Detailed Proceedings of Public Hearing held at Collectorate Conference Hall Lodhi,

Block-Sonebhadra on 19.09.2014 for environmental clearance in compliance of

provisions of EIA Notification dated 14.09.2006 prior to the establishment of 1.0

MTPA Coal beneficiation plant at Village – Kota, Tehsil-Robertsgunj, Block-

Sonebhadra, Uttar Pradesh by M/s. Jaiprakash Associates Limited.

Public Hearing was held at Collectorate Conference Hall Lodhi, Block-Sonebhadra on

19.09.2014, 01.00pm for environmental clearance in compliance of provisions of EIA

Notification dated 14.09.2006 as amended prior to the establishment of 1.0 MTPA Coal

beneficiation plant at Village – Kota, Tehsil-Robertsganj, Block-Sonebhadra by M/s.

Jaiprakash Associates Limited in compliance with the letter no.F-46907/C-9/Public

Hearing/ 227 /14 dated 31.07.2014 of Member Secretary, Uttar Pradesh Pollution Control

Board, Lucknow.

The public notice about the said public hearing has been published in daily newspaper

“Amar Sahara”, Varanasi on 14.08.2014 and in Hindustan Times, New Delhi on

13.08.2014. The copies of the same are enclosed.

Public Hearing was chaired by nominated official of District Collector, Additional

Collector (Finance and Revenue), Sonebhadra Shri Mani Lal Yadav, and it was

conducted by Regional Officer, UP Pollution Control Board, Sonebhadra Shri Kalika

Singh. In addition to the above, Regional Officer, Nagar Shri Anil Kumar Yadav,

Assistant Scientific Officer, UP Pollution Control Board, Shri Pradeep Kumar

Vishwakarma and Industry Representative as a chief Shri Ajay Sharma, (Executive

President), Shri Amit Sharma, (Executive President), Shri Sudheer Mishra (Dy.General

Manger) and Shri N.B.Ojha( Environmental Engineer) etc. also Present.

While initiating Public Hearing Regional Officer, UP Pollution Control Board,

Sonebhadra informed all the pubic present that a proposal has been forwarded for

environmental clearance to establish 1.0 MTPA Dalla Coal Beneficiation Plant (Coal

Washery) proposed by M/s.Jai Prakash Associates Limited. He has requested the industry

representative to give detailed information about the proposed industry.

Technical Adviser of Industry Proponent Shri B.K.Chowdhary, Vimta Labs, Hyderabad

gave detailed information about the proposed 1.0 MTPA capacity Dalla Coal

Beneficiation Plant by M/s.Jaiprakash Associates Limited and he said that Coal

Beneficiation Plant will be established within the industry premises and there will not be

any additional land requirement. There will not be any adverse affect on environment due

to the proposed project. The entire process of coal washery will be in a closed circuit.

Provision of Rs.30 Lakhs was made for controlling anticipated water and air pollution

control measures. The detailed information was given through a power point

presentation.

After the presentation about the proposed project Regional Officer, UP Pollution Control

Board, Sonebhadra has requested the public present there that they can express/ convey

their suggestions / comments / and objections with respect to environmental protection

regarding the proposed project. The following suggestions / comments and objections

were given by the public present in the public hearing. The details are given below:

1. Shri Vikas Shakya, Advocate , Robertsganj, Sonebhadra said that he is opposing

the proposed coal washery plant proposed by Jaypee Associates Limited in the

Block because ponds are constructed to control water pollution from different

machinery and through seepage its contaminate ground water and different type of

diseases will spread over. As per the report received from CSIR this place comes

under water pollution zone. Fluride, Arcenic and Mercury are found in the water

of the region. As per the figures of UP Government only 12% people are suffered

with ground water and out of which 30% people are suffered in the Block,

Sonebhadra.

2. Shri Amit Singh, Sonebhadra stated that he was present there against Jaypee

Associates. It may be cleared that the facilities stated by Jaypee Associates are

factual or not. Whether local people will be provided employment and it may be

cleared that how many people have been employed so far.

3. Shri Hardev Narayan Tiwari, Obra, Sonebhadra said “ I am a general secretary of

Electrical workers and I am not much aware of Cement factories. Due to

inefficiency of the government, this PSU was given to a private company. What

was the prior status of Dalla Cement Factory. I know very well. There should be

participation of local people. Today we dry our wheat in the open place. If we

want electricity etc, we should face difficulties to some extent. No objection

should be given to the proposed industry.

