    PUNJAB LOCAL GOVERNMENT ACT 2013(XVIII of 2013)

    A%Atto rationalize and reorganize the local government system in the Punjab.

    Pr"&!". Whereas it is expedient to establish an elected local governmentsystem to devolve political, administrative and financial responsibility and authority tothe elected representatives of the local governments; to promote good governance,effective delivery of services and transparent decision making through institutionalizedparticipation of the people at local level; and, to deal with ancillary matters;

    It is enacted as follows!

    C@APTER IINTRO*UCTION1. Short tt!"# "$t"%t &%' o"%""%t. "#$ %his &ct may be cited as the'un(ab )ocal *overnment &ct +#-.

    "+$ It extends to the whole of the 'un(ab except the antonment areas orany other area excluded by the *overnment by notification in the official *azette.

    "-$ It shall come into force on such date as the *overnment may, bynotification, appoint and different dates may be appointed for coming into force ofdifferent provisions of this &ct.

    2. *"f%to%+.In this &ct

    "a$ /&uthority0 means a 1istrict 2ducation &uthority or a1istrict 3ealth &uthority;"b$ /budget0 means an official statement of the income andexpenditure of a local government for a financial year;"c$ /building0 includes any shop, house, hut, outhouse,shed, stable or enclosure built of any material and used for any purpose,and also includes a wall, well, verandah, platform, plinth, ramp, stair!caseand steps;"d$ /building line0 means a line beyond which the outer faceor any part of an external wall of a building may not pro(ect in thedirection of any street, existing or proposed;

    "e$ /bye!laws0 means bye!laws made under this &ct;(f) /cattle0 includes cows, buffaloes, bulls, oxen, bullocks,heifers, calves, camels, sheep, goats and others;"g$ /hairman0 means the hairman of a local government;"h$ /ode0 means the ode of riminal 'rocedure, #454 "6of #454$;"i$ /conservancy0 means the collection, treatment, removaland disposal of refuse;"($ /dairy0 includes any farm, cattle!shed, cow!house, milkstore, milk shop or any other place from where milk or milk products aresupplied for sale;

    (k) /1eputy 7ayor0 means a 1eputy 7ayor of the7etropolitan orporation or a 7unicipal orporation;"l$ /1istrict0 means a 1istrict notified under the 'un(ab)and 8evenue &ct, #59: "6II of #59:$;

    "m$ /drain0 includes a sewer, a house drain, a drain of anyother description, a tunnel, a culvert, a ditch, a channel or any otherdevice for carrying sullage or rain water;"n$ /dwelling house0 means any building used substantiallyfor human habitation;"o$ /2lection ommission0 means the 2lection ommission

    constituted under &rticle +#4 of the onstitution of the Islamic 8epublicof 'akistan;"p$ /factory0 means a factory as defined in the $ /food0 includes every eatable used for food or drink byhuman beings but does not include drugs or water;"r$ /*overnment0 means *overnment of the 'un(ab;"s$ /infectious disease0 means cholera, plague, smallpoxand tuberculosis, and includes such other disease as the *overnmentmay, by notification, declare to be an infectious disease for purposes ofthis &ct;

    "t$ /land0 includes the land which is being built up or is builtup or is covered with water or is under cultivation or is fallow;"u$ /)ocal uid waste, drainage, public

    toilets, express ways bridges, flyovers, public roads, streets, foot paths,traffic signals, pavements and lighting thereof, public parks, gardens,graveyards, arboriculture, landscaping, billboards, hoardings, firefighting,land use control, zoning, master planning, classification declassificationor reclassification of commercial or residential areas, markets, housing,urban or rural infrastructure, environment and construction, maintenance

    or development of these services and enforcement of any law relating tomunicipal services;"ff$ /nuisance0 includes any act, omission, place or thing

    which causes or is likely to cause in(ury, danger, annoyance or offence tothe sense of sight, smell or hearing or which is or may be dangerous tolife or in(urious to health or property;"gg$ /occupier0 means any person, for the time being, inactual occupation of the land or building and includes an owner in actualoccupation of the land or building;"hh$ /owner0 includes the person for the time being receivingthe rent of land and buildings or either of them, whether on account of or

    as agent or trustee for any person or society or for any religious orcharitable purpose or who would so receive the same if land or building

    was let to a tenant;"ii$ /peasant0 means a person who is a landless farm workeror, one who during the period of five years preceding the year in which theelection is held, has been the owner of not more than five acres of land anddepends directly on it for subsistence living;"(($ /prescribed0 means prescribed by the rules;"kk$ /prohibited zone0 means any area or areas within a localgovernment declared as prohibited zone by a public notice by the localgovernment for purposes of this &ct;

    "ll$ /'rovince0 means 'rovince of the 'un(ab;"mm$ /'rovincial &llocable &mount0 means the moniesdeclared as such for distribution among local governments in accordance

    with the provisions of this &ct;"nn$ /'rovincial onsolidated >$ /public street0 means a street maintained by the*overnment or by a local government or by any other local authority;"rr$ /public way0 means a way maintained by the*overnment or by a local government or by any other local authority;"ss$ /public place0 means any building, premises or place to

    which the public have access;"tt$ /rate0 includes cess;"uu$ /refuse0 includes rubbish, offal, night!soil, carcasses ofanimals, deposits of sewerage, waste and any other offensive matter;"vv$ /rent0 means whatever is by law payable in money orkind by a tenant or lessee on account of the occupation of any building or

    land;"ww$ /revenue estate0 means a revenue estate declaredunder the 'un(ab )and 8evenue &ct, #59: "6II of #59:$;"xx$ /road0 includes a road which is not a thoroughfare;"yy$ /rules0 means rules made under this &ct;

    "zz$ /rural area0 means the area of a 1istrict ouncil;"aaa$ /@chedule0 means a @chedule appended to this &ct;"bbb$ /street0 includes a street which is not a thoroughfare;"ccc$ /streets line0 means a line dividing the land comprisedin, and forming part of, a street from the ad(oining land;"ddd$ /tax0 includes any cess, rate, fee, toll or other charge

    levied under this &ct;"eee$ /technocrat0 means a person who is the holder of adegree re>uiring conclusion of at least sixteen years of educationrecognized by the 3igher 2ducation ommission and at least five yearsof experience in the relevant field;"fff$ /%ehsil0 means a %ehsil notified under the 'un(ab )and8evenue &ct, #59: "6II of #59:$;"ggg$ /?nion ouncil0 means an area notified as a ?nionouncil under this &ct;"hhh$ /urban area0 means an area within the (urisdiction of the7etropolitan orporation, a 7unicipal orporation, or a 7unicipal

    ommittee and includes any other area which the *overnment may, bynotification, declare to be an urban area for purposes of this &ct;"iii$ /vehicle0 means a wheeled conveyance capable ofbeing used on a road or street;"((($ /6ice hairman0 means the 6ice hairman of a localgovernment;

    "kkk$ /village0 means an integrated and contiguous human habitation commonlyidentified by a name and includes a dho, cha, gao!n, bastior any othercomparable habitation;

    "lll$ /voter0 means a person, whose name for the time being appears on theelectoral rolls prepared or adapted for the purposes of the election under

    this &ct;"mmm$ /worker0 means a person directly engaged in work or is dependent

    on personal labour for subsistence living and includes a worker asdefined in the 'un(ab Industrial 8elations &ct +# "I of +#$; and

    "nnn$ /youth0 means a person who is twenty one years old and is less thantwenty five years of age on the last day fixed for filing of nominationpapers.

