Jefferson Township Board of Trustees Regular Meeting Minutes

The Jefferson Township Trustees met in Regular Session on August 2, 2016 at 7:00 p.m. at the Administration Building, One Business Park Drive, Dayton, Ohio.

Trustee Mann called the meeting to order and led the Pledge Allegiance to the Flag.

Fiscal Officer Tracey Edwards did the roll call: Roy Mann — Present

Mary Johnson — Present James McGuire —Present

Administrator Len Roberts and Fiscal Officer Tracey Edwards were also present.

Approval of Minutes Trustee Johnson moved to approve the July 5, 2016 regular meeting minutes and the July 1, 2016 work session meeting minutes. Trustee McGuire seconded the motion.

Fiscal Officer Report — Tracey Edwards Ms. Edwards provided financial reports for month of July. Any questions contact her. She stated that the State auditors are in the office this week. Trustee Johnson moved to accept the Fiscal Office Report, Trustee McGuire seconded the motion.

New Business: Recognition of Summer Youth Employees - Shirley Sibert Ms. Sibert, Administrative Assistant introduced Bryanna Sibert (volunteer), and Norridin Ingram (absent) who is a student with the Montgomery County Youth Works Program

Bryanna asked if she could volunteer in the office for the summer. She does not have prior work experience and wanted to gain some skills through volunteering. She was recognized with a Certification of Recognition from the Jefferson Township Board of Trustees for staying committed and successfully completing 100 hours of community volunteer service working as an office aide from June 6, 2016 —August 5, 2016.

Bryanna thanked the Township for the opportunity to volunteer in the office and she hopes that this will let others see that volunteering is good for the community. She says she has gained skills that will help her in the future.

Norridin Ingram was not in attendance but he will also receive a Certificate of Recognition working as an office aide from June 13 — August 5, 2016.

Recognition of Jefferson Township High School Students Dr. Richard Gates, Superintendent of Jefferson Township Schools & Ms. Shannon Lewis, District Counselor recognized students who completed their associates' degree at Sinclair Community College

Dr. Richard Gates stated that 8 years ago the Jefferson Township school system fully embraced the whole concept of college and a career. They wanted to make sure their students were prepared when

they graduated from high school for college and a career. He has students that were not only ready for college when they left high school, they finished their Associate Degree during high school.

He stated he has many conversations with Trustee Johnson and one of these things they talked about was having the opportunity to recognize the students within the general public. These students have embraced a rigorous curriculum with enthusiasm and passion. They have set the bar so high that 7th and 8th graders are taking college classes. It is one thing to have to do it, and another thing to want to do it.

Dr. Gates expressed he is so blessed and pleased to the parents and families that made sure their young people understood the challenges and made sure that they embraced it. He stated that the district counseling is a blessing and says: "students don't care how much you know, until they know how much you care."

Dr. Gates said that Ms. Lewis has understood the fact that when the students leave high school they are prepared to compete in this world so they have a better chance. He says this program started with only three students.

Shannon Lewis, the district counselor talked about the college prep program stating that when she first started working with the program in 2011-2012 it was dual credit, which meant, they hand-picked students as to who they wanted to be in the program. The program was very successful but the more they looked at it, they saw that it was a great way to prepare students for college. They eventually wanted to get more students involved in the program.

Ms. Lewis says the program changed to college credit, and in 2013 they thought the students might actually be able to get a degree.

The next year in 2014 two students graduated with an associate degree a week before they received their high school diploma.

Ms. Lewis said after 2014 they started thinking college may not be for everybody, what if they add careers into the program. That is when the Industry Credential Certification came into the program. Classes where expanded to allow students to take courses that would allow them to get an industry certification. In 2015, three students graduated with an industry certification.

Ms. Lewis says the following year as they grew and learned a little bit more, the students who graduated in 2014 got a degree in Liberal Arts.

This year in 2016 there are four students who have an associate degree (one student received an associate degree in psychology and want to become a psychologist, two students graduated with associates degree in Communications, and another student received Associate of Science degree)

Dr. Gates added that this is their signature program. It has put them on the map. He said that this year in the Miami Valley, twelve students received associates degrees as well as a high school diploma. Out of those twelve, four were from the Jefferson Township community. Next year a young lady who is an 1 1 th grader will finish up with an associate degree.

