Cruz, Jr. - Sponsor Chairman, Committee on Education & Information AN ORDINANCE ESTABLISHING THE CITY OF NAGA, CEBU STANDARD IDENTIFICATION SYSTEM (CN-SIDS) EXPLANATORY NOTE Section 16 Article XIll of the 1987 Constitution gives the people and its organizations the right to effective and reasonable participation at all levels of social, political, and economic decision-making and imposes upon the State, by law, to facilitate the establishment of adequate consultation mechanisms. The Local Government Code, specifically Section 16, imposes upon the local government unit (LGU) to exercise its powers which are necessary, appropriate or incidental for its efficient and effective governance and those which are essential to the 'promotion of the general welfare; Section 16 Supra. further provides that within their respective territorial jurisdictions, LGUs shall ensure and support, among other things, the preservation and enrichment of culture, promote health and safety, enhance the right of the people to a balanced ecology, encourage and support the development of appropriate and self-reliant scientific and technological capabilities, improve public morals, enhance economic prosperity and social justice, promote full employment among their residents, maintain peace and order, and preserve the comfort and convenience of their inhabitants; To complement the thrust of the City Government of Naga, Cebu for good governance, there is a need to promote responsible citizenship and community participation to attain holistic development of the City. Executive Order No. 14 Series of 2016, issued by the City Mayor, recognizes purok as people's organization (PO) and community service unit in the barangays that can be an active partner in the pursuit of local development. In relation to the preceding, there is a need to provide Nagahanons with the system or mechanism to properly identify and prioritize resident Nagahanons in the access of services in the barangays and other city government departments and/or facilities and avail privileges for the use of city's facilities, and reduce, if not totally eliminate fraudulent transactions and falsifications. AN ORDINANCE ESTABLISHING THE CITY OF NAGA, CEBU STANDARD IDENTIFICATION SYSTEM (CN-SIDS)

EXPLANATORY NOTE

Section 16 Article XIll of the 1987 Constitution gives the people and its organizations the right to effective and reasonable participation at all levels of social, political, and economic decision-making and imposes upon the State, by law, to facilitate the establishment of adequate consultation mechanisms.

The Local Government Code, specifically Section 16, imposes upon the local government unit (LGU) to exercise its powers which are necessary, appropriate or incidental for its efficient and effective governance and those which are essential to the 'promotion of the general welfare;

It is in the light of the foregoing that this representation, endorses the Executive Department's request for the Sanggunian to enact an ordinance establishing the City of Naga Standard Identification System (CN-SIDS).

For our colleagues' kind consideration.

BE IT ORDAINED by the Sangguniang Panlungsod of the City of Naga Cebu, in session assembled that:

SECTION 1. TITLE. This ordinance shall be known as: AN ORDINANCE ESTABLISHING THE CITY OF NAGA STANDARD IDENTIFICATION SYSTEM (CN­ SIDS).

SECTION 2. RECOGNITION, INSTITUTION AND UTILIZATION. The City of Naga Standard Identification System (CN-SIDS) is hereby recognized and instituted which shall be utilized as a convenient and efficient means of identifying the residents of the City for the delivery of basic services and facilities.

SECTION 3. THE CITY OF NAGA STANDARD IDENTIFICATION SYSTEM (CN-SIDS). All resident Nagahanons, with ages from 18 to 59 shall be issued the CN-SIDS Identification Card, with a corresponding ID Number, upon validation of his/her complete address that includes the Purok where he/she belongs, evidenced by a written endorsement from the Punong Barangay. The Identification Card shall be valid for five (5) years, subject to replacement under the following conditions;

a.) When there is a change in name andlor family name, by virtue of a court order or application of law, such as in the case of a married woman adopting the surname of the husband;

b.) A change in status, as when a resident contracts marriage with another or a married person whom by virtue of a court order gets an annulment or divorce from a foreign national spouse whose country recognizes divorce;

c.) When there is a change in sex by virtue of a court order;

d.) Lost, damaged or destroyed Identification Card, and

e.) For other modifications that may be deemed necessary by the cardholder, such as a change in facial features due to medical intervention.

The CN-SIDS Identification Card shall have on its face the imprinted photograph, full name, birth date, sex, marital status, date of issue, complete address, the corresponding CN-SIDS number, and the signature of the owner.

