope shall contain separately the technical (proposal) bid and financial

(proposal) bid.

The envelopes shall be marked as TECHNICAL (PROPOSAL) BID and FINANCIAL (PROPOSAL) BID in bold and legible letters to avoid confusion.

Initially, only the envelope marked TECHNICAL (PROPOSAL) BID shall be opened.

The envelope marked as FINANCIAL (PROPOSAL) BID shall be retained in the custody of OGDCL without being opened.



The technical (proposal) bid shall be reviewed by OGDCL/CONSULTANT and communications shall be exchanged or (if required) discussions will be held with

the bidders with reference to the OGDCLs technical requirements given in the tender document.

Those bidders willing to meet the requirements of OGDCL shall be allowed to revise the relevant part of the technical proposals as a result of exchange of

communications and discussions.

Bidders not willing to conform their technical (proposal) bid to the revised requirements of OGDCL shall be allowed to withdraw their respective bids

without forfeiture of their bid security.

Second Stage

After agreement between OGDCL and the bidders on the technical requirements, bidders who are willing to conform to the revised technical specifications and

whose bids have not already been rejected shall be asked to submit a

supplementary financial (proposal) bid, according to the technical requirement as

agreed during technical evaluation.

The original and supplementary financial (proposals) bids shall be opened at a date, time and venue announced and communicated to the bidders in advance.

OGDCL shall evaluate the original and supplementary financial (proposal) bids as per laid down evaluation criteria and the bid found to be the lowest evaluated bid

shall be accepted.

The award will be made in favor of lowest evaluated responsive bidder at sole discretion of OGDCL. OGDCL reserves the right to increase or decrease the

quantities of Nashpa Gas Processing, LPG Recovery Plant and Allied Facilities or

give partial order without any change in price or other terms & condition.

OGDCL reserves the right to accept or reject any bid or part of a bid and or to annul the bidding process and reject all bids at any time prior to award of contract,

without thereby incurring any liability to the affected bidder or bidders or any

obligation to inform the affected bidder or bidders of the grounds for OGDCLs action

8.0 COST OF BIDDING

The bidder shall bear all costs associated with the preparation and submission of its bid

including submission of Bid Bond and OGDCL will in no case be responsible or liable

for those costs, regardless of the conduct or outcome of the bidding process



9.0 ELIGIBILITY REQUIREMENTS

Bidder must meet the following eligibility requirements:

a) The Bidder shall be Oil & Gas industry contractors of Pakistan and of countries with whom Pakistan has bilateral relationship.

b) The bids of only those bidders shall be entertained by OGDCL who will submit the letter of intention to bid to OGDCL within two (02) weeks of downloading the tender

document from OGDCL website.

c) The equipment to be supplied and services to be provided for Nashpa Gas Processing, LPG Recovery Plant and Allied Facilities under this contract shall have origin in the

countries having bilateral trade relations with Islamic Republic of Pakistan. For

purpose of this Clause, origin means the place where the Goods are mined, grown or produced or from where the ancillary services are supplied. Goods are produced

through manufacturing, processing or substantial and major assembling of

components, a commercially recognized product results that is substantially different

in basic characteristics or in purpose or utility from its components.

d) The Bidders shall be experienced (at least five (05) years) possessing required resources and capable to execute the contract on EPCC basis of Nashpa Gas

Processing, LPG Recovery Plant & Allied Facilities. The bidders shall furnish as part

of the bid documents establishing bidders eligibility to bid and qualifications perform

the contract if their bid is accepted by OGDCL.

e) The bidder and its engineering staff shall meet all the requirements of Pakistan Engineering Council (PEC) Act 1976, its bye-laws and amendments and provide

documents to this effect.

f) The offshore companies registered at places e.g. Virgin Cayman, Nausa jersy and Bohman Islands shall not be eligible nor entertained and bids if submitted shall be

rejected.

