SECTION A: EMPLOYMENT SERVICES ACT 2014

• The new Employment Services Act , 2014 aims to:– Strengthen existing employment services

functions that remained within the Department of Labour

– The Bill draws on a wealth of international experience, challenges and seeks to assist employers and job seekers to adjust to changing economic situations.

MAIN FUNCTIONS OF THE PES• The main functions of the Employment Service are

simply ‘to obtain vacancies’ and identify other opportunities so as to facilitate the entry and re-entry of job-seekers into the labour market.

• The provision of Public Employment Services therefore has to be supported by two main programmes: Job Seeker Services & Employer Services

EMPLOYMENT SERVICES OF SOUTH AFRICA - ESSA

• The Department of Labour has implemented a system called Employment Services of South Africa - ESSA

• ESSA will enable employers to register themselves as an organisation (once off), but more important their opportunities/vacancies that become available within their business environment such as :– Formal jobs– Learner ships– Apprenticeships– Internships

• Based on the given criteria for an opportunity, ESSA can automatically match individuals who meet the required criteria for an opportunity

• The Department of Labour can make the cv’s of those individuals accessible to the employer.

• It remains the right of the employer to choose/screen/interview the individuals matched to suit the vacant opportunity

• As part of the service at ESSA, DoL keeps a database of numerous unemployed as well as employed candidates on the system

• ESSA database has people with different occupations, qualifications and experience seeking employment

• What to expect from the DOL:– Identification of candidates that meet the set criteria– Compilation of CV– Intervention before individuals are referred for

selection purpose (e.g. Career Counselling, employment Counselling through Life Skills Programmes)

What we need from the employer : A detailed job description and job

specification Timeous feedback on placement done by

your company on placed individuals Feedback on performance of placed or

HOW DOES THE SERVICE BENEFIT THE EMPLOYER?

– The service is free of charge– DoL do all the administration and recruitment for the

employers– DoL is able to do psychometric assessments upon

request from the employer of the required candidates (Note : This applies only for learnership opportunities and candidates recruited from our ESSA database)

– DoL makes its facilities available to the employer for interviews and briefing sessions

– DoL provide after care service once the job seeker has been placed.

HOW DOES THE SERVICE BENEFIT THE EMPLOYER?

Employers will have a quick and free access to a diverse pool of suitably qualified work seekers. This will not only reduce the turn around time for recruitment by employers, but will also result in savings on the massive advertisement costs and improve productivity.

DoL ESSA services are percieved as priority employment solution, this a renewed sense of destiny to the unemployed workseekers, some of whome are on the brink of despair after period of unsuccessful job-hunting endeavours due to poor access to the labour market. Thus promoting corporate governance responsibility.

SECTION B: INTERNATIONAL CROSS BOARDER LABOUR MIGRATION

PURPOSE•Globalisation- to enable the South African economy to access scarce and critical skills available elsewhere in the world in which local competencies are inadequate;•Protection stance- to protect the vulnerable South African citizens against unfair competition for scarce employment opportunities with the foreign labour migrants; much needed by locals, in which locals are equally competent to perform skilfully.