4. Shri Vineet Kumar Pandey, Ramgarh, Sonebhadra stated that the presentation

shown by the proponent seems to be not true, because 16 lakhs trees were cut

instead of planting 16000 trees. Local people are not given employment. They

should save the trees.

5. Shri Gurucharan Sharma, Obra, Sonebhadra said that he welcomes the golden

effort by Jaypee Associates and the pollution will be less. Pollution is possible due

to industries. In earlier days, if we go outside wearing white cloths, we have to

wash them by evening because dust and pollution was more. Now there will be

less pollution with their latest techniques.

6. Shri Santosh Kumar, Dalla, Sonebhadra said that he was a ITI passed student from

the institute run by Jaypee Company and now he was unemployed. The education

in their institute is such a costly one, that one can complete diploma with this

amount. No objection Certificate should not be given to them.

7. Shre Dharmendra, Obra, Sonebhadra stated that it was shown in the presentation

that Rs.30 lakhs will be spend by Jaypee for environmental protection and the

details should be provided. Local people should be provided employment. NOC

should not be given to them.

8. Shri Rajaram Yadav, Billi, Obra, Sonebhadra said that Dalla Cement Factory

should run by which people should get employment. He requested to give them

NOC. They have done many such social works by which people are benefitted.

Water tanks and drinking water facility is also included.

9. Shri Pavan Kumar Mishra, Advocate, Robertsganj, Sonebhadra said that there

should be more and more industries in the Block Sonebhadra by which people

should get employment. There should not be violation of law in the name of

development. You invest capital and we will put our labour/ hard work. Local

youth should get employment. No objection Certificate may be given to them.

10. Shri RC Chowdhary, Advocate, Robertsganj, Sonebhadra said that East India

Company came to our country and occupied our nation. Similarly Jaypee

Associates also captured and spoiled our forest. If lakhs of trees are not cut in the

name of development, there will not be a need for afforestation.

11. Shri Ajay Tiwari, Dalla, Sonebhadra said that so many trees were cut with the

entry of Jaypee. Only those people will get employment who oppose them.

Unemployed people will not get employment.

12. Shri Ramachandra, Village Pradhan, Kota, Sonebhadra told that they don’t have

any objection to establish the plant. Fees should be reduced for the wards of the

tribals in the region for their education. There was a lot of opposition many times

to reduce the fee, but no action was taken.

13. Shri Indresh Kumar Upadhayay, Kota, Sonebhadra said – “I am seeing first time

that public opinion / consensus is obtained to establish any plant. We only say that

the plant should be commissioned and people should get employment and the

region should develop. We request to issue NOC.

14. Shri Surendra Singh, Dalla, Sonebhadra said that Jaypee Associates Limited may

be issued No Objection Certificate with their entry people’s status in Dalla market

was improved. Many small big shops are opened, resulting increase in the income

of people. I am 100% in favour of Jaypee.

15. Shri Aravind Kumar Soni, Obra, Sonebhadra stated that there will be less water

pollution with their latest and good techniques. I am in favour of issuing NOC.

People say to provide education, employment. These all works should be provided

by Government. If any restriction to levied due to pollution, it should be on forest

mafia and mining mafia and illegal miners.

16. Shri Vikas Mishra, Robertsganj, Sonebhadra said that they should be given No

Objection Certificate.

17. Shri Imtiyaz Ahmed , Chairman, Nagar Panchayat, Chopan, Sonebhadra told that

whatever the things shown in the presentation by Jaypee Associates proponent

they should be at realty level. Whatever the standards/ parameters shown in the

presentation they should be followed/complied with true sense. Industry

management should consider employment, education and medical facilities and

whatever the problems of this block, their participation/ co-operation should be

ensured. Whether this block will be provided 24 hours electricity. They should be

given NOC. I am in favour of this.

18. Shri C P Mali Obra, Sonebhadra said that there is good arrangement for

controlling pollution. In olden days, the machines/ techniques put to stop dust

pollution in cement plants while they are in operation are not at all used, resulting

a thick layer of cement dust was formed in nearby houses. Lot of pollution was

there. But these people have made good measures for controlling pollution. Hence

Jaypee Should be given NOC.

19. Shri Nagina Yadav, Billi, Obra, Sonebhadra stated that with the entry of the

company people are seen here with helmet/cap going to Dalla Plant. We feel

better. If industry comes, the problem of employment will be solved. They may be

given NOC.

20. Shri Shyam Charan Giri, Patvadh, Sonebhadra stated that there is more floride

content in the water here, by which more people felt sick. Pollution will increase.

They should not issued NOC.

