Dear Mayor and Councillors,

June 14, 2015

TIARA, the Thousand Islands Area Residents' Association, is asking for the renewed support of the Township of Edwardsburgh/Cardinal for its nomination of the Upper St. Lawrence River as a Canadian Heritage River.

We are pleased that your Township passed a Resolution of approval in principle on March 6, 2008 for this initiative, which was spearheaded by our then President, Dr. Peter Macklem. Since then, we researched and eventually produced our Nomination Document (attached) which was presented to the Canadian Heritage Rivers System (CHRS) Board in May of 2011. Tragically, Dr. Macklem died suddenly that February, and we are now completing the project in his memory.

This past winter, we have been able to secure resolutions of renewed support from all the other riverfront municipalities as well as the Mohawk Nation of Akwesasne. To complete this part of our nomination package, we just need support from Edwardsburgh/Cardinal.

It is understandable that there might be concern that Canadian Heritage River designation will impact on your own jurisdiction. To reassure you, we quote from the CHRS's 2014 Policies, Principles and Operational Guidelines:, "Governments retain their traditional jurisdictional powers and management responsibilities throughout this process. Local communities, Aboriginal Peoples, landowners, and other stakeholders have their existing rights and concerns respected when rivers are included as part of the system."

The CHRS looks for a range of attributes of each nominated river, and many of these fall under their heading of "Cultural Heritage". We have emphasized that the St. Lawrence has always been a vital waterway for transportation, shipping and trading, central to the history of all of Canada starting from earliest Aboriginal times. Your well­equipped Port of Johnstown is proof that this heritage of river-based commerce continues proudly to this day. It is interesting to note that several other Canadian Heritage Rivers also boast thriving commercial ports, and obvious examples are the

Saint John River flowing past Saint John NB, the Detroit River going between Detroit/Windsor and the St. Marys River through Sault-Ste-Marie (Ontario and Michigan).

The CHRS is currently identifying "gaps" in the list of Canadian Heritage Rivers, with some areas or heritage values being under-represented. It is encouraging that they have identified the St. lawrence as a river which they would hope to add to the list.

We have requested an opportunity to come before your Council on June 22, 2015, and would be very happy to answer any questions you may have. We very much hope that your municipality will join the others up and down the River, and pass a motion to support our initiative, so that the St. lawrence might eventually join the other Canadian Heritage Rivers and be given the national and local recognition that it certainly deserves.

River Nomination

Whereas, the St. Lawrence River, known to First Nations as Kaniataraowaneneh (the majestic and magnificent river), was the central artery for exploration, commerce and cross-cultural contact between aboriginal groups and European settlers.

Whereas, the Upper St. Lawrence region shows evidence of prehistoric Aboriginal occupation as early as the Paleo-Indian period (9000- 5000 BCE).

Whereas, Europeans arrived in the Upper St. Lawrence region in the 1600s, providing Canadians with almost 400 years of history related to exploration, trade, conflict and settlement.

Whereas, the Upper St. Lawrence River was and continues to be a vital transportation route, helping to sustain earlier fur and timber trades and present-day international trade.

Whereas, numerous fortification-based communities can be found along the north shore of the Upper St. Lawrence, revealing the stories of relations among First Nations and Europeans and between Canadians and Americans.

Whereas, the Upper St. Lawrence offers a rich social history of trade between Canada and the U.S. spanning more than a century.

Whereas, the region was the scene of many battles that marked significant points in the development of Canada as a nation - from the Beaver Wars and the French and Indian War, to the War of 1812 and Rebellions of 183 7 - and was a hotbed of activity during the American Civil War.

Whereas, the construction of the Seaway on the Upper St. Lawrence River offers a unique and poignant story of the "Lost Villages" and the industrial development of Canada.

Whereas, well-preserved homesteads and buildings showcase a range of building and living styles from the nineteenth century.

Whereas, the Upper St. Lawrence traverses an area that represents more than one billion years of evolutionary history.

Whereas, the Upper St. Lawrence River consists of a complex array of habitats including more than 1,800 islands, 2,000 shoals and thousands of hectares of coastal wetlands.