The issuance of the CN-SIDS Identification Card shall be free of charge, provided, that in case of any circumstance mentioned in Sec. 3 a to f hereof, a replacement fee of THREE HUNDRED PESOS (p300.00) shall be paid by the card holder upon issuance of a replacement Identification Card.

No replacement CN-SIDS Identification Card shall be issued without the written endorsement of the Punong Barangay where the cardholder resides.

SECTION 4. FUNCTIONAL USE OF THE CN-SIDS. The CN-SIDS shall be recognized in all LGU Naga transactions requiring the identity, status, birth, address, and all other circumstances such as but not limited to the following:

a.) Availment of benefits and/or privileges afforded by virtue oflaw or from the City, to its residents, such as: 20% Discount on Sports Facilities (i.e. track oval, swimming pool, etc.), 20% Discount on Health Facilities (i.e. Laboratory, Ultrasound, X-Ray, Dialysis, Infirmary); 20% Discount on Fees for any and all present and future city­ owned facilities in which an enabling ordinance shall provide for collection of fees;

b.) Proof of identity, status, age, and address for transactions in the City Government (i.e. AICS, claim of honorarium.);

c.) Any Minor who is a resident of the City of Nag a, Cebu shall be qualified to avail of the discounts provided in Section 4.a hereof upon presentation of the CN-SIDS Identification Card of the parent/guardian of the said minor; and

d.) Any Senior Citizen who is a resident of the City of Nag a, Cebu shall be qualified to avail of the discounts provided in Section 4.a hereof upon presentation of his or her Senior Citizen Identification Card.

SECTION 5. IMPLEMENTING OFFICE. The implementation of the CN-SIDS shall be the duty and responsibility of the City Information Office.

SECTION 6. CHANGE EFFECTED ON CN-SIDS. Any person who intends to effect change on its CN-SIDS shall seek the prior written endorsement of hislher Punong Barangay.

SECTION 7. SAFEGUARD. No information collected from the implementation of the CN-SIDS shall be used, published, disseminate, given or released to any third party, agency, office, or instrumentality, government or otherwise, nor shall be used against any individual or utilized thereof, except in but not limited to the following cases:

a. The owner or holder of the CN-SIDS expressly authorizes the disclosure of such information to a third person, entity or agency;

b. In the interest of public health or safety; and

c. Upon a lawful order from a competent court.

The information collected shall be organized in a manner that allows proper safeguard, access, safekeeping and change in management.

SECTION 8. PENAL PROVISIONS. Any person who knowingly uses false information or misrepresents in applying for the issuance of an Identification Card or uses one for fraud or any unlawful manner, shall be punished with thirty (30) days imprisonment and/or a fine of FIVE THOUSAND PESOS (p5,000.00), or both, at the discretion of the court.

Any public official or employee who conspires with the offender in effecting the acts abovementioned, or on his own causes the issuance of the ID Card or approves the application of the same, despite the knowledge of its fraudulent content shall suffer the same penalty imposed and in addition, will be subjected to Administrative Penalties on falsification/tampering of public documents in accordance with Civil Service rules.

SECTION 9. FAILURE TO PRESENT CN-SIDS IDENTIFICATION CARD. Failure to present the CN-SIDS card for transactions in LGU Naga will not mean a denial of the services available in the City as long as the individual is able to furnish a verified identification that he/she is a bonafide resident of the City.

SECTION 10. IMPLEMENTING RULES AND REGULATIONS. Within 15 days upon approval of this Ordinance, City Information Office, in coordination with other departments involved shall promulgate rules and regulations and best practices for the issuance of the ID card to effectively and systematically implement the provisions of this Ordinance.

SECTION 11. BUDGET PROVISION. Funding for the issuance of the CN_SIDS Identification Cards shall be included in the Annual Budgetary Appropriation of the City.

SECTION 12. SEPARABILITY CLAUSE. If .any provision of this Ordinance is declared invalid or unconstitutional by any court of competent jurisdiction, those not so declared shall remain in full force and effect thereof.

SECTION 13. REPEALING CLAUSE. Any and all Ordinances or provisions thereof which are inconsistent with the provisions of this Ordinance are hereby repealed or modified accordingly.

SECTION 14. EFFECTIVITY. This Ordinance shall take effect immediately upon its approval in accordance with law.