21. Shri Ramesh Dev Pandey, Advocate, Robertsganj, Sonebhadra said that following

are types of pollution in which noise pollution, Air pollution and water pollution.

There is more floride content in the water resulting the health problems of

diseases. 10% amount has to be deposited with district development officer for the

development of the region. Employment should be provided to local people based

on their qualifications. They should not be issued NOC.

22. Shri Vijay Yadav, Obra, Sonebhadra told that there was more pollution in old

cement plants, after cleaning wheat it had to be covered with blanket/ sheet, so that

cement layer will not form on it. But now everywhere is greenery. There is a good

arrangement in Dalla. They may be given NOC.

23. Shri Tameswar Tiwari, Churk, Sonebhadra said that Jaypee should be given NOC,

but local people should also be given employment opportunities.

24. Shri Sesh Narayan Dixit, Advocate, Robertsganj, Sonebhadra stated as my friends/

brothers said earlier here in the water floride content is more. Here it is important

to mention that the coal to be used in the proposed project will be washed, which

will release Carbon. It is not correct to misguide the common public. Floride was

first found in 1962 at Bijapur while Jaypee Company came in 2006. There should

be suitable provisions for ensuring less pollution. They should be issued NOC.

25. Shri Umashankar Singh, Obra, Sonebhadra, Stated pollution more in Obra region

as compared to Dalla because there is no proper system to control pollution. If

water and electricity is not available for public, Government is responsible for this

and not for private company. It is pleasant to see that many people move towards

Dalla by wearing a helmet. No doubt, the region is developed and people also got

employment with the entry of Jaypee. I am in favour to issue them NOC.

26. Shri Rambali Mishra, Dalla Bazar, Dalla Sonebhadra stated “I remember the day

when crusher plant was closed. People became unemployed and people were

unable to get two times food, where as people get benefitted from the company.

They may get NOC.

27. Shri Nagesh Mani Pathak, Dalla, Sonebhadra told that it is to mention here that

pollution is negligible due to use of control equipement. Bari to Renukut region

can easily seen what measures are taken for controlling pollution. People should

be provided employment. They may be issued NOC.

28. Shri Ravinath Singh, Dalla, Sonebhadra said that pollution in Dalla is negligible.

People will get employment with the entry of Jaypee Project. It is not necessary if

60 people are required then total people of the Block will get employment. I

request to issue them NOC.

29. Shri Nandlal Gupta, Advocate, Tuddy, Sonebhadra said that today we see

happiness in the faces of the people here. When the cement factory was closed

people’s condition was bad. They should be given NOC. Time should given for

social environment. There should be a cell to create awareness among the people.

30. Shri Girish Pratap Singh, Robertsganj, Sonebhadra said “Jaypee Associates may

be given NOC and there should be more improvement in providing education and

health.

31. Shri Pramod Kumar Pandey, Advocate, Robertsganj, Sonebhadra said that there

will be less pollution from the plant. Pollution from this will not spread to far

places as it will be restricted to plant premises. And attention should be given to

this extent. I request to issue NOC.

32. Shri Ram Nivas Bharati, Dalla Sonebhadra said “we have seen bad status of Dalla

where there was no income for the people. They were suffering a lot. 20% Coal

saving will be there with the establishment of the plant, which will result less

consumption of coal. NOC may be given.

33. Shri Mukesh Jain, Dalla Bazar, Dalla, Sonebhadra said “nobody will satisfy with

the government. People should remember bad days, that was a tough time.

People should get employment. NOC may be given.

34. Shri Krishnakant Pandey, Obra, Sonebhadra said that all the standards/prescribed

norms should be complied with. There should be proper provisions for

environment management. They should be given NOC.

35. Shri Anjani Patel, Dalla, Sonebhadra said that factory was closed in 1999 and

Jaypee Company came in 30 January 2006. The income of people increased with

the entry of this group. Hence, they should be given NOC.

36. Shri C.P.Ray, Obra, Sonebhadra said Jaypee group is taking good measures for

environmental management. Local people are getting direct and indirect benefits

from them. Hence they may be given NOC.

37. Dr. Uday Narayan Singh, Obra, Sonebhadra said “Jaypee Associate’s entry in the

region provided employment to people Educational standards are improved. They

should be given NOC.

38. Shri H.N.Pandey, Dalla, Sonebhadra said that Lakhs of trees have been cut in the

name of roads and pollution. Nobody is there to ask about this. If we need

development we have to face some difficulties. They may be issued NOC.

