(. The People's Union for Civil Liberties (PUCL) has been consistently working for

protecting and pholding the h!an rights as well as civil liberties of the people

and has been intervening before this "on'ble Co!!ission and the Corts# Under

the $nternational "!an %ights Principles, it is dty of every State to protect the

h!an rights defenders# $n fact, it is right and responsibility of every individal,

grops and organs of society to pro!ote and protect niversally recognised h!an

rights and fnda!ental freedo!s# The U& eclaration of protecting h!an rights

defenders was adopted by U& eneral sse!bly in *+- rging the States to

acknowledge pblicly the i!portant and legiti!ate role of h!an rights defenders

and the pro!otion of "!an rights, de!ocracy and the rle of law# $n this regard,

we !ay also refer to the report of the U& Special %apporter .argaret Sekaggya

on h!an rights defenders, (*+-) which was presented before the U& "!an%ights Concil wherein the obligation cast on the .e!ber States was highlighted

to ensre that "!an %ights efenders can condct their work in a peacefl

!anner and that no ad!inistrative and legislative provisions are sed to restrict the

rights of defenders in order to show respect to the $nternational "!an %ights

Law#

). This "on'ble Co!!ission has adopted, a!ong others, the following

reco!!endation regarding h!an rights defenders in /ctober, *++01(i) It is the obligation of the State to protect human rights of all.

Individuals, groups or associations who work for promotion and protection

of human rights, commonly referred to as Human ights !efenders, should

also be provided protection by the State against any violence, threats,

retaliation, adverse discrimination, pressure or any arbitrary action as a

conse"uence of their activities for promotion and protection of human

rights and fundamental freedom. #H$ and SH$s can also play an

important role in this regard.%

$t is in this conte2t that the PUCL is concerned abot the prosection and

persection of Teesta Setalvad, 3aved nand and others of the Citi4ens for Peace

and 3stice, who had taken p the isses of the victi!s of 5arat riots which took

place in the year *++*# $t was their intervention before the "on'ble Spre!e Cort

and other corts which lti!ately led to over + conviction so far with other

trials nearing co!pletion# $t was this "on'ble Co!!ission which had challenged

the ac6ittals of all the accsed in 7est 7akery Case before the "on'ble Spre!e

Cort and had soght transfer of i!portant cases otside the State of 5arat8 the

Citi4en for 3stice and Peace was also one of the Petitioners in the case# The 7est

7akery case was transferred to .!bai and eventally the trial cort has

convicted 0 persons# The efforts !ade by the! are re6ired to be appreciated as

they acted for defending and protecting the gross h!an rights violations of thevicti!s of *++* riots# $t is the dty of the State of 5arat and all its ad!inistrative

organs to protect Teesta Setalvad, 3aved nand 9 others of C3P in defending the

legal constittional and h!an rights of the victi!s of 5arat %iots and to

provide the! protection as envisaged in the United &ational "!an %ights

oc!ents, which is also endorsed by this "on'ble Co!!ission#

%. Intern$t#n$* $nd N$t#n$* H!+$n R#'t- O*#'$t#n-/. s stated earlier nder international h!an rights principles there is a dty cast

pon every State to accord ade6ate protection to h!an rights defenders# The

United &ations :Declaration on the Right and Responsibility of Individuals,

Groups and Organs of Society to Promote and Protect Universally Recognized

uman Rights and !undamental !reedoms; (.arch, 000) acknowledges that

h!an rights defenders play a very i!portant role in the pro!otion and protection

of h!an rights and it is the dty of every State and its ad!inistrators to avoid

cri!inalisation, stig!atisation, i!pedi!ents, obstrctions or restrictions on the

work of h!an rights defenders# The U& e2pressed its grave concern that in so!e

instances national secrity and conter terroris! and other !easres have been

!issed to target h!an rights defenders or have hindered their work and

endangered their safety contrary to international law#

0. rt# < of this eclaration stresses that : individuals, groups, institutions and non&

governmental organisations have an important role to play and a responsibility in

safeguarding democracy, promoting human rights and fundamental freedoms and

contributing to the promotion and advancement of democratic societies,

institutions and processes;#

1. The U& eclaration on Protecting "!an %ights efenders adopted by the U&

eneral sse!bly in *+- rged States to acknowledge pblicly the i!portant

and legiti!ate role of h!an rights defenders in the pro!otion of h!an rights,

de!ocracy and rle of law# The declaration also rges States to create a safe and

enabling environ!ent for h!an rights defenders to e2tend spport free fro!

