As you might expect, the total number of facilities, statewide, continues to slowly increase as older facilities are abandoned and new facilities are constructed, often on different sites. The total number of UST and AST facilities not POU continues a long-term trend as smaller facilities are abandoned and larger,

higher throughput stations, replace them. Often two or three older facilities go out of business when one new facility starts up. The total number of TOU tanks remains about the same from quarter to quarter. As tanks are removed permanently, other tanks currently in use move to TOU status.

All USTs must have a leak detection method for the tanks and another one for all pressurized lines. All USTs must have spill prevention equipment and overfill prevention equipment. Suction lines that have no foot valve in the tank are exempt for all leak detection work and are referred to as safe suction or exempt suction. Suction lines with foot valves are required to be pressure tested every three years and are referred to as U.S. Suction or non-exempt suction. By far, most of the tanks in Wyoming are equipped with pressurized lines. Owners and/or operators of ASTs are required to register their tanks and to pay an annual fee. ASTs that are used to dispense gasoline and diesel to the public are the only ones covered by the program and these owners receive all program benefits. TANK AND CONTAMINATED SITE FEES: Tank fees and contaminated site fees are due January 1 of each year. Owners who do not pay by January 1 are not current with State of Wyoming Storage Tank Fees and thus are also not current with federal financial responsibility requirements. All 2,257 tank systems are subject to tank fees regardless of tank type. Owners of contaminated sites are also required to pay contaminated site fees to remain eligible for the state fund. Storage Tank fees were due January 1, 2008. Installation fees and new tank fees are invoiced after the final inspection is done. At this time, we are converting our databases to sequel server. The tank fees and contaminated site fees were both invoiced using the new system. We are just now getting the bugs worked out of this system and we are several weeks behind on getting the fees posted. For this reason, it is not possible to run a report showing which fees have not yet been paid. Under our new Storage Tank Act of 2007, there is a late fee of $100.00 per tank for all fees not paid by April 1. CATHODIC PROTECTION TESTS: One of our most important requirements is to have every cathodic protection system inspected once every three years by a cathodic protection tester to insure that the steel tanks and/or lines are still being protected against corrosion. This is the only requirement in the tank program that is designed to prevent leaks before they occur. Cathodic protection can be provided by either a sacrificial anode (galvanic anodes) system or by an impressed current system. There are 748 USTs in Wyoming that are protected against corrosion using sacrificial anodes. This number includes both Currently in Use (CIU) and TOU tanks. As of December 31, 2007, only 26 of these tanks had not been tested within the last 3 years. These tanks are located at 12 facilities. This is a 96.5% compliance rate. Facility ID  Tank(s

11 This facility is in the middle of a foreclosure proceeding. As soon as the ownership has been resolved, the company taking the facility back has pledged to remove the tanks.

TOU TANKS: Tanks can be placed in TOU status at any time, and they must be emptied within 1-inch of the bottom within 3 months of being placed in TOU status. Tanks that are TOU and empty are exempt from all leak detection requirements but not cathodic protection requirements. There are 134 USTs at 56 facilities that are TOU. to Colorado. Nothing has been done in regard to these tanks for years. We did an inspection and verified that the tanks are empty and not in use. Site is isolated very near the Utah border south of Flaming Gorge Reservoir.

17 A Notice of Violation and Administrative Order, Docket Number 3807-05 was issued to the owner of this facility.

18 This facility was recently repossessed by a bank and then purchased by a developer. These tanks will probably be removed within the next 18 months.

19 The Attorney General obtained a judgment against the owner of record for this site. Storage Tank fees have never been paid. Site is not a contaminated site.

20 Tanks may have already been removed. Waiting on decommissioning certificate. 21 The University of Wyoming has committed to remove these tanks, probably this calendar year.

22 This site is now owned by the same owner that owns two other stations on the same intersection. It is doubtful that these tanks will ever be placed back in service. However, the owner is monitoring the impressed current system as required and keeping all of the records. An inspection was done this year to verify the status.

