This document contains important information required under the Corporations Act 2001 (Cth) (the Act) and has been prepared to assist You in understanding Rent.com.au Contents Insurance Insurance and making an informed choice about Your insurance requirements. It is up to You to choose the cover You need. It is important that You carefully read and understand this document before making a decision.

Other documents may form part of Our Policy Wording and PDS and if they do, We will tell You in the relevant document.

In return for You paying Us a premium We insure You for the Events described in the Policy Wording and PDS, subject to the terms, conditions and exclusions of Your Policy. Please keep this document, Your Certificate of Insurance and any other documents that We tell You form part of Your Policy in a safe place in case You need to refer to them in the future.

Please check these documents to make sure all the information in them is correct. Please let Us know straight away if any alterations are needed or if You change Your address or payment details. For certain types of cover under the Policy, We will require You to provide receipts and other documentary evidence to Us before We pay a claim. You should keep those documents in a safe place.

General Insurance Code of Practice

We are a signatory to the General Insurance Code of Practice (the Code). The objectives of the Code are to further raise standards of service and promote consumer confidence in the general insurance industry. Further information about the Code and Your rights under it is available at www.codeofpractice.com.au and on request.

Financial Claims Scheme

We are an insurance company authorised under the Insurance Act 1973 (Cth) (Insurance Act) to carry on general insurance business in Australia by the Australian Prudential Regulation Authority (APRA) and are subject to the prudential requirements of the Insurance Act.

The Insurance Act is designed to ensure that, under all reasonable circumstances, financial promises made by Us are met within a stable, efficient and competitive financial system.

Because of this We are exempted from the requirement to meet the compensation arrangements Australian financial services licensees must have in place to compensate retail clients for loss or damage suffered because of breaches by the licensee or its representatives of Chapter 7 of the Corporations Act 2001 (Cth). We have compensation arrangements in place that are in accordance with the Insurance Act. In the unlikely event that We were to become insolvent and were unable to meet Our obligations under the Policy, a person entitled to claim may be entitled to payment under the Financial Claims Scheme. Duty of Disclosure

Your Duty of Disclosure

Before You enter into this contract of insurance, You have a duty of disclosure under the Insurance Contracts Act 1984.

The duty applies until We first agree to insure You, and where relevant, until We agree to any subsequent variation, extension, reinstatement or renewal (as applicable).

Answering Our questions

In all cases, if We ask You questions that are relevant to Our decision to insure You and on what terms, You must tell Us anything that You know and that a reasonable person in the circumstances would include in answering the questions.

It is important that You understand You are answering Our questions in this way for Yourself and anyone else that You want to be covered by the contract.

Variations, Extensions and Reinstatements

For variations, extensions and reinstatements, You have a broader duty to tell Us anything that You know, or could reasonably be expected to know, may affect Our decision to insure You and on what terms.

Renewal

Where We offer renewal, We may, in addition to or instead of asking specific questions, give You a copy of anything You have previously told Us and ask You to tell Us if it has changed. If We do this, You must tell Us about any change or tell Us that there is no change.

If You do not tell Us about a change to something You have previously told Us, You will be taken to have told Us that there is no change.

What You Do Not Need to Tell Us

You do not need to tell Us anything that:

• reduces the risk We insure You for; or • is common knowledge; or • We know or should know as an insurer; or • We waive Your duty to tell Us about.

If You Do Not Tell Us Something

If You do not tell Us anything You are required to tell Us, We may cancel Your contract or reduce the amount We will pay You if You make a claim, or both.

If Your failure to tell Us is fraudulent, We may refuse to pay a claim and treat the contract as if it never existed.

The Meaning of Certain Words and Interpretation

Throughout this document, certain words begin with capital letters. These words have special meaning and are included in the Definitions. Please refer there for their meaning.

Any reference to an Act, legislation or legislative instrument in this document also refers to that Act, legislation or legislative instrument as amended and as may be in force from time to time.

Eligibility Criteria

In order to purchase a Policy, You must be eighteen (18) years of age or older when You apply.

You must have a permanent residence in Australia, unrestricted right of entry into Australia and:

a) be an Australian resident; or

b) be on a skilled working visa (e.g. a Temporary Skill Shortage visa), but not a working holiday visa; or

c) have a partner/spouse visa which allows You to stay in Australia for at least (two) 2 years; or

d) have a New Zealand passport.