hindrance and insecrity# The eclaration specifically called pon States to

ensre procedral safegards are in place, inclding in cri!inal cases, against

h!an rights defenders ### so as :to avoid the se of nreliable evidence,

nwarranted investigations and procedral delays;#

a. Report of the UN Special Rapporteur

2. The %eport of the U& Special %apporter .argaret Sekaggya on the sitation of

h!an rights defenders, (*+-), as presented before the U& "!an %ights

Concil also deals with h!an rights defenders and reco!!ends1

'ember States should

(a) nsure that defenders can conduct their work in a

conducive legal, institutional and administrative framework. In this

vein, refrain from criminali*ing defenders+ peaceful and legitimate

activities, abolish all administrative and legislative provisions that

restrict the rights of defenders, and ensure that domestic legislation

respects basic principles relating to international human rights law

and standards

(b) $ombat impunity for violations against defenders byensuring that investigations are promptly and impartially

conducted, perpetrators are held accountable, and victims obtain

appropriate remedy. In this conte-t, pay particular attention to

violations committed by non&State actors

(e) nsure that violations by State and non&State actors

against defenders, particularly women defenders, are promptly and

impartially investigated, and ensure that perpetrators are brought to

ustice. /urthermore, provide material resources to ensure the

physical and psychological protection of defenders, including

through gender&sensitive polices and mechanisms(f) 0ublicly acknowledge the particular and significant

role played by women human rights defenders, and those working

on women+s rights or gender issues, and make sure that they are

able to work in an environment free from violence and

discrimination of any sort%

b. National Human Rights Obligations

3. The "on=ble &"%C, has adopted, a!ongst others, the following reco!!endation

regarding h!an rights defenders in /ctober *++01

(i) It is the obligation of the State to protect human rights of all.

Individuals, groups or associations who work for promotion and

protection of human rights, commonly referred to as Human ights

!efenders, should also be provided protection by the State against

any violence, threats, retaliation, adverse discrimination, pressure

4. The "on=ble Co!!ission had also reco!!ended that1

(iv) 2here is a need to set up a /ocal 0oint for human rights defenders,

preferably at #H$, so that human rights defenders can reach out

to it for support. 2he focal point should be accessible through a

phone no. or email etc.(v) /or protection of human rights, modern technology like satellite

2.3. coverage and S'Ss etc. could be effectively utili*ed. 0rint

media and electronic media can play an important role in this

regard.

(vi) $omplaints of harassment of human rights defenders could be

posted on #H$4 SH$ websites to draw specific attention of the

people to such cases.

(vii) 2he 5# !eclaration on the ights and responsibilities of

Individuals, 6roups and 7rganisations of society to promote andprotect universally recogni*ed human rights 1 /undamental

/reedoms% adopted by the 6eneral 8ssembly in 9::; should be

disseminated to the $hief Secretaries and !irectors 6eneral of

0olice of all States and 52s as also other 6overnment

functionaries.

(viii) #H$ may consider including cases of violation of rights of human

rights defenders along with action taken thereon in a section of itsannual report.

(i-) #H$ may consider writing to the 6overnment of India for

granting permission to 5# Special apporteur on human rights

defenders to visit India.