    3. S,"++o%. "#$ %he following local governments established under this &ctshall succeed the rights, assets and liabilities of the local governments establishedunder the 'un(ab )ocal *overnment Ardinance, +# "III of +#$ for the local area

    "a$ the 7etropolitan orporation shall succeed the rights, assets and liabilities ofthe ity 1istrict *overnment and %own 7unicipal &dministrations;

    "b$ a 1istrict ouncil, 7unicipal orporation or 7unicipal ommittee shall succeedthe rights, assets and liabilities of the ity 1istrict *overnment, 1istrict*overnment and %ownB%ehsil 7unicipal &dministrations which fall within thearea of the 1istrict ouncil, 7unicipal orporation or 7unicipal ommittee;

    "c$ a 7unicipal ommittee shall succeed the rights, assets and liabilities of theity 1istrict *overnment, 1istrict *overnment, %ownB%ehsil 7unicipal&dministration and ?nion &dministration which fall within the area of the7unicipal ommittee;

    "d$ a ?nion ouncil shall succeed the rights, assets and liabilities of the ?nion

    &dministration which falls within the area of the ?nion ouncil; and"e$ an &uthority shall succeed the rights, assets and liabilities of the ity 1istrict

    *overnment or 1istrict *overnment respectively to the extent of health andeducation.

    "+$ %he *overnment or an officer designated by the *overnment shall, within onehundred and eighty days of the commencement of this &ct, divide rights, assets andliabilities of the local governments amongst the local governments and the*overnment, and the decision of the *overnment or of the designated officer shall befinal.

    -. Lo&! o/"r%"%t+ to or th% th" Pro/%&! fr&"or. "#$ %he localgovernments established under this &ct shall function within the 'rovincial frameworkand shall faithfully observe the

    "b$ such local government shall, to the extent and in the manner specified inthe notification, be the successor of the local government so divided orreconstituted.

    7. *"!t&to% of U%o% Co,%!+. "#$ & ?nion ouncil shall be an areaconsisting of one or more revenue estates or, in the case of an area where revision of

    settlement under the law has not taken place, one or more census villages or, in thecase of an urban area, a census block or blocks as delimited for purposes of the lastpreceding census or a census block and a revenue estate, notified as such by the*overnment.

    "+$ &s far as possible"a$ the area of a ?nion ouncil shall be a territorial unity;"b$ the boundaries of a ?nion ouncil shall not cross the limits of the

    7etropolitan orporation, a 7unicipal orporation #CDDDE or a 1istrict ouncil;and

    "c$ the population of ?nion ouncils within a local government shall beuniform.

    8. *"!t&to% of &r'+ % M,%4&! Cott""+. "#$ %he *overnment shall, inthe prescribed manner, delimit a 7unicipal ommittee into wards for election ofmembers of the 7unicipal ommittee on general seats.

    "c$ one technocrat member;"d$ one youth member; and#C"e$ such non!7uslim members, not exceeding five, as the *overnment may

    notify for each 1istrict ouncil.E"-$ %he members of a 1istrict ouncil shall, in the first session of the 1istrict

    ouncil, elect, as (oint candidates, from amongst the members of the 1istrict ouncil,

    the hairman and the 6ice hairman or 6ice hairmen of the 1istrict ouncilmentioned in the

    7unicipal orporation, the 7ayor and the 1eputy 7ayor or 1eputy 7ayors mentionedin the

    description in the electoral rolls of any person listed or of an omission of the name ofany person entitled to be enrolled or of inclusion of the name of any person not soentitled.

    "-$ 2very person whose name is entered in the electoral roll shall be entitledto cast a vote at the direct elections of the local government.

    C22. A44o%t"%t of *+trt R"t,r%% Off"r# R"t,r%% Off"r "t. "#$%he 2lection ommission shall appoint from amongst the officers of the 2lectionommission, the *overnment, a body or entity controlled by the *overnment,1istrict 8eturning Afficers, 8eturning Afficers and &ssistant 8eturning Afficers forpurposes of election under this &ct.

    "+$ &n &ssistant 8eturning Afficer shall assist the 8eturning Afficer inthe performance of his functions under this &ct and may, sub(ect to suchconditions as may be imposed by the 2lection ommission, exercise the powersand perform the functions of the 8eturning Afficer, under the control of the 1istrict8eturning Afficer.

    "-$ %he 1istrict 8eturning Afficer shall do all such acts as may be necessaryfor effectively conducting an election in accordance with the provisions of this &ct andthe rules.E

    +C23. Po!!% +t&to%+. "#$ %he 8eturning Afficer shall, before such time as the2lection ommission may fix, submit to the 1istrict 8eturning Afficer a list ofpolling stations he proposes to provide in a ?nion ouncil or ward for purposes ofelection of a member for the ?nion ouncil or ward.

    "+$ @ub(ect to the direction of the 2lection ommission, the 1istrict8eturning Afficer may make such alterations in the list of polling stations

    submitted under subsection "#$ as he deems necessary and shall, within fifteendays before the polling day, publish in the official *azette the final list of pollingstations specifying the electoral area, the voters who are entitled to vote at eachpolling station.

    "-$ %he 8eturning Afficer shall establish in each ?nion ouncilor ward apolling station or polling stations according to the final list published undersubsection "+$.

    "=$ & polling station shall not be located in any premises belonging to or underthe control of any candidate.E

    C2-. Pr"+'% Off"r+ &%' Po!!% Off"r+. "#$ & 8eturning Afficer shallappoint for each polling station a 'residing Afficer and such number of &ssistant'residing Afficers and 'olling Afficers from amongst the officers of the*overnment, local governments and corporations established or controlled bysuch governments to assist the 'residing Afficer as the 8eturning Afficer mayconsider necessary.

    "+$ & person who is or has, at any time, been in the employment of anycandidate shall not be appointed as a 'residing Afficer, &ssistant 'residingAfficer or 'olling Afficer.

    "-$ & list of such 'residing Afficers, &ssistant 'residing Afficers and'olling Afficers shall be submitted to the 1istrict 8eturning Afficer within fifteendays before the polling day for its approval and no change in the personnel shallbe made except with the approval of the 2lection ommission.

    "=$ & 'residing Afficer shall conduct the poll in accordance with the

    provisions of this &ct and the rules, and shall be responsible for maintaining orderat the polling station and shall report to the 8eturning Afficer any factor incident

    which may, in his opinion, affect the fairness of the poll.