23 These tanks have been removed but not yet decommissioned. When the decommissioning certificate is received, they will be shown as permanently out of use.

lake has been too low for the boat ramp. For this reason, this site is TOU, but may reopen when the water levels return to normal.

29 Site is now owned by a developer who will probably re-develop the site and remove the tanks. 30 These sites will re-open in the spring.

LINE PRESSURE TESTING: There are 1,461 lines in Wyoming that require testing: 1,423 pressurized lines and 38 U.S. suction lines. There are 96 pressurized lines that are overdue for testing, or an overall 93.3% compliance rate. As you can see, many of these tests were due within the last 60 days. Many of them may have been done already, but the paperwork has not yet arrived at our office. There are 38 U.S. Suction lines in Wyoming. None of the U.S. Suction lines are past due on the 3-year pressure tests of the lines. SIGNIFICANT OPERATIONAL COMPLIANCE MEASURE 3: During the past 12 months, the STP identified 76 violations at 60 sites that fit the definition for Significant Operational Compliance Measure 3. This is a compliance rate of 87.6% for SOC-3. Since SOC-3 is a combination of SOC-1 and SOC-2, the listing will not be repeated. OPERATOR’S ANNUAL INSPECTIONS: When Chapter 17 was amended in 2005, a provision was placed in rule that requires the operator of the station to conduct their own annual inspections. During an operator’s annual inspection, the operator is required to complete all tasks this agency would do during a field inspection and to fully document the inspection in a report to the department. Between December 31, 2006, and January 1, 2008, operators have conducted, documented, and reported 628 inspections. In some cases, the submitted reports did not include the last 12 months automatic tank gauging results and inventory control spreadsheets. When this happens, we are requesting this information in the same way that we would if the information was not at the facility during our own inspections. CLEANUP OF CONTAMINATED SITES: At the present time, there are a total of 729 unresolved contaminated sites. There are 433 sites that are not in corrective action and are not resolved. Corrective action is underway at 301 sites. We have resolved 828 contaminated sites. The following 17 sites were cleaned up during calendar year 2007:

UNDERGROUND STORAGE TANK COMPLIANCE ACT OF 2005: This section of the Energy Policy Act requires states to perform a number of functions:

• Inspection of every facility not inspected since December 22, 1998: This has been completed.

• Inspection of every facility on a three (3) year schedule: We are on track with this work. • Write compliance report of government owned tanks: This was completed on schedule

and updated on schedule. This report is available on our website. • Require new tanks and lines within 1000 feet of a community water supply or a potable

water supply well to be installed as double wall tanks and lines: The state statute was amended to require this state-wide without reference to water systems.

• Make available a list of all facilities and underground tanks, statewide: This list is available on our website now. We are also working to make our database into a web-based system with the goal of eventually making the entire database available on the web.

• All states must have the ability to prohibit deliveries to non-compliant tanks: A draft rule has been written and passed through the Water and Waste Advisory Board twice. The last hearing was done on September 13, 2007. A final rule-making hearing is scheduled for March 18, 2008 before the Environmental Quality Council.

• States must require that operators of underground storage tanks be certified: In Wyoming, we opted to require operators to pass either the International Code Council - Underground Storage Tank Operator’s Test (U6) or the International Code Council - Wyoming State Specific test (W7). All work through the International Code Council to implement these tests has been completed. Tests will be available in Casper, Sheridan, and Cheyenne as well as many sites in adjacent states. A draft rule has been written and passed through the Water and Waste Advisory Board twice. The last hearing was done on September 13, 2007. A final rule-making hearing is scheduled for March 18, 2008 before the Environmental Quality Council.

The above list of inspections due includes inspections scheduled at less than a three year interval because of violations during the last inspection, all above ground storage tank facilities, and any new facilities that have not yet been inspected for the first time. The two Safeway stores on this list are not even complete yet. With all of these inspections listed, there are only 394 inspections due in 2008. We expect to make all or nearly all of these inspections without problems. SUMMARY: At this time, the Wyoming Storage Tank Program has an excellent compliance rate.
