No accessions, additions, alteraUons or improvements to the Locomotive(s) of any nature shalf be made without Lessors consent Lessee shall keep the Locomotive( s) at all times, free and clear from all claims, liens, and encumbrances. E. Najmoprimac ce kormtiti Lokomotivu(e) samo u ·svrhu i na naein za kojf projekt1rana i namijenJena. Najmoprimac c~ se pridrza.vati svih drzavnih. opcinskih i lokalnih zakona, pravilnika, pravila, propisa i smjernica bHo kojeg drzavnog ill upravnog tijela koji se odnose na najam, posJedt osiguranje, qpotref)u f rad Lokomofiva(e).

F. NaJmoprimac je Jskljucivo odgovoran za isplatµ biio kakvlh i svih novcanih kazni, kazni iii odstetnih zahtjeva koji su nametnufi m koji proizlaze iz upotrebe, rada. odrzavanja ifi osiguranja Lokomotive(a) uslijed krsenja bilo kojeg zakona, pr~vUnika, pravjla m prop1sa t>Uo .kojeg drzavnog tijela.

G. Najmoprimac mora platiti sve troskove i naknade nastale u vezi ·s najmom, upotrebom i radom Lokomotive(a).

H. Najmodavac irna obvezu odrzavanja Lokomotive(a) i snosi sye troskove vezane uz odizavanje Lokornotive{a} u skladu sa PrHogom ,A".

1. OBJECT OF LEASE Object of the Lease are three Locomotives of the series G26 CW (HZ 2 062) as specffied under Section 2, which were customized for the use on the Railway infrastructure in Croatia.

Locomotives are designed exclucesvly for pull of freight trains, and using of locomotives for shunting is not recommended. Using of locomotives for Shunting rs acceptable only in smaller extent, two hours daily maxtmum, two days per week maximum. If Lessee's permanent need for use of locomothies as shunters rises up during exptoitcition, Lessor and Lessee will agree fair price for that type of use of locomotives. U slucaju dq se stopa dostupnosti ne postigne. NaJmoprlmac nema obvezu placanja naknade za naj~m u dantma nedostupnosfi koji prelaze ugovorenu stopu.

Payment date is ten days since the date of delivery of invoice. For late payment Lessee is obliged to pay int~rest for the deiay period of 8 % per year.

8. DOZVOLA ZA UPOTREBU NA ZELJEZNJCKOJ INFRASTRUKTURt DRUSTVA HZ INFRASTRUKTURA, DOKUMENTI

Najmbdavac je ti'uzan izd~tf dozvofe za koristenje fokomotiva na podrucju Hrvatske, ukljucujuci i za koristenje na zeqezniekoj infrastrukturi drustva HZ fNFRASTRUKTURA i pruzanje svih potrebnih dokumenata za predmetne dozvole. Najmodavac je duzan opremlti lok.omotive svim potrebnim sigumosnlm uredajima sukladno vazecim standardima i propisima za upotrebu u Republici Hrvatskoj. Troskovr tih procesa ukljuceni su u mje.secnu naknadu za najamj a daljnji se troskovi ne mogu potrazivati od Najmoprimca.
