A background information document and notification letter with an invitation register to I&APs, to

submit comments as per attached comment sheet was distributed as follows:

Physically distributed during site visit and distributed at the Inkosi and Focus Group Meetings

held;

Placed at locations frequently used by the public.

Refer to Background Information Document provided in the PPP section (Appendix E).

Advertisements

Advertisements regarding inter alia the proposed project scope of works, location, details of public

meeting and details of locations and date for draft Basic Assessment Report review as well as

details of EAP will be placed in the Isolezwe (08.11.2013).

Proof of placement of advert will be provided in the final Basic Assessment Report.

Meeting

No public meeting was held but stakeholders were engaged with. A meeting was held with

Councillors and Inkosis on 16.10.2013 and a focus group meeting was held on 16.10.2013 at the

Umzumbe Local Municipality. Please refer to Appendix E for the agenda, presentation, register

and minutes of these meetings.

As a result of the advertisement, BID’s and public meeting, correspondence was received from

I&APs.

Draft Basic Assessment Report Review

The draft Basic Assessment Report has been made available for review for a period of 40 days

BACKGROUND INFORMATION DOCUMENT

WHAT DOES THIS DOCUMENT TELL YOU?

This document aims to provide you, as an

Interested and Affected Party (I&AP), with

background information regarding the proposed

initiative by the initiative by Umzumbe Local

Municipality, to establish the Ntatshana Road

within Mthwalume in Umzumbe Municipality within

the Ugu District Municipality, KwaZulu-Natal

Province. .

The document also provides information regarding

the Basic Assessment (BA) process to be

undertaken as well as a water use licence

application in terms of Section 21 of the National

Water Act (Act No 36 of 1998). Furthermore, the

document advises how you can become involved

in the project, receive information and/or raise

issues, which may concern and/or be of interest to

you. The sharing of information forms the basis of

the public participation process and offers you the

opportunity to become actively involved in the

project from the outset. Public participation plays

an important role in the undertaking of a BA as

input from I&APs ensures that all potential issues

are considered within the study.

WHAT DOES THE PROJECT ENTAIL?

The Umzumbe Local Municipality proposes to

develop the Ntatshana Road. The proposed road

is located in Mthwalume in Ugu District

Municipality, KwaZulu-Natal. The proposed road

will be approximately 2.9 km in length and 5m in

width. The proposed road alignment will cross

over a river and a bridge is proposed for this

crossing. The EIA Regulations (2010) require a

basic assessment for any development which will

fall within the 32 meter buffer to a watercourse.

WHAT ARE THE POTENTIAL ENVIRONMENTAL

IMPACTS ASSOCIATED WITH THE PROPOSED

PROJECT?

During the assessment process specialist and

desk-top studies combined with a site visit will

identify potential issues which require further

investigation within the Basic Assessment Report.

Specialist studies which have been identified and

will be conducted include:

Ecological and Wetland Assessment

Heritage and Cultural Impact Assessment

Input from the public through the public participation

process provides valuable input in the identification

of issues requiring investigation within this BA

process. The study will highlight areas that should be

avoided in order to minimise potential impacts, and

evaluate the project alternatives.

The Basic Assessment will aim to achieve the

following:

to provide an overall assessment of the

social and biophysical environments of the

affected area by the proposed construction

of the project;

to undertake a detailed assessment of the

preferred route/s in terms of environmental

criteria including the rating of significant

impacts;

to identify and recommend appropriate

mitigation measures for potentially

significant environmental impacts; and

to undertake a fully inclusive public

participation process to ensure that I&AP

issues and concerns are recorded and

commented on.

WHY ARE ENVIRONMENTAL STUDIES

NEEDED?

In terms of the Environmental Impact Assessment

(EIA) Regulations Government Notice R. 543 to

Notice R. 546 of 2010 published in terms of

Section 24(5) read with Section 44 of the National

Environmental Management Act (NEMA), 1998

(Act No 107 of 1998), The Umzumbe Local

Municipality requires authorisation from the

KwaZulu-Natal Department of Agriculture and

Environmental Affairs (DAEA) for the undertaking

of the proposed project as it includes activities

listed under Regulation 544 and 546 of the NEMA

EIA regulations as well as a water use licence

application in terms of Section 21 of the National

Water Act (Act No 36 of 1998) . Activities under

these listings may have an effect on the

environment, hence a BA process, as prescribed

in Regulations 21 to 25 of the Environmental

Impact Assessment Regulations (Regulation 543),

will have to be undertaken.

The Umzumbe Local Municipality has appointed

Royal HaskoningDHV, as an independent

Environmental Assessment Practitioner (EAP), to

undertake the required Basic Assessment

Process to identify and assess all potential

environmental impacts associated with the

proposed project. As part of these environmental

studies, all I&APs will be actively involved through

a public participation process.