Cooling Off Period

You have fourteen (14) days after entry into the Policy (including renewals) to decide whether to return it. If the request is made to Us in writing within those fourteen (14) days, We will cancel the Policy, provided You have not exercised a right or power under the terms of the Policy in that period (e.g. a claim has been made or benefit paid). We will provide a full refund of Premium, less charges or taxes which We are unable to recover. Even after the cooling off period ends You have cancellation rights, as outlined in the next section. These cooling off rights do not apply if You have made or You are entitled to make a claim during this period.

Cancellation of Your Policy

Your Policy may be cancelled in one of three (3) ways:

1. You can cancel Your Policy at any time by telling Us in writing or calling Us on 1800 958 123. If You:

a) pay Your premium by instalments and wish to cancel, We will cancel on the date to which You have paid Your premium in advance.

b) do not pay Your premium by instalments, the cancellation will take effect at 4pm Australian Eastern Standard Time on the day We receive Your cancellation. We will refund the premium for Your Policy, less an amount which covers the period for which You were insured. However, We will not refund any premium if We have paid or are obliged to pay a benefit under Your Policy.

2. We can cancel Your Policy by giving You written notice to the address on file and in accordance with the Insurance Contracts Act 1984 (Cth), including where You have:

a) breached the Duty of Disclosure;

b) breached a provision of Your Policy (including one requiring payment of premium); or

c) made a fraudulent claim under any policy of insurance.

If We cancel, We will refund the premium for Your Policy less an amount to cover the period for which You were insured.

3. Your Policy will be cancelled automatically and without any written notice from Us if You have not paid Your premium within thirty-one (31) days of when it is due. The cancellation takes effect from the date the premium You have paid Us ceases to cover the insurance under this Policy.

Premium

We take a number of factors into account when calculating Your premium which could include Your risk profile, the level of coverage limits You have chosen and other information You provide to Us when applying for this insurance.

Factors that increase the risk to Us generally increase the premium (e.g. where You apply to be covered under the plan with the highest level of cover) and those that lower the risk reduce premium payable (e.g. where You apply to be covered under the plan with the lowest level of cover).

Your premium is paid in advance and includes any amounts payable that take into account Our obligation (actual or estimated) to pay any relevant compulsory government charges, taxes, levies (including stamp duty and GST) in relation to the Policy.

We will tell You, when You apply, what premium is payable, when it needs to be paid and how it can be paid.

Cover is effective from the Commencement Date as shown on Your Certificate of Insurance.

If You will be paying Your Premium by instalment payments and an instalment remains unpaid for at least fourteen (14) days, We may refuse to pay a claim arising after the instalment was due.

We may change Your premium from the Renewal Date if We notify You of the change in writing prior to that date.

Excesses and Policy Limits

For each particular benefit, item, loss or claim insured by the Policy an Excess may apply. An Excess is the amount You are required to pay. - It is the amount You must contribute towards each claim and for which We are not liable. Please refer to the Summary of Benefits Table on page 11 of this document or the Certificate of Insurance issued to You for details of any Excesses that may apply.

Further, in some cases the maximum amount We are liable to pay for a particular benefit, item, loss or claim within a Policy benefit may be limited and You should refer to the Summary of Benefits Table, the Policy and Your Certificate of Insurance to understand the limits that are applicable.

Complaints and Dispute Resolution

We take the concerns of our customers very seriously and have detailed complaint handling and internal dispute resolution procedures that you can access. Please note that if we have resolved your initial complaint to your satisfaction by the end of the 5th business day after we have received it, and you have not requested that we provide you a response in writing, the following complaint handling and internal dispute resolution process does not apply. This exemption to the complaints process does not apply to complaints regarding a declined claim, the value of a claim, or about financial hardship.

The members of our complaint handling team are trained to handle complaints fairly and efficiently.

Please provide us with your claim or policy number (if applicable) and as much information as you can about the reason for your complaint.

We will investigate your complaint and keep you informed of the progress of our investigation. We will respond to your complaint in writing within fifteen (15) business days provided we have all necessary information and have completed any investigation required. In cases where further information or investigation is required, we will work with you to agree reasonable alternative time frames and, if We

cannot agree, you may request that your complaint is taken to Stage 2 and referred to Our internal dispute resolution team. We will otherwise keep you informed about the progress of our response at least every ten (10) business days, unless you agree otherwise.

Please note if your complaint relates to Wholesale Insurance (as defined in the General Insurance Code of Practice), we may elect to refer it straight to Stage 2 for review by our Internal Dispute Resolution team.

Stage 2 – Internal Dispute Resolution Procedure

If you advise us that you wish to take your complaint to Stage 2, your complaint will be reviewed by members of our internal dispute resolution team, who are independent to our complaint handling team and are committed to reviewing disputes objectively, fairly and efficiently.