10.0 BIDS OF JOINT VENTURES/CONSORTIUM

The bids submitted by a Joint Venture/Consortium comprising of two or more firms as

partners shall comply with the requirements given below:

a) The Joint Venture/Consortium shall nominate one of the partner as Partner Incharge and this authorization shall be evidenced by submitting a power of attorney signed by

partners themselves or legally their authorized signatories. The power of attorney

shall be certified by Notary Public.

b) The Partner Incharge shall be authorized to incur liabilities and receive instructions for and on behalf of any and all partners of the joint venture/consortium and the entire

execution of the contract (including release of payment) shall be made with the

Partner Incharge.



c) All partners of the joint venture/consortium shall be liable jointly and severally for executing and fulfilling the obligations stipulated in the contract document. A

relevant statement to this effect shall be incorporated in the authorization mentioned

under clause (a) above as well as Form of Bid and the Form and Conditions of

Contract in case of successful bid

d) The bidder shall submit a copy of Memorandum of Understanding (MOU) entered into by the joint venture/consortium partners giving the relationship and

responsibilities of the partners with respect to supply of Nashpa Gas Processing, LPG

Recovery Plant & Allied Facilities. (A format of Responsibility Matrix is given as

Annexure-I).

e) The bid, and in case of a successful bid the form and conditions of contract shall be signed so as to be legally binding on all partners

f) The bidder, if successful shall within ten (10) days of receiving the notification of award from OGDCL shall furnish a copy of contract entered into by joint

venture/consortium partners.

11.0 AGENT / REPRESENTATIVES

The agent / representatives can download the tender document from OGDCL website and

submit the bid (including the bid bond) on behalf of their principals. However, they shall

be required to submit agency / distributorship / representation letter (On Principals letter head) duly signed and stamped with authorization for the subject tender.

12.0 PREFERRED VENDORS

The Bidder shall procure various components of Nashpa Gas Processing, LPG Recovery

Plant & Allied Facilities from OGDCLs Preferred Vendors list given in Volume-II of this Tender Document. However, the bidder can propose other reputable equivalent

vendors for OGDCLs approval. Bidder shall submit documentary evidence to prove equivalency such as client list, past experience etc. for evaluation by OGDCL /

CONSULTANT.

13.0 SITE VISIT

The Bidders are required to visit the Site of proposed facilities. During the visit the

bidders will examine the site and its surrounding area. The Bidder should verify the

information present in the Tender Document assess and obtain on its own responsibility

all required information for preparing the bid proposal. OGDCL/Consultant will

coordinate the visit and bidders will be informed about the exact date and timing of the

visit. The visit will be scheduled to take place within two (02) weeks of tender sale

closing date.

In order to visit the site of proposed facilities the prospective bidders should send to

OGDCL the Proforma for Site Visit & Pre-Bid Meeting enclosed with Invitation to Bid in

a timely manner.



The cost to be incurred on the visit shall be on Bidders expense. The Bidder and any of its personnel or Agents/Consultants will be granted permission by OGDCL to enter upon

its facilities for the purpose of such visit, but only upon the express condition that the

Bidders, its personnel or Agents/Consultants will release and indemnify OGDCL its

personnel Agents/Consultants form and against all liability in respect thereof including

personal injury (whether fatal or otherwise) and any other loss, damage, costs and

expenses.

14.0 PRE-BID MEETING

OGDCL will organize a pre-bid meeting, the venue, date, timing of the pre-bid meeting

will be notified to all the prospective bidders. The Bidders representatives should attend

the meeting to obtain clarifications and any other information required for preparation of

the bid.

15.0 TENDER DOCUMENT

15.1 Contents

As stated earlier, the tender document comprises of following together with any

addenda that may be issued from time to time:

The prospective bidders shall carefully study and examine all sections of the

document and shall comply with the stipulated requirements. Failure to furnish all

information required by the tender document or submission of bid not

substantially responsive to the tender requirement in every respect will be at

Bidders risk and may result in the rejection of the Bid.

A prospective bidder requiring any clarification of the Tender document or

OGDCL/ Consultant will respond in writing to any request for clarifications of the

Tender Document, which it receives not later than one (01) week prior to deadline

for the submission of bids prescribed in the Tender Document. Written copies of

Consultants response (including an explanation of the query clarification but without identifying the source) will be communicated to all the participating

bidders.



15.3 Amendment

Any time prior to the deadline for submission of bids, OGDCL for any reason

whether at its own initiative or in response to clarification requested by a

prospective bidder, may modify the tender document by issuing

addenda/amendment.