PUBLIC PARTICIPATION PROCESS

It is important that relevant I&APs are identified

and involved in the public participation process

from the outset of the project. To ensure effective

public participation, the process includes the

following steps:

STEP 1: Advertise the BA Process (local

newspaper)

STEP 2: Register I&APs and key stakeholders on

the database (on-going)

STEP 3: Consultation with, and transfer of

information to, I&APs through consultation and

stakeholder engagement

STEP 4: Invite I&AP comment and input on the

draft BA report (40-day comment period)

STEP 5: Record all comments, issues and

concerns raised by I&APs within an issues trail,

which will form an integral part of BA Reports

1. By responding (by phone, fax or e-mail) to our

invitation for your involvement in the process;

2. By completing the attached comment form and

mailing or faxing it to Royal HaskoningDHV;

3. In writing contacting consultants if you have a

query, comment or require further project

information; and

4. By reviewing and commenting on the draft BA

Report within the allowed 40-day review period.

process to become involved in the process and

provide comment, or raise those issues and

Notice is hereby given in terms of the Environmental Impact Assessment Regulations

published in Government Notice No.R543 to No.R545 of 2010, in terms of Section 24

(5) of the National Environmental Management Act (Act No 107 of 1998), of the

initiative by The Umzumbe Local Municipality, to establish the Ntatshana Road within

Mthwalume in Umzumbe Municipality within the Ugu District Municipality, KwaZulu-

Natal Province.

In respect of the above, the applicant, Umzumbe Local Municipality intends to submit a

basic assessment report as contemplated in the Regulations to the KwaZulu-Natal

Department of Agriculture & Environmental Affairs (KZN DAEA) as well as a water use

licence application in terms of Section 21 of the National Water Act (Act No 36 of 1998)

INKOSI MEETING PROCEDURE

On 16 October 2013, RHDHV was afforded the opportunity to present the project to the councillors of

the Ntatshana rural area. This was arranged by Cllr. Mthembu.

Considering the lack of presentation facilities and that this was a formal Inkosi council meeting, we

were afforded a fifteen minute slot which did not entail and formal presentation with the use of a

projector. RHDHV’s Andile Mnyandu made use of the presentation developed for the Focus Group

Meeting to translate into IsiZulu and thereby explain the details of the project to the council members.

Their comments were noted and are presented here in the form of meeting minutes. A register is also

provided as a combined one with that of the Focus Group Meeting register.

BACKGROUND AND NEED

Accessibility to the Maqhikizana farm is limited to a dirt

road.

The establishment of the Ntatshana Road will enable

ease of accessibility to this area and the easy movement

of vehicles other than off-road vehicles.

The road will also allow for public transport modes to

cater to the local community - currently the surrounding

community have to walk extremely long distances to the

public transport serviced areas.

TECHNICAL DETAILS

The Umzumbe Local Municipality proposes to develop

the 2.2 km Ntatshana Road located in Mthwalume. The

proposed road will be 2.2 km in length and 5 m in width.

The proposed road alignment will cross over the

Mtwalume River and a bridge is proposed for this

crossing. There is no current access road between the

D1050 and the D20 to the east.

Two alternatives have been proposed.

CURRENT DEPICTION OF SITE

The majority of the proposed newaccess road is situated within

moist Aristida junciformis

hillslopes. However, this has been

historically transformed around theproposed Ntashana access road.

Several terraced agricultural fields

as well as old livestock enclosuresoccur on the lower slopes.

The majority of habitats adjacent to

the proposed alignment havealready been completely

transformed previously during

construction of housing platforms

and adjacent rural and agriculturalactivities.

The vegetation is completely

transformed and dominated byweedy pioneer plants (rurals) as

well as alien invasive species.

ENVIRONMENTAL LEGAL REQUIREMENTS

uMzumbe Local Municipality requires authorisation from

DAEA for the undertaking of the proposed project as it

includes the following activities listed under EIA Regulations

Government Notices R. 543 to R. 546 of 2010

GNR. 544

11: The road will require the construction of a bridge; which

crosses a watercourse.

18: The construction of the road may require infilling or

depositing of any material of more than 5 cubic metres or the

dredging, excavation, removal or moving of soil, sand or rock

more than 5 cubic metres from a watercourse.

4: The road is proposed to be wider than 4 metres with a reserve

less than 13,5 metres, outside of an urban area.

ENVIRONMENTAL LEGAL REQUIREMENTS

A Water Use Licence (WUL) application is currently

underway and will be submitted to the Department of

Water Affairs (DWA) as per Section 21 (c) and (i) of the

National Water Act (Act No 36 of 1998) for all water

crossings – this includes wetland crossings and the

proposed river crossing via the proposed bridge on the

Mtwalume River.

SPECIALIST INPUT - ECOLOGICAL

The Ecological Assessment proposes that the development proceeds with

the following mitigations:

It is imperative that construction activities are restricted to the road

servitude within sensitive habitats and that the road reserve is

appropriately rehabilitated/re-vegetated to prevent further erosion.

The proposed road bisects a non-perennial drainage line including two

large Umdoni (Syzigium cordatum). The road should be re-aligned to

avoid these two trees.

SPECIALIST INPUT – ECOLOGICAL CONT

Construction activities of the Mtwalume bridge should be scheduled

to take place during low flow periods when as little of the

construction site and exposed sediment is in contact with the flow as

possible.

The original geometry, topography and geomorpholgy in both cross-

sectional and longitudinal profile should be reinstated at, above and

below the Mtwalume bridge crossing.

The current Ntatshana road alignment bisects a small patch of

degraded woodland (wood harvesting) adjacent to the Mtwalume

River. Ideally the road should be situated away from any densely

vegetated areas or alternatively restricted to the existing livestock

and human pathways.

development proceeds having not identified any aspects
