Meeting Minutes

I. Call to Order / Roll Call The meeting was called to order at 5:32 p.m. Present: Mark Drumheller, Glen Irwin, Sam Staples, Cathy Tilmann Absent: Patty Stangle-Krcmarik City Staff Present: Bill Brickner, Airport Manager

II. Approval of Agenda Motion by Drumheller, support by Staples to approve the agenda with the addition of a quote from Sparling Corporation Motion passed unanimously

III. Public Comment on Agenda Items None

IV. Approval of Meeting Minutes Motion by Drumheller, support by Staples, to approve the minutes of the March 2019 meeting Motion passed unanimously

VI. Airport Manager’s Report Airport Manager Bill Brickner gave the manager’s report. Brickner stated that the turf runway is rolled and open. Brickner also stated that there have been 44 call outs to date.

VII. Old Business None

VIII. New Business Brickner explained the quote received from Sparling Corporation and the need to have the card reader changed in a timely manner.

Motion by Drumheller, support by Staples, to recommend the City Commission accept the quote from Sparling Corporation as written.

Motion passed unanimously IX. Announcements on Airport Related Issues and Concerns There are currently two open 20 hours-per-week positions.

This is to follow up on my e-mail to you of March 19, 2019 regarding the decision to allow parking on the south side of East Preston Street between Elizabeth and Crapo. All of my arguments against the change still apply:

No public hearing Hazard to pedestrians Hazard to bicyclists Blocked driveways and extra policing Personal financial loss Lower tax revenue Available parking in the Mt. Pleasant High School parking lots Available parking on the north side of E. Preston Street, east of Crapo and There was no problem before the change was made

All of these arguments still apply. Two have been experienced, and one more has emerged, as follows:

1. Last week I contacted the Mt. Pleasant Police Department to report a truck partially blocking mydriveway during events in the tennis courts and baseball diamond. The Police responded.2. I have experienced that exiting my driveway while cars are parked within inches on either side ishazardous because vision is blocked in both directions.

The two situations, above, are not acceptable.

In addition, another unacceptable unintended consequence emerged and is described below.

3. Today the USPS delivery person hand delivered my US Mail with an apology that it was notdelivered yesterday. Yesterday was Monday, May 13, a day when mail would ordinarily have beendelivered. The USPS delivery person told me today, however, that the mail was not deliveredyesterday because my mailbox was blocked by parked vehicle(s). They do not deliver mail when themailbox is blocked. The City does not have the right to interfere with agencies of the federal

government and, in particular, does not have the right to create circumstances that prevent the timely delivery of U.S. Mail to my mailbox. Pleasant requests that the City Commission issue Traffic Control Order No. 1-2019 (Place ‘3 Hour Parking’ sign in the bump-out area on the west side of Franklin St. between Mosher and Chippewa). Said traffic control order was presented to the City Commission on May 13, 2019 for review and after reviewing said control order and being fully advised in the premises, BE IT RESOLVED, that the City Commission approves traffic control order No. 1-2019 as a permanent traffic control order.

5. Resolution establishing regulations for small cell wireless facilities: WHEREAS, 2018 PA 365 (Act 365), known as the Small Wireless

Communications Facilities Deployment Act, and the Federal Communications Commission Declaratory Ruling and Third Report Order (FCC Order) allows the City of Mt. Pleasant to establish requirements for wireless providers that protect the City to the extent allowed by the Act; and

WHEREAS, the Act requires reasonable, nondiscriminatory requirements of general applicability adopted by ordinance or otherwise that apply to the

location of groundmounted equipment and new poles and that do not prevent a wireless provider from serving any location; and

WHEREAS, the Act also provides that an authority may adopt written, objective requirements for reasonable, technically feasible, nondiscriminatory, and technologically neutral design or concealment measures in a historic district, downtown district, or residential zoning district;

NOW, THEREFORE, BE IT RESOLVED, that pursuant to the requirements of the Act, the City Commission hereby establishes the following regulations:

1. The applicant shall annually submit an insurance certificate meeting the City’s requirements for contractors working the right-of-way.

2. New right-of-way poles shall be place in line or nearly in line with property lines of the adjacent parcels. Placing them in the right-of-way in the middle of lots will not be permitted.

3. Small cell wireless facilities on new poles or collocated on existing poles shall not be within 300’ of an existing small cell wireless node.

4. Any facility requiring power that is situated more than 10’ from the existing above ground electric line will be fed from an underground drop.

5. Any facility requiring a connection to an existing wired telecom network more than 10’ from an existing above ground wire or fiber on that system shall gain its connection via an underground feed.

6. Screening and/or camouflage may be required depending on the proposed location of wireless facilities.

7. Facilities will not be permitted in the clear vision area of any intersection.

8. Facilities will not be permitted that conflict with any driveway, trees, light poles, or other infrastructure.

9. New poles may not be placed adjacent to properties in the CD-3L and CD-3 zoning district when a suitable alternate location is available adjacent to property in any other zoning district.

10. An applicant for a small cell wireless facility must operate in compliance with all provisions of 2018 PA 365, including payment of the maximum fees, rates and bond requirements allowed under the Act.

6. Authorize the Mayor to sign the Storm Sewer Extension and Reimbursement Agreement with the Central Michigan Mental Health Facilities Board as presented.