Ms. Lewis honored and presented Plaques and Proclamations from the Jefferson Township School Board to the following graduates:

Victoria Flowers received her STNA certification while she interned at MVH and is currently in the nursing program at Wright State University). Joshua Napier (certification in Business and Operations Support and interned at Sinclair IT department)- he is in the

process of racking up a third semester at Miami University. Moriah Moreland (certification in STNA and interned at MVH). She is attending Bowling Green State University,

majoring in Psychology, and she is in the Air Force Military Reserves.

2016 Graduates — Associate Degrees: Jayvonna Armstrong, Leilani Judkins, Mackensie Ragland, and Joseph Walters.

Trustee Mann also presented Jayvonna Armstrong, Leilani Judkins, Mackensie Ragland, and Joseph Walters

with a signed Certificate of Recognition from the Jefferson Township Board of Trustees for their successes.

Two of the 2016 graduates will be attending Bowling Green State University, two will be attending Wright State

University. A group photo was taken of all the students with the Jefferson Township Board of Trustees.

School Board member, Emmett Orr, remarked that there has been a real culture change within the population. There

are students that are serious about making a difference in their own life and their families and the community. He

thanked Dr. Gates and Ms. Lewis.

County Engineer — Road Work Paul Gruner, the Montgomery County Engineer gave an overview regarding funds for road work.

Mr. Gruner said that locally, statewide and national there has not been any increases in funds in the last

20 years. He says the county have to compete for federal funds. His budget come from State, gas tax and

license increase. The last license increase was in 1989, early 2000's a 6 cent state gas tax increase.

The gas tax is distributed equally among 88 counties.

He relies more on the license fees because it's based on where a person lives. The county is trying to do

something about this with the legislature. There has been no success at the federal level to get a gas

increase.

He says his office has been promoting an idea of an increase of permissive license fee. The legislature

does not have to increase license fees, they just have to give counties, cities and townships permission to

increase the license fees. He said the county is proposing in addition to the existing license fees, an

additional $5 to county, another $5 split between city and county for township residents, another $5 put

on by the city for the township. The township could put on $5 of their own and that would all go to the

township.

The county is not starting any new road improvements, just paving about 25%. There are 520 bridges,

that is where the money is going. He says they watch the bridges carefully.

Mr. Roberts has handouts that Paul passed out if anyone need a copy.

DEPARTMENT REPORTS (detailed department reports at www.jeffersontwp.org)

Administrator - Len Roberts Mr. Roberts gave an update on the Rauch case. The Supreme Court refused to hear the case and sent the case back to Judge Wiseman initial order. The township reads Judge Wiseman opinion as permitting conditions to be added to that conditional permit.

He says that in the last week-and a-half Mr. Rauch has been pushing the township to issue a permit without conditions. Mr. Rauch filed a motion in court earlier this week to hold Mr. Roberts and Mr. Payne in contempt of court for not issuing a permit. Mr. Roberts says the Board of Zoning Appeals (BZA) are the only ones who have authority to issue a permit. The BZA will meet on the August 18th. Mr. Roberts and Mr. Payne have reviewed a series of conditions with the BZA that they think are consistent with the record, and consistent with Judge Wiseman opinion. The BZA intend to issue those conditions as part of the permitting process.

Mr. Roberts says he rewrote the zoning code. About a month ago the Zoning Commission forwarded the zoning code rewrite to the county for their review. The township is still waiting on the county for their review before final action can be taken. Mr. Roberts stated he has had some discussion with the county and there is a whole section he needs to rewrite as it relates to the signs, some of it is based on new court decisions. He expects to rewrite that section in the next couple of days. It will then go back to the township zoning commission for their final approval then go to the Board of Trustees for their final approval. Once the township approves it, Mr. Roberts and Mr. Payne will start working on taking the zoning districts and applying it to the map to create a zoning map to move forward. That deals with individual properties and what the zoning of that individual property will be. That will be started once the zoning commission approves it. So in the next two months at the latest they could forward to the Trustees a combination of the zoning text approval and the zoning map. That will complete the rewrite of the zoning code.

Mr. Roberts said that during the last election residents approved moving forward on an energy aggregation program. Paperwork was submitted to PUCO. Last week PUCO certified the township as an energy aggregation, and consultants are gathering data, and will prepare a RFP to go out for bids within the next month.

Mr. Roberts informed Mr. Green that the order for parking lot lights have been put in. DPL says it will take about four weeks to get the lights in.

