The session started with a prayer song led by the City Government Employees Performing Arts Choir

Division followed by the singing of the Philippine National Anthem and the General Santos City Hymn. After

acknowledging the presence of everyone the chair likewise took this opportunity to express the 17th

sanggunian’s condolences and sympathy to Councilor Rosalita Nuñez and family for the death of her husband,

the late Dioscoro “Dodong” Nuñez. After which she called the session to order. The Secretary called the roll

and there being a quorum the chair thereby ruled the session open for business.

F. READING AND ADOPTION OF MINUTES : 53rd Regular Session

On separate motions of Councilor Lagare jointly seconded by Councilors Bagonoc, Pestaño, Tan and

Pacquiao, the reading of the minutes of the 53rd regular session was dispensed with and finally adopted without

any correction.

G. PRIVILEGE HOUR:

Councilor Mario Empal when recognized and when given the floor thanked the present administration, from

the City Mayor to the Vice Mayor, the NCIP and the councilors specially Hon. Nuñez for paving the way for him

to represent the Indigenous People which was also mandated by law. After narrating a little of the history of the

City of General Santos and some of the IPs social or tribal customs, he implied that he would be interested in

helping the committee involved in ancestral domain claims, land conflicts and other similar matters. To end with,

the chair stated that the representation of Mr. Empal was the concerted efforts of all the honorable members

particularly Councilor Nuñez with the support also of the City Mayor. Although there are still some concerns to

be threshed out like the claim of the Maguindanaons to be similarly represented, the chair hopes that Councilor

Empal will indeed the voice of the IPs in the sanggunian where their interests will be addressed.

Councilor Bagonoc informed the privileged speaker that his worries including that of this office were already

acted upon by the sanggunian. The chair said that other concerns of the sanggunian would be discussed on the

last Wednesday of this month including the matter raised by Councilor Lagare III – reorganization of the different

committee chairmanship.

When her motion for reconsideration was granted, Councilor Pestaño under suspended rules presented to the

body the seven members of the General Santos City Skimboarding team who won as first runner up in the

national skimboarding competition held in Camarines Norte during its 17th Kadagatan Festival on August 2-3,

2014. A video clips was presented showing their exhibition tricks and stunts as they glide in the waves in

Camarines shore. Skimboarding uses skate board smaller than surfboard. The chair appreciated the youth for

engaging into sports as this would prevent them away from drugs and also they are actively pursuing their

studies.

Another set of champions that was presented by Councilor Pestaño were the 25 pupils of South Central

Elementary School who pitted talents in the recent 18th Mindanao Milo Little Olympics held at Pelaez Sports

Complex in Cagayan de Oro City on August 8-10, 2014. Over all, both in the Men’s and Women’s Artistic

Gymnastics they garnered gold, silver and bronze medals in floor exercises, vault apparatus, and in individual all

around. They are to represent the city in Marikina City on October 24-26, 2014. Their coaches were Mrs. Maria

Neri Pormentera, Ms. Jane Rose Ronquillo and the trainor, Mr. Clint Jude Aniñon.

Councilor Melliza informed that the landing foam used by these pupils was substandard which he feared

might injure the children. Accordingly, the standard one will cost around P40 to P45 thousand and he suggested

if they could source out some funds to support them as October is fast approaching. The pupils have given honor

to the city and among the many elementary schools in the city, they are the only ones that have dared and

competed in the said affair. He also informed the body that the SK funds could now be utilized. The chair said

they will discuss the same in their meeting. A photo ops followed and after which, the PTA president of the said

school thanked the August Body for their support.

Lastly, Councilor Pestaño introduced the four students from the Holy Trinity College who landed as first

runner up in the national competition - ENACTUS International held in SMX Mall of Asia, Pasay City. The

completion was said to be based on the most effective, most empowered people in need by applying business

and economic concepts and entrepreneurial approach to improve their quality of life and standard of living.