Whereas, the Upper St. Lawrence is situated in the centre of the most important area of ecological connectivity east of the Rocky Mountains, with Algonquin Park to the north and Adironacks State Park in New York State to the south.

Whereas, the region is home to the Frontenac Arch Biosphere, one of 15 UNESCO­designated biospheres in Canada.

Whereas, the Upper St. Lawrence is home to 31 species at risk and supports more than 88 species of fish in the Thousand Islands area alone.

Whereas, the Upper St. Lawrence has an impressive network of scenic roads and hiking and biking trails along both its north and south shores, most prominent of which is the Thousand Island Parkway.

Whereas, the Upper St. Lawrence River includes the full range of water-based activities such as boating, angling, camping, hiking, and natural and cultural appreciation, which work together to form a unique river-touring experience.

Whereas, environmental, cultural and recreational groups on both the Ontario and American sides of the Upper St. Lawrence work together to conserve and celebrate the river's rich heritage.

Therefore, it is recommended by the Province of Ontario that the 200-kilometre-long section of the St. Lawrence River bordering the Province of Ontario, from the headwaters at Kingston on Lake Ontario to Lake St. Francis, be nominated to the Canadian Heritage Rivers System for the purpose of recognizing, celebrating and conserving the River's outstanding cultural heritage values.

Executive Summary

This document presents the case in support of the nomination of the Upper St. Lawrence River for inclusion in the Canadian Heritage Rivers System. The nomination is based on the river's cultural heritage values, and covers the area from the St. Lawrence's headwaters at Kingston to the Ontario-Quebec border.

The Upper St. Lawrence River has a long and storied role in the pre-history and development of Canada. Activity on the river can be traced back to prehistoric times. From the fur trade to the lumber trade, the St. Lawrence River served as the shipping link between the Atlantic Ocean and the Canadian interior, and was used by Aboriginal and European communities alike. By enabling the trading of Canada's natural resources, it was a key facilitator of Canada's development as a country.

Today, the Upper St. Lawrence boasts abundant historic sites and museums along its length, offers a stunning and internationally-recognized riparian environment in the Thousand Islands, and remains a vital transportation route linking the Atlantic Ocean to the Great Lakes.

Designating the Ontario portion of the St. Lawrence River would address recognized gaps in the Canadian heritage river network. This section of the river crosses both international and provincial boundaries; has been the backdrop for Aboriginal and European cross­cultural contact; boasts distinctive architecture inspired by the river; and is home to well­developed and nationally recognized land-based tourism attractions.

Future designation of the Ontario portion of the St. Lawrence will build on the considerable community support and momentum that exists on both the Canadian and American sides of the river. There already exists a strong grassroots commitment to sustainable living and stewardship of cultural and natural values built by initiatives such as the Frontenac Arch Biosphere Reserve. Disparate communities in the region are working together and building networks.

Designating the Ontario portion of the St. Lawrence River as a heritage river will build upon this strong foundation in the interests of protecting, enhancing, and publicizing the cultural and natural heritage of this special waterway.

a) Brian West, Eastern Mainline Project Manager- TransCanada

Mr. West provided an overview of the Eastern Mainline Project which proposes to construction of 270 km of natural gas transmission pipeline between Markham and Edwardsburgh/Cardinal, and to add nine new units to five existing compressor stations along the proposed route. He reviewed safety measures of the proposed line, a timeline of the project and planned community engagement sessions.

Questions were raised with respect to the need for the project and contact with and compensation for landowners along the pipeline. Members briefly discussed the Energy East pipeline project, a separate TransCanada project which proposes to transition a natural gas line to oil.

b) Thorpe-Ellis Drainage Assessment (Holmes)