Any addendum/amendment shall form part of the tender document and shall be

notified in writing or fax or email to all prospective bidders and will be binding

on them. The prospective bidders should acknowledge receipt of any such

addenda/amendment in the tender document.

In order to allow prospective bidders reasonable time to take the

addenda/amendment into account in preparing their bids OGDCL at its discretion

may extend the deadline for submission of bids.

16.0 PREPARATION OF BIDS

16.1 Language of Bids

The Bids prepared by the Bidder and all correspondence and documents relating

to the Bid exchanged between the Bidder and OGDCLs Consultant, shall be written in English language. Any supporting printed literature furnished by the

Bidder written in another language should be accompanied by an English

translation of its pertinent pages in which case, for purposes of interpretation of

the Bid, the English translation shall govern.

16.2 Documents Comprising the Bid

The Bid to be submitted by the Bidder shall comprise Technical Bid and Financial

Bid:

16.2.1 Technical (Proposal) Bid

The Technical (Proposal) Bid shall consist of the following:

I) General

a) Original Bid Bond for an amount of US $ 2,000,000/- (US Dollars two million only) or equivalent Pak Rupees as per format given in

Annexure-II.

b) An un-priced copy of Annexure-IX along with a statement confirming the bid validity period as per tender requirement.

c) Documentary evidence established in accordance with Instructions 16.3 that the bidder is eligible to bid and is qualified to perform the

Contract.



d) Documentary evidence established in accordance with Instructions 9.0 and 16.4 that the required units/equipment to be supplied,

installed, constructed & commissioned by the bidder are eligible

material and conform to the Tender Document.

e) Details of major components items of Gas Processing & LPG Recovery Plant proposed to be supplied including the following:

Sources/Country of origin Name and complete address of manufacturers/packager Profile of manufacturers/packager, their credentials, details of

items to be supplied and their capacity.

f) Bidders and its joint venture partners (if any) profile as per details given in Annexure-III.

g) Detailed Project Execution Plan covering all components including Design, Procurement (Supply), Installation, Construction &

Commissioning of Nashpa Gas Processing, LPG Recovery Plant &

Allied Facilities.

h) A reference list of plants similar to Nashpa Gas Processing, LPG Recovery Plant & Allied Facilities executed on EPCC basis

designed supplied, installed, constructed & commissioned in the

country of origin, Pakistan and other countries during last five (05)

years as per format given in Annexure-IV. The documentary

evidence in the form of Copies of Contracts and

performance/Completion Certificates should be provided. Only

those Projects whose complete documentary evidence (including

performance/ completion certificates) have been submitted will be

considered in the evaluation.

i) Bidders proposed project organization plan and resources (i.e. physical and human resources) to be deployed. The details of

physical resources and curriculum vitae of key personnel are

required to be provided as per format given in Annexure-V. The

curriculum vitae (CV) shall include the proposed position,

qualification, experience and age of the person. The key personnel,

if accepted by OGDCL, shall be nominated in the final Contract.

j) Proposed master and level-3project schedule with CPM network of project execution covering all components i.e. Design, Supply,

Construction, Installation, Construction & Commissioning of

Nashpa Gas Processing, LPG Recovery Plant & Allied Facilities.

k) List of major construction & related machinery & equipment available with the Bidder and its joint venture partner.



l) List of computer software and hardware available with the Bidder and its joint venture partner. Also specify the software(s) to be

used in:

Design Engineering Procurement of material/inventory management Construction Project Planning & Control

m) Bidders plan for co-ordination with OGDCL/Engineering Consultant and relevant government agencies and departments.

n) Detailed procedure of how physical progress and percent completion will be measured, tracked and reported for each

component of the Contract i.e. Design, Supply, Installation,

Construction & Commissioning of Nashpa Gas Processing, LPG

Recovery Plant & Allied Facilities.

o) Detailed description of project management system and Quality Assurance and Quality Control procedures and safety, QA/QC

organization which the Bidder intends to adopt/follow for this

project (These procedures should be Project specific).

p) Health, Safety and Environment (HSE) project specific plan and procedures. The plan and procedures should be inline with

OGDCLs HSE policy and procedures.

q) Areas of the work proposed to be sub-contracted with names, address, capabilities and other details of Sub-Contractors and their

written consent for entering into an agreement with the bidder for

the specified work of the Project.

