1. INTRODUCTION 1.1 Minerals Core Strategy Background As Mineral Planning Authority (MPA), Devon County Council has a duty under the Planning and Compulsory Purchase Act (2004), to prepare documents within a Mineral and Waste Development Framework (MWDF). The first of these Development Plan Documents to be produced will be the Minerals Core Strategy (MCS) which will largely replace the existing Minerals Local Plan. The area covered by the Strategy is the area for which Devon County Council is the MPA. This excludes Plymouth, Torbay and both Dartmoor and Exmoor National Parks. This area will be referred to throughout this report as the ‘Framework Area’, and any references to ‘Devon’ should be taken to mean the Framework Area, plus Plymouth, Torbay and the National Parks. The Minerals Core Strategy aims to achieve sustainable minerals development in the Framework Area by: • identifying which mineral resources should be worked and the broad

locations in which this will occur; • proposing measures to conserve mineral resources to ensure their

future availability; • addressing the potential adverse impacts of minerals development on

people and the environment; and • seeking to maximise the contribution of minerals development to

Devon’s communities, economy and environment. 1.2 Aggregate Minerals Policy The supply of aggregate minerals, which are defined in the Minerals Local Plan as “sand, gravel, crushed rock and other bulk materials used by the construction industry”, is a key issue for the Minerals Core Strategy. Annex 1 of Minerals Policy Statement 1 (MPS1) sets out the current Government policy on aggregates, and requires MPAs to “make provision for the sub-regional apportionment of the current National and Regional Guidelines for land-won aggregate”. It continues by stating that provision in the MWDF may take the form of specific sites, preferred areas and/or areas of search, and that “specific provision may need to be made for aggregates that meet particular or demanding specifications”. The MPS1 Annex also advises that the length of an MPA’s landbank is an indicator of the need for new planning permissions for aggregates extraction. A landbank of less than seven years for sand and gravel and less than ten years for crushed rock should be taken as an indication that “additional

reserves will need to be permitted if acceptable planning applications are submitted”. The sub-regional aggregates apportionment derived from the Government’s 2003 aggregates guidelines identified an apportioned figure for crushed rock for Devon of 55.99 million tonnes for the period 2001-2016, which results in an annualised rate of 3.5 million tonnes. For sand and gravel, Devon’s apportionment included Somerset and Cornwall as the low level of production in those counties raises issues of confidentiality, with the total requirement for the period being 21.8 million tonnes, giving an annualised rate of 1.36 million tonnes. 1.3 2009 National and Regional Aggregate Guidelines New aggregates guidelines for the period 2005-2020 were published by the Government in June 2009, and reflect a forecast decline in demand for primary aggregates and an increase in the contribution of alternative materials, with a national requirement over the period 2005-2020 for 1,028 mt of land-won sand and gravel and 1,492 mt of crushed rock. For the South West region, the 2009 guidelines provide for 85 mt of land-won sand and gravel and 412 mt of crushed rock. South West Councils (the Regional Planning Body), working with MPAs and representatives of the minerals industry, commenced preparation of a sub-regional apportionment of the 2009 guidelines. The methodology comprised the development of a baseline scenario based on past production levels, together with further scenarios taking account of environmental constraints and the location of major markets. Following the recent announcement of the withdrawal of funding for South West Councils’ planning function, it is unclear how the sub-regional apportionment exercise will be completed. 1.4 Purpose of the ‘Call for Sites’ The Minerals Core Strategy that is currently being developed will cover the period to 2031. Notwithstanding the potential lack of an up-to-date sub-regional aggregates apportionment for Devon, national minerals policy continues to require that the County Council ensures the maintenance of a landbank of aggregate reserves. It has been identified that, based on current reserves and recent levels of production, Devon will have a potential shortfall of sand and gravel during the Core Strategy period to 2031. While the crushed rock landbank is currently in excess of 60 years, there is a limited supply of high-specification crushed rock aggregates within Devon. In order to provide robust evidence for the appraisal of options for the delivery of a sustainable supply of aggregate resources, and to contribute towards the

identification of potential strategic sites to provide this supply, Devon County Council made a ‘call for sites’ for aggregate resources on 19 May 2010. A set of required criteria for any proposed sites was issued: • any site must be within the ‘Framework Area’ (as identified above); • the site can be a new extraction site or an extension to an existing

quarry; • the site must be capable of operating within the period between now

and 2031 (not necessarily for the whole of this period); and • the resource to be worked must be a primary land-won aggregate. It was underlined to potential proposers that the nomination of a site is without prejudice to the decisions that will be taken by Devon County Council on the strategy for aggregates supply and identification of strategic sites within the Minerals Core Strategy.