>eeping in !ind the letter and spirit of the $ndian Constittion, U&

eclarations specifically protecting h!an rights defenders, reco!!endations of

the "on=ble &"%C (*++0), as well as the %eport of the U& Special %apporter on

the sitation of h!an rights defenders (*+-), and the Protection of "!an

%ights ct, 00-, PUCL wold like to highlight that C3P and its office bearers

Teesta Setalvad, 3aved nand and their tea! of h!an rights defenders have

nder threats of grave risk to their personal safety, ensred that the rle of law

prevailed in the state of 5arat at a ti!e when the entire state !achinery was

sbverted and all pblic officials either abdicated their constittional and stattory

fnctions or worse connived ? actively participated with the perpetrators of terror

and violence# $t is pertinent to point ot that even as they strived to establish the

rle of law and ensred that perpetrators were pnished, a slew of co!plaints and

@$%s were foisted against the!# .any co!plaints were later fond to be

nfonded# Ahile we do not want to co!!ent on the specifics of any of the

pending co!plaints we are of the fir! belief that the co!plaints against C3P,

Teesta and 3aved nand have to be appreciated in the larger contin! of facts

and events#

for their sstained efforts the cri!inals who indlged in heinos cri!es wold not

she had been coerced to resile on her eye witness testi!ony# fter diligently

verifying the athenticity and veracity of her clai!, the C3P facilitated her to

record her state!ent before a @ll 7ench of the &ational "!an %ights

Co!!ission (&"%C)# $n an nprecedented !ove, the &"%C challenged the

ac6ittals before the Spre!e Cort and soght a transfer of key cri!inal cases

otside the state of 5arat# C3P was also one of the petitioners in the case# &ot

only did the SC order fresh trial bt eventally the trial cort went on to convict 0

of the accsed persons# (please see table , nne2re ) The ape2 cort also

directed appoint!ent of Special Pblic Prosectors to prosecte the 5arat riot

cases# s Table shows, the co!bined efforts of Teesta Setalvad and the C3P

tea! have secred !ore than + convictions so far with !any other trials nearing

co!pletion#

D. Intere-t 5 G!=$r$t >*#"e #n +$tter- $'$#n-t CJP $nd #t-

((. $t is necessary to point ot here, that it was in the conte2t of convictions of

people owing allegiance to the rling dispensation, inclding conviction of

police!en and politicians that allegations and co!plaints against C3P and Teesta

Setalvad were vigorosly prsed by 5arat Police# Aithot going into the !erits

of the co!plaints we wold like to point ot that the co!plaints against C3P and

Teesta have to be e2a!ined closely and catiosly in the light of the !ore than

decade long strggle that she and her organisation had waged against the 5arat

State agencies, especially the police and law enforce!ent agencies#

(). PUCL wold also like to point ot that sch co!plaints tend to discredit h!an

rights defenders in the pblic eye thereby !aking their task as h!an rights

defenders !ore oneros and difficlt to discharge# $t cannot be gainsaid that

allegations of financial i!propriety are easy to !ake8 bt the da!age sch

allegations case to individal reptation and self respect is irreparable# ery often

thogh nothing !ch co!es ot of sch allegations finally, the allegations wold

well have achieved their prpose of ptting the individals and organisations

concerned on the defensive and force the! to necessarily participate in an endless

spiral of litigation trying to prove their innocence# part fro! diverting defenders

fro! the !ain task of protecting, pro!oting and preserving h!an rights work,

i!!ense a!onts of ti!e, physical and e!otional energy, and finances are lost in

fighting !alicios prosections and litigations#

E. Pr-e"!t#n Pr"eed#n'- $'$#n-t Tee-t$ Set$*7$d, J$7ed An$nd

(/. PUCL is of the opinion that keeping in !ind the backgrond circ!stances in

which @$%s against C3P and Teesta Setalvad are being filed and prsed there is a

need to have an independent review of all the cases filed against C3P, Teesta and

others by the "on=ble &"%C# The i!portance of having a co!prehensive review

of the entirety of cases prsed by Teesta Setalvad and the C3P and the !anner of

hrdles thrown in their path can be better appreciated when we consider the type

of allegations and prosections lanched against her as listed in the table

reprodced in ANNE:URE/#

(0. case in point is the allegation !ade by Bahira Sheikh, the eye witness in the

