Page 2: Rebuttal 11 01-14 with notes

The following slides represent a composite of Jane Smith of Bright Futures Rescue’s animals in happier times, at the time of seizure and their condition upon arrival at The Wayne County Humane Society (WCHS). None of this was allowed as testimony at her trial!

Jane was charged with 47 counts of animal cruelty on her dogs. No mention was made of the 2 cats, 7 birds, 1 rabbit and 1 gecko, however, she was charged $300/month for each of the above and they have not been returned to her, as required by Ohio Revised Code 959.132 (G).

The prosecution has also made the statement that they do not want Jane Smith to ever have animals again!

Please look at the slides presented, and make your own decision on whether or not these animals were victims of cruelty. If you agree that this was a total travesty of justice based on an illegal entry violating her Fourth Amendment rights, please make your feelings known to the Ohio Supreme Court, the Ohio Attorney General’s Office and John Kasich, Governor of Ohio!

Thank you for looking at our presentation.

And so patiently they sat . . .

. . . waiting on transport

Transport ready . . .

. . . and loading begins!

Observe spaces between kennels.

Stacked 3 kennels high in a closed van – how many deep?

. . . finally, ready to go . . .

. . . a journey of 13+ miles with only bungee cords keeping them safe!

Page 6: Rebuttal 11 01-14 with notes

Living quarter of Jane Smith’s animals now at WCHS – behind closed,

locked doors – only favored kennel workers and volunteers allowed

in to see them!

At WCHS after seizureTammi ID JS01

During seizure at Jane Smith’s 05/1914 Tammi arrived at Jane’s so

afraid that she crawled. With loving care from

Jane, she was able to trust humans again. Now she is back in the same situation Jane pulled her from . . .

what is her condition now?

Page 8: Rebuttal 11 01-14 with notes

Sheba ID JS02 During seizure at Jane Smith’s 05/1914

SHEBA . . . Jane’s personal dog . . . when she arrived at Jane’s rescue, she had been so abused that she would not

walk. Jane carried her in and out. At the time of the seizure she was the one that greeted all the new dogs, comforted them, taught them the rules. She was never crated. How can the WCHS possibly feel that living in a

kennel 24/7 for 6+ months can be a better life?

Tulip (Maria) ID JS08During seizure at Jane Smith’s 05/1914

A terrified little dog – the person holding her is not trying to make it better. These people did not care

about the animals.

Tulip was one of the 3 dogs that WCHS said was heartworm positive and wanted to kill

because she was suffering. Later tests proved she was heartworm negative. She

would now be dead if Jane’s attorney had not filed an appeal to stop the killing.

After 13 mile trip to WCHS

WCHS said he needed grooming. What they did not know or ask was that he had an ulcerated eye when he came in to rescue. Jane felt saving his eye was more important that grooming. What do you think?

Scout on 05/19/14 ID JS29

At WCHS after 13 mile trip

Scout tested positive for heartworm and was treated on 04/17/14. He was one of the 3 dogs that WCHS said was heartworm positive and wanted to kill because he was suffering. Anyone involved in animal rescue should know that a dog treated for heartworm can test positive for up to 6 months after treatment. Later tests proved he was heartworm negative. He, also, would now be dead if Jane’s attorney had not filed an appeal to stop the killing.

People involved in the seizure threatened to arrest Jane Smith if she talked to, gave water to, or tried to clean cages. This is the way Bopper was transported to WCHS,

after sitting 5 hours in the sun. Bopper also had a new home waiting on him!

THIS A CARING/COMPASSIONATE BUNCH OF PEOPLE? He was

extremely scared when he arrived . . . what is he like now?

Piper & Pixie belong to Jane’s daughters. They have been

unable to get them back. Again, not dirty, no feces, good body

weight. Why were they seized?

Pixie was also one of the 3 dogs that WCHS said was heartworm

positive and wanted to kill because she was suffering. Later tests proved she was heartworm

negative. She would now be dead if Jane’s attorney had not

filed an appeal to stop the killing.

After 13 mile trip to WCHS

At WCHS after seizure

Jasper had been returned 4 days prior to the seizure in the condition seen on the left. If covered in feces, why would he be carried instead of walked on a leash? He also had an eye infection & medication was sent with him. It does not look like they used it, but accuse Jane of cruelty!

Jane has been charged $300/month for the care of the rabbit and the gecko. This is

extortion on the part of WCHS. It DOES NOT COST $300/month

TO FEED A RABBIT OR GECKO!

No bedding was provided for the rabbit when seized. We do not know whether or not he was injured in transport

because of this.

Page 60: Rebuttal 11 01-14 with notes

Jane has also been charged $300/month for the care of the birds. Again, this is extortion on the part of WCHS. It DOES

NOT COST $300/month TO FEED A BIRD!

Page 61: Rebuttal 11 01-14 with notes

Mac, above, was put in a dog crate with no perch

for transport. No way for a parrot to travel.

Parrots will go insane if not given enough attention. They are also very difficult to rehome

because of their special needs – what kind of interaction are they getting in the garage?

Page 62: Rebuttal 11 01-14 with notes

Protective foot wear left behind – according to the person above, her statement said that the floor was covered in feces and she stuck to the floor when walking. These were worn inside and outside of the home during the seizure (see picture above). There is no

evidence of what this person stated in her report. PERJURY?