Please provide us with your claim or policy number (if applicable) and as much information as you can about the reason for your dispute.

We will keep you informed of the progress of our review of your dispute at least every ten (10) business days and will respond to your dispute in writing within fifteen (15) business days, provided we have all necessary information and have completed any investigation required. In cases where further information or investigation is required, we will work with you to agree reasonable alternative time frames. If we cannot agree, you may refer your dispute to the Australian Financial Complaints Authority (AFCA) as detailed under Stage 3 below, subject to its Rules. If your complaint or dispute falls outside the AFCA Rules, you can seek independent legal advice or access any other external dispute resolution options that may be available to you.

Stage 3 – External Dispute Resolution

If you are dissatisfied with our internal dispute determination, or we are unable to resolve your complaint or dispute to your satisfaction within forty-five (45) days, you may refer your complaint or dispute to AFCA, subject to its Rules.

AFCA is an independent external dispute resolution scheme approved by the Australian Securities and Investments Commission. We are a member of this scheme and we agree to be bound by its determinations about a dispute. AFCA provides fair and independent financial services complaint resolution that is free to consumers.

In this Statement We, Our and Us means Chubb Insurance Australia Limited (Chubb).

You and Your refers to Our customers and prospective customers as well as those who use Our Website.

This Statement is a summary of Our Privacy Policy and provides an overview of how We collect, disclose and handle Your Personal Information. Our Privacy Policy may change from time to time and where this occurs, the updated Privacy Policy will be posted to Our website.

Why We collect Your Personal Information

The primary purpose for Our collection and use of Your Personal Information is to enable Us to provide insurance services to You. Sometimes, We may use Your Personal Information for Our marketing campaigns, in relation to new products, services or information that may be of interest to You. How We obtain Your Personal Information

We collect Your Personal Information (which may include sensitive information) at various points including but not limited to when You are applying for, changing or renewing an insurance policy with Us or when We are processing a claim. Personal Information is usually obtained directly from You but sometimes via a third party such an insurance intermediary or Your employer (e.g., in the case of a group insurance policy). Please refer to Our Privacy Policy for further details.

When information is provided to Us via a third party We use that information on the basis that You have consented or would reasonably expect Us to collect Your Personal Information in this way. We take reasonable steps to ensure that You have been made aware of how We handle Your Personal Information.

When do We disclose Your Personal Information?

We may disclose the information We collect to third parties, including service providers engaged by Us to carry out certain business activities on Our behalf (such as claims assessors and call centres in Australia). In some circumstances, in order to provide Our services to You, We may need to transfer Your Personal Information to other entities within the Chubb group of companies such as the regional head offices of Chubb located in Singapore, UK or USA (Chubb Group of Companies), or third parties with whom We (or the Chubb Group of Companies) have sub-contracted to provide a specific service for Us, which may be located outside of Australia (such as in the Philippines or USA). Updating Our PDS

We may update the information contained in Our PDS when necessary. A paper copy of any updated information is available to You at no cost by calling or emailing Us or You can access a copy via Our website at www.rent.com.au.

We will issue You with a new PDS or a supplementary PDS where the update is to rectify a misleading or deceptive statement or when an omission is materially adverse from the point of view of a reasonable person deciding whether to buy this product.

What You are Covered For

In this section We outline full details of each benefit. The cover provided is subject to the terms, conditions and exclusions contained in this Policy. We will pay or reimburse You in respect of such benefits up to the maximum Sum Insured specified in the Summary of Benefits table for the plan You have selected as shown on Your Certificate of Insurance. Please note that other documents that make up the Policy such as the Certificate of Insurance and any Supplementary Product Disclosure Statement (SPDS) may amend the standard terms, conditions and exclusions contained in this Policy document.

Benefit 1 - Your Personal Possessions

We will pay You up to the maximum amount specified in the Summary of Benefits table for the plan You have selected as shown on Your Certificate of Insurance for loss, damage or destruction to Your Personal Possessions during the Period of Insurance while at the Location.

The following limitations apply:

1. Each item of Personal Possessions is limited to the maximum sum insured per item specified in the Summary of Benefits table for the plan You have selected as shown on Your Certificate of Insurance.

2. We will at Our option:

a) repair the Personal Possession to a condition equal to but not better or more extensive than its condition when new; or

b) reimburse You subject to the maximum Sum Insured (and any sub-limits that apply) for the plan You have selected as shown on Your Certificate of Insurance.