During the work session discussion, general direction was provided to keep the current sidewalk snow removal ordinance in effect, thereby not requiring residential properties to clear snow. Additional direction provided was to have City staff continue to clear only the identified school routes with the routes reviewed on a regular basis. School routes are reviewed with school administrators every two years.

The City Commission has held a number of work session discussions, requested various research and surveys, and obtained input on sidewalk snow removal. Although there is a desire to have clear sidewalks and it would be desirable for all property owners to be good neighbors that provide clear sidewalks, it was recognized that change cannot occur quickly. Throughout the process three primary options were discussed as potential methods to increase the likelihood of having clear sidewalks during the winter months. Those options include the following:

• Option 1-Hire a contractor to clear 44 miles of sidewalk in the CD-3, CD-3L districts.o A Request for Proposals (RFP) for such service was sent out for bid this summero No bids were receivedo Feedback received indicated concerns regarding:

Significant capital investment required Concern about ability to have sufficient on-call staff

• Option 2-Utilize City staff to clear sidewalkso The same challenges that an outside contractor would have apply to utilizing

City staff for this service.• Option 3-Ordinance requirement for all property owners to clear sidewalks

At the work session on August 13, 2018 discussion was held regarding the ordinance change of Option 3 and a draft ordinance was discussed. After that discussion the general agreement was to have staff and the City Attorney present an amended ordinance for City Commission consideration that included a one year educational period for residential properties.

Attached to this communication is the current ordinance which requires commercial and industrial properties to clear the sidewalks within 18 hours after the snow fall ends. Attached is a new ordinance which keeps those requirements in place and includes the additional following provisions:

• Provides clarity that the responsibility falls to the building and land owners

The discussion during the work session regarding the implementation of enforcement in 2019 was based on the following desires: Allows one year to properly educate residential property owners on the change Provides one year for property owners who are physically challenged to clear their

sidewalk to identify other potential options for the work to be completed

Discussion on enforcement indicated that a rotating schedule for enforcement would be implemented starting with different areas of the City each time, since there is not enough enforcement staff to cover the entire City at once. In addition, there was general agreement that City staff would no longer clear school routes if the ordinance was approved.

The attached amended ordinance addresses the items discussed during the August 13 work session. The City Commission has essentially three options with this draft ordinance as follows:

1. Accept the draft as presented and set a public hearing for October 8, 20182. Postpone action until further discussion can be held on the updated draft3. Take no action

Due to the amount of discussion this item has had, it is recommended the City Commission move forward with setting a public hearing so that formal public input can be received on the draft. After holding the public hearing, the City Commission can then determine what the preferred next steps are.

Recommended motion: Move to accept the draft ordinance amendment regarding sidewalk snow and ice removal and set a public hearing for October 8, 2018

§ 98.37 SNOW AND ICE REMOVAL FROM SIDEWALKS.

(A) (1) Every person, partnership or corporation in charge or in control of any commercial or industrialbuilding or commercial or industrial lot of land within the city fronting or abutting on a paved sidewalk,whether its owner, tenant, occupant, lessee, or otherwise, shall remove and clear away or cause to beremoved and cleared away, snow and ice from a patch of at least 48 inches in width from so much of saidsidewalk as is in front of or abuts on said building or lot of land.

(2) Except as provided in division (B) hereof, snow and ice shall be so removed from sidewalks in allbusiness districts within the city by 18 hours after the cessation of fall and accumulation of snow, sleet orfreezing rain, with the exception of Sundays and holidays. Holidays to be defined as Thanksgiving Day,Christmas Day, and New Year's Day. The exclusion of Sundays and holidays applies only if the subsidenceof snow storm occurs after 4:00 p.m. the previous day, in which case sidewalks must be cleaned by 12:00p.m. (noon) the day following a Sunday or a holiday.

(B) In the event snow and ice on a sidewalk have become so hard that it cannot be removed withoutlikelihood of damage to the sidewalk, the person or entity charged with its removal shall, within the timementioned in division (A) hereof, cause enough sand or other abrasive to be put on the sidewalk to maketravel thereon reasonably safe; and shall then, as soon thereafter as weather permits, cause a path in saidsidewalk of at least 48 inches in width to be thoroughly cleaned.

(C) If the sidewalks covered in this section are not cleared within the time limits set above, the propertyor business owner will be issued a civil infraction ticket. After the receipt of a civil infraction ticket, theproperty or business owner will have a 24-hour period to comply with the requirements of this section.

(D) If the property or business owner fails to clear the sidewalks after the 24-hour period following theissuance of a civil infraction ticket, the DPW crews are authorized to clear the walk. The cost to clear thewalk will be charged to the property owner at a fee to be set by resolution of the Commission.

The City of Mount Pleasant Ordains: Section 1. Amendment. Section 98.37 of the Mount Pleasant City Code is amended to read as follows:

§ 98.37 SNOW AND ICE REMOVAL FROM SIDEWALKS.(A) (1) All building and land owners (collectively referred to as “owners”) are responsible to

remove snow and ice from the sidewalk that fronts or abuts the building or land or as may extend to an adjoining road.

(2) Owners must remove snow and ice from the sidewalk within the timeframes listed in thissection, which are based on the cessation of snow and ice as determined by the Department of Public Safety Director or his or her designee in accordance with information from the National Weather Service.

