EXECUTIVE SUMMARY: The Local Government Act (1999) – Local Government (Financial Management and Rating) Amendment Act 2005, gazetted on 25th January 2007, amended Number 81 of 2009 requires a Council to prepare an annual business plan, and a budget for each financial year. Council is required to prepare a draft of the plans and consult with the community according to the act. As at 10th June 2014 no written submissions were received for Draft V2 of the 2014/15 Annual Budget, LTFP and Annual Business Plan. Attached are summaries of the 2.5%, 3.5% and 5% rate modeling and budget reports for discussion and consideration. The resolutions contained within the agenda reflect the 3.5% model. PURPOSE: To provide Council with information that will assist them to formulate the 2014-15 Annual Budget, Annual Business Plan and ten year Long Term Financial Plan. BACKGROUND: The following information is provided; At the Council meeting of the 24th June 2014 Council considered the draft budget V3 and gave direction to Council staff regarding cost reduction strategies and alternative rate increase options.

Management Plan and keep the community informed. RECOMMENDATION: That pursuant to and in accordance with section 123 of the Local Government Act 1999 and regulation 6 of the Local Government (Financial Management) Regulations 2011, Council, having considered any and all submissions made during the public consultation period in accordance with Section 123(6) of the Local Government Act 1999, and having considered new or revised information in the possession of the Council since 15th April 2014, adopt the Annual Business Plan for the 2014/15 financial year EXECUTIVE SUMMARY: The Local Government Act (1999) requires the Council to prepare an annual business plan, and a budget for each financial year. Council is required to prepare a draft of the plans and consult with the community before adopting the annual business plan and then the budget.

PURPOSE: The Draft Annual Business Plan as adopted for public consultation by Council on 6th May 2014 was advertised for public consultation in the three newspapers generally circulating in the Goyder area on 14th May 2014, placed on the Councils website on 9th May 2014 with written representations sought by 10th June 2014. No written representations were received.

Council allocated time at the budget meeting of the 24th June 2014 between 1.00pm and 2.00pm to receive either written or verbal submissions on the draft Annual Business Plan. No written and/or verbal submissions were received.

The draft plan V2 as at 6th May 2014 distributed for Public Consultation has been amended to V3 to include amendments from the Council meetings of the 20th May and 24th June 2014.

EXECUTIVE SUMMARY: The Local Government Act (1999) requires the Council to prepare an annual business plan, and a budget for each financial year. Council is required to prepare a draft of the plans and consult with the community and must adopt the budget after adopting the annual business plan. PURPOSE: Following the Council meetings of the 15th April, 6th May, 20th May and 24th June 2014, the Audit Committee Meeting of the 22nd April 2014, the draft annual budget V1 has been adjusted and re submitted as V3 to make allowance for events occurring in April-June 2014.

RECOMMENDATION 1: That Council, in accordance with section 167(2)(a) of the Local Government Act 1999, adopts for rating purposes, for the financial year ending 30th June 2015, the most recent valuations of the Valuer-General of the Capital Value of land within the area of the Council, and specifies that the total of the values that are to apply within the area is $1,092,373,800 of which $1,067,001,451 is rateable. EXECUTIVE SUMMARY: The Local Government Act (1999) enables the Council to declare rates and service charges consistent with the annual business plan and budget for each financial year. Before doing so, the Council must first adopt valuations (in this instance capital valuations as prepared by the Valuer General) for rating purposes. PURPOSE: Adoption of Valuations

RECOMMENDATION 2: For Information PURPOSE: Rates Increase 2014-2015 & Differential General Rating

Total rate revenue increase forecast in the 2014/15 budget is an increase of 3.5% being $145,080

Three rating models are submitted (2.5%, 3.5% and 5%) with the 3.5% being the preferred option. The modelling report compares the effect of the revised 3.5% rate increase in relation to the 2012 rating review which targeted a general rate increase of 3.5%

RECOMMENDATION 3: That pursuant to section 153(3) of the Local Government Act 1999 Council determines not to fix a maximum increase in the general rate to be charged on any rateable land within its area that constitutes the principal place of residence of a principal ratepayer. PURPOSE: Maximum Rate Increase on Principal Place of Residence RECOMMENDATION 4:

That Council, having taken into account the general principles of rating in section 150 of the Local Government Act 1999 and the requirements of section 153(2) of the Local Government Act 1999, and pursuant to section 152(1)(c) of the Local Government Act 1999, declares that the general rate in respect of rateable land within the Council’s area for the year ending 30th June 2015 will be a rate consisting of two components:

(a) one being the value of the rateable land; and (b) the other being a fixed charge. Pursuant to sections 153(1)(b) and 156(1)(c) of the Local Government Act 1999, Council

determines that the following differential rates for the year ending 30 June 2014 be declared on rateable land within its area, based upon the capital value of the land and varying according to the locality of the land and its use:

(a) 0.2805 cents in the dollar for all rateable land within the area with a land use of Primary Production;

(b) 0.4592 cents in the dollar for rateable land located within the township of Burra with a land use of Residential, Commercial Shop, Commercial Office, Commercial, Light Industry, Industry, Vacant Land, or Other;

(c) 0.4332 cents in the dollar for rateable land located within the township of Eudunda with a land use of Residential, Commercial Shop, Commercial Office, Commercial, Light Industry, Industry, Vacant Land, or Other; and

(d) 0.3630 cents in the dollar for all other rateable land in the Council area. That Council, pursuant to section 152(1)(c)(ii), and in accordance with Section 152(2), of the Local Government Act 1999, impose a fixed charge of $311 against each separately valued piece of rateable land within the Council area for the year ending 30th June 2015.

