PREAMBLE

WHEREAS, the 1987 Philippine Constitution recognizes the vital role of the youth in nation-building and mandates the promotion and protection of their physical, moral, spiritual, intellectual, and social well-being, as provided in Article II, Section 13 of the 1987 Philippine Constitution;

WHEREAS, the City of Manila, likewise, recognizes the invaluable role of the youth in the development of the city and value of education in the families of every citizen of the City of Manila;

WHEREAS, on May 15, 2013, Republic Act No. 10533, otherwise known as Enhanced Basic Education Act of 2013, was signed into law;

WHEREAS, the Enhance Basic Education Act of 2013 provides that the Republic of the Philippines will adopt the K-12 Curriculum which is designed to provide a holistic education for all Filipino students. The K-12 Curriculum is also designed to enable graduates to join the workforce right after high school, and suitably prepare those who want to go on to higher education;

WHEREAS, under the K-12 Curriculum, students shall go through these levels of education before going to higher education: Kindergarten, Elementary, Junior High School and Senior High School;

WHEREAS, Senior High School refers to Grades 11 and 12 of the K-12 Curriculum;

WHEREAS, there is a need to support the youth of the City of Manila intellectually by providing allowances to its public school students to allow them to continue their education despite the hardships and struggles of the family;

WHEREAS, in Section 458(a) of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, the Sangguniang Panlungsod is empowered to approve legislation that shall provide for general care of its inhabitants, particularly its youth and students;

WHEREAS, the same Code empowers the City Government to adopt measures that will ensure the protection of the social, moral and intellectual welfare of its inhabitants; NOW, THEREFORE, be it

Be it ordained by the City Council of Manila, in session assembled, THAT: SECTION 1. TITLE OF THE ORDINANCE. – This Ordinance shall be known as “AN ORDINANCE PROVIDING FIVE HUNDRED PESOS (PHP. 500.00) MONTHLY MONETARY ALLOWANCE TO QUALIFIED TWELFTH (12TH) GRADE STUDENTS OF PUBLIC SCHOOLS IN THE CITY OF MANILA, APPROPRIATING FUNDS THEREOF AND FOR OTHER PURPOSES”.

SEC. 2. DEFINITION OF TERMS. - As used in this Ordinance, the following words, terms and phrases shall be defined as follows:

(a) Qualified Student – duly enrolled twelfth (12th) grade senior high school student, in good standing, in any public school under the supervision of the Division of City Schools – Manila (DCM-Manila) of the City of Manila, who is a resident and registered voter of the City of Manila, or if the student is not yet of legal age to register to vote, his or her parents, one of the parents, legal guardian is a registered voter of the City of Manila; and

(b) Student in Good Standing – enrolled twelfth (12th) grade senior high school student of a public school in the City of Manila not under probation or without any citation and disciplinary record.

SEC. 3. BENEFICIARY OF THIS ORDINANCE. - All qualified twelfth (12th) grade students duly enrolled in any public school within the supervision of the Division of City

Schools – Manila (DCM-Manila) of the City of Manila, in good standing.

SEC. 4. MONTHLY ALLOWANCE. - The Five Hundred Pesos (PHP. 500.00) monthly allowance shall be given to the beneficiaries as defined by Section 3 hereof, provided that the hereunder requirements shall be complied with.

SEC. 5. REQUIREMENTS FOR THE AVAILMENT OF THE BENEFITS:

a. Must be duly enrolled twelfth (12th) grade senior high student, in good standing, of a public school in the City of Manila offering Senior High School Programs under the K to 12 Curriculum;

b. Must be a bonafide resident and registered voter of the City of Manila; and

c. If the student is not of legal age to be a registered voter, his or her parent, or legal guardian must be a registered voter of the City of Manila.

SEC. 6. DISQUALIFICATION. - In case of dismissal from the school before the end of the school year, the student and his or her parent or legal guardian must immediately surrender the corresponding Automated Teller Machine (ATM) card to the Division of City Schools – Manila (DCM-Manila). Failure to comply with this provision shall cause the filing of the appropriate charges.