3. We will not pay more than:

a) 25% of the total Sum Insured for any one Event resulting in loss, damage or destruction to Valuables. For an item which is part of a set, replacement or repair is limited to that item lost, stolen or damaged. We will not pay for any special value the item may have as part of a set, or the entire set.

b) $250 for any one Event in any one Period of Insurance for money, money orders, bonds or other such negotiable instruments including but not limited to bills of exchange, banknotes, demand draft and cheques.

c) $500 for any one Event for loss, damage or destruction to accessories and spare parts for motor vehicles, motorcycles, motor scooters, mini-bikes, caravans, trailers, watercraft and aircraft, but not whilst attached to or contained in motor vehicles, motorcycles, motor scooters, mini-bikes, caravans, trailers, watercraft or aircraft.

Benefit 2 – Your Guest’s Personal Possessions

We will pay up to the maximum amount specified in the Summary of Benefits table for the plan You have selected as shown in Your Certificate of Insurance for loss, damage or destruction to Your Guest’s Personal Possessions during the Period of Insurance while at the Location.

The following limitations apply:

1. Each item of Your Guest’s Personal Possessions is limited to $500 per item.

2. We will at Our option:

a) repair the property to a condition equal to but not better or more extensive than its condition when new; or

b) reimburse You subject to the maximum Sum Insured (and any sub-limits that apply) for the plan You have selected as shown on Your Certificate of Insurance.

a) 25% of the total Sum Insured for Your Guest’s Personal Possessions for any one Event resulting in loss, damage or destruction to Valuables. For an item which is part of a set, replacement or repair is limited to that item lost, stolen or damaged. We will not pay for any special value the item may have as part of a set, or the entire set.

b) $500 for any one Event for loss, damage or destruction to accessories and spare parts for motor vehicles, motorcycles, motor scooters, mini-bikes, caravans, trailers, watercraft and aircraft, but not whilst attached to or contained in motor vehicles, motorcycles, motor scooters, mini-bikes, caravans, trailers, watercraft or aircraft.

Benefit 3 - Temporary Accommodation

We will reimburse You for reasonable temporary accommodation expenses You incur, up to the maximum amount specified per day and in total in the Summary of Benefits table for the plan You have selected as shown on Your Certificate of Insurance, should the Location become uninhabitable during the Period of Insurance. We will pay these expenses for a period of no more than thirty (30) days, or until the Location becomes habitable again, whichever occurs first.

There is a seventy-two hour (72) Waiting Period applicable.

Benefit 4 - Moving Transit

We will pay You up to the maximum amount specified in the Summary of Benefits table for the plan You have selected as shown on Your Certificate of Insurance for Your Personal Possessions while they are being transported by a vehicle to a new Location if You are moving permanently to a new Location within Australia. We will cover Your Personal Possessions against fire, lightning, explosion, impact damage caused by a motor vehicle accident, or theft following forcible and violent means.

We will not cover:

i. Loss or damage to glassware, crystal, crockery, mirrors or china, or

ii. Loss or damage to any jewellery, money or negotiable instruments or gold or silver items which are left in any unattended vehicle, or

iii. Loss or damage resulting from denting, scratching, chipping or bruising.

Benefit 5 –Your Personal Possessions Temporarily Removed from the Location

This benefit is an optional benefit. We will only pay this benefit if You have selected this option when taking out this insurance and have paid the additional premium applicable. This benefit will be shown on Your Certificate of Insurance if You have chosen and paid for it and We will only make a payment under this benefit if it is shown on Your Certificate of Insurance.

We will pay You up to the maximum amount specified in the Summary of Benefits table for the plan You have selected as shown on Your Certificate of Insurance for loss, damage or destruction to Your Personal Possessions during the Period of Insurance while Temporarily Removed from the Location.

The following limitations apply:

1. We will at Our option:

a) $250 for any one Event in any one Period of Insurance for money, money orders, bonds or other such negotiable instruments including but not limited to bills of exchange, banknotes, demand draft and cheques.

b) $500 for any one Event for loss, damage or destruction to accessories and spare parts for motor vehicles, motorcycles, motor scooters, mini-bikes, caravans, trailers, watercraft and aircraft, but not whilst attached to or contained in motor vehicles, motorcycles, motor scooters, mini-bikes, caravans, trailers, watercraft or aircraft.

3. We do not cover;

a) items permanently removed from the Location;

b) items in an unattended trailer, boat, caravan, mobile home, motor vehicle, train, aircraft or tent; or

c) computers, mobile phones, tablets, keys, equipment and tools which You or Your family use in a business, trade or profession.

