Dear Fellow Conservative,
The American Conservative Union Foundation is proud to present our ratings of the 2018 meeting of the Arkansas General Assembly. Like our Ratings of Congress, which date back 47 years, our state ratings are meant to reflect how elected officials view the role of government in an individual’s life. We begin with our philosophy i.e., conservatism is the political philosophy that sovereignty resides in the person, and then apply our understanding of government (its essential role is to defend Life, Liberty and Property).
Because our ratings are designed to educate the public about how consistently elected officials adhere to conservatism, we carefully examine the entire docket of legislation introduced in each state every year. We select the most meaningful bills and publish the results after the dust has settled. ACUF state ratings—launched in 2011 with ratings for five states—have become a nationally recognized resource for evaluating over 8,000 elected officials comprising each of America’s 99 state legislative chambers.
Each election cycle, citizens choose leaders whose vision for the state most closely matches their own, hoping that candidates’ promises will be kept. ACUF’s ratings measure whether those promises were fulfilled or forsaken. With nearly a decade of data on state legislators’ voting records and average scores for every legislative chamber, citizens in every state can assess how effectively their lawmakers have applied conservative philosophy to the role of government.
We at ACUF believe, as Ronald Reagan once said, that freedom is never more than one generation away from extinction. We hope that by providing this unique tool, these ratings will empower Americans to exercise their right to protect our unique American democracy from tyranny.

SELECTING THE VOTES
ACU researched and selected a range of bills before the Arkansas General Assembly that determine a member’s adherence to conservative principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of Arkansas’s elected leaders best defend the principles of a free society: Life, Liberty and Property.

1. SB 30 Extending Funding for Medicaid Expansion. This bill provides an appropriation to Arkansas Works, the state’s version of Medicaid expansion under Obamacare. While the program has slightly improved by requiring work for some recipients between ages 19 and 49, the bill is projected to cost taxpayers over $2 billion for fiscal year 2019. ACU has long opposed Medicaid expansion under Obamacare, a program rife with waste, fraud, and abuse and opposed this bill. The Senate passed the bill on March 6, 2018 by a vote of 27-2.
2. SB 3 (Special Session) Expanding School Choice. This bill allows more students to attend the school of their choice by permitting siblings to transfer to a different school even if the transfer results in a school district exceeding its 3 percent limit of transferring students. Educational attainment provides substantial economic returns for families and for states, which is illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports efforts to expand school choice and supported this bill. The Senate passed the bill on March 14, 2018 by a vote of 31-1.
3. SB 5 (Special Session) Protecting the Right to Contract by Waiving Jury Trials. This bill permits borrowers and lenders alike to contractually agree to waive their rights to a jury trial to settle disputes. ACU supports efforts to reduce expensive litigation which burdens the court system and efforts that allow individuals to freely contract and supported this bill. The Senate passed the bill on March 14, 2018 by a vote of 27-2.
4. SB 8 (Special Session) Protecting Property Rights by Limiting Legal Action against Farms. This bill is designed to protect farms that need permits to retain and dispose of liquid animal waste from lawsuits or complaints by preventing third parties (such as advocacy groups) from taking any action against a farm once the comment period on the permit has expired. The ACU Foundation Center for 21st Century Property Rights is a leading voice on this issue and works to ensure all land owners are protected against undue government regulatory aggression. ACU supports efforts to protect property owners and reduce frivolous lawsuits and supported this bill. The Senate passed the bill on March 14, 2018 by a vote of 21-7.
5. HB 1008 (Special Session) Expanding 529 Tuition Savings Plans to K-12 Education. This bill helps expand school choice by allowing parents to use funds invested under the state’s tax-deferred tuition savings program or other 529 college savings accounts to help pay for their child’s K-12 education. This bill is in response to federal legislation sponsored by Sen. Ted Cruz (ACUF 99% Lifetime). Educational attainment provides substantial economic returns for families and for states, which is illustrated by the ACU Foundation’s Family Prosperity Index. The Senate passed the bill on March 15, 2018 by a vote of 22-5.
6. SB 1 (Special Session) Permitting the Limited Use of All-Terrain Vehicles on Public Roadways. This bill eases the regulations governing the usage of All-Terrain Vehicles (ATVs) on public streets or highways by permitting a driver of an ATV to use a public road to get from one off-road trail to another or to return to their property. ACU supports common sense regulatory reforms that expand individual freedoms and supported this bill. The Senate passed the bill on March 15, 2018 by a vote of 29-2.
