Executive Summary The Court Facilities Advisory Committee recommends that the Judicial Council adopt a catalog of courtroom layouts with associated holding areas for use in the design of new courthouses that are fully or partially funded by the state. Each courthouse project and the courthouse construction program as a whole will save time in the design process and therefore save project costs through the application of the layouts, compared to the individual design of each project’s courtrooms and adjacent holding areas.

Recommendation The Court Facilities Advisory Committee recommends that the Judicial Council, effective June 26, 2015, take the following action:

1. Adopt the Catalog of Courtroom Layouts for California Trial Courts (Catalog) for application in the design of all fully or partially state-funded new courthouses to be used by the trial courts.

Previous Council Action The council has taken no previous action on the attached Catalog. In May 2013, the council’s Executive and Planning Committee approved formation of the Courtroom Standards Workgroup (CSW), a workgroup of the advisory committee’s Courthouse Cost Reduction Subcommittee (CCRS). This approval was made at the request of the CCRS chair so that this workgroup could focus specifically on development of the courtroom layouts with a goal to explore how project costs could be saved by minimizing the design time required to lay out courtrooms and adjacent holding areas.

Rationale for Recommendation The advisory committee and its CSW have been studying how to best lay out typical trial courtrooms and adjacent holding cell areas—with a goal to simplify and shorten the design process—by cataloging and developing courtroom layouts and associated holding cell areas that can be provided to design teams, rather than having them develop their own for each new courthouse project. This streamlining process will save time and therefore project costs. The process for developing the Catalog has unfolded in two phases. The initial phase involved developing “typical” layouts, and the second phase focused on cataloging judge-approved courtroom layouts that are in existing buildings or those under construction. The initial phase began in January 2014, when the CSW and Judicial Council staff began studying the features of a “typical” trial courtroom. The results of their work proposed two alternatives: a center-bench and a corner-bench layout of approximately 1,700 square feet (SF) each. Members of the council’s Trial Court Presiding Judges Advisory Committee (TCPJAC) and the Court Executives Advisory Committee (CEAC) reviewed this layout using their knowledge of trial court operations and provided very useful feedback in late summer 2014. The second phase involved incorporating this feedback into the typical trial courtroom layouts as well as gathering, reviewing, and selecting courtroom and holding cell layouts that represent a range of courtroom calendars and local judicial practice. The results of this second phase were reviewed by members of the TCPJAC and the CEAC in December 2014. Their input was then incorporated into a draft Catalog that was distributed for comments by the courts. The attached Catalog incorporates the one comment received by including the courtroom layout of the newly opened Banning Courthouse in Riverside. Any one of the Catalog’s courtroom layouts could be used for a future new courthouse project, depending on the unique nature of each court, the particular calendar types to be heard in the new courthouse, and the anticipated need for spectator and voir dire seating. The layouts can be modified in minor ways to reflect particular local judicial practice, with the overall goal of expediting the design process while delivering courtrooms and holding cells that function well for the court for years to come.