Benefit 6 -Legal Liability

We will indemnify You up to the maximum Sum Insured specified in the Summary of Benefits table for the plan You have selected as shown on Your Certificate of Insurance should You become legally liable to pay compensation for:

1. death or bodily injury or illness to any person; and

2. loss of or damage to property

resulting from an Event during the Period of Insurance anywhere in the world.

We will also pay the reasonable costs, charges and expenses incurred with Our consent in the investigation, settlement or defence of a demand, claim or legal proceeding subject to the total maximum Sum Insured for Legal Liability specified in the Summary of Benefits table (less the Excess) for the plan You have selected as shown on Your Certificate of Insurance.

The following limitations apply:

1. the cover We provide is limited to Your Legal Liability as occupiers of the Location and for any personal legal liability occurring anywhere in the world where You are away from the Location for a period no greater than 14 consecutive days; and

2. the most that We will pay is $1,000,000 for any one (1) claim or series of claims arising from any one Event inclusive of all reasonable legal costs, charges and expenses.

Definitions

Please use this Definitions section to find the meaning of these words throughout this PDS.

1. Action of the Sea means waves, tidal waters or spray from any of these even if it is driven by wind.

2. Act of Terrorism means any actual or threatened use of force or violence directed at or causing damage, injury, harm or disruption, or commission of an act dangerous to human life or property, against any individual, property or government, with the stated or non-stated objective of pursuing economic, ethnic, nationalistic, political, racial or religious interests, whether such interests are declared or not, committed by a Terrorist or Freedom Fighter.

Act of Terrorism shall also include any act, which is verified or recognised by the (relevant) government as an act of terrorism. Robberies or other criminal acts, primarily committed for personal gain and acts arising primarily from prior personal relationships between perpetrator(s) and victim(s) shall not be considered an Act of Terrorism.

3. Art means private collections of paintings, etchings, pictures, tapestries, rugs, art glass windows, other bona fide works of art, including but not limited to statues, antiques, rare books and manuscripts, porcelain, rare glass, crystal, and other items of historical value or artist merit.

4. Certificate of Insurance means the document We send You which contains details of the cover provided to You by Us.

5. Civil War means any of the following, whether declared or not: armed opposition, insurrection, revolution, armed rebellion, sedition, between two or more parties belonging to the same country where the opposing parties are of different ethnic religious or idealistic groups, any military or usurped power.

6. Commencement Date means the date We agree to provide insurance under the Policy as shown on Your Certificate of Insurance.

7. Event(s) means an occurrence that could give rise to a claim for a benefit under Your Policy. Any one occurrence or series of occurrences attributable to one source or originating cause is deemed to be one Event.

8. Excess means the amount payable by You in respect of each Event where You make a successful claim. The Excess is the first amount of a claim which You must bear. We do not pay for this amount.

9. Flood means the covering of normally dry land by water that has escaped or been released from the normal confines of any lake, river, creek or other natural watercourse (whether or not these have been altered or modified), reservoir, canal or dam.

10. Guest(s) means any person staying at the Location for no more than 30 days, provided always that You are not receiving any form of monetary reward related to their stay.

11. Guest(s)’ Personal Possessions means goods owned by Your Guests which are in a building at the Location. Guest’s Personal Possessions does not include:

- money, money orders, bonds or other such negotiable instruments including but not limited to bills of exchange, banknotes, demand draft and cheques;

- sporting equipment whilst in use, motor vehicles, motorcycles, motor scooters, mini- bikes, trailers, caravans, aircraft or watercraft;

- business property of any kind including books, stationery, cash takings, equipment, stock or plant;

- fish, birds, animals of any kind;

- trees, shrubs and plants;

- grass or lawns;

- unset precious or semi-precious stones; and

- contents in a commercial storage facility.

12. Location means the location where You permanently reside in Australia and only as shown in the Certificate of Insurance.

13. Period of Insurance means one (1) calendar year from the Commencement Date or the latest Renewal Date, whichever is later.

14. Personal Possessions means goods owned by You or for which You are legally responsible including fixtures and fittings installed for Your use in premises that You occupy which You normally keep in a building at the Location. Your Personal Possessions does not include sporting equipment whilst in use, motor vehicles, motorcycles, motor scooters, mini- bikes, trailers, caravans, aircraft or watercraft; business property of any kind including books, stationery, cash

takings, equipment, stock or plant; fish, birds, animals of any kind; trees, shrubs and plants; grass or lawns; unset precious or semi-precious stones; contents in a commercial storage facility.

15. Policy means Your Policy Wording and Product Disclosure Statement (PDS), Certificate of Insurance and any other document that We tell You forms part of Your Policy describing the insurance contract between You and Us.

