As applicable for property, if there is an existing electric or water sub-meter intheTenant’sspace,thentheTenantmusthavethemeterrecommissionedtoensureproperinstallationandfunctionality.Alternatively,theTenantcanchoosetoinstallanewmeterthatmeetsMacerich’smeterspecifications.EitheroptionmustbeperformedbyaLandlord-approvedelectricianandverifiedbyMacerich,andwillbeattheTenant’ssolecost.

METER SPECSTenantmayinstallthemeterspecifiedbyMacerichorthelike.Metermustmeet the following criteria: Electric:• Metersmustberevenuegrade.• Theremustbeatleasta6-digitdisplay.• Metermustbeabletoreaddemand(kW)andusage(kWh).• The meter must capture the electric usage of the entire Tenant space,

includingHVACunits.Ifthisisnotpossible,thenitmustbenoted.• IfusingameterwithCTs,noteifamultiplierisrequiredandwhatthe

multiplierisonthefaceofthemeter.

Water:• Metermustbeproperlysizedforthewaterflowinthespace.Generally

thismeansthesizeofthemetershouldmatchthesizeofthewaterline,orthemetercanbe1/4”smallerthantheline.Thismeansthatifthereisa1”waterlineservicingthespace,aproperlysizedmeterwouldbe3/4”or1”.

Installation Requirements:• MetersmustbeinstalledbyaLandlordapprovedelectrician.• InstallationmustbeverifiedandapprovedbytheOperationsManager,

oramemberoftheOperationsstaff,attheproperty.• Proof of inspection must be sent to the Energy Management Depart-

ment(AlaineMarx,[email protected])andshouldincludethefollowing:- Date of installation or recommissioning- Pictureofthemeterattimeofinstallationorrecommissioning. PictureshouldbeclearandshoulddisplaykWhandkWlegibly.-Confirmationthatthemetercoverswholetenantspace.- Metermakeandmodel- Unitsthatthemeterreadsin- Multiplier, if applicable

New York City Energy Efficiency Code Requirements

Electrical Sub-Metering

Tenants5000grosssquarefeetandabovearerequiredtoprovideandinstall Electrical Sub-Meters, per New York City Council File Number Int 1160-2016.ElectricalPlansshowingmeterlocationandinstallationshallbesubmittedandapprovedpriortotenantbuild-out.TenantisrequiredtocoordinatewithlocalutilityandOwnershipforanyshutdownsasaresultofmeterinstallation.OwnershipreservestherighttobackchargeinstallationfeestoTenantfoundnottohaverequiredsub-meter.

LightingEfficiency

TenantsarerequiredtoupgradetheirlightingsystemtomeetorexceedNewYorkCityEnergyConservationcodeinaccordancewithNewYorkCityCouncilFireNumberInt1165-2016.LightingdesignsshallbesubmittedandapprovedbyOwnershipandlocalauthoritypriortotenantbuild-out.OwnershipreservetherighttobackchargeinstallationfeestoTenantfoundnottobeincompliancewithNewYorkCityEnergyConservationcode.

General Design/Construction CoordinationTheelectrical criteria isprovided for thepurposeofdesigning theTenant’selectricalsystem.ThiscriteriaisprovidedasaguidelineforTenant’sEngineer. It is theTenant’s responsibility to verify existing conditions andcomplywithallapplicablecodesandstandards.

1. Conduit and raceway hangers, clamps, light fixtures, junction boxes,supports,etc.mustbe fastenedto joistsand/orbeams. Donotattachdirectlytotheslab,roofdeck,ductwork,pipingorconduitabove.

2. Tenant’sequipment in theMallelectric roommustbeclearly identifiedwithTenant’snameandspacenumber.

3. Provideaccesspanelsatalljunctionboxlocationsandatsmokedetectorsabovetheceiling.

4. All outlet boxes, floor boxes, wire raceways, power/telephone poles,plug-inmolding,wiringdevices,hangersupportsandotheritemsrequiredforacompletedistributionmustbefurnishedandinstalledbyTenant.

5. Furnishandinstallpowertowaterheater,storefixtures,signage,musicsystems and any other fixtures or equipment provided byTenant. AllcuttingandpatchingmustbeprovidedbyTenant.