Morrell whereas in 2010 the Township of South Dundas completed work on the Thorpe-Ellis Drain and assigned drainage benefit costs to several properties in the Township of Edwardsburgh Cardinal including properties on roll numbers 0701 701 04501 106 & 107 located at 713 Pittdale Road (Holmes); and Whereas the owners of these two properties were not initially aware that their drainage assessment was some $200.00 or so higher than the neighbouring properties and subsequently missed the opportunity to appeal their assessments during the mandated appeal period; and Whereas numerous attempts over the past five years to have South Dundas review and adjust the drainage assessments for these two properties have failed to bring any satisfactory resolution to the property owner; and Whereas it is the responsibility of Edwardsburgh Cardinal to collect and remit to South Dundas the required assessment amounts, which have now been added to the tax accounts of these properties; Therefore be it resolved that in the interest of resolving this long outstanding dispute and bringing closure to this matter the Township of Edwardsburgh Cardinal shall write-off $200.00 of the Drainage Assessment amounts for each of the properties on roll numbers 0701 701 04501 106 & 107 and issue a credit to the tax account of each property.

c) Recreation Survey Expenses

Barrett that Municipal Council authorize the purchase of a "Professional Subscription" to Survey Monkey to allow for more than 1 0 recreation survey questions and unlimited responses at a cost of $19/month for a two month period and that the surveys be distributed through a Township-wide mail-out at a cost of approximately $530.00 as recommended by Recreation Advisory Committee.

The Co-Chair of the Recreation Advisory Committee remarked on reasons for the proposed survey distribution both online and through mail outs.

The policy was reviewed and a number of suggested edits were put forward for consideration.

Members discussed provincial directives with respect to the sale of surplus land and the process for disposing of land in the Industrial Park.

It was the consensus of Committee that the notice period be extended to 30 days and that advertising be placed in more than one local newspaper, on the municipal website and on social media and that the policy specify that all tenders be opened in public with any negotiations being discussed in Closed session. These changes will be made and circulated and an updated policy will come forward for adoption by Council on July 2ih.

7. Action/Information Items Tabled June 1st

a) Budget to Actual

Members sought clarification with respect to the process of creating the Budget to Actual report as changes have been made to this process recently. It was noted that the next Budget to Actual report stating expenses and revenues to the end of June will be presented at the August Administration & Finance meeting.

b) Budget Addendums for PSAB

Members discussed the PSAB requirements with respect to accrual accounting principles. Allocation of 2014 water and wastewater revenue was clarified.

As a chair had not yet been appointed by Committee, Ms. Earl called the meeting to order at 6:30pm. She reviewed the process with respect to the role and function of the Compliance Audit Committee as outlined in the Committee's Terms of Reference.

Ms. Earl also noted that the decision of the committee with respect to the reasonableness of the request for an audit may be appealed to the Ontario Court of Justice within 15 days after the decision is made.

Mr. Larocque explained the function of the Compliance Audit Committee with respect to Ms. Ball's request for a compliance audit. He then called on Ms. Ball to provide any additional information that she may wish to provide. Ms. Ball said that her request was succinct and complete and that she did not have any further information to add at this time.

Mr. Barrett was then asked if he had any information to provide in addition to the response that he had forwarded to the Deputy Clerk and was distributed to

Mr. Barrett was asked to clarify when election materials contributed to his campaign as in-kind contributions were delivered to or collected by him. Mr. Barrett said that he was not in receipt of campaign materials prior to filing his nomination papers and reiterated the stance in his response that materials were not available for public consumption, or used to promote his candidacy in advance of his campaign period.

Committee referred to Section 76 of the Municipal Elections Act which states that (1) "an expense shall not be incurred by or on behalf of a person unless he or she is a candidate"; and (2) an expense shall not be incurred by or on behalf of a candidate outside his or her election campaign period." Members provided their opinions with respect to the definition of "incurred" and "expense".

It was the consensus of members that expenses are incurred at the time of delivery/possession and therefore believed that the request for compliance audit was unreasonable.

Pincott that Whereas a request for a Compliance Audit under Section 81 (1) of the Municipal Elections Act was presented by Ms. Ball with respect to Mr. Barrett's election campaign finances prior to the deadline for submissions; and Whereas the Compliance Audit Committee has considered the request from Ms. Ball and believes that the request for a Compliance Audit is unreasonable pursuant to the expenses being incurred within the candidates campaign period; Now therefore the Compliance Audit Committee rejects the request for Compliance Audit as submitted by Ms. Ball.

a) Ms. Erin Merkley & Ms. Katie Garswood - Cardinal Baby Pool

Ms. Merkley and Ms. Garswood presented a petition created in support of the repair and reopening of the Cardinal baby pool. They noted that the petition currently has 291 signatures with 174 of those from residents of the Township.

