MLS® New Policy: Broker loading cancellations and suspensions

ffective Tuesday, July 15, Brokers, Managers and members/users with broker load privileges may broker load listing cancellations and suspensions.

All rules regarding cancellations and suspensions remain the same – the cancel-lation/suspension form must be signed and dated by the seller, signed by the Broker of Record/Manager and be in hand prior to processing the cancellation.

Brokers of Record may set their own office policies as to whether they will allow mem-ber/users with broker load privileges in their office to process their own cancellations and suspensions. RAHB will not monitor who in an office may or may not broker load cancellations and suspensions – it is up to the Broker of Record/Manager to enforce the policy they set for their office.

Broker loaded cancellations and suspen-sions will be audited by the MLS® depart-ment. Fines will be assessed if members are found to be processing these changes without the appropriate forms being prop-erly completed prior to processing.

The Board of Directors recently approved the following new policy for broker loading cancellations and suspensions:

NEW - Miscellaneous#24 UPON CHECKING 1 IN 5 CANCELLATIONS AND SUSPENSIONS, IF ANY AUDITED CANCELLATION OR SUSPENSION OF LISTING AGREEMENT IS FOUND TO BE IN CONTRAVENTION OF THE RAHB’S RULES AND REGULATIONS, SECTION 3, AND IS MISSING THE SELLER’S SIGNATURE AND DATE OF SIGNING OR MISSING THE LISTING BROKER OF RECORD’S SIGNATURE(S), THE LISTING WILL BE REACTIVATED AND A FINE WILL BE ASSESSED AS OUTLINED IN MLS® POLICY #23, AS FOLLOWS: $250 FOR FIRST OFFENSE, $500 FOR SECOND OFFENSE, $750 FOR THIRD OR SUBSEQUENT OFFENCES. FOLLOWING THE THIRD OFFENSE THE MEMBER’S BROKER LOAD PRIVILEGES MAY BE REVIEWED.

Currently all broker loaded listings are subject to an audit of every one in 10 listings. For cancellations and suspensions, one in five listings will be audited.

he 2006 census indicated that Milton was the fastest growing municipality in the Greater Golden Horseshoe, with a 71.4% increase in population be-tween 2001 and 2006. In early 2012, the town’s planner estimated Milton’s population to be between 94,000 and 95,000 and growing.

With this rapid growth, it was recommended that we divide the Milton area into sub areas, and create a Halton Hills, Acton and Georgetown sub area with three separate neighbourhood codes. This breakdown will allow members to do more specific searches in these areas. Please update any prospecting searches you already have saved using the previous Milton sub area 87, neighbourhood 087 with the new codes.

Transaction Desk by Instanet. This is a cloud-based document and transaction management solution and includes unlimited online document storage integrated with the member’s WEBForms® account. Faltour Electronic Document Management (EDM) is a web-based real estate transaction and document management solution designed to simplify real estate related tasks. Files and documents are stored and archived in a secure and unlimited Canadian storage facility. These services are under $40 per year each. More information is available in WEBForms®.

The situation from last month: Sophie Salesperson was the target of verbal abuse and disparaging comments at her public open house. The abuser was Mary, a new salesperson from another Brokerage. Was there anything Sophie could do about Mary?

here are actually a number of ways Sophie could proceed. First, she can try to work things out with Mary and come to some agree-ment about how they can deal with each other in the future. If that doesn’t work, she should speak with her Broker and see if there’s something her Broker could do with Mary’s Broker to resolve the issue.

Sophie could also lodge a complaint about Mary with RECO, citing her behaviour as a possible breach of the REBBA 2002 Code of Ethics:

Fairness, honesty, etc. 3. A registrant shall treat every person the registrant deals with in the course of a trade in real estate fairly, honestly and with integrity.

There is a corresponding Article in CREA’s REALTOR® Code – Article 19: Discrediting another Registrant – which is more descriptive about a REALTOR®’s obligation to treat other real estate professionals with courtesy:

Article 19: Discrediting another Registrant The REALTOR® shall never publicly discredit any other Registrant. If the REALTOR®’s opinion is sought, it should be rendered with strict professional integrity and courtesy.