16. Product Disclosure Statement (PDS) means this document.

17. Renewal Date means one (1) year from the Commencement Date and subsequent anniversaries of that date.

18. Sum Insured means the amount of cover as shown in Your Certificate of Insurance.

19. Temporarily Removed means for a period of no more than fourteen (14) days and still in Australia.

20. Valuables means jewellery and watches; Art; items made of or trimmed in fur; items made of precious metals; stamp, medal and coin collections; musical instruments; cameras and wine.

21. Waiting Period means the period of time for and in respect of which no benefits are payable.

22. War means war, whether declared or not, or any warlike activities, including use of military force by any sovereign nation to achieve economic, geographic, nationalistic, political, racial, religious or other ends.

23. We/Us/Our means the insurer Chubb Insurance Australia Limited, (ABN 23 001 642 020, AFSL 239687) (Chubb) who is the insurer/issuer of the policy.

24. You/Your means:

(a) the person who is named as the insured in the Certificate of Insurance; and

(b) the spouse (legal or de facto) of 24.(a) above who lives at the Location.

Exclusions

There are certain times when this insurance may not provide cover.

1. Exclusions Applicable to Benefit 1 - Your Personal Possessions; Benefit 2 - Your Guest’s Personal Possessions; Benefit 3- Temporary Accommodation; Benefit 4- Moving Transit and Benefit 5 – Your Personal Possessions Temporarily Removed from the Location

We will not pay for any claims arising directly or indirectly from:

a) theft without evidence of forcible and violent entry to the Location;

b) any item of sport or exercise equipment used for competitive amateur or professional sporting events where Your livelihood is substantially dependent on income received as a result of Your playing that sport;

c) Flood;

d) Action of the Sea, high water or high tide, storm surge, tidal wave or tsunami;

e) malicious or deliberate or intentional damage involving Your participation, Your Guest’s participation or the participation of anyone else permanently residing at the Location;

f) any Act of Terrorism or any action taken in controlling, preventing, suppressing or in any way relating to any Act of Terrorism. This exclusion operates to the extent permitted by the Terrorism Insurance Act 2003 (Cth);

g) asbestos or asbestos products or any materials containing asbestos in whatever form or quantity;

h) any computer equipment which fails to perform or function in the manner for which it was designed;

i) total or partial destruction, distortion, erasure, corruption, alteration, misinterpretation or misappropriation of electronic data or any error in creating amending entering deleting or using electronic data;

j) faults and defects in Personal Possessions known by You or Your Guest or which ought reasonably to have been known by You or Your Guest and not disclosed to Us at the time this Policy was entered into;

k) action taken by the government authorities including confiscation, seizure, destruction and restriction;

l) any prohibition, regulation or intervention by government authorities;

m) mildew, mould, algae or other atmospheric or climatic conditions;

n) contamination or pollution of land, air or water arising directly or indirectly from the actual, alleged or threatened discharge, dispersal, release, seepage, migration, emission or escape of pollutants or the cost of testing, monitoring, containing, removing, nullifying or cleaning up pollutants, or any fines, penalties, punitive or exemplary damages arising directly or indirectly out of the discharge, dispersal, release or escape of pollutants;

o) the discharge, disposal, release, seepage, migration or escape of pollutants or the cost of preventing the escape of pollutants;

p) any nuclear reaction or contamination, ionising rays or radioactivity;

q) War or any act of War, invasion, foreign enemy, Civil War, rebellion, revolution, insurrection, military or usurped power;

r) mechanical, electrical or electronic breakdown including when caused by the actual burning out or power surge of an electric motor;

s) soil or earth movement including erosion, subsidence, landslide or mudslide unless the loss or damage directly arises out of an earthquake;

t) wear, tear, rust, corrosion, wet or dry rot, depreciation or gradual deterioration;

u) inherent defects, structural defects, faulty workmanship or faulty design;

v) any process of cleaning, restoring, repairing, retouching or maintenance;

w) any failure on Your part or the part of Your Guest to use all reasonable means to protect and maintain the Location and/or Personal Possessions at any time;

x) renovations, repairs, alterations or additions;

y) scratching, denting, chipping, rubbing or scuffing any surface;

z) consequential loss of any kind including loss of enjoyment or any financial loss not specifically covered in the Policy;

aa) infectious or contagious disease outbreak;

bb) bushfire or grassfire for the first 72 hours from the Commencement Date or any amended cover. However, We will cover You for bushfire and grassfire within that period if immediately prior to commencing this Policy, another Policy covering the same risk expired, without a break in cover;

cc) any pre-existing loss or damage;

dd) any process necessarily involving the application of heat;

ee) birds, wildlife, insects, vermin, termites or moths;

ff) water seeping or percolating through a wall, floor or roof.

gg) You leaving the Location unoccupied for sixty (60) consecutive days or more and not maintaining it in a lived-in state by:

i) keeping any lawns and gardens mowed and tidy;

ii) stopping regular mail and deliveries; and

iii) arranging for someone to check inside and outside the Location at least once per week.