    "G$ %he 'residing Afficer may, during the course of poll, entrust such ofhis functions as may be specified by him to any &ssistant 'residing Afficer and itshall be the duty of such &ssistant 'residing Afficer to perform the functions soentrusted.

    "9$ %he 8eturning Afficer shall authorize one of the &ssistant 'residingAfficers to act in place of the 'residing Afficer if the 'residing Afficer is, at any

    time, during the poll, by reason of illness or any other cause, not present at thepolling station or is unable to perform his functions; and any absence of the'residing Afficer and the reasons for the absence shall, as soon as possible afterthe close of poll, be reported to the 8eturning Afficer.

    ":$ %he 8eturning Afficer may, at any time during the poll, for reasons to berecorded in writing, suspend any 'residing Afficer, &ssistant 'residing Afficer or 'ollingAfficer and make such arrangements as he may consider necessary for theperformance of the functions of the officer so suspended.E

    2. S,44!; of "!"tor&! ro!!+. "#$ %he 2lection ommission shall provide theelectoral rolls of the constituency to the 8eturning Afficer.

    "+$ %he 8eturning Afficer shall provide to the 'residing Afficer the electoralrolls containing the names of the voters entitled to vote at a polling station.

    25. Oth"r 4o"r+ &%' f,%to%+ of th" E!"to% Co++o%. In addition to thepowers and functions of the 2lection ommission under this &ct, the 2lectionommission shall, in relation to local government elections, exercise such other powersand perform such other functions as may be prescribed.

    holders of elected public office and part!time officials remunerated eitherby salary or fee; provided that in case of a person who has resigned orretired from any such service, a period of not less than two years haselapsed since his resignation or retirement;

    "f$ is under an existing contract for work to be done or goods to be suppliedto a local government or has otherwise any direct pecuniary interest in its

    affairs;"g$ has been dismissed from public service on the grounds of misconduct

    unless a period of five years has elapsed since his dismissal;"h$ has been removed or compulsorily retired from public service on the

    grounds of misconduct unless a period of three years has elapsed sincehis removal or compulsory retirement;

    "i$ has been convicted by a court of competent (urisdiction for a term notless than two years for an offence involving moral turpitude or misuse ofpower or authority under any law unless a period of five years haselapsed since his release; #CandE

    "($ has been convicted for an offence involving activities pre(udicial to the

    ideology, interest, security, unity, solidarity, peace and integrity of'akistan unless a period of five years has elapsed since his release+C.E

    "k$ -CDDDE"-$ If a person"a$ is found by the 2lection ommission to have contravened any provisions

    of subsections "#$ or "+$, he shall stand dis>ualified from being acandidate for election to any office of a local government for a period offour years; or

    "b$ has been elected as a member of a local government and is found by the2lection ommission to have contravened any provision of subsections"#$ or "+$, he shall cease forthwith to be an elected member or to hold the

    office of such member and shall stand dis>ualified from being acandidate for election to a local government for a period of four years.

    =C"=$ & candidate who claims to be a 7uslim shall submit to the 8eturningAfficer the declaration given in Finth @chedule along with the nomination papers.E

    27. B&r &&%+t ',&! ""r+h4. "#$ & 7ayor, a 1eputy 7ayor, a hairman or a6ice hairman may contest election for any other political office after resigning from theoffice of the 7ayor, 1eputy 7ayor, hairman or 6ice hairman.

    "+$ & member of a local government, other than the hairman of a ?nionouncil, may contest election for any other political office without resigning from themembership of the local government but any such member shall not simultaneously

    hold more than one office."-$ If a member of a local government is elected to any other political office,

    on the notification of election of that political office, his seat as member of the localgovernment shall become vacant.

    "=$ If a hairman of a ?nion ouncil is elected as the 7ayor or a 1eputy7ayor, or as the hairman or a 6ice hairman of the 1istrict ouncil, he shall ceaseto be the hairman of the ?nion ouncil and the seat of the hairman of the ?nionouncil shall stand vacated.

    "G$ Fothing in this section shall apply to bar a member of a local governmentto contest the election of 7ayor, 1eputy 7ayor, hairman or 6ice hairman of a localgovernment or a member of an &uthority.

    30. T"r of off". "#$ @ub(ect to the this &ct, the term of office of a localgovernment shall be five years commencing on the date on which it holds its first

    meeting."+$ %he first meeting of a local government shall be held not later than thirty

    days from the day on which the names of its members are notified."-$ When an elected local government is, for any reason, not in office, the

    *overnment may appoint an administrator to perform the functions of the localgovernment until the elected local government assumes office but such period shallnot exceed six months.

    "=$ @ave as otherwise provided, a local government, other than a ?nionouncil, shall, in its first meeting and to the exclusion of any other business, elect the7ayor and 1eputy 7ayor or 1eputy 7ayors, hairman and 6ice hairman in theprescribed manner.

    31. O&th of off". "#$ & member shall, before taking his seat in a localgovernment other than an &uthority, make and subscribe to an oath in such form asmay be prescribed.

    "+$ %he 7ayor, 1eputy 7ayor, hairman and 6ice hairman, other than thehairman of an &uthority shall assume office by making and subscribing to an oath insuch form as may be prescribed.

    "-$ & 7ayor, 1eputy 7ayor, hairman, 6ice hairman and a member shall,after taking oath of office, declare his assets in the prescribed manner.

    32. C&+,&! /&&%;. "#$ If the office of a 7ayor, 1eputy 7ayor, hairman or 6ice

    hairman other than the office of hairman or 6ice hairman of an &uthority, or amember indirectly elected on a reserved seat, for any reason, falls vacant during theterm of office of a local government, the new 7ayor, 1eputy 7ayor, hairman, 6icehairman or member shall be elected in the prescribed manner within thirty days fromthe date when such vacancy is notified and he shall, sub(ect to this &ct, hold office forthe remaining term of the local government.

    "+$ If the office of hairman of a ?nion ouncil, for any reason, falls vacantduring the term of office of the ?nion ouncil, the 6ice hairman of the ?nion ouncilshall become hairman of the ?nion ouncil.

    "-$ If the office of 6ice hairman of a ?nion ouncil, for any reason, fallsvacant during the term of office of the ?nion ouncil, the members of the ?nion

    ouncil shall, from amongst themselves, elect the 6ice hairman of the ?nion ouncil."=$ If a member of a ?nion ouncil is elected as 6ice hairman of the ?nion

    ouncil under subsection "-$ or the office of a directly elected member of the ?nionouncil, for any reason, falls vacant during the term of office of the ?nion ouncil, thenext candidate in the same category who secured the highest number of votes in theelection of the ?nion ouncil shall become member of the ?nion ouncil for theremaining term of the ?nion ouncil.

    "G$ If the office of a directly elected member of a 7unicipal ommittee, forany reason, falls vacant during the term of office of the 7unicipal ommittee, the newmember shall be elected in the prescribed manner within one year from the date suchvacancy is notified and he shall, sub(ect to this &ct, hold office for the remaining term

    of the 7unicipal ommittee."9$ If the vacancy in the office of a directly elected member of a 7unicipal

    ommittee occurs within one year before the expiry of the term of the 7unicipalommittee, the vacancy shall not be filled.