(3) For commercial or industrial buildings or properties, as defined and classified by the generalproperty tax act, 1983 PA 206, except as provided in division (B) hereof, owners shall remove snow and ice from sidewalks within the city by 18 hours after the cessation of fall and accumulation of snow, sleet, or freezing rain. In the event of continuous snow, sleet, or freezing rain, sidewalks shall be cleared at least every 48 hours.

(i) If the snow and ice accumulation occurs after 4:00 p.m. on a Saturday or the day before aholiday (defined as Thanksgiving Day, Christmas Day, and New Year's Day), the owner shall remove the snow and ice from sidewalks by 12:00 p.m. on the day following the Sunday or holiday.

(4) For residential properties, as defined and classified by the general property tax act, 1983 PA206, except as provided in division (B) hereof, owners shall remove snow and ice from sidewalks within the city by 48 hours after the cessation of fall and accumulation of snow, sleet, or freezing rain. In the event of continuous snow, sleet, or freezing rain, sidewalks shall be cleared at least every 72 hours.

(B) In the event snow and ice on a sidewalk have become so hard that it cannot be removedwithout likelihood of damage to the sidewalk, the owner shall, within the time mentioned in division (A) hereof, cause enough sand or other abrasive to be put on the sidewalk to make travel thereon reasonably safe; and shall then, as soon thereafter as weather permits, thoroughly clear the snow and ice from the sidewalk.

(C) If the sidewalks covered in this section are not cleared within the time limits set above, a civilfraction shall be issued in accordance with section 98.99 of the code.

(D) In addition to or in the alternative to pursuing a civil infraction violation, the City Manager or theCity Manager’s designee is also authorized to formally notice, in writing, any violations of this section.

(1) Said notice will require the owner to remove snow and ice in accordance with this sectionwithin 24 hours after receipt. The notice shall be addressed to the last-known owner as shown on the city’s tax assessment records, and it shall be hand delivered to the owner or sent by first-class mail and posted upon the premises. If the notice is not hand delivered, it shall be deemed received two business days after mailing and posting on the premises.

(2) If the owner fails to comply with the notice, then the city may remove or may cause the snowand ice to be so removed at the owner’s expense. The city shall send the owner an invoice for such work at an amount set by resolution of the Commission. The invoice shall inform the recipient of the right to request a hearing before the Department of Public Works Director (provided the Department of Public

Works Director was not involved in issuing the notice) within 15 days of the issuance of the bill. At the hearing, the recipient shall have the opportunity to show cause as to why he or she should not be held financially responsible for the cost of the work.

(3) Any unpaid invoices issued under division (2) shall be added to the owner’s next regular tax bill from the city. Where the full amount due the city is not paid and the tax bill becomes delinquent, the City Manager shall cause to be recorded in the Treasurer’s office of the city a sworn statement, showing the cost and expense incurred for the work, and the date, place, or property on which the work was done, and the recordation of such sworn statement shall constitute a lien on the property, and shall remain in full force and effect for the amount due in principal and interest in the amount of 1% per month since the work was performed, plus the costs of court, if any, for collection until final payment has been made. The costs and expenses shall be collected in the manner fixed by law for the collection of taxes. Sworn statements recorded in accordance with the provisions hereof shall be prima facie evidence that all legal formalities have been complied with and that the work has been properly and satisfactorily done, and shall be full notice that the amount of the principal plus interest constitutes a charge against the property designated or described in the statement and is due and collectable as provided by law.

(E) Notwithstanding the above, the city shall not issue formal notices under division (D) or prosecute civil infractions under division (C) of this section against residential properties until November 1, 2019. The city may issue educational violation notices to persons in violation of that division prior to that date as a means of informing and educating such persons about its requirements.

Section 2. Publication and Effective Date. The City Clerk shall cause to be published a notice of adoption of this ordinance within 10 days of the date of its adoption. This ordinance shall take effect 30 days after its adoption.

Principal Shopping District / Central Business District to expand their operations; 2. To promote sidewalks, streets and alleyways as useful and properly planned visual amenities; 3. To provide adequate space for pedestrians and drivers on the streets, alleyways and sidewalks

adjacent to outdoor dining and to insure access to adjacent businesses. On February 11, 2019 the City Commission approved a pilot for an outdoor dining igloo (bio-dome) and we committed to review the pilot as to its success for the business, issues that could not be mitigated and any recommendations to add to the existing policy. Information from the February 11, 2019 meeting packet is attached. Various departments were asked to provide feedback on the igloo pilot and existing city policy on outdoor dining. The following questions were sent to Public Safety (police and fire), Public Works (engineering, streets), and Community Services (building, zoning, parks downtown).

• What, if any, issues arose from the outdoor dining igloo? • Are there any deal-breaker issues, meaning they cannot be overcome and no outdoor dining

could/should take place in the winter? • What, if any, changes need to be made to the policy (see attached)?

Feedback received:

• Public Safety o Add language to policy that all structures used for outdoor dining must have appropriate

flame spread rating of class I or class A, similar to a tent structure and no open flame can be used in the structures.

o Add language to policy that all outdoor dining should be inspected prior to public use.

• Public Works o No issues that weren’t taken care of. o Add language for use of cord covers on sidewalks.

