OverviewEvery year, the Philippine government spends billions of pesos of taxpayers’ mon-
ey on a vast variety of things — from pens and papers, books and chairs, to mas-sive purchases such as jets and ships and big-ticket infrastructure projects such as roads, railways, and airports.
bonuses for retiring officials, interference by
trapo, etc. The list goes on.
Indeed, more than a few examples show
why contracting — or procurement in the local
lingo — is a major government undertaking
fraught with big risks, too.
There is no dearth of hard lessons in Phil-
ippine procurement — from the PEA-Amari
and Textbook Scams in the 1990s, the Fertil-
izer Fund Scam, and the botched NBN-ZTE
and North Rail deals in the 2000s, to the
more recent Pork Barrel Scam in 2013 and the
Dengvaxia controversy in 2017.
Many of these cautionary tales have

P956 billion — a good quarter of the P3.767
trillion annual budget — on public works and
other capital outlays alone. The shopping list
will extend to nearly all forms of goods and ser-
vices in order to meet people’s needs.
However, every year, too, Filipinos have to
suffer the consequences of fraud-marred proj-
ects, resulting in insufficient medicine supply,
unfinished roads, substandard school build-
ings, and inefficient transport systems. Taxpay-
ers bear the burden of weak project planning
and implementation, as well as kickbacks, Ka-
mag-anak Inc., lagay, luto, tongpats, take-home

prompted reforms such as the pivotal passage
of the Republic Act No. 9184 or the Govern-
ment Procurement Reform Act of 2003, which
now serves as the principal legal basis for all
public contracting activities in the country. R.A.
No. 9184 consolidated all previous laws, rules,
executive orders, and pronouncements relat-
ed to government procurement.
Institutions have been organized and pol-
icies instituted to improve the integrity of pro-
curement by making records available and al-
locating space for citizens to participate.
Created by R.A. No. 9184, the Government
Procurement Policy Board (GPPB) oversees
the proper implementation of the procure-
ment law. The Philippine Government Elec-
tronic Procurement System (PhilGEPS), which
the same law formed, serves as the primary
source of procurement information in gov-
ernment. The government’s Open Data portal
also assigns priority to the disclosure of pro-
curement data.
The Philippines is a founding member of
the Open Government Partnership (OGP),
a multilateral initiative that aims to secure
commitments from governments to promote
transparency, empower citizens, and use new
technologies to strengthen governance. Re-
forming the e-procurement system is one of
the Philippine commitments in its OGP action
plan.
The Philippine government has also
pledged to support the Open Contracting
Partnership (OCP) regime through Resolution
No. 13-2012, that GPPB issued in 2012. OCP
emerged from a community of policy experts,
leaders, and campaigners who believe that
better open data and more community en-
gagement can help transform public goods
and services.
Even though the Freedom of Information
Act has been in legislative limbo for many
years, a battery of other laws, orders, and cir-
culars supports public access to procurement
records. These include the Aquino administra-
tion’s National Budget Circular No. 542, other-
wise known as the Transparency Seal Circular;
Executive Order No. 2, also known as the FOI
E.O. issued by President Rodrigo R. Duterte in
July 2016; and Republic Act No. 6713 or the
Code of Conduct and Ethical Standards for
Public Officials and Employees.
Yet while there are enabling laws and dis-
closure mechanisms that allow access to pro-
curement records, many important and long-
standing issues linger.
For one, contracting data produced, main-
tained, and published by agencies are uneven
and unrelated, making it difficult for citizens
to track the procurement of goods and ser-
vices from start to finish. For example, con-
tractors awarded with major road projects are
assumed to have the capacity to implement
such big projects because they demonstrate a
good procurement track record and a healthy
financial standing. However, not all contractors
have these attributes.
As early as the bidding stage, annual finan-
cial statements submitted to the Securities and
Exchange Commission (SEC) and information
uploaded on PhilGEPS could provide insight on
the financial capacity and track record of these
firms. These two sets of documents paired with
bidding records filed with the procuring entity
could provide a window to the kind of contrac-
tors tendering for a certain project. While these
data are available, they are not routinely com-
pared and connected by officials in charge of
the procurement process.
This and more similar observations from
years of reporting on government deals have
led PCIJ to conduct a study aimed at gathering
evidence on these supposed gaps by assess-
ing the availability and accessibility of contract-
ing data vis-à-vis Open Contracting Data Stan-
dards (OCDS).