They are again to compete in China in October, 2014. These four students are Adeline Mendoza, Cleneil

Sustraido, Theo San Pedro and Kristine Jade Asturias. Some queries and concerns of the honorable members were

addressed by them. After the photo ops the chair requested them to furnish a copy of their winning entry in CD

form so that it can be posted in the sanggunian website.

of the City Mining & Regulatory Board. The City Mining & Regulatory Board (CMRB) shall be composed

of the Mines and Geo-Sciences Bureau(MGB) of the Department of Environment & Natural Resources

(DENR), the Regional Director of which as chairperson who could attend meetings personally or through

his duly authorized representative.

2. Paragraph 4, the 4th paragraph of Section 1 will now read as: The City Mining & Regulatory Board shall,

among others, accept, process, and evaluate applications and determine administrative charges and fees

for quarry, sand and gravel, guano, gemstone gathering and small scale mining permits duly filed with

the same.

3. On the process of applications step 3 it shall read as: If the application is found in order, the application

shall be endorsed favorably to the chief executive for perusal and approval. If not in order, the

application shall be returned to the applicant with explanation why the application cannot be granted

and/or the list of deficiency.

ruling of the chair there were questions raised as to the legality of requiring small scale business investors to

secure a consent from the barangay through a resolution. As discussions went on, the chair said there is a need to

update the Land Use Plan and the Zoning Ordinance, to define the community consent whether or not it is

through a resolution and the type of barangay ordinances and resolutions to be affirmed by the sanggunian.

Since there was no objection registered on the foregoing resolution the chair thereupon ruled the resolution as

approved.

J. QUESTION AND ANSWER HOUR:

At this juncture, under suspended rules, Dr. Marilyn “Mimi” Abiera, the Vice Chancellor of MSU was

recognized and before presenting her liquidation report as far as Kalilangan 2014 is concerned, she thanked the

body for their trust and confidence to manage and organize the Kalilangan Festival, the carrier event for the

foundation anniversary of the City of General Santos and for three consecutive years, the Kalilangan was chosen

by ATOP as the Best Tourism Event of the Philippines in Culture & Arts Category. Accordingly, the City Mayor is

set to receive the Hall of Fame Award in Bacolod this October, 2014.

After presenting the liquidation report, there were queries and concerns that were raised and the good Vice

Chancellor satisfied such concerns.

Councilor Lagare III in response to some queries said the allocation for this coming Tuna Festival was increased

to P4 Million where the organizer would have the same counterpart because of the Mindanao-wide pageant

“Mutya ng Mindanao” and the city also vies for the Guinness Book of Record as far as tuna industry is

concerned.

Councilor Atendido requested for an account balance of the city from the City Treasurer’s Office as of June 30,

2014. Likewise, the concern of Councilor Leyson IV about the promise of SOCOTECO II to return the more than

P3 Million overcharged Real Property Tax & Franchise Tax collected from consumers was referred to the

Committee on Public Utilities.

Councilor Nuñez at this juncture thanked the City Mayor, the chair and her colleagues and all the employees

for their support, presence and sympathy extended to her family in their moment of bereavement.

K. ANNOUNCEMENT:

1. September 1-5, 2014 – World 10-Ball Billiard Tournament in the City to be held at Pacman Gymn sponsored

by Brgy. Captain Rogelio “Ruel” Pacquiao and Congressman Manny Pacquiao.

The chair informed the body of the new law, RA 10389, “An Act Institutionalizing the Recognizant as a Mode

of Granting the Release of an Indigent Person in Custody as an Accused in the Criminal Case and for other

purposes” in which the process entails the resolution from the Sanggunian, and right now she said, there are

already 500 applicants. This matter will be included in their legislative meeting.

2. Resolution No. 33, series of 2014 of Barangay Dadiangas South which expresses its heartfelt sympathy and

condolences to the family of Councilor Rosalita Nuñez for the death of her husband, Dioscoro, “Dodong”

Nuñez.

3. A letter from the DILG –Project Development Service which was a favorable response to Res. No. 82, series

of 2014 of this council requesting fund support for the road improvement of Brgy. Lagao. The city is required

to submit annual work program based on the allocation approved by the Road Board under the Special

Local Road Fund and this accordingly should be coordinated with the DPWH and the City Engineer’s Office.

4. The upcoming 23rd Mindanao Business Conference (MINBISCO) on September 1-3, 2014 would also be

supported by the Regional Development Council, Region XII.