• Community Services

o No issues or recommendations. Heard only positive things regarding installation.

The owner of Midori Sushi restaurant where the igloo was located has indicated the dining option was very popular and was booked for the season. Staff did not hear back from other business or property owners regarding the igloo.

Based on this feedback staff has updated the outdoor dining policy for year-round dining, keeping the existing warmer weather dining and added a winter season option for those businesses that may want the option. Staff recommends a fee of $125 per parking space for the winter season. The calculation uses the $250 summer season as a guide for this. Current cost per space is $250, covering 35 weeks of the year, making the rate $7.14 per space, per week. A redline draft version of the downtown outdoor dining policy is attached with the recommended changes staff provided. Multiple departments have reviewed and made recommendations related to the safe use of the igloos and the applicant has agreed to the considerations suggested. The time period and location of the pilot project would be 105 East Broadway from February 12, 2019 to March 15, 2019. The recommended payment for use of the space would be prorated for the amount of time it would be in use. All other costs including electricity would be the responsibility of the pilot project applicant. Recently the property and business owner at 105 East Broadway (Midori Sushi Restaurant) approached staff requesting an extension of the existing outdoor dining policy for the popular outdoor dining trend of igloos, formally known as bio domes, during the winter months and hoping to have the unique seating available for the upcoming Valentine’s holiday. Although most of the igloos around the state are on private property, two communities, Grand Rapids and Detroit, have them located on public property. Staff suggests piloting the idea of bio domes for the remainder of the 2019 winter rather than update the existing policy. A pilot program provides Commission and staff the ability to see what elements of the existing policy should be changed with this new outdoor seating using real-world experiences rather than change the existing policy using theoretical situations, which might necessitate more changes after the pilot is conducted. Various departments were asked to review the concept of a pilot program and provide feedback. Staff recommends the creation of a pilot of the igloos with the following considerations in addition to the existing outdoor dining policy:

• Fire/Police o The flame spread rating should be a class I or Class A rating (similar to a temporary tent

structure); o Elimination of electrical cords on sidewalks o Electrical wiring (lights & heaters) inside of them must have GFI protection;

o No use of propane or open flame.

• DPW o Keep electric cords from being trip hazard or being snagged by snow clearing; o Igloo should have barricades along Broadway if not illuminated; o Owner must clear snow around igloo in parking spaces and immediately around base; o Must be anchored or held down to prevent movement while occupied to prevent

injuries and to prevent it from being blown into street; o Suggest insurance waiver for accidents resulting from this type building, or at least

discussion with our insurance company about concerns; o Keep 5’ of barrier free public sidewalk access around the front (building side) of the

igloo. The following comments were also received regarding the pilot:

• Building o Permit is not needed as structure is under 120 square feet. We can do that as a courtesy

inspection on heating and lighting prior to their initial use.

• Zoning: o No issue as a temporary, accessory use to a restaurant.

Information about the bio dome requesting piloting:

• Diameter of 11′ 9″. Max height is 7′ 2″. Base area is 107 ft². • Made of non-corrosive, 100 % recyclable PVC and PA6 materials. The transparent cover is made

of cold-resistant (-4°F) transparent soft PVC. • Withstands strong wind conditions (Beaufort scale 6) approximately 31 mph. • Can bear up to max. 90 lbs of snow. • Structure is stable between temperatures ranging from -4°F to +140°F and withstands exposure

to sunlight of up to UV index 5. • The transparent cover is waterproof. There are no holes, attachments, stitches that can cause

leaking. However, as the bio dome has conditions of a greenhouse, moisture can condense on the inside surface and cause dripping.

• Like a greenhouse, the temperature in the bio dome will always be several degrees hotter than the external temperature.

• Can be installed both on soft and hard surfaces. On hard surfaces like concrete, wood deck, etc., use the metal clamps with suitable screws. At softer grounds like soil, lawn, etc., use the provided base weight kit to fix the bio dome to the ground.

• Provides seating for four to eight adults in each. Applicant will mitigate staff concerns by:

• Keeping 5’ of sidewalk clear; • Use of electrical with GFI from Midori building, not city utilities; • Eliminating trip hazards by utilizing cord covers on sidewalk for electrical cords; • Having no open flame or propane; • Illuminating igloos at night; • Clearing snow from around the igloos; • Insurance waiver is on file at city hall from summer dining patio; • Anchoring down the igloo on the platform.

Staff recommends a pro-rated fee based on existing policy for this pilot. Cost per space is $250, covering 35 weeks of the year, making the rate $7.14 per space, per week. Based on this calculation staff recommends $30 as the fee as the applicant would like to use one spaces for four weeks, three days prior to the spring dining patio season. Locations of igloos in other communities include: Bay City, Cascade, Detroit, Fenton, Grand Rapids, Kalamazoo, Marquette, Mason, New Buffalo, Northville, Rochester, and Suttons Bay. Applicant is aware of the additional considerations staff recommends and has agreed to meeting them. Additionally, the applicant will have an igloo on-hand and available to look at in the city hall parking lot prior to the city commission meeting. 1. Applications to license public sidewalks, or parking spaces for outdoor dining shall be limited to the area within the downtown Principal Shopping District (PSD) and/or Tax Increment Finance Authority (TIFA) Central Business District (CBD) and those commercially zoned properties specifically authorized by the City Commission that can also meet all of the following criteria.