CompleteEngineereddrawingsmustbesubmittedtotheLandlord’sTenantCoordinator for review and approval. Landlord will review the plans forconformancetobasicMallrequirements.TheLandlorddoesnotreviewforelectricaldesign,nordoestheLandlordacceptresponsibilityfortheTenant’sadherencetogoverningcodes.

The documents to be submitted for Landlord approval must include the following:1. Complete plans and specifications for all electrical work, including

lighting,powerandonelineriserdiagram.Documentsmustbesignedand sealed by a Licensed Engineer in the state where the ShoppingCenterislocated.

2. Drawings must include panel schedules, load calculations and meterinformation.

3. Structural drawings must be submitted for all equipment that will besuspendedfromthesteelstructure.

Power SourceAll work required to connect Tenant to the main power source must beperformed by Landlord’s designated electrician, at Tenant’s expense.ExceptionstothisrequirementmaybegrantedbytheTenantCoordinator.

ServicesizeandfeedersvarywithrespecttothesizeofthedemisedLeasedPremises.

Electrical service shall be 460/265 volts or 208/120 volts, 3 phase, 4 wire, at theLandlord’sdiscretion.TheTenantshallprovideanovercurrentprotectivedevice inLandlord’sswitchboard,andanelectricmeter(CutlerHammerIQ200,CatalogNumberIQ220,withabasemeteringmodule,displaymodule,and 14” of Cat 5 cable at time of installation). Tenant shall also provideappropriate Cutler Hammer solid coremetering class C/T’s sized for theirdesignedservice.ThereshallbenometerorC/Tsubstitutions.

TheLandlordhasinstalledadatatransmissionsystemwithinthecenter,withconnectionnodeslocatedthroughout.ThissystemallowstheTenanttoimportand export data from the leased premises, includingmusic, sales reports,stockinventory,etc.LocationsofthenodepointsareavailablefromCenterManagement.

Allwiring,includinglowvoltage,mustbeinstalledinconduit.BranchcircuitsconcealedwithinwallsorabovefinishedceilingsmaybeMCcablewithaninsulatedground.

Allequipmenttobere-usedfromapreviousTenantshallbebroughtintofirstclassworkingorderandshallbeupgraded tocomplywithall currentcoderequirements,andtothesatisfactionoftheCityBuildingInspectors.

Communications Services1. Landlordhasinstalledahigh-speedfiberinfrastructureattheCenterfor

purposesofprovidingvoiceanddataaccessthroughouttheCenter.Allaccess forTenant’s voiceanddata servicesmust be sourced throughLandlord’s designated provider which is currentlyGraniteTelecommu-nications or such alternative provider as designated by Landlord. Thevendorcontact forvoiceanddataservicescanbe found in theTenantCriteriaPackageunderGeneralInformation.

2. Forallwiringneedsincommonelectricalrooms,arequiredvendormustbeusedtomaintaintheintegrityoftheelectricalroom.Thevendorcon-tactforlowvoltagewiringneedscanbefoundintheTenantCriteriaPack-ageunderGeneralInformation.

LightingProvidealightingscheduleforreviewinconjunctionwithareflectedceilingplan.Lightingmustconformtothefollowingguidelines:

1. Displaywindow lightingmustbecontrolledbya timeclockandbeonduringthehourstheShoppingCenterisopen.Displaywindowlightingattheceilingmustbeglare-freeandatapprovedlevelsatthestorefrontglassline.

2. Recessedincandescentdownlightsmaybeused.

3. Exit, emergency and night lights must be provided throughout, asdeterminedbygoverningcodes.

4. Fluorescent lighting in thesalesareamustbe recessedandmustusemetalparaboliclouvertypelenseswithaminimumof18cellconfigurationforastandard2’x2’fixture.Barelampfluorescentorfluorescentfixtureswith acrylic prismatic lensesmay be used only in concealed areas orstockrooms.

5. Track lightingmaybeused if the track ispainted tomatch the ceilingcolor.Atthestorerfrontarea,alltracklightingmustbehiddenfromview,asseenfromthemallcommonarea.

TenantisresponsibleforconnectiontotheFireAlarmsystem.Allemergencylighting,exitsigns,hornsandstrobesmustbeprovidedbyTenantasrequiredbycode.