Ms. Merkley and Ms. Garswood outlined the history of the pool and the fund raising efforts of the Cardinal Fire Department. Both discussed the importance of the pool in building confidence and skill development among young swimmers and asked that consideration be given to repairing and reopening the pool as soon as possible.

Ms. Garswood asked committee why there had been no attempts to fix the pool, how it was able to fall into disrepair and for estimated costs of work based on quotations.

Members asked Ms. Merkley and Ms. Garswood questions with respect to the timing of their petition distribution. A number of criteria for evaluating the options in the decision making process of Council with respect to the repairs were discussed. Statistical significance of anonymous surveys was discussed.

Staff noted that estimated repair costs are between $48,000-$53,000 plus additional funds to act as a contingency in case sandblasting reveals additional damage.

Funding options were briefly discussed among members and the delegation .. It was requested that the petition and presentations be provided to Council for their consideration.

Ms. Jodoin, present in the gallery, spoke briefly about an issue she and her child had experienced at the pool earlier in the day, which she believed could have been avoided if her child had been in a shallower pool. She also noted her discontent with the estimated cost listed on the recreation surveys.

6. Discussion Items

a) Recreation Surveys Update

Staff provided a brief update on survey responses thus far. Details of the survey were discussed among members. It was noted that completed surveys would be collected for one month with results to be presented to RAC in September.

b) Vision for Township Recreation

Members were asked to present visions for Township recreation based on information gained from the meetings and facilities tours thus far.

A number of ideas and suggestions were discussed. It was the consensus of members that a focus should be placed on recreation programming in current

This motion will come forward to the next Recreation Advisory Committee meeting for consideration.

Members briefly discussed some history with respect to an engineering report completed on the canal and preventative or maintenance work directed by the past few terms of Council.

Edwardsburgh/Cardinal Recreation Meeting -July 9, 2015- ERIN MERKLEY, CARDINAL

We are here to request that the Recreation Committee make a recommendation to Council that the Baby Pool

in Cardinal be fixed and reopened.

Recently the "hot topic" question of the non-operational baby pool arose in a Facebook group. There seemed

to be a lot of folks within the township who missed and valued this resource (Katie and myself included).

Given this is the second full season the pool hasn/t been operational/ and with little being done to move

forward with repairs/ we were inspired to conduct our own official poll to see where people stood.

The response has been overwhelming. Within 5 days/ the online petition has generated 291 signatures; and of

those 2911 174 are E-C current residents. Another 58 are from lroquois/Morrisburg/Prescott/Brockville and

are folks who have indicated they would use the pool if it was still operational. The remaining are former

concerned E-C residents (including many former swimming instructors) who realize what a mistake it would be

to lose this piece of our history that is still so valued today.

We have three paper petitions in circulation to seniors and others in the community who don/t have access to

the internet/ but heard of our efforts by word of mouth and sought us out so they could sign. These are people

who have watched their children and grandchildren learn to swim in our little poot and want their tax dollars

to continue to keep it around for future generations.

There are also 118 thoughtful comments that endorse the cause. People have acknowledged that fundraising

will be a player in getting the pool running again 1 and we have received numerous offers to help with those

efforts.

35 years ago/ our firefighters raised the funds to build our baby pool. My late grandfather/ Ralph Merkley

being one ofthem 1 Torls father/ Charles Deschamps/ Gerry Morell- your old neighbor Rick Hare was part of

that team. We all have a connection to this little pool because thafs what small communities are all about.

We acknowledge and understand that kids can learn to swim/ and do learn to swim without the assistance of

wading pools. This is true of most other communities in Eastern Ontario. We/ however/ in

Edwardsburgh/Cardinal are lucky. We already HAVE a baby pool. Our toddlers and small children have had the

luxury of learning to respect the water by being introduced to it in a pool their own size/ without being

hindered by life jackets and fear. Confidence comes from being able to touch bottom and not feeling

overwhelmed.