=est =akery $ase8 even as the retrial was going on, sddenly on - rd&ove!ber,

*++D Bahira Sheikh in a Press Conference in adodara alleged that she had been

kidnapped by Teesta Setalvad and forced to testify in cort against the accsed#

Aithin 5st * days, on E th&ove!ber, *++D Teesta Setalvad herself approached the

SC seeking a high level en6iry into the allegations against her# The %egistrarF

eneral of the Spre!e Cort of $ndia was appointed by the pe2 Cort who after

an elaborate en6iry fond the allegations against Teesta Setalvad by Bahira

Sheikh to be baseless# Ahile the e2oneration helped the C3P to concentrate on its

h!an rights work, valable ti!e, resorces and energy were wasted in the effort#

(2. nother e2a!ple of the !isse of the investigative powers of the 5arat Police

can be fond in the private co!plaint case filed by one %aees >han (&o# -H?* dtd

*+#+G#*+*, &o# +?* dtd *-#+H#*+*) This si!ple defa!ation case, was sed to

condct a roving $n6iry by the C7 Cri!e 7ranch, h!edabad# This roving

$n6iry has been challenged in a petition before the "on=ble "igh Cort of 5arat

(SC &o *endent En?!#r8 $nd Re7#e6

(3. $n this conte2t when repeated allegations against Teesta Setalvad, 3aved nand

and the C3P were fond to be withot sbstance, there is a dty and an obligation

cast pon the overn!ent of 5arat, the Central overn!ent, the 5diciary,

h!an rights bodies as well as the civil society to ensre that h!an rights

defenders like Teesta Setalvad, 3aved nand and C3P are protected and they are

not hindered in their work by having to overco!e repeated co!plaints# There has

to be accontability for nfonded cri!inal proceedings8 especially when the

Ipersectors= are the!selves those who are the Ilaw protectors= and prosectors# $t

is no solace that the allegations are re5ected or that .s# Setalvad or other h!an

rights defenders are ac6itted by corts of law#

(4. The U$ Declaration on uman Rights Defenders(*+-) recognises the dangers

faced by h!an rights defenders even as it e2presses its concerns that there are

instances when :national security and counter terrorism legislation and other

measures, such as laws regulating civil society organisations, have been misused

to target human rights defenders or have hindered their %or# and endangered

their safety in a manner contrary to international la%%.(e!phasis ors)

(9. @rther!ore the "on=ble &"%C has also stated in its reco!!endations regarding

h!an rights defenders that it will beco!e the focal point for h!an rights

defenders to who! they can reach ot to phone?e!ail etc# The crrent en6iries in

that conte2t#

G.Pr$8er$n the facts and circ!stances stated hereinabove it is !ost respectflly prayed that this

"on=ble Co!!ission !ay be pleased to1

(i) %eview all the cases filed against Citi4ens for 3stice and Peace and its

Trstees Teesta Setalvad, 3aved nand in the light of the U& eclaration on

"!an %ights efenders and other relevant laws#

(ii) Pending sch review reco!!end that the overn!ent of 5arat refrain

fro! initiating any coercive action sch as arrest, free4ing of acconts etc

or in any !anner hindering the work of the h!an rights defenders

!entioned above8

(iii) To create a !echanis! by which all co!plaints, as !ay arise, against

h!an rights defenders like Teesta Setalvad, 3aved nand, C3P tea! and

others are first referred to this "on=ble Co!!ission before initiating any

frther action on sch co!plaints so as to ensre that their sefl work to

secre h!an rights is not hindered by sch co!plaints in ftre8

(iv) %eco!!end the initiation of cri!inal and disciplinary action against all

police!en, prosectors and govern!ent officials, and individals against

who! there is pri!a facie evidence of !ala fide actions against h!an

rights defenders like Teesta Setalvad, 3aved nand and others#

(v) $ntervene in the !atters?cases referred above, going on against h!an rights

defenders Teesta Setalvad and 3aved nand so as to protect their rights as

h!an rights defenders

(vi) Take all other appropriate and necessary actions in respect of protecting

h!an rights defenders, as per international and national h!an rights