Material/Equipment Specifications1. Drawings must include complete material specifications, including

manufacturer’snameandproductnumberandcompleteschedulesofallequipmentandfixturestobeinstalled.

2. AllmaterialandequipmentmustbenewandofacommercialgradeandmustbearUnderwriter’slabelswheresuchlabelingapplies.

3. Atgrade levelelectrical conduitmaybe installedat least4”under theslabandmustbeinSchedule40PVCconduit.Butneverallowedtobeinstalledintheslaborlessthan4”belowslab.

4. Floorboxesmustbewatertight.

5. Pullboxesorjunctionboxesmustbeaminimumof12gaugegalvanizedsteeloutlets.Boxesinwallsmustbegalvanizedpressedsteelorcasemetal.Caulkaroundboxestoeliminatenoisetransmission.

6. Allmain and branch feeders and circuitry wiringmust be copper. Allconductorstohave600voltinsulationtypeTHW,THWNorTHHN.

7. Conveniencereceptaclesmustbespecificationgrade,120volt,20ampsandbegroundingtypeperNEC.

8. Manual or magnetic starters, switches, contactors, relays, time switches, safetydevices,dimmersandothercontrolsmustbecommercialtypewithheavydutyratingsandmustbeinstalledinstrictconformancewiththemanufacturer’srecommendationandapplicablecodes.

9. Anyexposedlowvoltagewiringmustbeplenumgraded.

Fire Alarm System - Life Safety1. Tenantmustprovideacompletefirealarmdetectionsystemwithin the

TenantspaceasanextensionoftheLandlord’sbuilding-wideaddressablefirealarmsystem.

2. TenantisrequiredtouseLandlord’sdesignatedcontractorforinstallationofthenecessarysmokedetectorsandconnectiontothemainfirealarmsystem. Systemmust complywith the requirements of the governingauthority.

3. Allemergencylighting,exitsigns,hornsandstrobesmustbeprovidedbyTenantasrequiredbycode.

4. Tenants are required to contract directly with Siemens BuildingTechnologies(see“MallRequiredContractors”intheGeneralInformationSectionoftheQueensCenterMallCriteriaManual)fortheprogrammingandinspectionoftheTenanttoLandlordFireAlarmandSmokeSystemconnection.

General Design/Construction CoordinationThemechanicalcriteriaisprovidedforthepurposeofdesigningtheTenant’sheating,ventilatingandairconditioningsystem.ThiscriteriaisprovidedforTenant’sEngineer.ItistheTenant’sresponsibilitytoverifyexistingconditionsandcomplywithallapplicablecodesandstandards.

Complete Engineered drawings must be submitted to Landlord’s TenantCoordinator for review and approval. Landlord will review the plans forconformance to basic Mall requirements. The Landlord does not reviewformechanical design, nor does the Landlord accept responsibility for theTenant’sadherencetogoverningcodes.

Restriction Area for Solar PanelsEquipmentorotherobstaclesplacedinthevicinityofexistingsolarpanelsshallfollowtheguidelinesoutlinedbelow:

• Noequipmentshallbeplacedwithin10feetofanysolarinverterorACjunctionbox

• Toavoidinterferingwithsolarpanelproduction,objectsshallbeplacednocloserthanthedistancedefinedas2timestheirheight.Forexample,ifa4footHVACunitisinstalled,itmustbelocatedatleast8feetawayfromasolarpanel.

• Innocases,regardlessoftheheightshallanobstaclebeplacedwithin3 feet of solar equipment

• Noconduits,pipesorotherdevicesshallbeaddedtoexistingconduitcarryingdevices

• Nowires,pipesorotherdeviceswillberoutedacrossoroverexistingsolar equipment

• Allmodificationswithin20’ofsolarequipmentshallrequirereviewandapproval from Macerich personnel

The documents to be submitted for Landlord approval must include the following:1. Completeplansandspecificationscoveringtheheating,ventilatingandair

conditioningsystem.Showmake,typeandperformanceofallequipment.DocumentsmustbesignedandsealedbyaLicensedEngineer in thestateofNewYork.

2. Calculations showing the heating and cooling required, includingtransmissionandventilation losses in thespaceandheatandcoolingprovided for theventilationsupplyandexhaust required for thespace.Calculationsshallbeasdescribedin“LoadCalculations”includedbelow.

