    Activity Description

    The New Castle County Department of Public Works pumps groundwaterand landfill leachate from 11 different groundwater recovery wells.The purpose of the activity Is to control the migration of landfillleachate by the creation and maintenance of a hydraulic dividedowngradlent of the landfill.

    Statutory and pepilatorv Basic

    The Delaware Department of Natural Resources and EnvironmentalControl (DNREC) proposes to reissue an NPDES penult to dischargewastewater aubject to certain affluent limitations Identified below.The effluent limitations are consistent with 40 CFR pXrt 122, the Stateof Delaware Regulations Governing the Control of Water Pollution, as•mended on June 23, 1963 and the State of Delaware Water QualityStandards for Streams. Section 402 of the Federal Clean Vatar Act of '1977 as amended and 7 Del. C.. Chapter 60 provide authority for NPDES "permit Issuance,

    Receiving Stream Classification

    The discharges are to the Army Creek which Is classified for thefollowing designated protected uses: secondary contact recreation;and the propagation and maintenance of fish, aquatic life andwildlife,

    Description of the Discharge as Required bv the Permit

    Discharge 001 consists of groundwater and landfill leachate thatIs pumped from 11 different recovery wells. The recovered water Is tobe combined and treated prior to being discharged to Amy Creek,

    Proposed Effluent Limitations and Compliance Schedule

    1. Change in Discharge

    All discharges authorized herein shall be consistent with the termsand conditions of this permit. The dlschsrge of any pollutantIdentified in this permit at a level in excess of that authorizedshall constitute a violation of the permit, Any anticipatedfacility expansions, production Increase, or process modificationswhich will result in new, different or Increased discharge ofpolluants oust be reported by submission of a new NPDES applicationat least 180 days prior to commencement of the changed discharge,Any other activity which would constitute cause for nodlfication or

    . revocation and relasuance of this permit, as described In Part II,B-5 of this permit, shall be reported to the Department. Followingluch notice, the permit nay be modified to specify and limit anypollutants not previously limited.

    2. Noncompllance Notification

    a. If, for any raason, the permittee does not comply with or willbe unable to comply with any dally Baxlaum affluent limitationsor Baxlmum Instantaneous concentration specified In thispermit, the permittee shall provide the DepartneW with thefollowing Information, in writing, within five (5) days ofbecoming awara of auch conditions;

    (1) A description of the discharge and cause of noncompllancc;'

    (2) The period of noncompllance, Including exact dates andtimes and the anticipated time when the discharge willreturn to compliance;

    (3) Steps being taken to reduce, eliminate and prevent recur-rence of the noncomplylng discharge,

    b. In the case of any upset or discharge subject to any toxic pol-lutant effluent standard under Section 307(a) of the Act, theDepartaent shall be notified within 24 hours of the time thepermittee becomes aware of the noncomplylng discharge,Notification shall Include Information as described Inparagraph 2(a) abova. If such notification Is ude orally, awritten submission «ust follow within five (5) days of the tinethe permittee becomes aware of the noncomplylng discharge.

    The permittee ahall at all tines aalntaln in good working order andoperate as efficiently as possible all collection and treatment fa-cilities and systems (and related appurtenances) installed or usedby the permittee to achieve compliance with the terms andconditions of this permit, Proper operation and maintenanceIncludes, but is not limited to, effective performance based ondesigned facility removals, adequate funding, effective management,adequate operator staffing end training and adequate laboratory andprocess controls Including appropriate quality assuranceprocedures,

    It, Adverse Impact

    The permittee shall take all reasonable steps to minimize anyadverse Inpact to the waters of the State or the United Statesresulting fron nonconpllance vlth this permit, Including suchaccelerated or additional Monitoring as necessary to determine thenature and Inpact of the noncomplying discharge.

    5, Bypassing

    Any bypass of treatment facilities necessary to Balmaln compliancewith the terns and conditions of this permit la prohibited unless:

    a. The bypass Is unavoidable to prevent loss of life, personal . >Injury or aevera property damage; and

    t>. There are no alternatives; and

    e. The Departaent Is notified within S4 hours (If orally notified,'then followed by a written submission, within five (5) days ofthe permittee's becoming aware of the bypass, Where tlic needfor a bypass la known (or ahould have been known) In advance,this notification ahall be submitted to the Departaent for ap-proval at least ten (10) days before th< date of bypass; and

    d, The bypass la allowsd under conditions determined by theDepartment to be necessary to nlnlnlte adverse effect aaprovided under 7 pel. C.. Chapter 60, $6011,

    6, Conditions Necessary for Deaonscratlon of an Upset

    An upset shall constitute an affirmative defense to an actionbrought for noncompllance with technology-based effluentlimitations only If the permittee demonstrates, through properlysigned contemporaneous operating logs, or other relevsnt evidence,that:

    c, The permittee submitted a notification of noncompUance asrequired by Part 11, A.2,b.

    d, The permittee has taken all remedial measures required tominimize adverse Impact.

    7. ' Removed Substances

    Solids, sludges, filter backwash, or other pollutants removed inthe course of collection or treatment of vastewaters shall bedisposed of In • Banner such as to prevent any pollutant from auch•aterlals from entering aurface vaters or groundwatera.

    6. Failure

    The permittee shall allow the Secretary of the Department ofNatural Resourcis and Environmental Control, the RegionalAdministrator, and their authorlted rapKientatlves, jointly andacverally, upon the priaentation of credentiala and auch otherdocuments as may be required by law:

    a. To enter upon the permittee's premises where a point lource lalocated or where any records are required to be kept under theterms and conditions of this permit; and

    2, Transfer of Ownership and Control

    In the event of any change in ownership or control of facilitiesfrom which the authorized discharge emanates, the permit may betransferred to another person If the permittee',

    a. 'Notifies the Department, In writing, of the proposed transfer;and

    b. A written agreement between the transferer and the transferee,Indicating the epeciflc date of proposed transfer of permitcoverage and acknowledging responsibilities of current and newpermittees for compliance with and liability for the terms andconditions of this permit, Is aubmltted to the Department; and

    c. The Department within thirty (30) days of recelpTof thenotification of the proposed transfer does not notify thecurrent permittee and the new permittee of Intent to modify,revoke and reissue, or terminate the permit and require that • '•new application be aubmltted,

    3. Reappllcatlon for a Fernit

    At least 1BO days before the expiration date of this permit, thepermittee ahall submit a new application for a permit or notify theDepartment of the Intent to cease discharging by the expirationdate. In the event that a timely and sufficient reappllcatlon hanbeen submitted and the Department Is unable, through no fault ofthe permittee, to Issue a new permit before the expiration date ofthis permit, the terms and conditions of this permit areautomatically continued and remain fully effective and enforceable,

    4. Availability of Reports

    Except for data determined to be confidential under Section 308 ofthe Act, all reports prepared In accordance with the terms of thispermit shall be available for public Inspection at the offices ofthe Departmei.t of Natural Resources and Environmental Control, Asrequired by the Act, effluent data ahall not be consideredconfidential, Knowingly making any false statement on any suchreport may result In the imposition of crUlnal penalties asprovided for under 7 Del. C.. S6013.

    5, Permit Modification, Revocation and Rrlaauanca and Termination