NOTICE OF VIOLATION; FAILURE TO COMPLY. Upon a finding by a City staff member that an applicant has violated any provisions of this policy, the Downtown Development Director shall give notice to the applicant to correct said violation. Upon failure to immediately correct said violation, the City Commission may revoke the applicant's license to operate the outdoor dining license. Upon the revocation of such license, the applicant shall be entitled to a hearing before the governing body within 30 days, upon notice thereof, provided that a hearing is requested by the applicant, in writing, within five days of revocation of the license. All conditions are to be met by applicants, unless waived by the City Commission.

GENERAL TERMS - LAYOUT, MAINTENANCE, AND HOURS OF OPERATION Outdoor dining offers a unique opportunity for cities and downtowns to improve the public realm and create spaces for pedestrians to socialize and linger. Though modest in size, outdoor dining platforms and spaces are significant in their representation of prioritizing people over automobiles. However, outdoor dining platforms and spaces could also result in a cluttered and unattractive appearance and create obstructions for pedestrians and vehicles. The following guidelines were developed to support the efforts of our downtown business community and keep it attractive and safe. Outdoor dining is allowed in downtown (Central Business District and/or Principal Shopping District), subject to the following guidelines:

1. The owner of the business shall be responsible for compliance with all city, state and federal ordinances and codes. Questions on applicable building and fire code can be directed to the Building Official at (989) 779-5301.

2. Dining spaces and/or platform shall be located in front of the applicant’s business frontage. Utilization of parking spaces is up to three spaces provided those spaces shared with abutting businesses are agreed on.

3. The use of barrier-free parking spaces, corresponding ramps and sidewalk transition spaces is prohibited for the purpose of outdoor dining for either sidewalk or dining decks.

4. All structures used for outdoor dining must have appropriate flame spread rating of class I or class A, similar to a tent structure. Structures must be anchored to a base and/or patio. Structures cannot be anchored into street or sidewalk.

5. Illumination at night is suggested in the spring/summer/fall season and mandatory during the winter season. Illumination source may not use city utilities. No open flame can be used in the structures.

3.6. All dining units should be inspected by the fire department and building official and have a certificate of compliance from the building official before public use.

4.7. ADA Accessibility/Universal Design

Universal Design (UD) is a strategy for making products, environments, operational systems, and services welcoming and usable to the most diverse range of people possible. Its key principles are simplicity, flexibility and efficiency. Originally developed in response to the needs of the aging population and people with disabilities, UD has much broader applicability than ADA. It increases ease of access to products, places and services for multiple, diverse populations. Using UD means taking into account the broad range of abilities, ages, reading levels, learning styles, languages and cultures in their customer base. At a minimum all outdoor dining locations must meet American with Disabilities Act (ADA) standards and encourage UD whenever possible. Due to each potential outdoor dining location (sidewalk or dining deck) having site challenges with the existing infrastructure elements (ex. crown of road, tree wells, light poles, etc.) and building code requirements (ex. load per sq ft, support, limited thickness in materials, etc.) we have provided options for business owners to reach ADA, recognizing that one design option cannot fit all situations. The following are recommended strategies for implementing ADA standards with regards to outdoor dining on sidewalks and/or decks: Sidewalk Dining:

a. Shall be located so as to provide the pedestrian access required by the American with Disabilities Act. An unobstructed, walkway of 36” shall be maintained at all times.

Dining Decks Options: a. Dining platforms/patios should be flush with the curb and should not have more than a

½ inch gap from the curb; or

b. Incorporate an ADA compliant ramp as part of the dining deck design; or

c. Use of an accessibility ramp to allow access from the sidewalk to the dining area.

i. Where ADA ramps and/or other resources are used, signage indicating their availability will be posted clearly so patrons can see it.

5.8. Umbrellas or shade structures can be used on public sidewalks if vertical clearance is greater than 80 inches, so as to not cause a hazard to blind or visually impaired persons.

6.9. Tables, chairs, umbrellas and any other objects used shall be of quality design, materials, and

workmanship both to ensure the safety and convenience of users and to enhance the visual and aesthetic quality of the urban environment.

7.10. The licensed area, perimeter of the seating area and abutting public sidewalk shall be kept clean, attractive and free of all litter, snow and debris, and must allow for the safe and easy flow of pedestrian traffic and city street sweeper. Cord covers are required for the entire width of the sidewalk when cables are used to eliminate tripping hazards and provide unobstructed sidewalk access. In addition, it is the responsibility of the license holder to inspect the licensed area and report any deterioration or other hazard(s) to the Director of Public Works.

8.11. License of public right-of-way shall not be permitted if the proposed dining area results in sight obstructions for vehicles or pedestrians or result in the obstruction of normal traffic flow. Any outdoor lighting shall be arranged in such a manner so as not to create a hazard for vehicular traffic or a nuisance to residential land uses in the area.

9.12. No advertising signage shall be present on or in the outdoor seating area.

10.13. The licensed area shall be limited to portions of right-of-way abutting the property owned, leased, or rented by the applicant unless given approval by adjacent property and business owners.