3. Temperature control system data showing make, control and energymanagementsystems.

4. ChilledandHotwaterpipingdiagrams.

5. Exhaustsystemlayout,includingCFMandequipmentspecifications.

6. Structural details for support of all roof top equipment and equipmentsuspendedfromthesteelstructure.

General Requirement1. TheTenantisresponsibleforprovidingaCarriersingle-zoneairhandler

unitandallsubordinatecomponentstoprovideacompletesystemwithenoughcapacitytoadequatelyairconditionthepremises.

2. Tenant will provide the Landlord with engineering calculations whichassure the adequacy and Code compliance of the HVAC system theTenantisinstalling.

3. TenantwillprovideLandlordwithshopdrawings, installationguidelinesand product samples (where requested) detailing all equipment to beinstalled.Landlordwillhavefinal rightofapproval forallmaterialsandequipment.

4. InteriorDesignConditionsForAllTenants:72°Fhealing,50%RH78°Fcooling,50%RH.

5. OutdoorDesignConditions:Asper1991ASHRAE2½%design(whereoutsideairisnotpre-conditioned).

Tenant Structural Requirements1. Currently,theCenterisdefinedasbeinglocatedinaSeismicZone2with

alocalSeismicZoneFactor(Z)of0.15.AllequipmentinstalledshallmeetthecurrentrequirementsoftheBuildingCodeorappropriateReferencedStandard.

2. TheTenantmust retainastructuralengineer, registered in thestate inwhich thework isbeingperformed todesignanyhangersor supportsrequired.

3. The Tenant’s structural engineer must examine the existing structure todeterminefieldconditionpriortosubmissionofdesign,fabricationorInstallationdrawings.

Landlord Hydronic Provisions1. TheLandlordshallprovidevalvedandcappedchilledandheatinghot

watertothepremisesinaccordancewiththeprovisioncontainedIntheLease.

2. Chilledwatersupplyandreturnpipingconnectionsshallbe2”.Heatinghot water supply and return piping connection shall be 1¼”. TenantrequirementsbeyondthesepipesizesshallbereviewedbyLandlordatTenant’sexpense.

3. Landlordshalldeliverchilledwaterbasedon:46°Fenteringchilledwatertemperature and a 62°F leaving chilled water temperature to Tenantsthatareprovidedchilledwaterfromthemaincentralplant.TheLandlordreservestherighttoresetchilledwatertemperaturesasloadandambientconditionsvarytomaximizecentralplantenergyefficiency.

Landlordshalldeliverchilledwaterbasedon:45°Fenteringchilledwatertemperatureanda57°FleavingchilledwatertemperaturetoTenantsthatareprovidedchilledwaterfromthenewpackagedchiller.TheLandlordreservestherighttoresetchilledwatertemperaturesasloadandambientconditionsvarytomaximizecentralplantenergyefficiency.

4. IntheexistingMallareaallTenantsuppliedAHUmustbeprovidedwithcoolingcoilshavingthefollowingminimumcharacteristics:8rows,12finsper inch, coil face velocity less than or equal to 400 ACFM, 10 feet water pressuredropmaximumatdesignconditions.

IntheexpansionMallareaallTenantsuppliedAHUmustbeprovidedwithcoolingcoilshavingthefollowingminimumcharacteristics:6rows,12finsper inch, coil face velocity less than or equal 400 ACFM, 10 feet water pressuredropmaximumatdesignconditions.

MECHANICAL CRITERIA (cont’d.)5. Landlord shall deliver heating hotwater basedon: 200°Fentering hot

watertemperatureanda160°FleavinghotwatertemperaturetoTenantsthatreceivehotwaterfromthecentralplant.TenantsnotprovidedwithLandlord supplied heating hot water may choose to provide electricheatingcoilsintheirAHU’s.

Landlord Duct Provisions1. Within certain areas of the new and existing Center, the outside air

ductworkwill also serve as the smoke evacuation/purge ductwork.Allremainingareaswillutilizeseparateoutsideairandsmokeevacuation/purgeducts.Refertoplansinthismanualtodeterminethelimitsofeachspace.

2. Inareasoftheplansdefinedas‘NewBuildingArea’,allrequiredoutsideairshallbesuppliedat“neutral”conditionsbyLandlordsuppliedrooftopequipment.