Mr. Roberts says he is rewriting a document on property maintenance codes. He hopes to have a draft in the next month or so. Will probably discuss with the Trustees at the September Work Session.

Montgomery County Sheriff Department — Captain Brem Citizens Academy fliers in back on table. The classes start September 13 — November 14 for about three weeks.

Crime Report — total crime in the township is down 4% compared to this time in 2015. June 2016 compared to May 2016 total reported crime is up 44%.

Captain Brem reminds everyone to contact the Sherriff office when you go on vacation so they can go by and check your property.

There are two drug drop off points one located downtown in front of jail, the other at 555 Infirmary Road —the drop box is in the lobby.

Zoning Department — Jeff Payne • During the past month 1 boarding appeal case — Re-plat. • Comprehensive Plan has been forwarded to Montgomery County and should be available in next

couple days on Montgomery County Planning Commission website. • Two zoning certificates issued — rezoning restaurant on W Third, and the other the re-plat. • Have received a number of calls about properties needing demolitions. • Nuisances — 27 properties in past month was cut. Doing 1st cuts but due to budget not able to do

recurring cuts. • Will be doing more declarations this month. • Trailer in 6300 block Germantown — owner went through BZA process, BZA turned it down, his 30

days to appeal has expired. A cease and desist notice will be issued to remove trailer or township will remove it.

Mr. Roberts added they have a little success with getting property owners to take care of property, for example the Chappy James property is being cut by the people who plan to purchase it. Similarly, on Liberty-Ellerton Road a gentleman is trying to acquire the property through Landbank so he is keeping it cut.

Road Department — Craig Howell Maintained and cut throughout township including cemeteries. Installed signs, patching spots on several roads. Cleaned alleyway, provided maintenance on equipment. Swept streets on one side of Derby. Weed eating done along roads.

Fire Department — Chief Larry Sexton 132 emergency responses. Completed driver recertification class; hose testing completed; preparing for the ladder testing next month;

Community Paramedic — Tammi Whalen Tammi says the CDS Grant program that gave money to fund the Community Paramedic Program ended June 30. 819 runs of Jefferson township residents to hospitals Jul 1 2015-Jun 30-2016. About 39% were admitted to hospital. 2 out of 3 could have gone to urgent care. Activities are continuing at Station 59.

She says they are on track to exceed the number of transport from last year.

Home visits and office visits were down in the month of July. One of the nurses retired at Reach Out so they are looking for a replacement.

Still doing home inspections, fire safety inspections, pressure checks, and medications.

Still working on Dayton Foundation Grant. Will be getting new chairs delivered tomorrow. Looking at purchasing an audio visual projection system. Looking at a new sink for the kitchen. Thanks for the new cabinet. Working on some plumbing issues.

A township resident is donating a stove.

Has received the Grant package from Commission of Minority Health.

Surveys for transportation from RTA, she wants to put bus stops in some areas.

She provided a calendar of August events which includes (1) a new class on Insurance — open enrollment, and (2) class on how to talk to your doctor, Thursday August 18 5:30pm-7:00pm

Trustee Comments Trustee Johnson reminds everyone to come out to Community Days at Fisher Park, August 6th starting at 12 noon. Newsletter updates are on table in back.

Trustee McGuire encouraged everyone to come out to Community Days also. He says he cooks a mean burger, Trustee Mann will be assisting him.

Trustee McGuire said that couple of weeks back he came in the office and a resident Mr. Taylor came in and wanted some recognition for his friend Henry Wilson. Mr. Taylor has been in the township since 1956, planted trees in his yard, and he is a wood worker. He is 88 years old and he is still cutting his grass.

Trustee McGuire sat in on classroom evaluation with Fire Department.

Trustee McGuire has been going through a lot of the zoning cases, and monitoring the Point getting cleaned up. He is asking for code enforcement and trash pickup along Third Street. He has met with Ms. Shackleford about a burned out house next to her, he emailed to Mr. Payne.

Trustee Mann, thanked the Police Department for putting blue ribbons on poles. He would like citizens to tie some on post also starting on August 6. Do not have to meet, just pick a spot and put a ribbon there.

Trustee Mann has asked Mr. Dozier to add a link to the site regarding mosquitos (Zika Virus).

Trustee Johnson asked Captain Brem to convey to Sherriff Department their appreciation for how they handled the incident on July 13.