11.14. Hours of operation for licensees shall be limited to between 7:00am and 12:00am.

12.15. The location of sidewalk cafes where alcohol is served shall be subject to the requirements of the Michigan Liquor Control Commission. The operator of any outdoor dining space or platform shall take whatever steps are necessary to procure the appropriate license from the M.L.C.C. and shall comply with all other laws and regulations concerning the serving of alcoholic beverages in the State of Michigan.

PERMANENT FENCING

1. Fence materials shall be of durable commercial-grade building materials, such as powder-coated aluminum or steel. Decorative fences should generally be four and a half feet (54 inches) or below. However, exceptions may be considered for special circumstances.

INSURANCE REQUIREMENTS

1. The applicant shall provide evidence of the following with the application for an Outdoor Dining License:

Since 2003 the City has utilized Public Act 120 for a Principal Shopping District Board and resulting special assessment to provide funding for certain activities unique to the downtown area. In 2003-2006 the special assessment funds were used for both promotions and maintenance in the downtown area. Since 2007 the funds have only been used for maintenance activities. According to the state law, the Principal Shopping District Board must recommend a special assessment to the City Commission. The attached memo from Downtown Development Director Michelle Sponseller outlines the recommendation from the Principal Shopping District Board for 2020-2021. The information from Michelle includes a map of the district, the history of the special assessment back to 2003, and written communications received by her. As we all know, snow removal costs are difficult to adequately predict. Any savings from snow removal in lighter winters goes to the fund balance of the Downtown Fund and in heavier winters the fund balance is used to cover additional needs. As the memo from Ms. Sponseller indicates, a change in the process this year is that the power washing of the sidewalks will only be done if the approved snow removal budget is not fully utilized during the season. The fund balance in the Downtown Fund as of December 31, 2018 is $79,798 so adequate funds exist if the upcoming winters experience heavier snowfalls. Projected funds balance at December 31, 2021 is $33,848 based on the snow removal budget figures identified in Ms. Sponseller’s memo. The City Commission may recall that a special assessment process takes five resolutions. Resolution #1 indicates the City Commission tentatively believes there is interest in creating a special assessment and asks staff to prepare a report. The report that is provided for this resolution is the attached recommendation from the Principal Shopping District Board. Resolution #2 indicates the City Commission tentatively believes the level of funding is appropriate and asks staff to notify the property owners of the need for the special assessment and sets a public hearing for June 10, 2019 to obtain input.

It has been our practice to include the specific calculations by property of how the assessment would be spread and that information is also attached for your review. The fourth column from the right on the spreadsheet provides the annual amount per property for 2020 and 2021. The estimated dollar amounts for each property will be included in the notice of public hearing that is required to be mailed to all of the property owners in the district. The next steps in the process after the June 10 public hearing would include two more resolutions, another public hearing and then a final resolution providing the final approval for the special assessment amount. Staff recommends the City Commission adopt resolutions #1 and #2 for the Principal Shopping District for 2020-2021. Since 2016 the downtown special assessment has generated approximately $115,000 annually to cover the cost of maintenance and snow removal from parking lots, grounds care, power washing of sidewalks and utilities. On the next two pages you will find a recap of the special assessment funding for the past 14 years. At the March 11, 2019 PSD meeting the consensus from members on the level of services for the upcoming 2020-2021 special assessment are as follows:

• Power washing o No change to service level but, only conduct if snow removal is under budget.

• Hanging Baskets o No change.

• Grounds Care o No change, include minimum wage increases.

• Snow Removal o No change but track in 2019-2020 season what the difference would be if snow was

removed at 3” accumulation rather than current 4”. • Utilities

o No change With these levels of service staff developed the 2020-2021 special assessment with inclusion of minimum wage increases and adequate reserve balance for heavier or more frequent snow removal as weather necessitates. These changes result in an increase of $8,000 (6.9%) on an annual basis to the special assessment. Additionally, staff recommended the special assessment timeframe be two years so as to adequately make service level changes as necessary. The estimated 2020 and 2021 PSD budget is as follows: 2020 2021 Grounds Care* (including hanging baskets) $72,620 $74,430 Utilities and Electrical $26,880 $27,560 Snow Removal (parking lots and adjacent sidewalks) $40,840 $41,860 *Please note that grounds care was bid in 2018 and costs are reflective of those updated costs, including minimum wage increases.

At their May 8, 2019 meeting, the PSD approved the following for city commission:

• Recommend to the city commission the principal shopping district special assessment with an increase of $8,000 on an annual basis for a two-year period (2020-2021) with no changes to the calculation methodology.

To ensure the greatest level of transparency, the proposed special assessment was emailed, on three separate occasions, to the downtown email list. Below are the results for the three emails sent:

• April 5 o 185 recipients o 93 opened the email o 39 clicked on the proposal document

• May 2

o 184 recipients o 77 opened the email o 22 clicked on the proposal document

• May 2 (sent with revision to previous minutes)

o 184 recipients o 75 opened the email o 27 clicked on the proposal document

To date three emails have been received. Additionally, questions pertaining to the current use of funds and calculation methods were asked by two property owners and answered by staff. Also, staff has verified the property owners parking credits to reflect changes in parking lot configurations. Requested Action: Consider the recommendation for the central business district special assessment with an increase of $8,000 on an annual basis for a two-year period (2020-2021) with no changes to the calculation methodology.