3. Inareasoftheleasingplandefinedas‘ExistingRetailCenter’,allrequiredoutsideairshallbeconditionedbytheTenant’sairhandlingsystem.

4. In either case, accesswill be given to outdoor air shafts or ductwork.Tenant HVAC documentation must show a table detailing compliancewiththeBuildingCodeIndexforVentilation.

5. InthenewbuildingareaoftheCenter,Landlordshallextendcombinationoutside air/smoke evacuation ductwork approximately 3’-0” into theTenant space and provide a capped branch takeoff. TheTenant shallprovidesmokedampersorcombinationfire/smokedampersandelectricalwiringasappropriate.TheTenantmayextendandarrangetheoutsideairductworkfromthispointwithintheirspaceasrequired.TheTenantshallcontractwiththeLandlord’sFMSvendorforfinalconnectionoftheFACPcontrolwiringtotheLandlordFApanel.

6. In theexisting retail areaof theCenter,Tenant shall provideductworkfromexistingoutdoorairshaftsanddirectlyconnecttotheirairhandler.Theoutsideairductworkwillnotbeusedforsmokeevacuation.

7. The Tenant at Tenant’s sole cost and expense, shall ascertain andcomplyfullywiththerequirementsofthefiremarshalandothershavingjurisdiction concerningall aspectsof the smokepurgeandevacuationsystem.

Tenant System Design Parameters1. Tenantshallprovidefancoil/airhandlingunitswithchilledandhotwater

coilstosupplyspaceconditioningneedswithintheLeasedPremises.

2. Tenantchilledandhotwatercoilsmustbeselectedbasedontemperaturesdefined.

3. Allfancoil/airhandlingunitsshallbeprovidedwith2-waycontrolvalvesonlyforchilledandhotwatercoilcontrol.

4. Local controlofallTenantairhandlingsystemsshall bebyelectronic,programmablethermostatwithsetbackcapability.

5. AllTenantHVACsystemsshallutilizeaductedsupplyandplenumreturn.Ducted returns (aboveanacousticorhard)ceilingwillnotbeallowed.This requirement for plenum returns is to satisfy the Building Codemandateforsmokeremoval.

6. Reliefair(excessair),mayberelieveddirectlyinto(oroutof)theTenantpremisesiftheTenantpremisesarenotodorproducing.TheTenantwillprovidemechanicalexhaustasrequiredbycode.

Tenant Bathroom Exhaust1. TheLandlordshallprovidenegativelypressurizedexhaustairductwork

tooracrossapartoftheLeasedPremises.

2. Tenant shall provide exhaust fan(s)whichwill discharge into Landlordprovidedduct.

3. Tenant toiletexhaust fan(s)shalloperatecontinuouslyduringoccupiedhours.

4. Tenanttoiletexhaustfan(s)shallexhaustaminimumofonecompleteairchangeevery5minutesorasdescribedbyapplicablecode,whicheverisgreater.

Requirements for Odor Producing TenantsThefollowingspecialrequirementsapplytoodorproducingTenants(includingbutnotlimitedtohairstyleshops,petshops,restaurants,fastfooduseshopsoranyotherpremiseattheLandlordsdiscretion).

MECHANICAL CRITERIA (cont’d.)a. OdorProducingArea-Tenant isrequiredtofurnishandinstall the

necessaryequipmenttoremoveorneutralizeanyodors.ThisworkwillbeapprovedinwiringbytheLandlordandatthesoleexpenseoftheTenant.

b. The Tenant, as required by special conditions such as grills,restaurant exhaust systems, etc. will request that the Landlordprovidespecialroutingformake-upair.Thismaycomeintheformofadditionalductwork,increasedtemperedairsupplyoracombinationofboth.Allcostsincurredbytherequestforadditionalmake-upairwillbetheresponsibilityoftheTenant.

c. TenantsshalloperateHVACsystembetween5%and10%negativepressure (when referenced to Center common areas) and shallprovideacertifiedairbalancereportpriortoopeningandonayearlybasisasrequestedbyCenterManagement.

d. All installations shall comply with governing codes and shall beapprovedbytheFireMarshal.