    ":$ If the office of a hairman or a 6ice hairman of an &uthority for anyreasons, falls vacant during the term of office of the &uthority, the *overnment shallappoint a new hairman or the 6ice hairman of the &uthority within thirty days fromthe date of such vacancy and the new hairman or 6ice hairman shall, sub(ect to this&ct, hold office for the remaining term of the &uthority.

    33. R"o/&!. "#$ Where proceedings of dis>ualification under section +: havebeen initiated against a member, the 2lection ommission or any authority authorisedby it may issue a notice to the member to show cause within a specified period as to

    why proceedings against him may not be taken for his removal for breach of any of theprovisions of section +:.

    "+$ Where the 2lection ommission or an authority authorised by it is notsatisfied with the reply to the notice referred to in subsection "#$ or any reply to thesaid notice is not filed within the period fixed by it, it may order for an en>uiry in thematter and for that purpose appoint an en>uiry officer.

    "-$ An the basis of en>uiry held under subsection "+$, the 2lectionommission or an authority authorised by it may order the removal of the member.

    3-. R"+%&to%. "#$ & 7ayor, 1eputy 7ayor, hairman, 6ice hairman or amember may resign his office by tendering resignation in writing under his hand to thelocal government of which he is the 7ayor, 1eputy 7ayor, hairman, 6ice hairmanor a member.

    "+$ %he resignation tendered under subsection "#$ shall be deemed to havebeen accepted and effective forthwith and the local government shall forward copies ofthe resignation to the 2lection ommission and the *overnment.3. Vot" of %o>o%f'"%". "#$ @ub(ect to this section, a 7ayor, 1eputy 7ayor,hairman or 6ice hairman of a local government, other than that of an &uthority andof a ?nion ouncil, shall cease to hold office if a vote of no!confidence is passed

    against him in the prescribed manner by two!third ma(ority of the total number ofmembers of the local government.

    "+$ & motion of no!confidence shall not be moved before the expiry of oneyear of his assumption of office as the 7ayor, 1eputy 7ayor, hairman or 6icehairman.

    "-$ Where a motion of no!confidence against the 7ayor, 1eputy 7ayor,hairman or 6ice hairman has been moved and fails for want of the re>uisitema(ority of votes in a meeting, no similar motion shall be moved against him before theexpiry of one year from the date when such motion was moved.

    35. B&r &&%+t r">"!"to% or r">&44o%t"%t. When a 7ayor, 1eputy 7ayor,

    hairman or 6ice hairman, of a local government, other than the hairman or 6icehairman of an &uthority, is removed from office on the ground of misconduct, he shallnot, during the unexpired period of the term of that local government be eligible for re!election or re!appointment to any office during the remaining term of the localgovernment.

    36. Notf&to% of "!"to%# r"+%&to% &%' r"o/&!. "#$ 2very election orremoval of an elected member shall be notified by the 2lection ommission.

    "+$ %he *overnment shall notify"a$ vacation of office owing to resignation or death of a member; and"b$ election, appointment or vacation of office, owing to any cause, of the

    7ayor, 1eputy 7ayor, hairman or 6ice hairman.

    37. E!"to% 4"tto%. "#$ @ub(ect to this &ct, an election to an office of a localgovernment shall not be called in >uestion except by an election petition.

    "+$ & candidate may, in the prescribed manner, file an election petitionbefore the 2lection %ribunal challenging an election under this &ct.

    38. E!"to% Tr,%&!. "#$ %he 2lection ommission shall, by notification, appointan 2lection %ribunal for such local area as may be specified in the notification.

    "+$ %he 2lection ommission may transfer an election petition from one

    2lection %ribunal to another 2lection %ribunal."-$ @ub(ect to the rules, the 2lection ommission may, by notification, issue

    instructions for presentation, hearing and trial of an election petition."=$ %he 2lection %ribunal shall decide an election petition within one hundred

    and twenty days from the date of filing of the election petition.

    -0. Po"r+ of E!"to% Tr,%&!. %he 2lection %ribunal may exercise powers of acivil court trying a suit under the ode of ivil 'rocedure, #54 "6 of #54$ and shall bedeemed to be a ourt within the meaning of sections =4 and =4+ of the ode.

    -1. *"+o% of th" E!"to% Tr,%&!. "#$ %he 2lection %ribunal may, on the

    conclusion of trial of an election petition, make an order !"a$ dismissing the petition;"b$ declaring the election of the returned candidate to be void;"c$ declaring the election of the returned candidate to be void and the

    petitioner or any other contesting candidate to have been duly elected; or"d$ declaring the election as a whole to be void."+$ %he decision of the 2lection %ribunal shall take effect from the date on

    which it is made and shall be communicated to the 2lection ommission.

    -2. Gro,%' for '"!&r% "!"to% of r"t,r%"' &%''&t" /o'. "#$ %he 2lection%ribunal shall declare the election of the returned candidate to be void if it is satisfied

    that !"a$ the nomination of the returned candidate was invalid; or"b$ the returned candidate was not, on the nomination day, >ualified for or

    was dis>ualified from, being elected as a member; or"c$ the election of the returned candidate has been procured or induced by

    any corrupt or illegal practice; or"d$ corrupt or illegal practice has been committed by the returned candidate or

    his election agent or by any other person with the connivance of thecandidate or his election agent.

    "+$ %he election of a returned candidate shall not be declared void if the2lection %ribunal is satisfied that any corrupt or illegal practice was committed without

    the consent or connivance of that candidate or his election agent and that the candidateand the election agent took all reasonable precaution to prevent its commission.

    -3. Gro,%' for '"!&r% & 4"r+o% oth"r th&% & r"t,r%"' &%''&t" "!"t"'.%he 2lection %ribunal shall declare the election of the returned candidate to be void andthe petitioner or any other contesting candidate to have been duly elected, if it is soclaimed by the petitioner or any of the respondents and the 2lection %ribunal is satisfiedthat the petitioner or such contesting candidate was entitled to be declared elected.

    --. Gro,%' for '"!&r% "!"to%+ &+ & ho!" /o'. %he 2lection %ribunal shalldeclare the election as a whole to be void if it is satisfied that the result of the election

    has been materially affected by reasons of!"a$ the failure of any person to comply with the provisions of this &ct or the

    rules; or"b$ the prevalence of extensive corrupt or illegal practice at the election.

Where after the conclusion of the trial, itappears that there is an e>uality of votes between two or more contesting candidatesand the addition of one vote for one such candidate would entitle him to be declaredelected, the 2lection %ribunal shall draw a lot in respect of such candidates and thecandidate on whom the lot falls shall be deemed to have received the highest number ofvotes entitling him to be declared elected.