OCDS is an open-data standard created
by the Open Contracting Partnership for the
publication of documents and data in all stag-
es of the contracting process, from planning
to implementation. It was designed to support
governments and organizations to increase
transparency in procurement and allow deep-
er analysis of documents and data by a wide
range of users.
CASE STUDY: DPWH
As a case study, PCIJ assessed documents
and data produced during the planning, tender,
award, contract, and implementation of infra-
structure projects delivered by the Department
of Public Works and Highways (DPWH).
DPWH is the government’s engineering
and construction arm. One of three depart-
ments undertaking major infrastructure proj-
ects, DPWH is responsible for the planning,
design, construction, and maintenance of in-
frastructure, including national highways, flood
control and water resources development and
other public-works systems.
Next to the Department of Education,
DPWH receives the second biggest budget
annually. For 2018, DPWH was allotted P637.9
billion, reflecting a 40-percent increase from its
P454.7 billion budget in 2017.
It made good sense to focus on DPWH as
infrastructure development is a key economic
driver. Too, civil works projects have long been
marred by corruption and inefficiency.
In 2009, for instance, the World Bank’s an-
ti-corruption unit, the Department of Institution-
al Integrity, debarred three Filipino contractors
for allegedly colluding to inflate bid prices in
Bank-funded projects. In 2010, DPWH under
then Secretary Rogelio Singson, initiated re-
forms to improve transparency in the procure-
ment of civil-works projects. These reforms
took place alongside the Aquino administra-
tion’s transparency initiatives, which required
executive agencies to post relevant records on
their websites.
However, Singson’s early gains in institut-
ing integrity in the contracting of road projects
did not resonate well with local politicians who,
contractors said, then imposed and collected
payoffs. The contracts that remained most vul-
nerable to corruption were those being bidded
out by local DPWH engineering districts, and
those that were being implemented using the
Priority Development Assistance Fund or “pork
barrel” funds at the time.
DPWH, together with the Department of
Transportation (DoTr), is now getting ready
to implement the Duterte’s administration’s
“Build, Build, Build” program. Touted to usher
in the “golden age of infrastructure,” the pro-
gram is estimated to cost P8 trillion in public
and private spending until Duterte’s term ends
in 2022.
OBJECTIVES
The key objectives of the project are:
• To assess the availability, completeness,
accessibility, and timeliness of docu-
ments and data produced and pub-
lished along the contracting or procure-
ment process – from planning, tender,
and award to contract and implemen-
tation – vis-à-vis the Open Contracting
Data Standards;
• To document good practices in trans-
parency as a result of laws and guide-
lines pertaining to government procure-
ment and information access; and
• To identify areas for further improve-
ment to make contracting in the Philip-
pines more open and responsive to the
needs of citizens, agencies, businesses,
civil society, and journalists.

All these contribute to the long-term goal of
gaining a clear set of open contracting policies
and practices that enable greater transparency
and accountability and meaningful participa-
tion in the procurement of infrastructure proj-
ects.
SCOPE
This assessment report covered documents
and data produced and published during the
planning, tender, award, contract, and imple-
mentation of infrastructure projects under
DPWH. As such, records held by GPPB-Tech-
nical Service Office, PhilGEPS, Securities and
Exchange Commission (SEC), Department of
Trade and Industry (DTI), Construction Industry
Authority of the Philippines (CIAP), Philippine
Contractors Accreditation Board (PCAB), and
the Commission on Audit (COA) were also an-
alyzed.
In addition, the assessment took into ac-
count civil society and media experience in
using procurement/contracting data in their
advocacy and reporting.
Only projects funded by the national gov-
ernment were included in the assessment,
however; thos e supported by Official Devel-
opment Assistance (ODA) or foreign loans
and grants are thus not covered in the report.
While the research recognizes the value of re-
cords kept by local government units and the
Bureau of Internal Revenue that are related
to the procurement of infrastructure projects,
these were not covered in this report as well.
The research did not also include other rele-
vant documents that may be cross-checked
for conflicts of interest such the Statement of
Assets, Liabilities, and Net Worth and cam-
paign-finance reports.
METHODOLOGY
The research involved both paper and
people trails. Through documentary research
and consultations with agencies, including the
DPWH, GPPB-TSO, PhilGEPS, SEC, DTI, CIAP,
PCAB, and COA, PCIJ assessed government
records and datasets produced and published
in the procurement of infrastructure projects
vis-à-vis Open Contracting Data Standards
(OCDS).
Specifically, the assessment involved these
steps:
1. Understand the general role of the
agency and its specific role in the con-
tracting of infrastructure projects;
2. Identify all documents and data pro-
duced by the agency in the contract-
ing of infrastructure projects and un-
derstand how these are produced and
maintained;
3. Test the availability of records produced
and maintained by an agency that are
not disclosed online by making pub-
lic-records requests;
4. Assess the availability, completeness,
accessibility, and timeliness of docu-
ments and data produced and pub-
lished along the contracting process
– from planning, tender, and award to
contract and implementation – vis-à-vis
OCDS;
Two rounds of consultations were then
made with the agencies. The first was con-
ducted during the research process, and the
second after preliminary research findings had
been collected. Civil-society representatives
who have had long experience monitoring
government contracts were also interviewed
to guide the research.