2. METHODOLOGY 2.1 Standard Response Form In order to ensure that any site information submitted was in a standard format that could be easily recorded and assessed, a response form was provided (copy available at Appendix 1). The form included a number of questions covering topics including current site ownership, location, area, current land use and details of the mineral resource. All completed forms were also required to be submitted with a site plan showing the extent of the land, the proposed extraction area, the extent of the land currently under the landowners/operators’ control and the proposed vehicular access. 2.2 Response Form Distribution The response form was distributed, along with a covering letter (copy available at Appendix 2) to the Minerals and Waste Policy Team’s existing database of mineral operators, agents and landowners. Where email addresses were available, the documents were sent electronically. In total, the response form and accompanying letter were sent to 42 contacts from the database: 22 mineral operators, 13 agents and 7 landowners. Of these 42, 25 were sent by email and 17 were sent by post. Two organisations representing aggregate minerals operators, the Mineral Products Association and the British Aggregates Association, were also sent the response form and letter and invited to circulate them to their members. 2.3 Publicity for the ‘Call for Sites’ In order to ensure that any other potentially interested parties were aware of the ‘call for sites’ and given the opportunity to respond, a press release was issued by the County Council. It appeared in both the Western Morning News and the Express and Echo, and was available on the News page of the Devon County Council website. Additionally, the press release was included in the County Council’s internal staff bulletin ‘Insider’ and in the monthly email bulletin ‘In Touch’, which is sent to all parish councils, MPs, MEPs and partner organisations. From the press release, people were directed to the Minerals Core Strategy web pages (www.devon.gov.uk/mineralscorestrategy) where alongside further information, copies of both the covering letter and response form could be downloaded or printed. Additionally, from the press release, people were given the opportunity to contact the Mineral and Waste Policy Team via email or phone for more information. Finally, the ‘call for sites’ was included on the County Council’s database of consultations, ‘Consultation Finder’.

2.4 Timescale The press release was issued by the County Council on 12th May 2010. Response forms and covering letters were distributed to database contacts on 19th May 2010, and the ‘call for sites’ was open for responses from 19th May 2010, until 2nd July 2010. 2.5 Collation of Submitted Sites Details of each nominated site have been entered into a standard table, supplemented by additional information from the County Council. These tables are provided in the following section of this report.

3. SUBMITTED SITES As a result of the ‘call for sites’, a total of 12 site proposals were received. Two of these sites were excluded from subsequent consideration as they fell outside of the scope of the exercise for the following reasons: Lapthorne Cross, Dittisham The aggregates produced at this site are derived from the processing of construction and demolition waste, and therefore do not fall within the definition of ‘primary aggregates’. Uplyme Quarry, Uplyme The sand and gravel at the quarry already benefits from planning permission for its extraction. The remaining ten sites are identified in Table 1 below. Site Ref.

4. USE OF THE EVIDENCE Devon County Council is intending to undertake consultation on a ‘Preferred Strategy’ for the Minerals Core Strategy by the end of 2010. To reach that stage, the Council is refining the options that were consulted on through the ‘Issues and Options’ consultation paper in 2007/08, and an ‘Objective Options Paper’ for delivery of the aggregates objective of the Minerals Core Strategy will be published on the County Council’s website1. The options for aggregates development will then be subjected to a process of evaluation including sustainability appraisal. The evidence gathered through the call for aggregates sites will be used to contribute to the refinement and evaluation of options for three key issues: ♦ the future spatial pattern of aggregates working in the Framework Area; ♦ the identification of new strategic sites for aggregates extraction; and ♦ the identification of Mineral Safeguarding Areas for the protection of

potential aggregate resources. As highlighted earlier in the report, there is no suggestion that the submission of a site in response to the call for sites will necessarily result in that site being included within the Minerals Core Strategy. Site allocations within the Core Strategy will be limited to those sites considered crucial to delivery of the Strategy’s objectives and policies, although criteria-based policies may allow for other sites to be brought forward during the plan period. Dear Sir / Madam CALL FOR SITES FOR NEW AGGREGATE MINERAL RESOURCES This letter has been sent to mineral operators, agents and landowners with a current or potential interest in aggregate mineral working in Devon who may wish to identify sites to be considered for future working. As part of its Minerals and Waste Development Framework, Devon County Council is preparing a Minerals Core Strategy that will replace the Minerals Local Plan that was adopted in 2004 and provide the policy context for minerals development in Devon for the period to 2031. The area covered by the Minerals Core Strategy is that for which Devon County Council is the mineral planning authority. This area – referred to as the ‘Framework Area’ – excludes the unitary councils of Plymouth and Torbay and the National Parks of Dartmoor and Exmoor. Devon County Council consulted on the issues and options for the Minerals Core Strategy in November 2007, and a copy of the consultation paper and a summary of the responses received can be viewed on the Council’s website at www.devon.gov.uk/mineralscorestrategy. At the time of this consultation, the period for the Core Strategy was to 2026, but this has since been amended to 2031 to ensure that, when adopted, the document looks forward for a minimum of 15 years in accordance with Government guidance. One of the key issues facing the Minerals Core Strategy is the maintenance of a sustainable supply of aggregate minerals to meet future construction requirements and to contribute to regional guidelines. The Issues and Options Consultation Paper highlighted the potential shortfall in sand and gravel reserves and noted that, while the overall crushed rock landbank is in excess of 60 years, there is limited supply at present from within the county of high-specification aggregates. In order to provide robust evidence for the appraisal of options for the delivery of a sustainable supply of aggregate resources, and to contribute towards the identification of potential strategic sites to provide this supply, Devon County Council is making a ‘call for sites ’ for aggregate resources. The criteria to be met are that: • any site must be within the ‘Framework Area’ identified in the second

paragraph above; • the site can be a new extraction site or an extension to an existing quarry; • the site must be capable of operating within the period between now and

2031 (not necessarily for the whole of this period); and • the resource to be worked must be a primary land-won aggregate1