Robyn Merkley- 110ne of the most important components of learning to swim is slow progression which

allows learners to build confidence in the water. The little pool gave children the opportunity to learn the

basics of floating and breath regulation in a controlled environment where they still had independence."

Kim Holmes- 11i used to be a lifeguard at that pool and the baby pool was a great starter for the toddlers to

build up their confidence to go in the big pool."

On a more personal level -I have a 2-1/2 year old son, Charles, who has been enrolled in the Parent/Tot

swimming lessons this summer (and last). I wish I could say he is excelling, but that would be a lie. The

majority of the 30 minute lesson is spent coaxing him to put his feet in, convincing him he'll be held and not

let go, and reassuring him that he doesn't need to cry. To quote him, 11There's too much water. I'm scared."

The Baby Pool is a valued resource that has unfortunately gone ignored. 2 non-operational years is 2 years too

long. I speak for everyone who has signed the petition by saying that we want to see the current valued assets

of Edwardsburgh/Cardinal properly maintained. We don't want to lose a piece of our community history that

should still be serving our young children today.

PETITION OUTLINE

Repair and Reopen the Edwardsburgh/Cardinal "Baby Pool"

The "Baby Pool", in the village of Cardinal, within the Township of Edwardsburgh/Cardinal, has been a

valued community fixture for decades. This pool is not only popular with parents for its degree of safety,

but has enabled thousands of children to build confidence around the water in at more gradual manner,

which is of significance in a waterfront community such as Cardinal. Our little pool has also attracted

families from surrounding townships, as it's the only of its kind in Eastern Ontario. Unfortunately, however,

in recent years, our pool has fallen into disrepair, and is now under the threat of permanent closure. Our

toddlers and young children are now being forced to learn in the large pool, with a small, make-shift table

apparatus affixed to the floor.

The purpose of this petition is to show Council that our little pool is worth saving. We have an existing

structure that has been popular and utilized for many years. It is missed by many, and it is important that

we fix, maintain and fully utilize the assets our township already has to offer.

We, the undersigned, current and former concerned residents of the Township of Edwardsburgh/Cardinal

and the surrounding areas, pledge our ongoing support for the repair, maintenance and continued use of

the Cardinal "Baby Pool" and call on the elected Councillors of Edwardsburgh/Cardinal to pledge their

support and work with the community to ensure this valued facility is saved from permanent closure, and

instead, remains an important and vital resource for local families.

I grew up near Cardinal

I grew up learning to swimming in this pool. All of my swimming lessons were

completed in here. Living so close to the river children need a place to feel safe as

they learn to swim in order to protect their safety and allow them to learn proper

swimming techniques. I was also a short child and I believe I was well into second

grade before I could touch the bottom of the "big pool" on my tip toes with my

head tilted all the way back. This place helped to make my summer memories year

after year. The skills children learn at this facility will transfer on to other areas of

their lives.

small Pool acquired a sense of confidence, became stronger swimmers, and

developed water safety skills that served them well living in a waterfront

community. I learned to swim in the Cardinal small pool and would love to have my

course behind Benson School at the time but it was a gift to be able to build the

confidence needed with your feet touching the ground. I never grew to be a strong

swimmer but I hated water in my face. I'm sure my success in learning to swim

began in that pool. I'm not so sure I would have been brave enough to do the same

in a bigger, deeper pool of water. I had my own children and they both had to learn

in a large pool with the drop in floor supports. One of my children was much the

same as I was and very insecure in such an environment. I think it would be well

worth maintaining the little pool for our little people.

04/07/2015 II worked at the Cardinal pool and Johnstown pool. It made a huge difference being

able to teach kids under the age of 6 in a small pool where they can touch and

rather than a tiny table that stopped them from learning as quickly as the baby

pool. Not too mention the risk of a child falling off the tot dock and not making it

back on was much greater than being in a baby pool where they can easily regain

balance.

swim as a child in a kiddie pool then on a table in the big pool.

