COUNCIL OF MINISTERS REGULATION TO

PROVIDE FOR THE ESTABLISHMENT OF THE

ETHIOPIAN AGRICULTURAL COMMODITIES

WAREHOUSING SERVICE ENTERPRISE

This Regulation is issued by the Council of

Ministers pursuant to Article 5 of the Definition of

Powers and Duties of the Executive Organs of the

Federal Democratic Republic of Ethiopia Proclamation

No. 691/2010 and Article 47(1)(a) of the Public

Enterprises Proclamation No.25/1992.

1. Short Title

This Regulation may be cited as the "Ethiopian

Agricultural Commodities Warehousing Service

Enterprise Establishment Council of Ministers

Regulation No.331/2014."

2. Establishment

1/ The Ethiopian Agricultural Commodities

Warehousing Service Enterprise (hereinafter

the "Enterprise") is hereby established as a

public enterprise.

2/ The Enterprise shall be governed by the Public

Enterprises Proclamation No.25/1992.

3/ Supervising Authority

A body to be designated by the government shall

be the supervising authority of the Enterprise.

4. Responsibility of the Ethiopia Commodity

Exchange Authority

The Ethiopia Commodity Exchange Authority

shall regulate the activities of the Enterprise to

ensure the integrity of all transactions in

accordance with the powers provided under its

establishment Proclamation No. 551/2007.

5. Head Office

The Enterprise shall have its head office in Addis

Ababa and may have branch offices elsewhere as

may be necessary.

6. Purposes

The purpose of the Enterprise is to render

warehousing services for agricultural commodities

traded in Ethiopia Commodity Exchange and shall

have in particular the following purposes:

1/ to construct modern and technology based

commodity warehouses in strategic locations

of the country and manage same;

2/ to receive, grade, weigh, and deposit incoming

commodities and deliver out-turn

commodities; issue warehouse receipt and

deliver commodity; put in place modern

inventory management system and implement

same;

3/ to carryout quality certification of

commodities as per the grades and standards

of the Ethiopia Commodity Exchange;

4/ to set up modern, efficient, centralized and

automated warehouse receipt system and

implement same;

5/ to put in place standardized grade- specific

commodity depositing system with proper

quality control regime;

6/ to put in place and utilize secured electronic

communication system along with various

working-stations that permits recording,

monitoring, transmitting and reporting of data;

7/ to keep and maintain in a safe place complete

records at all times, including daily position

records showing the quantity, kind and grade

of commodities received, delivered and the

amount remaining in storage at the closes of

each business day;

8/ to charge fees for its services;

9/ to provide complaint handling mechanism for

resolution of grievances related to quality

grading and put in place risk management

system;

10/ to engage in any other related activities

necessary for the attainment of its purposes.

7. Capital

The authorized capital of the Enterprise shall be

Bin 1,000,000,000.00 (One Billion Bin) of which

Bin 250,000,000.00 (Two Hundred Fifty Million

Birr) is paid up in cash and in kind.

8. Liability

The Enterprise may not be liable beyond its total

assets.

9. Duration

The Enterprise is established for an indefinite

duration.

10. Transfer of Rights and Obligations

The rights and obligations of the Ethiopia

Commodity Exchange established under

Proclamation No. 550/2007 relating to warehouse

operations are hereby transferred to the Enterprise.

11. Transitory Provisions

As per this Regulation, the Ethiopian Commodity

Exchange shall give necessary assistance to the

Enterprise relating to warehousing services until

the Enterprise operates to its full capacity.

12. Effective Date

This Regulation shall enter into force on the date

of publication in the Federal Negarit Gazette.