    -5. A44"&! &&%+t th" or'"r+ of E!"to% Tr,%&!. "#$ &ny person aggrievedby a final order of an 2lection %ribunal may, within thirty days of the communication ofsuch order, prefer an appeal to the )ahore 3igh ourt.

    "+$ %he )ahore 3igh ourt shall decide an appeal preferred undersubsection "#$ within three months.

    -6. Corr,4t 4r&t". & person guilty of bribery, personating or undue influence shallbe punishable with imprisonment for a term which may extend to three years or withfine which may extend to one hundred thousand rupees or with both.

    -7. Br"r;. & person is guilty of bribery if he, directly or indirectly, by himself orby any other person on his behalf

    "a$ receives, agrees or contracts for any gratification for voting or refrainsfrom voting or refrains from being a candidate at or withdrawing orretiring from, an election;

    "b$ gives, offers or promises any gratification to any person for purposes of !"i$ inducing a person to be or to refrain from being a candidate at an

    election; or"ii$ inducing a voter to vote or refrain from voting at any election; or"iii$ inducing a candidate to withdraw or retire from an election; or"iv$ rewarding a person for having been or for having refrained from

    being a candidate at an election; or"v$ rewarding a voter for having voted or refrained from voting at an

    election; or"vi$ rewarding a candidate for having withdrawn or retried from an

    election.E$4!&%&to%. In this section, Hgratification includes a gratification in money orestimable in money and all forms of entertainment or employment for reward.

    -8. P"r+o%&t%. & person is guilty of personating, if he votes or applies for aballot paper for voting as some other person whether that other person is living, deador fictitious.

    0. U%'," %f!,"%". & person is guilty of undue influence, if he(a) in order to compel any person to vote, refrain from voting, or to induce or

    compel any person to withdraw his candidature at an election, directly orindirectly, by himself or by any other person on his behalf

    "i$ makes or threatens to make use of any force, violence or restraint;"ii$ inflicts or threatens to inflict any in(ury, damage, harm or loss; or"iii$ uses any official influence or *overnmental patronage; or

    (b) on account of any person having voted or refrained from voting, orhaving withdrawn his candidature, does any of the acts specified inclause "a$; or

    (c) by abduction, duress or any fraudulent device or contrivance!"i$ impedes or prevents the free exercise of the franchise by a voter;

    or"ii$ compels, induces or prevails upon any voter to refrain from voting

    or compels any voter to vote.

    "i$ disturbs or causes annoyance to any voter visiting a polling stationfor the purpose of voting; or

    "ii$ interferes with the performance of the duty of a presiding officer,polling officer or any other person performing any duty at a pollingstation; or

    (d) abets the doing of any of the aforesaid acts.

    -. T&4"r% th 4&4"r+. & person is guilty of an offence punishable withimprisonment for a term which may extend to six months or with fine which may extendto twenty thousand rupees or with both, if he !

    "a$ fraudulently defaces or destroys any nomination paper or ballot paper;

    "b$ fraudulently takes out of the polling station any ballot paper or puts intoany ballot box any ballot paper other than the ballot paper he isauthorized under the rules to put in;

    "c$ without due authority !"i$ supplies any ballot paper to any person;"ii$ destroys, takes, opens or otherwise interferes with any ballot box or

    packet or ballot papers in use for the purpose of election; or"iii$ breaks any seal affixed in accordance with the provisions of the rules; or

    "d$ causes any delay or interruption in the beginning, conduct or completionof the procedure re>uired to be immediately carried out on the close ofthe poll; or

    "e$ fraudulently or without due authority attempts to do any of the aforesaidacts.

    . I%t"rf"r"%" th th" +"r"; of /ot%. & person is guilty of an offencepunishable with imprisonment which may extend to six months or with fine which mayextend to twenty thousand rupees or with both, if he !

    "a$ interferes or attempts to interfere with a voter when he records his vote;"b$ in any manner obtains or attempts to obtain, in a polling station,

    information as to the candidate for whom a voter in that station is aboutto vote or has voted; or

    "c$ communicates at any time any information obtained in a polling station

    about the candidate for whom a voter in that station is about to vote orhas voted.

    5. :&!,r" to &%t&% +"r";. &ny candidate or polling agent attending apolling station, or any person attending the counting of votes, is guilty of an offencepunishable with imprisonment which may extend to six months or with fine which mayextend to twenty thousand rupees or with both, if he !

    (a) fails to maintain or aid in maintaining the secrecy ofvoting; or

    (b) communicates any information obtained at thecounting of votes as to the candidate for whom any vote is given by any

    particular ballot paper.

    6. Co%',t of off&!+. & presiding officer, polling officer or any other officer orofficial performing duty in connection with an election, or any member of a police force,is guilty of an offence punishable with imprisonment for a term which may extend to six

    (a) persuades any person to give his vote;(b) dissuades any person from giving his vote;(c) influences in any manner the voting of any person;

    (d) does any other act calculated to further or hinder theelection of a candidate;

    (e) fails to maintain or aid in maintaining the secrecy ofvoting;

    (f) communicates, except for any purpose authorisedby any law, to any person before the poll is closed any information as tothe name or number on the electoral roll of any voter who has or has notapplied for a ballot paper, or has or has not voted at a polling station; or

    (') communicates any information obtained at thecounting of votes as to the candidate for whom any vote is given by anyparticular ballot paper.

',t; % o%%"to% th "!"to%. & 8eturning Afficer,&ssistant 8eturning Afficer, 'residing Afficer, &ssistant 'residing Afficer, or any otherperson employed by any such officer in connection with his official duties imposed byor under this &ct is guilty of an offence punishable with imprisonment for a term whichmay extend to two years or with fine which may extend to fifty thousand rupees or withboth, if he, willfully and without reasonable cause, commits breach of any such officialduty, by act or omission.

    "-$ %he *overnment may, on the recommendations of the 'un(ab )ocal*overnment ommission and by notification in the official *azette, delegate anyfunction of a 7ayor or a hairman to a 1eputy 7ayor or 6ice hairman sub(ect tosuch conditions as may be prescribed in the notification.

    "=$ &ll acts of a local government, whether executive or otherwise, shall beexpressed to be taken in the name of the local government and shall be authenticatedin the manner prescribed.

    "=$ & meeting of a local government shall be open to public except when a localgovernment, by simple ma(ority, decides to consider any matter in a session attendedexclusively by its members and officials.

    "G$ %he hief Afficer or an officer authorised by him shall record minutes of themeeting of a local government and submit the same to the person who presided themeeting for approval.

    "9$ %he hief Afficer shall, after approval, issue the minutes of a meeting under hissignatures.

    ":$ & member who, directly or indirectly, by himself or by any partner, employer oremployee has any share or interest in respect of any matter or has actedprofessionally, in relation to any matter on behalf of any person having therein anyshare or interest as aforesaid, shall not vote or take any other part in any proceedingsof the local government or any of its committees.