SEC. 7. APPROPRIATION. - The City Government shall appropriate funds therefore which shall be used for the above purposes mandated by this Ordinance in the City’s Annual Budget or any other available funding source and in every succeeding budget year thereafter.

SEC. 8. SEPARABILITY CLAUSE. - If any provision of this Ordinance or the application of such provision to other persons or circumstances is declared invalid, the provisions thereof not affected thereby shall remain in full force and effect.

SEC. 9. REPEALING CLAUSE. - All ordinances, resolutions, executive orders, rules and regulations, and other issuances or parts thereof found to be inconsistent with the provisions of this Ordinance are hereby repealed, modified or amended accordingly.

SEC. 10. EFFECTIVITY CLAUSE. - This Ordinance shall take effect upon its approval and after publication in a newspaper of general circulation. The Division of City Schools is hereby directed to immediately draft the Implementing Guidelines upon the approval of this Ordinance, PROVIDED, that the failure of the concerned agencies to promulgate the said Guidelines/Rules and Regulations shall not prevent the implementation of this Ordinance upon its effectivity.

This Ordinance was finally enacted by the City Council of Manila on _______________.

PREAMBLE

WHEREAS, no less than the paramount law of the land, the 1987 Constitution under Article XIII, Section 11 thereof, specifically provides that the state shall adopt an integrated and comprehensive approach to health development which shall endeavor to make essential goods, health and other social services available to all the people at affordable cost and prioritizing the elderly, disabled, women and children; WHEREAS, the aforesaid provision of the Constitution treats the elderly and disabled as similarly situated in terms of being afforded essential goods, health and other social services in accordance with their needs; WHEREAS, similar to elderly citizens, it is the valued policy of the State to protect the disabled by rehabilitating them so they can be productive citizens upon their integration to the mainstream society; WHEREAS, the rights of senior citizens and disabled persons should be recognized and must be the primordial concern of the City Government; WHEREAS, there is an imperative need to provide the senior citizens and disabled persons with a comprehensive health care and financial assistance to foster their capacity to attain a more meaningful and productive lifestyle; WHEREAS, in Section 458 (a) of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, the Sangguniang Panlungsod is empowered to approve legislation that shall provide for the care of its inhabitants particularly the elderly and the disabled; WHEREAS, the same Code empowers the City Government to adopt measures that will ensure the protection of the health, social and moral welfare of its inhabitants especially the needy ones: NOW, THEREFORE, Be it ordained by the City Council of Manila, in session assembled, THAT:

SECTION 1. TITLE. – This Ordinance shall be known as “AN ORDINANCE

PROVIDING FIVE HUNDRED PESOS (PHP. 500.00) MONTHLY MONETARY ALLOWANCE

TO ALL BONA FIDE SENIOR CITIZENS, DIFFERENTLY ABLED OR PERSONS WITH

DISABILITY AND SOLO PARENT RESIDENT OF THE CITY OF MANILA, AS PART OF THE

SOCIAL AMELIORATION PROGRAM OF THE CITY, APPROPRIATING FUNDS THEREFOR

AND FOR OTHER PURPOSES”.

SEC. 2. DEFINITION OF TERMS. – As used in this Ordinance, the following words,

terms and phrases shall be defined as follows:

1.) Senior Citizens or Elderly – Refers to any resident of the City of Manila who are at least sixty (60) years of age;

2.) Differently Abled Person – Proposed as a substitute for “disabled” or “handicapped” and it emphasizes the fact that many people with disabilities are quite capable of accomplishing or performing a particular task and function only in a different manner or taking more time and effort than people without the disability in question;

3.) Persons With Disability (PWD) – Are those suffering from restriction or different abilities as a result of an impairment, to perform an activity in the manner or within the range considered normal for human being as determined by the Manila Social Welfare and Development Office (MSWDO);

