RESUMEN / ABSTRACT

El estudio del ADN codificante ha permitido conocer el funcionamiento de gran parte

del genoma humano. En las ciencias forenses, una de las aplicaciones prcticas es la

prediccin de caractersticas del donante de una muestra annima. Estos rasgos, de

tipo fsico, mdico, conductual o de ancestralidad, pueden conformar un retrato

robot gentico de un individuo con un porcentaje de acierto suficientemente alto

como para ser tenido en cuenta por la jurisdiccin penal. En la actualidad ya se

encuentran en el mercado kits de anlisis de varias caractersticas individuales

cuyo uso debera ser regulado por las leyes.

DNA codification studies have allowed us to know the workings of an extensive area

of the human genome. For the forensic sciences, one of the practical applications is

the phenotype prediction taken from an unknown sample. These traits can provide us

with a highly degree of certainty about the individuals genetic portrait robot; so

that it can be presented as evidence in a criminal jurisdiction. Nowadays a myriad

of DNA test kits are available in the market considering different types of

characteristics. The use of these kits should be regulated by law.

La psicologa de la escritura es una disciplina que, como test proyectivo, permite el

estudio del signo grfico mediante un mtodo cientfico y que puede ser aplicada a

la investigacin criminal y criminolgica en diversos aspectos, todos ellos con la

caracterstica comn de conocer cmo piensan, cmo sienten y cmo actan tanto la

vctima como el victimario.

The Psychology of writing is an academic discipline which, as a projective test,

allows the study of the graphic sing, whereby a scientific method can be applied to

both the criminal investigation and criminology in a variety of aspects. All of them

share a common characteristic, which involves knowing how the victim and culprit

think, feel and behave.

RESUMEN / ABSTRACT

El fallecimiento de un aficionado en noviembre de 2014, tras una pelea entre las

aficiones del Atltico de Madrid y el Deportivo de La Corua, se suma a las otras

ocho muertes registradas en nuestro pas desde 1982 como consecuencia de la

violencia en el ftbol. Trgicos sucesos que nos hacen replantearnos el recurso a la

introduccin de figuras meramente formales en nuestro Cdigo Penal, entre ellas la

agravante de discriminacin contemplada en el apartado cuarto del artculo 22.

The recent death of a football fan in November 2014, after a fight between Atltico de

Madrid and Deportivo de La Corua supporters, could be added to the other eight

deaths registered in our country since 1982 as a consequence of the football

violence. Although this tragic events have important differences between them, they

make us to rethink the introduction of purely formal figures in our Criminal Code,

including the aggravating of discrimination provided in the fourth paragraph of

its Article 22.
