3. BUSINESS OUT OF MINUTES

.1 P. and M. Leyen, 2784 Lucern Crescent - Development Variance Permit No. 1142 (3020-201D97-64)

Report No. DEV 98-159 dated May 15, 1998, from the Deputy Approving Officer, recommended issuance of Development Variance Permit No. 1142 for the P. and M. Leyen property at 2784 Lucern Crescent. If approved, Land Use Contract No. 155-1976 would be varied by relaxing the minimum rear and side building setbacks for a proposed house.

The owners, P. and M. Leyen, had agreed to the contents of the permit, and surrounding property owners and occupiers had been notified that they may comment on the proposal.

There were no comments or questions.

Moved by Councillor Warawa, seconded by Councillor Gill that, as recommended in Report No. DEV 98-159 dated May 15, 1998, from the Deputy Approving Officer, Development Variance Permit No. 1142 be approved for issuance for the P. and M. Leyen property at 2784 Lucern Crescent.

.2 Blue Mountain Estates Ltd., 3500 Block McKee Road - Development Permit No. 1141 (3020-201D98-6)

Report No. DEV 98-165 dated May 19, 1998, from the Deputy Approving Officer, recommended issuance of Development Permit No. 1141, for the Blue Mountain Estates Ltd. property at 3500 block McKee Road. If approved, site preparation works would be permitted for a proposed bareland strata residential subdivision. The site is located in the Natural Environment and Hazardous Conditions Permit Area of the Official Community Plan.

Moved by Councillor Wiebe, seconded by Councillor Warawa that, as recommended in Report No. DEV 98-165 dated May 19, 1998, from the Deputy Approving Officer, Development Permit No. 1141 be approved for issuance for the Blue Mountain Estates Ltd. property at 3500 block McKee Road, subject to receiving the $42,500 environmental security and the $2,125 inspection fee.

4. DELEGATIONS

.1 K. Khan, Ministry of Children and Families - Restorative Youth Justice Committee Proposal

K. Khan, Ministry for Children and Families, submitted a proposal for a Restorative Youth Justice Committee, which would give the community direct involvement in ensuring that low risk offenders face immediate and meaningful consequences outside the traditional court process. The restorative program would ensure that young offenders accept responsibility for their actions, and would help make decisions and choices that can prevent repeat offences. A steering committee would be representative of the community, including membership from various cultural groups, people working with victim-serving and other justice organizations, schools, businesses, religious organizations, recreational services, social services, and offender groups, among many others. Victims would play an important role in the program, to ensure that they are heard and supported.

L. Chapman, Ridge Meadows Youth and Justice Advocacy Association, provided details of the community accountability program established in Maple Ridge, where assessments and referrals to the Committee are made by Crown Counsel and the R.C.M.P. The nature of the alleged offence is explained to the offender, who voluntarily accepts responsibility and accountability for the incident. Parents or legal guardians are apprised of their right to legal counsel and to have the matter heard in the courts, the alleged offender is fully aware of his/her responsibility to comply with any agreement reached through the process, and all agreements are entered into voluntarily with the consent of all parties. Ms. Chapman advised that the success rate in Maple Ridge is approximately 93%, i.e. only 17% commit another offence within one year.

In response to questions from Council, it was noted that the Ministry of Attorney General would provide a one-time grant of $5,000 for adult and youth community accountability program development. Additional municipal funding would be required, as well as funding from the business sector.

Moved by Councillor Wiebe, seconded by Councillor Peary, that the delegation of K. Khan, Ministry of Children and Families, and L. Chapman, Ridge Meadows Youth and Justice Advocacy Association, submitting a proposal for a Restorative Youth Justice Committee, be received.

Moved by Councillor Wiebe, seconded by Councillor Peary, that By-law No. 623-98, cited as "Abbotsford Zoning By-law, 1996, AmendmentBy-IawNo. 125", now be read a second and third time.

Although supportive in principle of a community care facility, one member of Council was opposed to the proposed location at McDougall Avenue and Montrose Avenue, which he considered to be a focal lot. He was of the opinion that the design of the building was architecturally inappropriate for the area, and that higher density development should be established. Councillors speaking in support of the proposal stated that the facility is not located in the downtown core, and would be attractive and complementary to the surrounding area.

The motion was then put and

Report No. DEV 98-155 dated May 12, 1998, from the Manager, Current Development, recommended issuance of Development Variance Permit No. 1140 for the Provincial Rental Housing Corporation's property at 33720 McDougall Avenue. If approved, lot line setbacks and the requirement of a loading space would be varied to accommodate the construction of a 10-bedroom community care facility.

Moved by Councillor Peary, seconded by Councillor Gibson that, as recommended in Report No. DEV 98-155 dated May 12,1998, from the Manager, Current Development, Development Variance Permit No. 1140 be approved for issuance for the Provincial Rental Housing Corporation property at 33720 McDougall Avenue, subject to: (a) completion of the rezoning which would allow the proposed development; (b) provision of a $19,500 landscaping letter of credit; and (c) payment of a $500 landscaping inspection fee.

.1 Salish Disposal- East Abbotsford Garbage Collection - Contract 96-20 - Extension (5360-02)

Moved by Councillor Warawa, seconded by Councillor Fast that, as recommended in Report No. ENG 98-40 dated May 12, 1998, from the Manager, Utilities, the City extend its garbage collection Contract No. 96-20 with Salish Disposal Inc. for one year, with the option to extend it for another year afterwards.

.2 Canadian Scottish Regimental Association - Abbotsford Reunion Parade June 7, 1998

Moved by Councillor Gill, seconded by Councillor Wiebe that, as requested by the Canadian Scottish Regimental Association, permission be granted to conduct the Abbotsford Reunion Parade on June 7, 1998, along the route outlined, subject to submission of insurance documents naming the City of Abbotsford as an additional insured.