2. Exclusions Applicable to Benefit 6 – Legal Liability

We will not pay should liability arise directly or indirectly from:

a) illegal or intentional acts (or omissions) by You or Your executors, administrators, legal heirs or personal representatives;

b) Your business, profession or occupation;

c) the ownership or occupation of buildings or land other than the Location specified in the Certificate of Insurance;

d) vibration or interference with support of land, buildings or other property;

e) any bodily injury or damage to property which is attributable to or contributed to by the consumption of illegal drugs of any kind by You or provided or permitted by You;

f) liability arising out of the transmission of a venereal or communicable disease;

g) the use of any motorised vehicle (except a domestic gardening appliance, wheelchair or golf buggy), caravan, trailer, motorcycle, motor scooters;

h) watercraft, aircraft or any landing area for aircraft. Watercraft means a watercraft with sleeping quarters, that is not a commercial ocean liner or other similar commercial watercraft. Aircraft includes but is not limited to drones and remote piloted aircraft (RPAs) as defined by Civil Aviation Safety Regulations (CASR) 1998 and associated legislation, as amended from time to time;

i) defamation (libel or slander);

j) any nuclear reaction or contamination, ionising rays or radioactivity;

k) the manufacture, storage, filling, breakdown, transport or use of fireworks, ammunition, fuses, cartridges, gunpowder, nitro-glycerine, celluloid, pyroxylin or other explosives;

l) any Act of Terrorism or any action taken in controlling, preventing, suppressing or in any way relating to any act of terrorism.

This exclusion operates to the extent permitted by the Terrorism Insurance Act 2003 (Cth);

m) War or any act of War, invasion, foreign enemy, Civil War, rebellion, revolution, insurrection, military or usurped power;

n) bodily injury or death to You, or any other person(s) living with You, Your employee or any other person deemed by law to be employed by You arising out of or in the course of their employment;

o) liability assumed under any contract, warranty or agreement unless the liability would have existed irrespective of the agreement;

p) fines, penalties, punitive, aggravated or exemplary damages;

q) the ownership or keeping of farm animals.

General Conditions

Commencement and Period of Your Policy

Your Policy begins on the Commencement Date or on the latest Renewal Date, whichever is the later, and continues for one (1) calendar year (being the Period of Insurance) after which time it expires, or until it is cancelled.

Cancellation of Your Policy

We may cancel Your Policy by giving You written notice to the address on file and in accordance with the Insurance Contracts Act 1984 (Cth), including where You have:

1. breached the Duty of Disclosure;

2. breached a provision of Your Policy; or

3. made a fraudulent claim under any policy of insurance.

If We cancel, We will refund the premium for Your Policy less an amount to cover the period for which You were insured.

You may cancel Your Policy by giving Us written notice of the future date the cancellation is to take effect.

Should We or You cancel Your Policy, We shall retain a pro rata proportion of the premium for the time the Policy has been in force.

Renewal of Your Policy

This insurance may be renewed for further consecutive yearly periods upon payment of the premium. Payment of Your premium is deemed to be acceptance of an offer of renewal for a further yearly period.

If You continue to pay Your premium, then unless Your Policy is cancelled or We advise You prior to the Renewal Date that We will not be renewing, a Policy on the same terms and conditions automatically comes in to existence for one (1) year from the Renewal Date.

Expiry of Your Policy

Your Policy expires at the end of the Period of Insurance. We may decide not to renew Your Policy. If We decide not to renew Your Policy, We will send You an expiry notice at least fourteen (14) days before the expiry of Your Policy.

If Your Policy is cancelled or otherwise terminated, the Period of Insurance will be from the Commencement Date or Renewal Date, whichever is the later, up to and including the date of cancellation or termination.

Significant Tax Implications

Generally, Your premiums are not tax deductible and claims payments are not assessable income for tax purposes unless You purchase Your Policy for business purposes. This tax information is a general statement only. See Your tax adviser for information about Your personal circumstances.

Where You are a registered entity You may be entitled to an input tax credit for Your premium and/or for things covered by this Policy. You must disclose these entitlements to Us if You make a claim under Your Policy. If We agree to pay a claim under Your Policy, We will base any claim payment on the Goods and Services Tax (GST) inclusive costs (up to the relevant policy limit).