39. Shri Pratap Narayan Srivatsav, Obra, Sonebhadra stated that they have inspected

so many plants of Jaypee, wherever their plants are situated. There is no pollution

at all. They should be given NOC. Educational standards improved with their

entry and the income of the people also increased. Earlier people were getting

Rs.3000-4000 per month in the crusher and now their income increased a lot.

40. Shri Om Prakash Tiwari, Dalla, Sonebhadra said –“Jaypee Associates Limited,

Dalla may be given NOC. Proper employment was provided to local people

through them. Even today many people are seen going to plant wearing helmet.

41. Mohd. Kaleem, Churk, Sonebhadra cautioned not to do any illegal thing in the

name of development. Works may be done keeping in view of environment. They

may be given NOC.

42. Shri Susheel Mishra, Obra, Sonebhadra said that NOC may be given. Other

company will not organize public hearing and they are also granted permission

without public hearing. Attention should be given on this.

43. Shri Vinod Kumar Yadav, Dalla, Sonebhadra told that Jaypee Associated Limited

may be given NOC. We are local people of Dalla. We now very well about this

place and we wish that this region should be developed.

44. Shri Susheel Kumar Goyal, Obra, Sonebhadra said NOC should be given.

Employment opportunities should be increased and people should get

employment.

45. Shri Bachav Prasad Yadav, Obra, Sonebhadra stated that special attention has

given to control pollution in this project. Pollution in other plants is 50 times more

than this plant. They may be given NOC.

46. Shri Arun Pratap Singh, Robertsganj, Sonebhadra told that NOC should not given

and even the permission granted for the plant should also be withdrawn.

47. Shri Murlidhar Upadhyay, Obra, Sonebhadra said –“Jaypee Associates Ltd may be

given NOC. Employment is generated in the block with their entry. People are

feeling happy.

48. Shri Neeraj Bhatiya, Obra, Sonebhadra said that NOC may be given. Employment

opportunities should be explored which will improve employment opportunities.

49. Srikanth Dubey, Advocate, Robertsganj, Sonebhadra said that Chief Minister and

Prime Minister are trying to increase industries and we are also talking for

commissioning and operating the plant. If we don’t want the plant here it will be

established elsewhere. And there will be employment opportunities. As you know

Tata was not given permission for Nano in West Bengal and the plant has gone to

Gujrat. NOC should be given. With the high technology there will be less

pollution.

50. Shri Bateswar Panika, Kota, Sonebhadra said that NOC may be given. Water

facility should be provided to village Kota.

51. Shri Avadesh Pandey, Robertsganj, Sonebhadra said that NOC may be given.

People will get employment. Industry should be established which results

development of the region.

52. Smt. Sashi Latha Tripathi, Dalla, Sonebhadra stated that this Block was formed in

1989. There is un education and un employment in the region. This has to be

solved and improved. They may be given NOC.

53. Shri Aswani Kumar Tripathi, Kota, Sonebhadra said that Jaypee Associates may

be given NOC. I am fully supporting this. Besides, I request to provide drinking

water facility to local people.

After the above, Regional Officer, UP Pollution Control Board, Sonebhadra

invited the Chairman, Jaypee Associates Limited, Dalla Sonebhadra Shri Ajay

Sharma and asked to give his views and opinion on the issues/ comments raised by

the local people.

Chairman, Jaypee Associates Limited, Dalla, Sonebhadra Shri Ajay Sharma while

giving his opinion on the above points said that very good suggestions have come

up and we will pay serious attention on them. No trees were cut by Jaypee

Associates to establish Industry. Industry was established by UP Cement

Corporation Limited. We have only done maintenance and improvement works.

Educational institutions were established. Employment was also provided

maximum extent possible. Medical facility in the region for people will be

strengthened.

At the end, Additional Collector (Finance & Revenue), Sonebhadra Shri Mani Lal

Yadav in his presidential speech assured that the points raised by the public will be

forwarded to Government of India for their attention. He said that all possible and

suitable measures to control pollution may be adopted as per the rules and norms

of Pollution Control Board. He requested Chairman, Jaypee Associates to pay

special attention for the overall development of the region.

A part from the above views, suggestions and comments, no other issue was raised

during the public hearing. The attended public has given their consent for capacity

extension of the project.

With the above summary the proposal/ letter is forwarded for conditional

environmental clearance to establish proposed 1.0 MTPA capacity Dalla Coal

Beneficiation Plant by M/s. Jaypee Associates Limited, Dalla, Sonebhadra. In the

end, Regional Officer, conveyed thanks and declared completion of Public

Hearing Process.