Grease Exhaust and Make-Up Air for Food Court or Restaurant Tenantsa. All exhaust hoods shall be suppliedwith integralmake-up air.All

hoodsshallbecommercialgrade.

b. Allexhaustductworkmustbe installed inconformancewithNFPABulletin 96, and the NYC Building Code. Location of exhaustductworkandpenetrationsmustbeapprovedbytheLandlordpriortoinstallation.

c. Agreasecontainmentsystemisrequiredforfoodserviceinstallations.TheTenantwillprovidetheLandlordwithacopyofthemaintenanceagreementforthegreasecontainmentsystem.

d. Exhaustsystemswillbedesignedinaccordancewiththesecriteria,governingcodesandtheTenant’suserequirements.

e. AllexhaustmustbeductedtodischargedirectlyintotheLandlord’snegativelypressurizedgreaseexhaustduct.

Tenant Metering1. TenantshallbemeteredforactualchilledorhotwaterusagebyaBTU

metering system. Each system shall be comprised of temperatureelements,aflowelementandBTUcomputertototalizeutilityandreporttoLandlord’sFMSsystem.

2. TenanttoprovideoneBTUmetereachforchilledandhotwatersupplyconnection topremise.Meters tobeOnicon Inc.,System-I,Model100with totalizingmeteron the frontandoutputcontacts forconnection tothe(FMS),System-lModel100BTUmetertobeprovidedwithOptionalOutputs forsupplyand return temperaturesaswellas liquidflowrate,in addition to the standard BTU Energy total output. Output signalconductors from BTU meter shall be terminated in Tenant providedjunctionboxaboveceilingonreardemisingwall.

3. Chilled and hot water flow elements and temperature sensors will beprovidedandinstalledbyTenantbasedonpipesize.Forhotorchilledwater piping 1¼” or larger use: Onicon Model P-IIOD single turbineinsertiontypeflowmeterwithfrequencyoutput.Forhotorchilledwaterpiping1½”orsmalleruse:OniconModelF-1300singleturbineinlinewithfrequencyoutput.

4. Tenant shall provide calibration, testing and certification for meter (ifexisting)priortooccupancytoensureaccuracy.TenantshallalsoprovidethesameforanynewmeterinstalledifsorequestedbytheLandlord,allattheTenant’ssolecostandexpense.

5. TenanttohireLandlordcertifiedFMSContractortoconnectoutputsignalconductorsfromTenantprovidedjunctionboxtoLandlordprovidedFMSinterface panel in service corridor. Landlord certified FMS Contractorshallalsoprovideallrequiredprogrammingtoacquireandprocessoutput

signals from Tenant BTU meter. All costs for connecting conductors,conduit,programmingandcommissioningtheBTUtotalizersystemshallbeatthesolecostandexpenseoftheTenant.

Reuse of Existing EquipmentIf the Lease expressly permits the Tenant to reuse existing HVAC equipment locatedintheLeasedPremises,thentheTenantwillproceedasfollows:

a. TheTenantmustestablishthattheexistingequipmentandinstallationconforms to the Landlord’s criteria and a request bemade to theLandlordforthereuseofsaidequipment.Inallcases,theequipmenttobereusedshallbebroughtintofirstclassworkingorderandshallconformtoallcurrentandapplicablecoderequirements.Allsystemsmust be installed and operational to the complete satisfaction ofthosehavingjurisdiction.

b. Should the Tenant reuse existing equipment and the Landlorddetermines that newequipment is required for any reasonat anytime during the term of the lease, the Tenant must install newequipment conforming to the Landlord’s criteriawithin 30 days ofLandlordprovidingwrittennotificationtoTenant.

c. TheTenantwill submitplansandapprovalsshowingclearly thosepiecesofequipmentplannedforreuseandhowtheywillbebroughtintofirstclassworkingorder.

d. Tenantmaynotreuseanyequipmentdeemedtobe10yearsoldorolder.

e. When reusing existing equipment, the Tenant is not in any way relieved of the responsibility to conform to the Landlord’s criteriagoverningtheHVACsystem.

f. Priortoopening,theTenantwillsubmitthefollowingdocumentationtotheLandlord,(1)aletterfromtheHVACContractorassertingthattheHVACsystemisoperatingina“likenew”condition,(2)acopyofthemaintenanceagreementfortheTenantHVACequipment,(3)theTenant’sHVACmaintenancecontractormustprovidephotographsoftheexistingunit(s).