The Open Contracting Partnership (OCP) emerged from a community of policy
experts, leaders, and campaigners who believe that better open data and more
community engagement can transform public goods and services.
The OCP’s vision, structure, and approach are drawn from a collaborative pro-
cess that included hundreds of stakeholders across government, business, and civil
society. The partnership started with a design meeting in 2012, forming an alliance
to foster collaboration, innovation, and collective action. The World Bank Group
served as OCP’s host until the end of 2014.
At the first global open contracting meeting in Johannesburg, South Africa, over
150 global and local participants co-created a work plan and a set of global princi-
ples that framed the OCP’s common understanding of open contracting.
This work led to a yearlong process resulting in the Open Contracting Data
Standard in 2014, a global non-proprietary standard structured to reflect the com-
plete contracting cycle. The standard enables users and partners around the world
to publish shareable, reusable, machine readable data, to join that data with their
own information, and to build tools to analyze or share that data.
With the appointment of OCP’s first Executive Director Gavin Hayman in 2015,
OCP was spun out of the World Bank to become an independent program based
at its fiscal sponsor the Fund for the City of New York. A lean secretariat is based
in Washington, D.C. and OCP is now governed by an independent Advisory Board,
made up of individuals from government, the private sector, civil society, the tech-
nology sector, and development organizations.
The vision and practices of open contracting are taking root and the first coun-
tries have begun to publish open contracting data. At present, countries and locali-
ties such as Ukraine, Mexico City, United Kingdom, and Nepal, among others, have
embarked on open contracting initiatives, and/or included open contracting in their
OGP Action Plans.

Findings
Finding 1:
Open contracting – the publication and use
of open, accessible, and timely information on
government deals – covers the full chain of
public procurement, starting from the planning
to the tender, award and contract and imple-
mentation of projects.
Ideally, citizens as end-users, businesses
as contractors, and journalists and civil society
as watchdogs must have access to information
that could help them identify where a road proj-
ect or a school building needs to be built, un-
derstand how it will be built, check how much
it will cost, and who will build and be account-
able for it, and monitor its implementation.
This process, according to Open Contract-
ing standards, involves the publication of at

least 35 documents, and includes the planning,
tender, award, contract, and implementation
of a project. Access and use of these records
are supposed to aid civic and business users
depending on their need, leading to improved
accountability and redress by agencies or con-
tractors by acting on the feedback received.
The research shows that agencies involved
in the procurement of public-works projects
produce nearly all 35 documents, but only 60
percent of these records are available at once.
Twenty-one of the 35 documents recommend-
ed for publication are either available online
or can be obtained through a request within
a considerable amount of time or within the
15-working-day period set in law. The rest are
not uploaded online or could not be requested
from agencies in a timely manner.

Open Contracting standards also classify
documents into three levels based on the in-
formation they contain.
Seven of the eight records that are consid-
ered to be “basic” are publicly available. The
basic level captures data that should already
be available in most contracting-data systems,
and that provides users with an overview of
contracting processes.
Nine out of 12 “intermediate” documents can
be obtained, while five of 15 documents consid-
ered to be “advanced” are available at once.
The intermediate level may require agen-
cies to take extra steps to provide identifiers
that join up data between systems, and that
enable users to see changes in contracting
processes over time.
The advanced level incorporates fields that
are important to connect open contracting
data with other data sources, and with the re-
al-world impacts of contracting.