Burra CWMS, an annual service charge of $527.00 per property unit on occupied rateable and non-rateable land.

(A ‘property unit’ is determined in accordance with the Code for Establishing and Applying Property Units as a factor for the imposition of Annual Service Charges for community wastewater Management Systems as published by the Local Government Association of South Australia on the 20th April 2006, adopted by Council in June 2006). RECOMMENDATION 2:

That Council impose a fee in respect of those persons requesting a Waste Collection Service for properties outside of the Townships of Terowie, Whyte Yarcowie, Hallett, Mt. Bryan, Burra, Robertstown, Point Pass, Eudunda, Farrell Flat and Booborowie at a rate of $175 per service for the year ended 30 June 2015.

PURPOSE:

Sundry Debtors – Rural Waste Management Collection

The State Government passed legislation under S155 of the Local Government Act 1999 on 10th May 2012 which imposes the obligation on Council to determine access points for properties serviced by the Waste Collection Service and the distance from the access point to the service provided. Council provides the weekly wet and fortnightly recycling service to all properties within the Council town boundaries and all properties are serviced within 500 metres of their access points.

In addition Council provides the service to rural properties along the designated route that apply for acceptance into the scheme. Council purchased a Waste Compactor in June 2010, employs an operator for the service and has taken out a CAD loan to fund the operation.

Council will post out a sundry debtor invoice for the full amount of the service in late July 2014 with a due date of 5th September 2014. If the sundry debtor invoice is unpaid as at 30th September 2014, the waste collection service to the designated drop off point will be suspended until paid in full.

The Natural Resources Management Act 2004 requires the Council to impose a levy, in the form of separate rates, in order to reimburse itself for the amounts contributed to the NRM Boards. PURPOSE:

PURPOSE: Rebate of General Rates Health Services, community services, religious purposes, public cemeteries, educational purposes and discretionary rebates RECOMMENDATION 4:

That Council adopt the 2014/2015 Valuer General site values for the purpose of calculating fees for annual rental of Council’s unmade roads and other land.

That, pursuant to Section 188 of the Local Government Act 1999, Council set a fee of 2.70 cents per dollar of the site value of land being rented.

Furthermore, the minimum amount payable for rental will be $20.00 per owner PURPOSE: Road Rents At the Council meeting of the 30th April 2013, Council decided to set a rate of 2.7 cents in the $ as the road rent rate for the 2013/14 financial year and let the movement in valuations determine the road rent in future budget years.

RECOMMENDATION 5: For information PURPOSE: Vehicle Reimbursement Pursuant to Regulation 5(2)(a)(ii) of the Local Government (Members Allowances and Benefits) Regulations 1999, the rates for reimbursement for motor vehicle costs incurred by a Council member are to be equal to the rate per kilometre prescribed for calculating deductions for car expenses for income tax purposes. The Australian Taxation Office is yet to announce the rates for the 2014-2015 financial year.

RECOMMENDATION: That pursuant to section 122 (1a) 9(a) and (b) of the Local Government Act 1999, Council, having considered submissions made to Council during the public consultation period, and having considered new or revised information in the possession of the Council since 15th April 2014, and having adopted the Annual Business Plan 2014/15 now adopts the Ten Year Long Term Financial Plan and the Asset & Infrastructure Management plan for the period 2014-2024. EXECUTIVE SUMMARY: Under Section 122 (1a) the Local Government Act 1999, A council must, in conjunction with the plans required under subsection (1), develop and adopt— (a) a long-term financial plan for a period of at least 10 years; and (b) an infrastructure and asset management plan, relating to the management and development of infrastructure and major assets by the council for a period of at least 10 years. PURPOSE: Council have incorporated the Annual Budget for 2014-15 into the Ten Year Long Term Financial Plan from 2014-2024 which incorporates the Asset Infrastructure Management Plan. The Ten Year Long Term Financial Plan and Asset and Infrastructure Management Plan (in conjunction with the Draft 2014/15 Annual Budget and Draft 2014/15 Annual Business Plan) as adopted for public consultation by Council on 6th May 2014, was advertised for public consultation in the three newspapers generally circulating in the Goyder area on 14th May 2014, placed on the Councils website on 9th May 2014 with written representations sought by 10th June 2014. No written representations were received. Council allocated time at the budget meeting of the 24th June 2014 between 1.00pm and 2.00pm to receive either written or verbal submissions on the draft Ten Year Long Term Financial Plan. No verbal representations were made at the Council Meeting during the allotted time. The draft plan V2 as at 6th May 2014 distributed for Public Consultation has been amended to V3 include amendments from the Council meeting of the 24th June 2014.

BACKGROUND: At the January 2014 Council meeting the following resolution was passed relating to the proposed Burra Country Music Festival 12/14 That Council supports the application by Country Music SA Inc. for funding from the SA Tourism

Commission or similar funding agencies towards the holding of a Country Music Festival in Burra and allocate $1000 from the Goyder Tourism budget to assist with their application for funding.

Attached is correspondence from Danny O’Brien , the president of Country Music SA (Inc) advising Council that they were unable to submit a grant application to SATC and wish to have the funds allocated as “seed funding” for the event.

That the request from the LGA for a Council contribution of $576 toward the RSL Virtual War Memorial Project be denied/approved.