Testing and BalancingTenantmustprovideforbalancingofallhydronicandairsystems.BalancingwillbeperformedbyanindependentcertifiedtestandbalancingagencyatthesolecostandexpenseoftheTenant.ThehydronicandairbalancereportistobeprovidedtotheCenter’sofficepriortothestoreopening.TheTenant’smechanicalcontractorshall cooperatewith theselectedbalanceagency inthe following manner:

a. Providesufficient timebeforefinal completiondateso that testingandbalancingcanbeaccomplished.

b. Provide immediate labor and tools to make corrections requiredwithoutunduedelay.Installbalancingdampersasrequiredbytestandbalanceagency.

c. Mechanicalcontractorandbalancingagencyshallnotalterordisablethesmokecontroldampersoranyotherequipmentassociatedwiththesmokecontrolorevacuationsystems.

d. Thecontractorshallputallheating,ventilatingandairconditioningsystems and equipment into full operation and shall continue theoperationduringeachworkingdayoftestingandbalancing.

e. Testingandbalancingagencyshallbekeptinformedonanymajorchangesmadetosystemduringconstructionandshallbeprovidedwithacompletesetof‘as-built’drawings.

Natural GasTheLandlord,atLandlord’ssolediscretionmayprovidegaspipingtoTenant’slocatedinthedesignatedFoodCourt,forwhichtheLandlordshallbeentitledtoreceivefromtheTenantpaymentondemand.

Closeout Requirements1. Tenantmust submit as-built drawingsand certifiedair balance reports

prior to construction close out showing the exact location of all equipment andductwork.

2. A copy of the maintenance agreement for the HVAC equipment must be providedtotheLandlord.

Waterproofing must be installed in all “wet areas” such as kitchens,restrooms,mopsinks,drinkingfountains,etc.Thewaterproofmembranemustextend4”verticallyonalldemisingwalls.ThismembranewillbewatertestedbytheGeneralContractorandinspectedandsignedoffbyMallPersonnel.Ifthemembranefailsthewatertest,itmustbereplaced.

2. Water Efficiency• TheTenantisrequiredtoinstallwaterlessurinalsintenantrestrooms

whenurinalsareused.

• Low-Flowwaterclosetsusing1.6GPForlessgallonsperflushwillbeinstalledinalltenantspaces.

• Operation sensors and low-flow heads using 0.5 GPM or less inlavatories.

3. TheLandlordshallprovideacappedwaterservicetoorneareachLeasedPremises.Theserviceshallgenerallybea¾”serviceforretailTenants,1”serviceforfoodcourtTenantsand2”serviceforrestaurantTenants.

4. Each Tenant shall be responsible for the coordination, supply andinstallationofawatermeterat thepointofconnection to theLandlordprovided service. Water meters with remote reading capabilities shallbeinstalledintheTenantspace.TheTenantisresponsibleforallworkassociatedwiththemeterandremotereadinghardwareinstallation.AllwatermetersandremotereadinghardwareshallbeasmanufacturedbyHerseyProductsandsizeasfollows:

• RetailTenants:¾”size,Model#442IIS,withER-1Encoder.

• FoodCourtTenants:1”size,Model#452IIS,withER-1Encoder.

• RestaurantTenants:2”size,Model#572IIS,withER-1Encoder.

7. OutputconductoronER-1EncodershallconnecttoLandlord’sBuildingManagement System (FMS). Output conductor from water metershall terminate in Tenant provided junction box above the ceiling onrear demising wall. The exact location must be agreed with Centermanagementpriortoanyworktakingplace.

8. The Tenant shall provide all calibration, testing and certification formeter (if existing) prior tooccupancy toensureaccuracy.Tenant shallalsoprovidethesameforanynewmeterinstalledifsorequestedbytheLandlord,allattheTenantssolecostandexpense.

9. TheTenantshallhireaLandlordcertifiedFMSContractortoconnecttheoutputsignalconductorsfromTenantprovidedjunctionboxtoLandlordprovidedFMSinterfacepanelinservicecorridor.LandlordcertifiedFMSContractor shall also provide all required programming to acquire andprocessoutputsignalsfromTenant’swatermeter.Allcostsforconnectingconductors,conduit,programmingandcommissioningthesystemshallbeatTenant’ssolecostandexpense.