    58. Co%tr&t+. "#$ &ll contracts made by or on behalf of a local government shallbe

    "a$ in writing and expressed to be made in the name of the local government;

    "b$ executed in such manner as may be prescribed; and"c$ reported to the local government by the 7ayor or the hairman at the meeting

    next following the execution of the contract."+$ & local government may assign any of its functions to a public or private

    organization on such terms and conditions as may be prescribed or enter into public!private partnership for efficient performance of any of its functions.

    60. R"4ort% &%' "/&!,&to%."#$ & local government shall !"a$ maintain such record of its working as may be prescribed or re>uired by the

    *overnment;"b$ prepare and publish such periodical reports and returns as may be prescribed

    or re>uired by the *overnment; and"c$ adopt such other measures as may be necessary for the publication of

    information about the working of the local government."+$ %he performance evaluation of officers and officials of the local

    governments shall be made in the prescribed manner.

    C@APTER VII

    UNION COUNCILS61. U%o% Co,%!+. "#$ & ?nion ouncil shall be a body corporate havingperpetual succession and a common seal, with power to ac>uire and hold property andenter into any contract and may sue and be sued in its name.

    "+$ & rural ?nion ouncil shall be called 6illage ouncil and an urban ?nionouncil shall be called ity ouncil.

    "-$ %he hairman of a ?nion ouncil shall be the executive head of the ?nionouncil and the 6ice hairman of the ?nion ouncil shall perform the functions of thehairman when the hairman is unable to perform his functions on account ofabsence or for any other reason.

    "=$ & hairman of a ?nion ouncil shall !"a$ provide leadership for ?nion!wide development and preparation of budget

    and the annual development plan;"b$ present the budget in the ?nion ouncil;"c$ensure that the business of ?nion ouncil is carried out strictly in accordance

    with this &ct and other laws;"d$ issue executive orders to the ?nion @ecretaries;"e$ represent the ?nion ouncil in the 1istrict ouncil; and"f$ report to the concerned authorities in respect of !

    "i$ encroachment on @tate or local government property and violation ofland use and building laws, rules and bye!laws;

    "ii$ dangerous and offensive articles and trades mentioned in @econd@chedule;

    "G$ & ?nion ouncil @ecretary, under the supervision of the hairman, shallcoordinate and facilitate in community development, functioning of the committees anddelivery of municipal services.

    "9$ %he *overnment may, in the prescribed manner, issue a schedule ofestablishment for a ?nion ouncil.

    62. :,%to%+ of th" U%o% Co,%!. "#$ & ?nion ouncil shall"a$ approve the budget of the ?nion ouncil;"b$ approve the levy of tax or fee assigned to the ?nion ouncil;"c$ nominate members of the Panchayat or "usalihat &n(uman and monitor the

    performance of the Panchayator "usalihat&n(uman;

    "d$ provide, improve and maintain public ways, public streets, public open spaces,graveyards, public gardens and playgrounds;

    "e$ arrange lighting of public ways, public streets and public places;"f$ mobilize the community

    "i$ for maintenance of public ways, public streets, culverts, bridges, publicbuildings and local drains;

    "ii$ for plantation of trees, landscaping and beautification of public places in the?nion ouncil;

    "iii$ for prevention and removal of encroachments on public ways, streets andplaces;

    "g$ provide and maintainrural water supply schemes and public sources of drinking

    water, including wells, water pumps, tanks, ponds and other works for thesupply of water and open drains;

    "h$ coordinate with the community organizations for proper maintenance of ruralwater supply schemes and seweragein the prescribed manner;

    ?nion ouncil to such persons and institutions as may be prescribed;"n$ support a public sector agency to establish public facilitation centre in the ?nion

    ouncil for such purpose and on such terms and conditions as may beprescribed;

    "o$ support relief measures in the event of any fire, flood, hailstorm, earth>uake,epidemic or other natural calamity and assisting relevant authorities in reliefactivities;

    "p$ promote local sports;">$ provide for libraries and reading rooms;"r$ take other measures likely to promote the welfare, health, safety, comfort or

    convenience of the inhabitants of the ?nion ouncil;

    "s$ identify deficiencies in delivery of services and making recommendations forimprovement of services to the 1istrict ouncil, 7unicipal orporation or7etropolitan orporation;

    "t$ execute development works in the prescribed manner; and

    "u$ maintain such statistics and data as may be prescribed and disseminateinformation on matters of public interest.

    "+$ & rural ?nion ouncil having urban characteristics, with the approval of the1istrict ouncil may, and if so directed by the *overnment shall, perform any of thefollowing functions

    "a$ exercise control over land!use, land!subdivision, land development and

    zoning by public and private sectors for any purpose, including for industry,commerce markets, shopping and other employment centers, residential,recreation, parks, entertainment, passenger and transport freight and transitstations;

    "b$ enforce all municipal laws, rules and bye!laws regulating its functioning;"c$ regulate affixing of sign!boards and advertisements;"d$ provide, manage, operate, maintain and improve the municipal infrastructure

    and services, including !"i$ water supply and control and development of water sources;"ii$ sewage and sewage treatment and disposal;"iii$ storm water drainage;

    "iv$ sanitation and solid waste collection and sanitary disposal of solid,li>uid, industrial and hospital wastes;

    "v$ roads and streets;"vi$ street markings, parking places, transport stations, stops and public

    transport stands;"vii$ street lighting;"viii$ firefighting;"ix$ parks, playgrounds, open spaces and arboriculture; and"x$ slaughter houses;

    "e$ prevent and remove encroachments;"f$ regulate dangerous and offensive articles and trades;

    "g$ collect approved taxes, fees, rates, rents, tolls, charges, fines and penalties;"h$ regulate markets and services and issue licenses, permits, grant

    permissions and impose penalties for violation thereof as and whereapplicable;

    "i$ manage properties, assets and funds vested in the ?nion ouncil;"($ develop and manage schemes, including site development; and"k$ authorize an officer or officers to issue notice to a person committing any

    municipal offence and initiate legal proceedings for continuance ofcommission of such offence or for failure to comply with the directionscontained in such notice.

    "-$ %he 1istrict ouncil may exercise general supervision and control on the

    performance of functions by the ?nion ouncil under subsection "+$.

    C@APTER VIII

    *ISTRICT COUNCILS63. *+trt Co,%!+. & 1istrict ouncil shall be a body corporate havingperpetual succession and a common seal, with power to ac>uire and hold property andenter into any contract and may sue and be sued in its name.

    6-. :,%to%+ of Ch&r&%. "#$ %he hairman of a 1istrict ouncil shall"a$ ensure that the business of 1istrict ouncil is carried out strictly in accordance

    with this &ct and other laws;

    "b$ ensure efficient, effective and transparent functioning of the 1istrict ouncil;"c$ ensure accomplishment of operational, developmental and financial ob(ectives

    set by the 1istrict ouncil or the *overnment in accordance with provisions ofthis &ct;

    "d$ present tax proposals to the 1istrict ouncil;"e$ present report on the performance of the local government to the 1istrict

    ouncil at least twice in a year;"f$ issue executive orders to the hief Afficer;"g$ represent the 1istrict ouncil at civic or ceremonial functions;"h$ exercise general supervision and control over officers of the 1istrict ouncil;

    "i$ guide and lead officers in achieving the goals and targets fixed by the 1istrictouncil in an effective and efficient manner; and

    "($ perform such other functions as the 1istrict ouncil may, by a general or specialresolution, direct or as may be prescribed.