Mr. Grant provided an outline of proposed tree planting at four different sites in the village noting the type of trees anticipated at each location. He noted that all sites and trees were chosen with the assistance of South Nation Conservation and that underground and overhead utilities were taken into account. Members discussed how the tree planting fits into the village's Streetscaping Plan and members participated in a walking tour stopping at each proposed site. During the tour, Mr. Grant noted that a number of plaques in the village would be refurbished, as well.

Deputy Mayor Taylor arrived at 7:35pm.

Following the walking tour, members discussed the new pedestrian cross walk signs and the rental sign at County Road 2. The four proposed planting sites were discussed in detail touching on the overall vision of the project.

Moved by: T. Nason, seconded by: L. Franks that planting at Site 1 be deferred and that funds allocated to Site 1 be transferred to Site 3 (first priority including benches & garbage cans), Site 4 (second priority as proposed) and Site 2 (as proposed).

a) CIP Streetscape Plan & Materials

This item was not discussed in detail as it was indicated that tree planting would represent the first phase of Streetscape implementation in Cardinal.

a) Severance Application B-55-15 & B-56-15 (Thelland)

Moved by: G. Morrell seconded by: T. Nason that Committee recommend that Council: 1. Recommend in favor of the severance 8-55-15 (Thellend); 2. Recommend in favor of the severance B-56-15 (Thellend) conditional

upon a development agreement being entered into with the current owner and registered on title of the property to be severed that sets out that no development can take place on the land to be severed until municipal water and sewer services are brought to the property line at the sole cost of the owner.

Members briefly discussed the size of the lot to be created. A typographical error was identified in the report and noted by staff.

Kenora Farms.

Members discussed policy with respect to hobby farms and the staff recommendation that the retained lot be reduced to less than 8 acres

Committee discussed the various instruments now contained within the investment portfolio. It was the consensus of Committee that $2,000,000 currently sitting in a cash account with RBC be invested in a Scotiabank Business Account carrying a 1.65% rate of return for 90 days. It was further agreed that the remaining $37,000 in that cash account be added to the CGC deposit funds and that RBC Dominion Securities be directed to invest the entire amount in an instrument bearing a minimum rate of return of 1%.

a) General Manager's Report Committee reviewed the report; the Mayor thanked the GM and Port staff for the cleanup efforts leading up to the recent grand opening event.

b) Operations Report Committee reviewed the Operation Manager's report. The wheat crop outlook was discussed.

6. Discussion Items

a) Galop Canal Maintenance

Staff sought direction regarding a previous request for input on maintenance/ improvement at the Galop Canal. Members identified the north and south slopes and the area off of Legion Way as priority sites. Health & safety requirements and liability was discussed in relation to permitting volunteers to complete maintenance.

A suggestion of collecting local improvement fees to be used to cover costs associated with maintaining the banks was discussed as was the development of a pilot project focusing on one specific priority area.

It was the consensus of members that staff be directed to present work plans for maintenance to be completed by staff, contractors or volunteers, costs/funding and health & safety implications associated with each option. This report will be brought forward to the next Public Works, Environmental Services & Facilities Committee of the Whole meeting in August.

8. Action/Information Items

a) Walking Track Limited Access

Members discussed hiring students to monitor the track and assist with other arena duties. Concerns were raised with respect to the possible poor treatment of these students by those using the track inappropriately. Suggestions were made to explore employment funding oppourtunities, to offer community service hours to students monitoring the track or to put the responsibility on the timekeeper or referee to ensure that there are no spectators on the track.

At a previous meeting, Committee discussed the option of installing a card lock system at the track in order to limit access. It was the consensus of members that staff provide more details with respect to proposed use and cost of a cardlock system to the next meeting.

b) Amend ATV By-law

Moved by: P. Sayeau seconded by: K. Smail that Committee recommends that Council amend the A TV by-law to reflect current legislative changes to expand the definition of ATV under the Highway Traffic Act.

c) 2nd Quarter Report- Fire Chief

Interim Fire Chief Moore presented his report and provided an overview of statistical data collected with respect to the 2nd quarter of 2015. He was asked by Committee to provide information with respect to value of losses in his next report. Brief discussions about the publication of burn bans and recruitment took place.

d) Award SCBA Equipment (ECFD)

Details of the recommended equipment were discussed. As all three options came in over budget, members discussed funding options.