Hi Amy;  I can help with that!  I looked up Art Reach’s taxes in 2018 and found that your total special assessment, which is included on your tax bill, was $590. The special assessment is broken into two parts so if you look at your tax bill it will say $298 (July) and $291 (December).   Assuming the 7% increase, Art Reach’s special assessment will go from $590 to $630, an annual increase of $40. The increase is due to additional wages with the minimum wage over the past two years and the ones taking place over the next couple of years. There are no new services and to keep the costs down as much as we could power washing the sidewalks will only take place if the snow removal funds haven’t all been used.  The special assessment pays for: 

Snow removal from the parking lots when the accumulation is 4”  

Grounds Care – mowing, weeding, hanging flower baskets, etc. 

Utilities – electrical for the lights in the parking lots, water   Let me know if you have additional questions.

Thanks for the input but I want to clear up a few things.  

Alleyways are cleared by the city but not paid via the special assessment, the funding source is the general fund like streets are. 

Error on minutes….McAvoy and Horton are on TIFA, not PSD. I’m fixing that and will resend.  

Two boards are necessary as they have separate enabling legislation, functions, boundaries and board member roles dictated by them. Event when we combined them they had to have action taken by the specific board, for example TIFA members couldn’t vote on PSD matters and vice versa.

Principal Shopping District 2-19

WHEREAS, pursuant to provisions of the City Charter of the City of Mt. Pleasant; Chapter 33: TAXATION, Section 33.17 "Authority to Assess", of the Code of Ordinances, and Public Act 120 of 1961 "Redevelopment of Shopping Areas", the City Commission of the City of Mt. Pleasant may commence proceedings to provide funding for the operations of the Principal Shopping District within the City and determine the tentative necessity thereof,

AND, WHEREAS, the City Commission has tentatively deemed it to be in the public's interest, health and welfare to provide funding for the operations of the Principal Shopping District in the City, Special Assessment District No. 2-19

NOW, THEREFORE, BE IT RESOLVED, THAT:

1. The City Manager is directed to cause to be prepared a report which shall include all analysis and information required by Section 33.20 "Survey and Report", of the Code of Ordinances,

2. When the aforesaid report is completed, the City Manager shall file the same with the City Clerk for presentation to the Commission.

Principal Shopping District 2-19

WHEREAS, the City Manager has prepared a report concerning funding for the Principal Shopping District in Special Assessment District No. 2-19, which includes all of the information to be included by Section 33.20 "Survey and Report" of the City's Code of Ordinances;

AND, WHEREAS, the City Commission has reviewed said report;

AND, WHEREAS, the City Commission of the City of Mt. Pleasant determines that it is tentatively necessary to provide funding for the Principal Shopping District in the City of Mt. Pleasant more particularly hereinafter described in this resolution;

NOW, THEREFORE, BE IT RESOLVED, THAT:

1. The City Commission hereby tentatively determines that providing funding for the Principal Shopping District described more particularly hereinafter provided for are necessary.

2. The total funding for the Principal Shopping District for the next two years (2020 and 2021) is estimated to be $123,480 per year. $123,480 shall be spread over the special assessment district per year as hereinafter described as a result of benefits to be received by the affected properties in the special assessment district.

3. Said special assessment district shall consist of all the lots and parcels of land as follows: all lots in the Principal Shopping District as established by the City Commission at the February 24, 2003 meeting and amended at the November 14, 2005 meeting.

4. The duration of the special assessment shall be two years.

5. The affected properties in the special assessment district shall be assessed in accordance with the relative portion of the sum to be levied in the district, as the benefit to the parcel of land bears to the total benefit to all parcels.

6. The aforesaid report shall be placed on file in the office of the City Clerk where the same shall be available for public examination.

7. The City Commission shall meet on June 10, 2019 at 7:00 p.m., Daylight Savings Time, in the City Commission Room, City Hall, 320 W. Broadway Street, for the purpose of hearing objections to providing funding to the "Principal Shopping District".

8. The City Clerk is hereby directed to cause notice of said hearing to be published and mailed in accordance with applicable statutory and ordinance provisions.

As the City Commission is aware, Initiated Law 1 of 2018, the Michigan Regulation and Taxation of Marihuana Act (recreational marijuana), passed on November 6, 2018. This law made marijuana legal under state and local law for adults 21 years of age or older, made industrial hemp legal and controlled the commercial production and distribution of marijuana. Local municipalities are assumed to automatically allow recreational marijuana establishments in their municipality unless action is taken to opt-out. The state was given one year to establish the regulations and procedures for the licensing of recreational marijuana establishments. The state presentations after the passage of the law consistently indicated the state would be ready to license on or about December 1, 2019. We based our timeline for discussions and ordinance considerations on that date (see attached timeline column labelled “Original”). Earlier this month the State’s Marijuana Regulatory Agency indicated they expect the regulations will be issued in June and are working toward being ready to start accepting license applications on September 1, 2019. Assuming the City is interested in allowing recreational establishments, the City of Mt. Pleasant’s regular meeting dates of the Planning Commission and City Commission make it impossible to have local regulations in place by September 1, 2019. The middle column of the attached timeline (Revision 1) indicates the fastest we could implement ordinances with the regular meeting schedules. The last column (Revision 2) provides additional time for discussions to occur after the state regulations are issued in June. As the two revised timelines indicate, it is not possible for us to have local regulations in place prior to September 1, 2019. The local regulations address whether the City is interested in allowing all six types of establishments and the time, place and manor for where those establishments could be located. Therefore, we are recommending the City temporarily opt-out of recreational marijuana establishments as allowed under the law. There are many differences between the medical marijuana facilities law and the recreation law in regard to commercial establishments. The attached chart provided by the Michigan Municipal League highlights some of those significant differences.