19.1 The REALTOR® should not comment in a derogatory manner as to the capacity, integrity, and competence of any other Registrant.

19.2 Where any REALTOR® is asked to comment on a specific transaction or the business practices of another Registrant, such comments should be given with strict professional integrity, objectivity and courtesy.

Just because RECO would handle Sophie’s complaint doesn’t mean that Mary doesn’t have to abide by CREA’s REALTOR® Code as well.

Mary is a new salesperson and has a lot to learn about how to work with other REALTORS®.

T he Cit y of Hamilton

● Hamilton is located in the centre of the Golden Horseshoe and is roughly the midway point between Toronto and Buffalo, New York. Its major physical features are Hamilton Harbour, which marks the northern limit of the city, and the Niagara Escarpment, which runs through the middle of the city, bisecting the city into ‘upper’ and ‘lower’.

● Hamilton Harbour was discovered by explorer Robert Cavelier De La Salle in 1669. The First Nations peoples who lived in villages around the harbour named it Macassa Bay, meaning “beautiful water”. ● The town of Hamilton was founded in 1816 and named after George Hamilton, a settler. ● A permanent jail was constructed in 1832; the first police board and town limits were defined in 1833 ● Dundurn castle, built by Sir Allan Napier McNab, was completed in 1835. McNab helped establish the first bank and the railway in Hamilton. ● Hamilton became a city in 1846. ● The Ferguson Station, built in 1875, was the Hamilton terminal for the Grand Trunk Railway Company and the principle passenger station for downtown Hamilton. At one time, Ferguson Street formed the eastern boundary of Hamilton. ● By 1878, Hamilton was home to the first commercial telephone service in Canada, the first telephone exchange in the British Empire and the second telephone exchange in North America.● The Around the Bay Road Race was begun in 1894, making it the oldest road race in North America.● Hamilton’s population doubled between 1900 and 1914, when Stelco and Dofasco were established and Proctor and Gamble built a manufacturing plant in Hamilton – P&G’s first plant outside the U.S. ● In 1921, the Pantages Theatre opened on King Street with a seating capacity of 3,500. It was the largest theatre in Canada at that time.● The Piggott Building, Hamilton’s first skyscraper, was built in 1929.● McMaster University moved from Toronto to its present site in Hamilton in 1930.● Ivor Wynne Stadium, originally known as ‘Civic Stadium,’ was constructed in 1930 for the British Empire Games. ● The first Tim Hortons opened on Ottawa Street in 1964.● On January 1, 2001 the new city of Hamilton was formed from the amalgamation of the Regional Municipality of Hamilton-Wentworth and its six municipalities: Hamilton, Ancaster, Dundas, Flamborough, Glanbrook and Stoney Creek.

Lockboxes are an important tool to your industry - practice the following measures at all times:

NEVER use the pre-set factory combination that is standard with the dial lockboxes (which are sold across North America with this code). The Realty Shoppe staff are happy to help you change the combination.

When leaving a location where you have used the lockbox, ensure the lockbox is locked again: spin the dial of the dial lockbox once it is shut, and re-key the number combination on the pushbutton style in order to close.

Never give out a combination to someone who you are not certain is a salesperson, particularly based on a request made via cell phone. If you are uncertain about the caller, call the salesperson back at the listing office for confirmation.

Members are reminded of RAHB’s Rules and Regulations Section 2 – MLS® Listings, Sub-section 2.17

Members shall ensure that lock boxes installed on each of their listings are set with a unique code for the security of their Seller’s property. Further, members shall change the lock box combinations, as required during the course of the listing to maintain reasonable security, and not use any preset manufacturer’s code.

Effective June 1, 2009 a member found to be in breach of the above, shall have a fine of $50 levied for the first offence, and for a second offence $200 will be levied.