Moved by: G. Morrell seconded by: K. Smail that Committee recommends that Council proceed with the purchase of 25 new Scott Safety Air-Pak X3 SCBA supplied by M&L Supply at the purchase price of $204,633.00 and that any shortfall at year end be covered through fire vehicle reserves.

e) Prysmian Site Plan Control Agreement Amendment

Moved by: K. Smail seconded by: P. Sayeau that Committee recommends that Council consider adopting a by-law to amend the site plan control agreement for Prysmian Power Cables Inc.

Members discussed the impact that the new well drilled by Prysmian would have on potable water revenues and the importance of ensuring against cross­contamination of the potable water supply. The possibility of charging a levy for non-potable water was discussed as was the importance of usage data collection.

It was the consensus of members that staff be directed to seek the insertion of a clause in the agreement amendment that would require Prysmian to supply data with respect to non-potable volumes to the Township.

Members discussed aspects of the report including unaccounted water, roadside spraying, dust control, and transfer station budget implications.

h) Unopened Road Allowance Policy Review

Moved by: P. Sayeau seconded by: P. Taylor that Committee recommends that Council consider an amendment to the Unopened Road Allowance Policy to Provide clarification with respect to permission for public use, to regulate the stopping up, closing and conveying of unopened road allowances and to provide flexibility with respect to the duties of the Director of Operations or alternate regarding unopened road allowances.

Additional amendments were suggested including discretion of Council with respect to opening unopened road allowances and wording changes for clarification purposes. It was the consensus of members that these additional amendments be made and that the amended policy return to Committee for further review.

i) Request to Stop Up, Close & Convey Road Allowance - Fischer

Councillor Morrell left the table and did not participate in discussions nor vote on the matter.

Moved by: K. Smail seconded by: P. Sayeau that Committee recommends that Council consider a by-law to stop up, close and convey the unopened road Allowance at 2115 County Road 44 to Mr. Henry Fischer.

Members discussed the request. Concerns were raised with respect to the apparent restricted access to provincial land and with respect to reduced public opportunity to purchase surplus provincial land in the future. Staff clarified that

the province does have frontage on County Road 44 in order to access their properties.

Members discussed possible solutions to the issues faced by Mr. Fischer as the unopened road allowance has been continuously blocked by neighbouring property owners.

j) Permission to Upgrade Road Allowance - Wynands

Moved by: K. Smail seconded by: P. Sayeau that Committee recommends that Council approve the request for upgrade of the unopened road allowance for access and direct staff to develop an agreement with the owner stipulating the conditions for use.

Members discussed the request, the agreement and the specific location in question. It was the consensus of members that the agreement be brought to Council for consideration.

k) Hyndman Road Drainage

Moved by: P. Sayeau seconded by: K. Smail that Committee receive the staff report as information with respect to Hyndman Road Drainage.

A question was raised with respect to budgeting for this item. Carried

I) Cardinal Water & Sewer Revenue Information

Revenue information up to June 31st was provided to committee for information. Monitoring of the revenues will continue throughout the year.

m) Winter Maintenance Policy

Moved by: K. Smail seconded by: G. Morrell that Committee recommends that Council amend the winter maintenance policy to implement earlier deployment of Township forces once snow accumulation levels are known to have reached Scm in depth.

Moved by: G. Morrell seconded by: K. Smail that Committee recommends that Council restrict sidewalk maintenance for winter operations to MCR, IN and CC zones in the villages of Cardinal and Spencerville and with the addition of County Road 2 east of St. Lawrence Street in Cardinal.

Members discussed the motion. It was the consensus of members that winter sidewalk maintenance should not be further restricted.

Members discussed locations of sidewalks throughout the Township and whether demand warranted exploring costs in clearing all of these areas.

Staff was directed to prepare a report on the costs associated with clearing all sidewalks at the same interval in the village of Cardinal.