    "+$ %he hairman of a 1istrict ouncil shall, in relation to the above duties or fortransaction of business of the 1istrict ouncil, exercise such powers as are conferredupon him by or under this &ct or any other law.

    6. Co%',t of th" ,+%"++ of *+trt Co,%!. "#$ %he business of a 1istrictouncil shall be conducted in such manner as may be prescribed.

    "+$ %he *overnment may, in the prescribed manner, issue a schedule of

    establishment for a 1istrict ouncil and such schedule may include planning, finance,regulation and infrastructure offices.

    65. :,%to%+ of *+trt Co,%!.%he 1istrict ouncil shall"a$ approve bye!laws and taxes;"b$ approve annual budget of the 1istrict ouncil including supplementary

    budgetary proposals and long term and short term development plans;"c$ review the performance of all offices working for the 1istrict ouncil;"d$ review the performance report presented by the hairman; and"e$ promote social counseling to inculcate civic and community spirit and motivate

    and galvanize the general public for compliance with municipal laws, rules and

    bye!laws.

    66. Oth"r f,%to%+ of *+trt Co,%!+. & 1istrict ouncil shall be responsiblefor performance of the following municipal functions

    "a$ prevention and removal of encroachment on public ways, streets andproperties;

    "b$ prevention of nuisance in public ways, streets and properties;"c$ regulation of dangerous and offensive articles and trades mentioned in @econd

    @chedule;"d$ regulation or prohibition of the excavation of earth, sand, stones or other

    material;

    "e$ regulation or prohibition of the establishment of brick kilns, potteries and otherkilns;

    "f$ to organize cattle fairs and cattle markets and regulation of sale of cattle andother animals;

    "g$ celebration of public festivals;(h) assistance in provision of relief in the event of any fire, flood, hailstorm,

    earth>uake, epidemicor other natural calamity and assisting relevant authoritiesin relief activities;

    "i$ provision of relief for the widows, orphans, poor, persons in distress andchildren and persons with disabilities;

    "($ promotion of sports including sports for persons with disabilities.

    (k) provision, improvement and maintenance of public ways and streets, publicopen spaces, graveyards, public gardens, playgrounds and farm to marketroads;

    (l) assisting ?nion ouncils in provision and maintenance of rural water supplyschemes and public sources of drinking water, including wells, water pumps,tanks, ponds and other works for the supply of water;

    "m$ construction of culverts, bridges and public buildings;"n$ control over land!use, spatial planning, land!subdivision, land development and

    zoning by public and private sectors for any purpose, including for agriculture,

    industry, commerce markets, shopping and other employment centers,residential, recreation, parks, entertainment, passenger and transport freightand transit stations;

    "o$ enforce all municipal laws, rules and bye!laws regulating its functioning;"p$ promote animal husbandry and dairy development;">$ hold fairs and shows, promotion of public games and sports, celebration of

    national occasions; and"r$ undertake other development activities.

    67. Str,t,r". "#$ %he hairman of a 1istrict ouncil shall be the executive headof the 1istrict ouncil and the 6ice hairman shall perform the functions of the

    hairman when the hairman is unable to perform his functions on account ofabsence or for any other reason.

    "+$ %he hief Afficer shall coordinate and facilitate the performance of functionsassigned to the 1istrict ouncil under supervision of the hairman.

    68. Ch"f Off"r. "#$ & hief Afficer shall be responsible for"a$ coordination;"b$ human resource management;"c$ public relations;"d$ legal affairs; and"e$ emergency services.

    "+$ %he hief Afficer, in carrying out his functions, shall"a$ supervise and coordinate all offices of the 1istrict ouncil responsible for the

    provision of municipal services;"b$ prepare a report on the planning and implementation of development plans

    of the local government for presentation to the house of the localgovernment in its annual budget session;

    "c$ ensure that the business of the local government is carried out inaccordance with law;

    "d$ ensure implementation of environmental and social safeguards;"e$ effect procurements, as prescribed, in accordance with law; and"f$ take action against violators of this &ct, rules or bye!laws.

    70. Off"+ of *+trt Co,%!. %he *overnment may, in the prescribed manner,issue a schedule of establishment for a 1istrict ouncil and such schedule mayinclude planning, finance, municipal regulation and municipal infrastructure offices.

    C@APTER IXMUNICIPAL COMMITTEES

    71. M,%4&! Cott""+. "#$ & 7unicipal ommittee shall each be a bodycorporate having perpetual succession and a common seal, with power to ac>uire andhold property and enter into any contract and may sue and be sued in its name.

    manner and on such terms and conditions as may be prescribed.

    72. Str,t,r". "#$ %he hairman of a 7unicipal ommittee shall be the executivehead of the 7unicipal ommittee and the 6ice hairman shall perform the functions ofthe hairman if the hairman is unable to perform his functions on account of absenceor for any other reason.

    "+$ %he hief Afficer shall coordinate and facilitate the performance of functions

    assigned to the 7unicipal ommittee under the supervision of the hairman.

    73. Ch&r&%. "#$ %he hairman shall !"a$ provide vision for development, leadership and direction for efficient functioning

    of the 7unicipal ommittee;"b$ identify the needs of the local area and evaluate and prioritize them in the light

    of integrated development plans and the estimates of revenue and expenditure,in addition to any applicable national and provincial policies, programs andpro(ects;

    "c$ recommend to the local government, the strategies, programmes and servicesto address prioritized needs;

    "d$ recommend or determine the best way to implement those strategies,programmes and services through partnerships, delegations, contracts andother means for the maximum benefit of the community;

    "e$ maintain administrative and financial discipline of the local government;"f$ present tax proposals to the local government;"g$ issue executive orders to the municipal offices for discharge of the functions;"h$ represent the local government on public and ceremonial occasions;"i$ present proposal to the local government for approval of budget and the revised

    budget; and"($ conduct inspections of municipal offices functioning under the local government."+$ %he hairman shall, in the performance of duties

    "a$ identify and develop criteria in terms of which progress in the implementationof the strategies, programmes and services can be evaluated, including keyperformance indicators;

    "b$ evaluate progress against the key performance indicators;"c$ review the performance of the local government in order to improve

    "i$ economy, efficiency and effectiveness;"ii$ efficiency of revenue collection services; and"iii$ implementation of the bye!laws;

    "d$ oversee formulation and execution of the annual development plan, deliveryof services and functioning of the local government;

    "e$ present report on the performance of the local government to the house of

    the local government at least twice a year; and"f$ perform such other duties and exercise such other powers as may be

    prescribed or as the local government may delegate.

