Pacific Gas and Electric Company (“PG&E”) hereby submits this advice letter requesting approval of an amendment to the existing “Agreement between San Francisco Bay Area Rapid Transit District and Pacific Gas and Electric Company for Specified CPUC Jurisdictional Electrical Services” (“Agreement”).

Purpose The purpose of this filing is to modify Exhibit “C” of the Agreement to update the list of “Miscellaneous Power Locations” to include the Richmond Parking Garage as a new power delivery location for the San Francisco Bay Area Rapid Transit District (“BART”).1

Background

BART takes Network Integration Transmission Service (“NITS”) under PG&E’s Federal Energy Regulatory Commission (“FERC”) jurisdictional Open Access Transmission (“OAT”) tariff. In conjunction with the NITS, PG&E provides certain services to BART pursuant to the Agreement. The Agreement was the result of Investigation and Suspension (“I&S”) Case No. 99-06-002. PG&E filed the Agreement on behalf of both BART and PG&E, and the California Public Utilities Commission (“CPUC” or “Commission”) approved the Agreement in Decision (“D.”) 00-10-015 dated October 5, 2000. On February 7, 2013, PG&E filed at FERC revisions to the NITS under PG&E’s OAT tariff to reflect BART’s new Richmond Parking Garage (Docket No. ER13-898).2 PG&E requested that the modification have an effective date of April 9, 2013.

Modifications to the Agreement PG&E is requesting that the Richmond Parking Garage be added to Exhibit C, “Miscellaneous Power Locations,” of the Agreement.3 This filing will not affect any rate or charge, cause the withdrawal of service, or conflict with any rate schedule or rule.

PG&E submits this advice filing as a Tier 2 advice letter, and requests that this filing

become effective on April 9, 2013, the same day PG&E has requested the approval by FERC of PG&E’s February 7, 2013 letter seeking to revise the NITS under PG&E’s OAT tariff to reflect BART’s new Richmond Parking Garage (Docket No. ER13-898)

Dear Ms. Bose,

In accordance with Section 205 of the Federal Power Act, 16 U.S.C. § 824d, and Sections 35.7 and 35.13(a)(2)(iii) of the Federal Energy Regulatory Commission’s (“FERC” or “Commission”) regulations, 18 C.F.R. §§ 35.71 and 35.13, Pacific Gas and Electric Company (“PG&E”) submits for filing and acceptance modifications to the Service Agreement for Network Integration Transmission Service (“NITS”), between PG&E and the San Francisco Bay Area Rapid Transit District (“BART”) under PG&E’s Open Access Transmission Tariff (“OAT Tariff”).

Specifically, this filing revises the NITS Agreement, at BART’s request, to add one service location to Table B-3 (Miscellaneous Power Locations). BART’s additional service location consists of a new metered location at the Richmond Parking Garage.

BACKGROUND AND DESCRIPTION OF FILING

The BART system provides rail transit services in four counties (Alameda, Contra Costa, San Francisco and San Mateo) in the greater San Francisco Bay Area. BART takes NITS under PG&E’s OAT Tariff. The NITS Agreement provides for network transmission service for delivery of up to 84 MW of power delivered to BART at the Points of Delivery identified in Appendix B of the NITS Agreement. BART purchases up to 14 MW from the Western Area Power Administration (“Western”) and up to 100 MW from the Northern California Power Agency (“NCPA”).

On January 29, 2013, BART submitted a written request, pursuant to Part III Section 29.2 of the OAT Tariff, to add the Richmond Parking Garage as a new load. In response to that request,

No other changes to the NITS Agreement are proposed in this filing.

BART intends to purchase sufficient power from NCPA and Western, either individually or together, to operate its entire system, including the Richmond Parking Garage load.

EFFECTIVE DATE

PG&E requests that this modification to the NITS Agreement become effective on April 9, 2013.

CONCURRENCE

BART requested these changes and has represented to PG&E that BART concurs with this filing.

REQUEST FOR WAIVERS

PG&E respectfully requests that the Commission grant whatever waivers of the Commission’s rules and regulations are necessary for acceptance of this filing and the effective dates requested under the Federal Power Act.

ABBREVIATED FILING REQUIREMENTS APPLY

Because there is no increase in revenue to PG&E under the NITS Agreement in this filing, PG&E is submitting, in compliance with Section 35.13(a)(2)(iii) of the Commission’s rules and regulations, 18 C.F.R. § 35.13(a)(2)(iii), only the information required in paragraphs (b) and (c) of Section 35.13.