However, We will reduce any claim payment by an input tax credit You are, or would be, entitled to for the repair or replacement of insured property or for other things covered by this Policy.

Australian Law and Currency

Your Policy is governed by the laws of the State or Territory of Australia in which You normally reside. Any dispute or action in connection with Your Policy shall be conducted and determined in the courts of the State or Territory of Australia in which You normally reside.

All payments by You to Us and Us to You or someone else under Your Policy must be in Australian currency.

If expenses are incurred in a foreign currency, then the rate of currency exchange used to calculate the amount payable in Australian Dollars (AUD) will be the rate at the time You incur the expense or suffer the loss.

Your Duty of Care

You must exercise all reasonable precautions:

• for the safety and protection of Your Personal Possessions and Your Guest’s Personal Possessions; • to prevent personal injury or damage to property; • to maintain Your Personal Possessions in good condition; and • to obey any laws or regulations that safeguard people or their property.

Alteration of risk

You must notify Us as soon as possible in writing of any change which may affect the state, condition or use of the Location which increases the risk of loss, damage or liability. Unless and until We agree in writing to cover the alteration of risk and You pay any additional premium required We shall not be liable for the loss, damage or liability caused by or contributed to by such alteration.

Transfer of Interest

No interest in this Policy may be transferred without Our written consent.

Other Insurance

If at the time of a claim there exists to Your knowledge any other insurance covering loss, damage or liability insured by Your Policy, You must notify Us immediately and provide Us with details of such other insurance.

Subrogation

We have the right on Your behalf (and in Your name) to conduct any negotiation, settlement or legal proceeding, whether prosecuting or defending. Your full co-operation is required in these matters. Where You have entered into an undertaking with any other party which prevents or limits Your/Our right to recover from that party all benefit under this Policy is forfeited unless You have Our prior written consent.

Sanctions

We shall not be deemed to provide cover and We shall not be liable to pay any claim or provide any benefit hereunder to the extent that the provision of such cover, payment of such claim or provision of such benefit would expose Us, or Our parent to any sanction, prohibition or restriction implemented pursuant to resolutions of the United Nations or the trade and economic sanctions, laws or regulations of Australia, the European Union, United Kingdom, or United States of America.

Claims

As soon as possible after an Event occurs which may result in a claim under this Policy You must at Your own expense:

a) take all reasonable precautions to prevent or minimise further loss, damage or liability;

b) notify the police immediately if any of Your Personal Possessions or Your Guest’s Personal Possession are lost, stolen, maliciously or intentionally damaged, or such loss is attempted or suspected;

c) take all reasonable steps to recover lost or stolen Personal Possessions of You or Your Guest, and assist in apprehending any guilty party;

d) give Us the opportunity to inspect any loss or damage before You carry out any repairs;

e) keep any damaged or recovered stolen Personal Possessions of You or Your Guest and allow Us to inspect it if necessary; and

f) obtain Our consent before You authorise or commence repairs or otherwise incur any cost, unless the repair or cost is necessary to protect the Personal Possessions belonging to You or Your Guest from further loss.

Procedure for Making a Claim

You should advise Us as soon as possible of an occurrence or Event which could lead to a claim. If You (or Your legal representative) wishes to make a claim You or they must:

1. visit www.rent.com.au to download and complete the claim form, once completed along with all supporting documents, email everything to Us at [email protected]. Alternatively You can contact Us on 1800 958 123.

2. The claim form will require You to provide:

a) receipts for any expenses that are being claimed;

b) any reports that have been obtained from the police, a carrier or other authorities about an accident, loss or damage; and

c) any other documentary evidence required by Us under Your Policy;

d) additional evidence that We may request to enable Us to assess Your claim; and

3. not make any offer, promise of payment or admit any liability without Our written consent.

You (or Your legal representative) should not make any offer, promise of payment or admit any liability without written consent from Us. You should request the claim against You to be put in writing.

In the event of any payment under this Policy, We will be subrogated to all Your rights of recovery against any person or organisation and You shall execute and deliver any appropriate instruments and papers and do whatever else is necessary to secure such rights. Any amount so recovered shall be applied in accordance with the provisions of s.67 of the Insurance Contracts Act 1984 (Cth).

Processing and Payment of Claims

We will take all reasonable steps to pay a valid claim promptly.

Making Claims After Your Policy is Cancelled

If Your Policy is cancelled this does not affect Your rights to make a claim under Your Policy if the Event occurred before the date of cancellation.