    76. :,%to%+ of M"tro4o!t&% &%' M,%4&! Cor4or&to%+. "#$ %he7etropolitan orporation and a 7unicipal orporation shall

    (a) approve spatial plans, master plans, zoning, land use plans, includingclassification and reclassification of land, environment control, urban design,urban renewal and ecological balances;

    "b$ implement rules and bye!laws governing land use, housing, markets, zoning,environment, roads, traffic, tax, infrastructure and public utilities;

    "c$ approve proposals for public transport and mass transit systems, constructionof express ways, fly!overs, bridges, roads, under passes, and inter!townstreets;

    "d$ approve development schemes for beautification of urban areas;

    "e$ develop integrated system of water reservoirs, water sources, treatmentplants, drainage, li>uid and solid waste disposal, sanitation and othermunicipal services;

    "f$ execute and manage development plans;"g$ exercise control over land!use, land!subdivision, land development and zoning

    by public and private sectors for any purpose, including for agriculture,industry, commerce markets, shopping and other employment centers,residential, recreation, parks, entertainment, passenger and transport freightand transit stations;

    82. A,thort;.# "#$ &n &uthority shall be a body corporate having perpetualsuccession and a common seal, with power to ac>uire and hold property and enter intoany contract and may sue and be sued in its name.

    "+$ %he *overnment shall, through open competition, appoint the hief 2xecutiveAfficer of an &uthority on such terms and conditions as may be prescribed and, until

    so appointed, the *overnment may appoint an officer not below the rank of J@!#4 tolook after the functions of the hief 2xecutive Afficer.

    "-$ %he hief 2xecutive Afficer shall be the 'rincipal &ccounting Afficer of the&uthority and shall perform such functions as are mentioned in this &ct or as may beprescribed or as may be delegated by the &uthority or as the *overnment may assign.

    "=$ &n &uthority may assign any of its functions to a public or private organizationon such terms and conditions as may be prescribed or enter into public!privatepartnership for efficient performance of any of its functions.

    83. :,%to%+ of *+trt E',&to% A,thort;. & 1istrict 2ducation &uthorityshall

    "a$ establish, manage and supervise the primary, elementary, secondaryand higher secondary schools, adult literacy and non!formal basic education,special education institutions of the *overnment in the 1istrict;

    "b$ implement policies and directions of the *overnment includingachievement of key performance indicators set by the *overnment for education;

    "c$ ensure free and compulsory education for children of the age from fiveto sixteen years as re>uired under &rticle +G!& of the onstitution;

    "d$ ensure teaching standards, infrastructure standards, student safetyand hygiene standards and minimum education standards for >uality educationas may be prescribed;

    "e$ undertake students assessment and examinations, ranking of schools on

    terminal examination results and targets, promotion of co!curricular activities,sports, scouting, girl guide, red crescent, award of scholarships and conduct ofscience fairs in *overnment and private schools;

    "f$ approve the budget of the &uthority and allocate funds to educational institutions;

    "g$ plan, execute and monitor all development schemes of educational institutionsworking under the &uthority, provided that the &uthority may outsource itsdevelopment works to other agencies or school councils;

    "h$ constitute school management councils which may monitor academic activities;"i$ plan and finance maintenance of school, support enrolment and retention,

    arrange donation and finances, plan development and may perform any other

    role as may be prescribed; and"($ perform any other function assigned by the *overnment, a ommission or a

    body established by law in the prescribed manner.8-. :,%to%+ of *+trt @"&!th A,thort;. & 1istrict 3ealth &uthority shall

    "a$ establish, manage and supervise primary and secondary health care facilitiesand institutions;

    "b$ approve the budget of the &uthority and allocate funds to health institutions;"c$ provide stewardship, ownership and oversight of health service delivery at

    primary and secondary levels within the policy framework given by the*overnment;

    "d$ coordinate planning and allocate finances for provision of service delivery at

    1istrict level;"e$ develop referral and technical support linkages between primary and secondary

    levels of health care on the one hand and tertiary level health facilities andmedical education institutions on the other;

    "f$ develop linkages between private and public health sectors for enhancing accessand coverage of health care facilities to the general public and improving >ualityof these services;

    "g$ coordinate health related emergency response during any natural calamity oremergency.

    "h$ ensure human resource management and capacity development of healthservice delivery personnel under the policy framework given by the *overnment;

    "i$ ensure performance based contracts with service delivery managers as perprescribed indicators;

    "($ monitor, exercise oversight and performance evaluation of service deliverymanagers as per agreed performance indicators either directly or through a thirdparty;

    "k$ liaison with the *overnment for technical and logistic support in case of anyemergency or disaster like situation;

    "l$ ensure timely and ade>uate reporting of progress on health indicators and issuesrelating to disease surveillance, epidemic control, disaster management to the*overnment;

    (m)implement policies and directions of the *overnment including achievement of

    key performance indicatorsset by the *overnment for health care programmes;"n$ ensure implementation of minimum service delivery standards, infrastructure

    standards, patient safety and hygiene standards and minimum public healthstandards as prescribed by the 'un(ab 3ealth are ommission; and

    "o$ perform any other function as may be assigned by the *overnment.

    "-$ If a person fails to pay any tax or fee or any other money payable to a local

    government, the local government and, if so re>uested by the local government, the*overnment shall recover the tax, fee or other money as arrears of land revenue.

    "=$ %he recovery of tax, fee or other money under subsection "-$ shall not absolvethe person from prosecution for any offence under this &ct or any other law.

    117. M%, r&t" of t&$ "t. "#$ Fotwithstanding anything contained in thishapter, the *overnment may, by rules, determine the minimum rate of a tax or fee tobe levied and collected by a local government.

    "+$ %he *overnment may, for reasons to be recorded in writing and by notificationin the official *azette, exempt the levy of any tax or fee of a local government for aspecified period of not more than fifteen days on any special occasion or in order to

    alleviate the specific hardship suffered by people at large or a section of people.

    C@APTER XVILOCAL GOVERNMENT RELATIONS

    118. R"!&to%+ of Go/"r%"%t &%' !o&! o/"r%"%t+."#$ & local governmentshall collect such 'rovincial tax or taxes within its local area as the *overnment maydirect and the local government shall, after the collection of such tax or taxes, depositthe receipts in the relevant *overnment account.

    "+$ %he *overnment may provide guidelines and render advice to a localgovernment for achieving the ob(ectives of the policy of the *overnment and forpromoting economic, social and environmental security of the 'rovince.

    120. Po"r+ of th" Go/"r%"%t. "#$ %he *overnment may, on therecommendations of the 'un(ab)ocal *overnment ommission, issue directions to alocal government and the local government shall be bound by such directions.

    "+$ Where the situation demands immediate action and the local government failsto comply with the directions given to it under subsection "#$, the *overnment maydirect the officer authorized by it to take such action as the situation may necessitate.

    121. E%tr,+t"%t of f,%to%+ to !o&! o/"r%"%t. "#$ When the *overnmentre>uires a local government to perform any specific task beyond the budgetaryprovisions of the local government, the *overnment shall provide necessary resources