r) Memorandum of Understanding (MOU) executed by joint venture partners with respective responsibilities for each package.

s) Copies of ISO, API and other certification/accreditations.

t) Authority Letter in the name of representative signing the Bid.

u) Duly initialed & stamped copy of complete Tender Document including Design Basis, Technical Details & Drawings, Form &

Conditions of Contract as well as Integrity and Ethics Undertaking

as per format given in Annexure-VI-A & B.

v) Statement that the goods are "Brand New



II) Technical Details:

a) The technical details of Nashpa Gas Processing, LPG Recovery Plant & Allied Facilities are presented in Annexure-VII.

16.2.2 Financial Bid

a) Bidding Form as per Annexure VIII.

b) Photocopy of Bid Bond for an amount of US $ 2,000,000/- (US Dollars two million only) or equivalent Pak Rupees.

c) Bid Price Schedule as per Annexure IX.

d) Item-wise (unit/system-wise) price list of Start-up & Commissioning Spares

e) Item-wise (unit/system-wise) price list of spare parts for two (02) years operation

f) Expenses of design review, HAZOP Inspection / witness testing by OGDCLs/Consultants Representatives.

g) Pre-Shipment Inspection Charges supported by verified quotation of nominated Inspection Agency.

h) Statement that the duties taxes levied by the exporting country and Pakistan are included.

i) Schedule of Rates for Additional equipment & material items given in Annexure-XVII.

j) Schedule of Rates for various types of works i.e. civil, mechanical, electrical & instrumentation.

k) Schedule of manday rates of home office and field staff and construction equipment.

l) Data Summary Sheet as per format given in Annexure-X.

16.3 Documents Establishing the Bidder's Qualification

The Bidder shall furnish, as part of its Bid, documents establishing Bidder's

qualifications to perform the Contract covering:

a) That, the Bidder offering the Nashpa Gas Processing, LPG Recovery Plant & Allied Facilities under the Contract has been duly authorized by the

manufacturer or producer to supply the materials to Pakistan.



b) That, the plant/units offered have been manufactured and supplied in the past and have been successfully in operation for at least three (03) years in similar

conditions

16.4 Documents Establishing Eligibility and Conformity to Tender Document of the Nashpa Gas Processing, LPG Recovery Plant & Allied Facilities

Proposed to be Supplied

The Bidder shall furnish, as part of the Bid, documents establishing the eligibility and conformity to the Tender Document of Nashpa Gas Processing,

LPG Recovery Plant & Allied Facilities which the Bidder proposes to supply

under the Contract.

The documentary evidence of Nashpa Gas Processing, LPG Recovery Plant & Allied Facilities eligibility shall consist of a statement in the Price Schedule

on the country of origin of the equipment offered which shall be confirmed by

a certificate of origin issued at the time of shipment.

The documentary evidence of the equipments conformity to the Tender Document may be in the form of literature, drawings and data and shall

furnish a detailed description of the goods and essential technical and

performance characteristics.

A clause-by-clause commentary on the Technical Specifications demonstrating the Nashpa Gas Processing, LPG Recovery Plant & Allied

Facilities substantial responsiveness to those specifications or a statement of

deviations and exceptions to the provisions of the Technical Specifications.

16.5 Bid Form and Price Schedule

The Bidder shall complete the Bid Form (Annexure-VIII) and Bid Price

Schedule (Annexure-IX) furnished in the Tender Document, indicating the

16.6 Deviation/Exceptions

The Bid shall clearly state, in a section explicitly devoted for this purpose, any or

all deviation/exceptions to the requirements of these Instructions to Bidders

including Conditions of Contract, also list of any departures or deviation from

specifications contained in Technical Documents given in Volumes 2 & 3. The

Deviation form is given as Annexure-XI.



16.7 Bid Bond

16.7.1 The Bidder shall furnish, as part of its Technical Bid, original Bid Bond

(Annexure-II) for an amount of US $ 2,000,000 (US Dollars two million

only) or in equivalent currency of the bid or in equivalent Pak Rupees.

16.7.2 The Bid Bond is required to protect OGDCL against the risk of Bidders'

conduct which would warrant the Bid Bond encashment pursuant to

Instructions given in following paragraphs.