Summary of Catalog The Catalog consists of a total of 38 possible courtroom layouts: 10 typical courtroom layouts and 28 courtroom layouts approved by judges in existing buildings and some now under construction. The Catalog also includes three examples of courtroom-adjacent holding areas. Each of these is described below. Summary of 28 Judge-Approved Courtroom Layouts in Catalog The Catalog includes layouts for standard and large size trial courtrooms and specialized courtrooms for double juries, arraignments, traffic, and family. Both center and corner bench layouts are included for all except the family court layouts due to lack of recent corner bench layouts for family court calendars in California. Sizes of the standard trial courtrooms range from 1,600 to 2,056 SF. Sizes of the large trial courtrooms range from 2,100 to 2,500 SF. Description of 10 Typical Layouts The typical layouts include four standard trial courtrooms and six large trial courtrooms. Each of the proposed typical layouts is an improvement over the original proposed layout in several areas. Each has an expanded judge’s bench and overall work surface area, and an expanded clerk’s work surface. Each of the typical layouts can accommodate up to four counsel tables by virtue of providing a moveable lectern, evidence table, and court reporter’s station. Each typical courtroom also has the option of alternate locations for the court security officer and a gate in the rail separating the well from spectator seating. Each typical layout expands the number of seats for voir dire through one or more enhancements: expanding the courtroom size, using moveable chairs in the well along the rail and next to the jury box, and trading attorney-client conference rooms for additional spectator seating. Each layout’s sight lines were tested to confirm that the relative locations of judge, witness, counsel, and jurors are functional, with multiple locations identified for side bar conferences. Each layout also includes adjustable-height work surfaces for the judge and clerks. In each of the courtroom layouts, there are three features that are standardized to minimize size and therefore cost. First, the judge’s bench is elevated 16 inches to minimize the length of ramps that serve the bench, witness, and clerks’ areas. Second, the first row of jurors is level with the courtroom well to eliminate a ramp to the jury box. Third, all spectator seating is provided in benches rather than individual auditorium seats for cost savings in both construction costs and long-term operations and maintenance costs. Summary of Courtroom Holding Areas The Catalog also includes three examples of courtroom-adjacent holding cores that synthesize various features of built examples with best practices in detention planning. These three layouts provide capacity for four to seven in-custodies in 496 to 605 SF. Estimated Cost Savings Tools that expedite the design process save time. There are hundreds of interrelated decisions to be made in laying out courtrooms and adjacent holding areas. Application of the courtroom and holding area layouts in the Catalog will save approximately one to two months of time from a

decisionmaking process that often involves all members of the bench of a particular court. This time savings may reduce the project escalation costs by as much as $1.5 million for all combined active and indefinitely delayed projects. Application of the Catalog will both eliminate the necessity to construct individual project courtroom mockups and employ more cost-effective designs. This is estimated to save an additional $7 million for all the currently funded projects that have not yet begun design or are just starting design, along with those that are indefinitely delayed.

Comments, Alternatives Considered, and Policy Implications Comments on the Catalog were solicited from the superior courts, as briefly described above. The very first materials developed for the Catalog was sent by the advisory committee chair to all presiding judges and court executive officers for a three-week comment period from April 23, 2014, through May 14, 2014. After Judicial Council staff incorporated comments from this process into a revised set of materials, including a draft Catalog, the advisory committee’s chair met with some of the members of the joint TCPJAC/CEAC courtroom templates working group on December 2, 2014, to discuss their comments. The draft Catalog was also posted for public comment on November 26, 2014, for discussion at the advisory committee’s meeting on December 3, 2014. No public comments were received in relation to that public meeting. However, Presiding Judge Robert C. Hight of the Superior Court of Sacramento County made comments including that the existing trial courtroom layout in the Gordon D. Schaber Courthouse, located in downtown Sacramento, be incorporated into the Catalog. That layout was thereafter incorporated. Factoring in all comments until that point in time, an updated version of the draft Catalog was sent by the advisory committee’s chair to all presiding judges and court executives for a three-week comment period from March 16, 2015, through April 6, 2015. In addition, the advisory committee’s chair met with and reviewed the draft Catalog at meetings of the council’s TCPJAC on March 19, 2015, and CEAC on March 25, 2015. At the conclusion of the three-week comment period, one comment was received from the Superior Court of Riverside County in support of the application of the Catalog, indicating preference for one layout that nearly matched the court’s preferred layout at the newly opened Banning Courthouse. This layout was added to the final draft Catalog posted for public comment on May 12, 2015, for discussion at the advisory committee’s meeting on May 15, 2015. No public comments were received in relation to that public meeting.

Implementation Requirements, Costs, and Operational Impacts Application of the Catalog is a way to save additional project costs by saving time in the design process, eliminating the individual project courtroom mockups, and employing more cost-efficient designs. As described above, it is estimated that $8.5 million will be saved in the long term through application of the layouts to all courthouse capital projects to be designed.
