REG: PNB (EMPLOYEES) PENSION REGULATIONS, 1995 – CALCULATION & PAYMENT OF PENSION CONSEQUENT UPON THE REDEFINITION OF ‘PAY’ IN BIPARTITE SETTLEMENT/JOINT NOTE DATED 02.06.2005.

Attention of all Incumbents is invited to HRD Division Circular Nos.262 dated 11.06.2005 and 264 dated 29.06.2005 intimating about Wage Revision Settlement of Officers and Workman staff, consequent upon signing of 8th Bipartite Settlement/Joint Note dated 02.06.2005 by IBA with Workmen Unions/Officers Organizations.

2. In terms of Clause 16 of the Bipartite Settlement dated 02.06.2005 relating to workmen and Paragraph 6 of the Joint Note dated 02.06.2005 relating officers, in respect of an officer or a workman employee (herein referred to as ‘employee’), who is a member of the pension fund and retiring/retired from service or died while in service or otherwise ceased to be in employment (hereinafter commonly referred to as retired/retirement) on or after, 01.05.2005, ‘pay’ to be reckoned for the purpose of arriving at ‘average emoluments’ for calculating pension shall be the ‘pay’ drawn by him prior to his retirement/death. ‘Pay’ here will have the same meaning as in Clause 6 of the Bipartite Settlement dated 02.06.2005 and Note (2) below paragraph 6 of the Joint Note dated 02.06.2005.

‘Pay’ for the purpose of Provident Fund and Pension shall mean Basic Pay including Stagnation Increment. Professional Qualification Pay. Increment component of Fixed Personal Pay and Officiating Allowance.

3. In view of the foregoing, in respect of an employee retiring/retired on or after 01.05.2005, for arriving at pension to be sanctioned, ‘average emoluments’ for the purpose shall be calculated reckoning actual ‘pay’ drawn in terms of the Bipartite Settlement/Joint Note dated 02.06.2005.

4. As a consequence of the re-definition of ‘pay’ for the purpose of pension as stated herein above and in view of the legal position obtaining in this regard, pension already sanctioned and being paid to retirees of the period 1st April 1998 to 31st October 2002 and of the period 1st November 2002 to 30th April 2005 is to be revised with reference to the new definition of pay as referred to in Paragraph 2 above and pension so revised paid to them with effect from 1st May 2005. On account of such revision of pension, no arrears of pension and/or difference in commuted value of pension is payable to the retirees of these periods.

5. Pension in respect of the retirees of the periods mentioned in paragraph (4) above, shall be revised as per procedure detailed herein below:

I. In respect of an employee who retired during the period from 1st November 2002 to 30th April 2005.

(a) If such retirement has taken place on or after 1st September 2003, i.e. after drawing ‘pay’ in the last 10 months of service in terms of 8th Bipartite Settlement/Joint Note dated 02.06.2005, then ‘average emoluments’ for arriving at pension shall be calculated reckoning ‘pay’ as in Bipartite Settlement/Joint Note dated 02.06.2005.

(b) If such retirement has taken place on or after 1st November 2002 but on or before 31st August 2003, i.e. after drawing pay in the last 10 months of service, both in terms of Joint Note dated 14.12.1999/7th Bipartite Settlement dated 27.03.2000 and 8th Bipartite Settlement/Joint Note dated 02.06.2005, then revision of pension shall be done as per example illustrated hereunder:

Illustrative Example :

Computation of Pension in respect of a retiree (Clerk retired on 31st March 2003) who received ‘pay’ say, for 5 months as per Seventh Bipartite Settlement and for 5 months as per Eighth Bipartite Settlement.

(b) If such retirement has taken place during the period 01.11.1997 to 31.08.1998 in the case of workmen and during the period 01.04.1998 to 31.01.1999 in the case of Officers i.e. after drawing pay in the last 10 months of service, both in terms of the 6th Bipartite Settlement dated 14.02.1995/ Joint Note dated 23.06.1995 and 7th Bipartite Settlement dated 27.03.2000/Joint Note dated 14.12.1999, then revision of pension in such cases may be done as per example illustrated hereunder:

(c) In the 7th Bipartite Settlement dated 27.03.2000, revision in Special Pay, Graduation Pay and Personal Qualification Pay had taken place from 01.04.1998 and of Fixed Personal Pay from 01.11.1999. In cases falling under (a) and (b) above, if an employee during the last 10 months of service, had drawn the above components of ‘pay’ at rates obtaining prior to 01.04.1998 or 01.11.1999, as the case may be, then for the purpose of calculating average emoluments, the aggregate of such component of ‘pay’ with Dearness Allowance thereon at CPI 1684 points may be reckoned

6. Dearness Relief on the basic pension computed as above shall be at

rates as given hereunder:

PART A

On and from 01.05.2005, in the case of employees who retired during the period 01.04.1998 to 31.10.2002 dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 1684 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said four points shall be calculated in the manner given below: -

The rate of dearness relief as a percentage of basic pension

(i) Upto 3,550 0.24 per cent (ii) Rs.3,551 to Rs.5,650 0.24 per cent of Rs.3,550 plus 0.20 per cent

of the basic pension in excess of Rs.3,550 (iii) Rs.5,651 to Rs.6,010 0.24 per cent of Rs.3,550 plus 0.20 per cent

of the difference between Rs.5,650 and Rs.3,550 plus 0.12 per cent of basic pension in excess of Rs.5,650