10. Asanitary connectionwill bemadeavailable in theceilingof the floorbelowatverticalrisersgenerallylocatedatonerowofalternatecolumns.Sanitaryconnectionswillbeminimum3”.Ventconnectionswillalsobemadeavailableinasimilarmanner.TheTenantmustverifythelocationsandconfirmthesuitabilityofallsanitaryandventlines.

11. Tile plumbing system shall be installed in accordance with governingbuildingcodesandallLandlordrequirements.Waterclosetswithinretailor food courtTenant areas shall be1100r orwallmounted lank stylepressure assisted siphon Jet type (1.6GPFMaximum).UrinalswithinretailorfoodcourtTenantareasshallbewashoutflushtypewith314spud(1.0GPFMaximum).LavatoryfaucetsinallTenantspacesshallbeofthemetering(selfclosing)type(2.5GPMMaximum).

12. Lowwaterconsumptionfixturesandcontrolsshallberequiredforwaterconservation.

13. TheTenantshallinstallfloordrainswithtrapprimersineachTenanttoiletroom.

14. DomesticwaterpipingmaterialshallbeType“L”copperwithsweattypefittings.

15. Sanitaryandventpipingmaterialshallbeserviceweightcast ironwithmechanicalfittings.

16. Anyplumbingfixturesthatreceivehair,asinpetshopsandhairstylingshopsetc.,arerequiredtoinstalllintandhairtrapsbeneatheachtrappedfixture.

17. A reduced pressure backflow preventer must be used on all Tenantwaterconnectionstosystemsorequipmentthatmaybehazardous.Thiswill include photo processing equipment, brine systems, etc.BackflowpreventerassemblytobeinstalleddownstreamofmeterandwithintheLeasedPremise.Crossconnectioncontrolpermits,applications,feesanddocumentationshallbeprovidedsolelyasresponsibilityoftheTenant.

18. Tenantshallprovideamainwatershutoffvalvelocatedateyelevelinawallbehindalabelledaccessdoor.LocateinornearemployeerestroomasdesignatedbyLandlord.

19. Domestic water heaters shall be supplied by Tenant using tank typeelectric.

20. Tenants located in the designated Food Court Area or Food ServiceTenant’s located elsewhere in the Center shall discharge waste fromkitchen equipment through a grease interceptor prior to connection to theLandlord’ssanitarysystem.Dishwashermachinesareexemptfromthis requirements. Grease interceptors shall be contained completelywithinthedemisedpremiseandabovethefloorslaborinotherLandlordapprovedlocations.Allfoodcourtandfoodservice(restaurant)Tenant’sgreaseinterceptorsshallbeabovefloortypecompletewithflowcontrolfilteringandsizedasfollows:

• FoodCourtTenants:JayR.SmithModel#8050orequal.

• Food Service Tenants: Sized using manufacturers procedure forsizing grease interceptors. Grease interceptors over 100 poundgreasecapacitymustbeapprovedbytheLandlordpriortoinstallation.

21. At theTenant’s expense, designated FoodCourt, Restaurant or FoodPreparationTenantsmustemployanindependentservicecontractortocleanandmaintainthegreaseinterceptorwithintheirpremises.TenantmustprovideLandlordwiththenameofthecontractorandtheirplumbing/greasedisposallicensenumber,aswellasacontractidentifyingtheworkscheduling.

TenantsontheupperlevelmustcoordinatewithlowerlevelTenantsandtheLandlordforfloorpenetrationsandanyplumbingundertheupperlevelfloor/deck.Tenantwillberesponsibleforallcostassociatedwiththiswork.

Gas ServiceGasmaybeavailableat theCenter. Tenant,at itssolecostandexpenseandincompliancewithlocalcode,mustprocuregasservicetoandwithinthedemisedpremisesandwillmakeallnecessaryarrangementswiththe localGasCompanyforsuchservice.Tenantisresponsibleforinstallationofagasmeteratthegasmeterheader.

PressureregulatorsandpipingrequiredforconnectiontoTenant’sequipmentistheresponsibilityoftheTenant.CoordinatewithLandlordforregulatorventrouting.

AllsanitarysewerandplumbingventpipingshallattachtoLandlordsuppliedventilationductworkandshallcomplywithalllocalcodes.