According to information on the State of Michigan’s Marijuana Regulatory Agency website, as of today’s date 417 municipalities have filed paperwork to opt-out of allowing recreational establishments. Attached is an ordinance drafted by the City Attorney which would temporarily opt-out of allowing recreational marijuana establishments in the City of Mt. Pleasant. We are recommending a public hearing on this ordinance be set for June 10, 2019. Approval of this ordinance will temporarily opt-out of allowing the establishments so that we can follow one of the attached timelines to have appropriate discussions and consideration of local regulations, assuming the City is interested in allowing establishments within the City limits. AN ORDINANCE PROHIBITING MARIHUANA ESTABLISHMENTS UNDER INITIATED LAW 1 OF 2018, THE MICHIGAN REGULATION AND

TAXATION OF MARIHUANA ACT THE CITY OF MOUNT PLEASANT ORDAINS: Section 1: Amendment of Title XI of City Code. The City of Mount Pleasant hereby amends Title XI of the City Code to add Chapter 115, which shall provide as follows in its entirety:

CHAPTER 115: RECREATIONAL MARIHUANA FACILITIES 115.01. Findings.

1. On November 6, 2018, Michigan voters approved Initiated Law 1 of 2018, known as

the Michigan Regulation and Taxation of Marihuana Act, MCL 333.27951 et seq (“2018 Marihuana Act”). Among other things, the 2018 Marihuana Act makes marihuana legal under state and local law for adults 21 years of age or older, makes industrial hemp legal under state and local law, and controls the commercial production and distribution of marihuana under a system that licenses, regulates, and taxes the businesses involved.

2. Section 6 of the 2018 Marihuana Act authorizes a municipality to completely prohibit or limit the number of marihuana establishments within its boundaries. A “marihuana establishment” under the 2018 Marihuana Act means a marihuana grower, marihuana safety compliance facility, marihuana processor, marihuana microbusiness, marihuana retailer, marihuana secure transporter, or any other type of marihuana-related business licensed by the Michigan Department of Licensing and Regulatory Affairs.

3. The State of Michigan’s Marijuana Regulatory Agency (“MRA”) anticipates

releasing draft emergency rules for the regulation of adult-use marihuana on or about June 1, 2019. Ninety days after issuance of the emergency rules, the MRA may begin accepting applications for marihuana establishments.

4. The City is continuing to evaluate the potential benefits, challenges, and costs of

permitting marihuana establishments within its boundaries, and wishes to review the emergency rules as part of that process. To allow sufficient time for such review and evaluation, and to ensure that the MRA does not issue licenses for marihuana establishments in the City in the absence of City regulations, the City has determined

that prohibiting marihuana establishments at this time is in the best interest of the public health, safety, and welfare.

115.02. Prohibition on Marihuana Establishments.

1. Pursuant to Section 6 of the 2018 Marihuana Act, the City prohibits marihuana

establishments within its boundaries.

2. The City may repeal this Ordinance in the future and adopt an ordinance that authorizes, limits, and/or regulates marihuana establishments in a manner consistent with the 2018 Marihuana Act and all applicable administrative rules. Unless and until this Ordinance is repealed, this Ordinance shall remain in full force and effect.

115.03. Scope. Nothing in this Ordinance shall be construed to prohibit activities that are permitted under the Michigan Medical Marihuana Act, Initiated Law 1 of 2008, MCL 333.26421 et seq. Nothing in this Ordinance shall be construed to amend or repeal Chapter 112 of the City Code, which governs medical marihuana facilities. 115.04. Validity and Severability. Should any portion of this Ordinance be found invalid for any reason, such holding shall not be construed as affecting the validity of the remaining portions of this Ordinance.

Section 2. Repealer Clause. Any ordinances or parts of ordinances in conflict herewith are hereby repealed only to the extent necessary to give this Ordinance full force and effect. Section 3. Effective Date. This Ordinance shall take effect immediately upon publication.

MEDC has worked with the U.S. Department of Housing and Urban Development (HUD) to reprogram the funds to make them available as revolving loan funds for businesses with job creation and/or blight conditions. Northern Initiatives has been working with Gursky Limited, who is the new owner of Motorless Motion. It appears the business plan for this applicant meets the criteria for job creation for the Revolving Loan Fund (RLF) Program and they are working toward loan consideration by the loan committee. Because the funds currently fall under some federal regulations, there are certain requirements that must be met by the unit of local government. The attached memo from Community Services and Economic Development Director Bill Mrdeza recommends approval of a resolution drafted by the City Attorney. The CO is required to ensure CDBG project compliance with the National Environmental Policy Act, 42 U.S.C. §4321 et seq. (NEPA) and the related provisions in 24 CFR Part 58, including the Federal laws and authorities cited at §58.5, and shall comply with all rules and regulations applicable to the CO for CDBG funded projects.