(iv) Above Rs.6,010 0.24 per cent of Rs.3,550 plus 0.20 per cent of the difference between Rs.5,650 and Rs.3,550 plus 0.12 per cent difference between Rs.6,010 and Rs.5,650 plus 0.06 per cent of basic pension in excess of Rs.6,010

PART B In respect of employees who retire on or after 01.05.2005, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 2288 points in the quarterly average of the all India Average Consumer Price Index for Industrial Workers in the series 1960=100, at the rate of 0.18 per cent of basic pension. Note: - In respect of retirees of the period 01.11.2002 to 30.04.2005, for whom pension will be revised w.e.f. 01.05.2005 in terms of Paragraph 5(I) of this circular, dearness relief shall be payable at 0.18 per cent of basic pension w.e.f. 01.05.2005. 7. The ordinary rates of family pension shall be as under:

PART A In respect of employees (other than part-time employees) who retired during the period from 01.04.1998 to 31.10.2002, on and from01.05.2005, the ordinary rate of family pension shall be as under: - Scale of pay per month Amount of monthly family pension Upto Rs.4,210 30 per cent of the ‘pay shall be the basic family

pension plus 30 per cent of allowances which are counted for making contributions to Provident Fund but not for dearness allowance shall be the additional family pension. The aggregate of basic

and additional family pension shall not be less than Rs.1,056 per month.

Rs.4,210 to Rs.8,420 20 per cent of the ‘pay shall be basic family pension plus 20 per cent of allowances which are counted for making contributions to Provident Fund but not for dearness allowance shall be the additional family pension. The aggregate of basic and additional family pension shall not be less than Rs.1,262 per month.

Above Rs,8,420. 15 per cent of the ‘pay shall be the basic family pension plus 15 per cent of allowances which are counted for making contributions to Provident Fund but not for the dearness allowance shall be the additional family pension. The aggregate of basic and additional family pension shall not be less than Rs.1,687 per month and more than Rs.3,521 per month.

PART B

In respect of employees (other than part-time employees) who retired/retires from service on or after 01.05.2005, the ordinary rate of family pension shall be as under: - Scale of pay per month Amount of monthly family pension Upto Rs.5,720 30 per cent of the ‘pay shall be the basic family

pension plus 30 per cent of allowances which are counted for making contributions to Provident Fund but not for dearness allowance shall be the additional family pension. The aggregate of basic and additional family pension shall not be less than Rs.1,435 per month.

Rs.5,720 to Rs.11,440 20 per cent of the ‘pay shall be the basic family pension plus 20 per cent of allowances which are counted for making contributions to Provident Fund but not for dearness allowance shall be the additional family pension. The aggregate of basic and additional family pension shall not be less than Rs.1,715 per month.

Above Rs,11,440. 15 per cent of the ‘pay shall be the basic family pension plus 15 per cent of allowances which are counted for making contributions to Provident Fund but not for dearness allowance shall be the additional family pension. The aggregate of basic and additional family pension shall not be less than Rs.2,292 per month and more than Rs.4,784 per month.

Note: -

i) Family pension in respect of employees who retired or died while in service on or after 01.11.2002 but before 30.04.2005 shall also be revised in terms of Part B above with effect from 01.05.2005.

ii) In the case of part-time employees, the minimum amount of family

pension and the maximum amount of family pension shall be in proportion to the rate of scale wages drawn by the employee.

8. The amount of minimum pension with effect from 01.05.2005 shall be

as under: -

(a) In respect of employees, other than part-time employees, who retired on or after 01.04.1998 but before 31.10.2002, the amount of minimum pension shall be Rs.1,060 p.m. In respect of part-time employees who retired during this period, the Minimum pension payable shall be Rs.355 p.m. in respect of part-time employees drawing 1/3 scale wages, Rs.530 p.m. in respect of part-time employees drawing ½ scale wages and Rs.795 p.m. in respect of part-time employees drawing ¾ scale wages.

(b) In respect of employees, other than part time employees, who retired

on or after 01.05.2005, the amount of minimum pension shall be Rs.1,435 p.m. In respect of part-time employees, who retired on or after 01.05.2005, the minimum pension payable shall be Rs.480 p.m. in respect of part-time employees drawing 1/3 scale wages, Rs.720 p.m. in respect of part-time employees drawing ½ scale wages and Rs.1080 p.m. in respect of part-time employees drawing ¾ scale wages.

Note: - Minimum pension being paid to retirees of the period 01.11.2002 to 30.04.2005 may also be revised with effect from to 01.05.2005 with reference to paragraph (b) above.

9. Pending amendments to PNB (Employees) Pension Regulations,

1995, pension may be computed provisionally after obtaining undertaking from pensioners/family pensioners/nominees as per performa enclosed (Annexure 14) to enable pension fund to make adjustment, if any, at a later stage.

10. The Competent recommending and sanctioning authorities are advised to prepare Pension Payment Proposals and Family Pension Payment Proposals on the revised format in case of employees retired/retiring on or after 01.05.2005. The revised formats of Annexure-I (Pension Payment Proposal) and Annexure-11 (Family Pension Payment Proposal) of Pension Fund Circular No. 5/2000 dated 30.09.2000 are enclosed herewith.

11. As regards revision of pension of the retirees mentioned in paragraph

(4) above, our Department has already sent proforma of undertakings (Annexure-15 and Annexure-16) to all the Regional Offices for obtaining Letter of Undertaking from all the pensioners/family pensioners retired/expired on or after 01.04.1998 to31.10.2002 and 01.11.2002 to 30.04.2005 and onwards.