4.) Solo Parent – According to Section 3 (a) of R.A. 8972, a “solo parent” is a person who has been left with the child’s responsibility or care under any of the following categories:

i) A woman who gives birth as a result of rape, and other crimes against chastity even without a final conviction of the offender, provided that mother keeps and raises the child;

ii) Parent left solo or alone with the responsibility of parenthood due to the following circumstances: a) Due to death of spouse; b) Spouse is detained or is serving sentence for a criminal

conviction for at least one (1) year; c) Physical and/or mental incapacity of spouse as certified by a

public medical practitioner; d) Legal separation or de facto separation from spouse for at

least one (1) year, as long as he/she is entrusted with the custody of the children; and

e) Declaration of nullity or annulment of marriage as decreed by a court or by a church as long as he/she is entrusted with the custody of the children.

iii) Unmarried mother/father who has preferred to keep and rear her/his child/children instead of having others care for them or give them up to a welfare institution;

iv) Any other person who solely provides parental care and support to a child or children; and

v) Any family member who assumes the responsibility as head of the family as a result of the death, abandonment, disappearance or prolonged absence of the parents or solo parent.

SEC. 3. BENEFICIARIES OF THIS ORDINANCE. — The following persons are entitled to receive the allowance covered by this Ordinance; to wit:

a. Senior Citizens; b. Persons With Disability; and c. Solo Parents.

PROVIDED, However, that in case the beneficiary falls on two (2) or more of the above-mentioned classification of beneficiaries, he/she can only avail of one (1) allowance covered by Section 4 hereof from the City Government of Manila.

SEC. 4. MONTHLY ALLOWANCE. — T he Five Hundred Pesos (PhP. 500.00)

monthly allowance shall be given to the beneficiaries as defined by Section 3 hereof, provided that the requirements under Section 5 of this Ordinance shall be complied with.

SEC 5. REQUIREMENTS FOR THE AVAILMENT OF THE BENEFITS. –

for Senior Citizens:

a. must be at least, 60 years of age; b. must be a bona fide resident and registered voter of the City of Manila; and c. must be included in the masterlist of the Office of the Senior Citizens Affairs

of the City of Manila.

for Persons with Disability and Solo Parent: a. must be a bona fide resident and registered voter of the City of Manila; and b. must be included in the masterlist of the Manila Department of Social Welfare

Office.

SEC. 6. NON-DISCLOSURE CLAUSE. PENALTY. – In case of death of the beneficiaries covered by this Ordinance, the nearest of kin should immediately report to the Office of the Senior Citizens Affairs the death of the beneficiary and surrender immediately the corresponding Automated Teller Machine (ATM) card to the Office of the Senior Citizens Affairs (OSCA) for Senior Citizen beneficiaries, and to the Manila Social Welfare and Development Office (MSWDO) for Persons With Disabilities and Solo Parent Beneficiaries. Failure to comply with this provision shall cause the filing of the appropriate charges to the relative concerned.

SEC. 7. APPROPRIATION. – The City Government shall appropriate funds therefor

which shall be used for the above purposes mandated by this Ordinance in the City’s Annual

Budget and in every succeeding budget year thereafter.

SEC. 8. SEPARABILITY CLAUSE. - If any provision of this Ordinance or the application of such provision to other persons or circumstances is declared invalid, the provisions thereof not affected thereby shall remain in full force and effect.

SEC. 9. REPEALING CLAUSE. - All ordinances, resolutions, executive orders, rules and regulations, and other issuances or parts thereof found to be inconsistent with the provisions of this Ordinance are hereby repealed, modified or amended accordingly.

SEC. 10. EFFECTIVITY CLAUSE. - This Ordinance shall take effect upon its approval and after publication in a newspaper of general circulation. The Office of the Senior Citizens Affairs (OSCA) and the Manila Social Welfare and Development Office (MSWDO) are hereby directed to immediately draft the implementing Guidelines/Rules and Regulations upon the approval of this Ordinance, PROVIDED, that the failure of the concerned agencies to promulgate the said Guidelines/Rules and Regulations shall not prevent the implementation of this Ordinance upon its effectivity.