Documents, which must contain the Technical
Specifications or Program of Works, Evalua-
tion Criteria, and Eligibility Criteria, are among
the documents that must be made public ac-
cording to law. Tender Clarifications or Sup-
plemental Bulletins are likewise uploaded on
PhilGEPS.
The only information withheld during the
tender stage is only the list of shortlisted firms.
The full list of all the contractors that submit-
ted bids for a project is not made known to
the public during the tender stage; it can be
seen only in the Bids and Awards Committee
(BAC) Resolution after the contract has been
awarded. The BAC Resolution is available on
PhilGEPS.
Of the five stages in the contracting chain,
the middle segment – tender and award – re-
sults in more available records primarily be-
cause Republic Act No. 9184, also known as
the Government Procurement Reform Act, and
its implementing rules and regulations, require
procuring entities, including the DPWH, to pub-
lish these records on PhilGEPS or the agency’s
website.
The procurement of locally-funded civ-
il-works projects by DPWH is governed by R.A.
No. 9184, the same law that created PhilGEPS.
In keeping with the government policy to pro-
mote economic development by tapping the
private sector, DPWH undertakes infrastructure
projects through contracts awarded after pub-
lic bidding. The bidding and awarding of civ-
il-works projects are thus conducted through
PhilGEPS.
As in all other procuring entities, records
on the tender and award of DPWH civil-works
projects are captured in PhilGEPS. Documents
for the first and last stages of the contracting
process – planning and implementation – may
be obtained from DPWH.
Relevant agencies also perform specific
roles in the contracting of infrastructure proj-
ects: Philippine Contractors Accreditation
Board (PCAB) for licenses; Securities and Ex-
change Commission (SEC) and Department
of Trade and Industry (DTI) as repositories of
corporate and business records; Construction
Industry Authority of the Philippines (CIAP) for
performance-evaluation reports; Government
Procurement Policy Board (GPPB) as the al-
ternative repository of contracting documents
and overall body in charge of government pro-
curement policy; and the Commission on Au-
dit (COA) for financial audit. Local government
units likewise play a role particularly in the is-
suance of permits to contractors.
During the tender stage, copies of the Ten-
der Notice or the Invitation to Bid and Bidding

of registration with government, such
as the first page of its Articles of
Incorporation, needs to be submitted.

organization may also sign up for
an account by making a request to
PhilGEPS.

During the award stage, copies of the No-
tice of Award and Evaluation Reports such as
Detailed Evaluation and Comparison of Bids
and Bids and Awards Committee Resolution
are uploaded on PhilGEPS and the DPWH
website.
Complaints or protests, meanwhile, are
published on the GPPB website, while infor-
mation on bidders, their validation documents
and any procedural exemptions for which they
qualify, are available through PCAB, CIAP, SEC,
or DTI.
Debarments or information about blacklist-
ed constructors can be found on the DPWH
and CIAP websites.
Records that are not publicly available
during the award stage are the Winning Bid,
Bill of Quantity, and Conflicts of Interest. These
are held by the Bids and Awards Committee of
the procuring entity. The researcher requested
but failed to obtain a sample of these records
from the DPWH.
Documents produced during the first and
last portions of the contracting process –
planning, contract, and implementation –
are not all available, although some like the
Medium-Term Public Investment Program can
be obtained through a public-records request,
a process that may take several weeks and
months by actual experience.
During the planning stage, only the Annu-
al Procurement Plans and Public Consultation
Notices are made available on the DPWH and
GPPB websites. Other planning documents
such as Environmental Impact Assessment,
Needs Assessment (which come in the form of
Medium-Term Public Investment Program), and
Feasibility Study may be obtained through a
request.
While copies of contracts are posted on
PhilGEPS, these do not appear to be com-
plete. Annexes, which must include, among
others, bidding documents, winning bidder’s
bid, performance security, and credit line,
are not all attached to the contract docu-
ment.
As for the implementation stage, only the
audit report fulfills the availability requirement.
Key information are made public through the
Constructors Performance Evaluation Summa-
ry Reports and the Status of Implementation
information posted on the DPWH website, but
these are incomplete. Financial Progress Re-
ports are not available as well.
Getting records from the DPWH through President Rodrigo R. Duterte’s
Executive Order No. 2 also known as the Freedom of Information E.O.
has been mostly successful even though it takes longer than the allowed
15-working day deadline in the EO. Take advantage of the EO, study the
agency manual, and establish a working relationship with the agency’s
Stakeholders Affairs Division that handles FOI requests. Follow up, follow
up, follow up like a good, diligent requester would do.TIP

Created to improve transparency in public
procurement, PhilGEPS is the primary source
of procurement information in government.
The system serves as an online platform on
the tender and award stages of the contract-
ing process. As such, all government agencies
(buyers) and suppliers, including manufactur-
ers, distributors, contractors, and consultants,
are required to register and use PhilGEPS in
the bidding and awarding of goods, civil works,
and consulting services.
Procuring entities, including the DPWH,
submit bid and award notices, along with other
relevant documents in PhilGEPS. PhilGEPS in
turn creates record repositories and databases
from the files provided by the agencies. To ac-
cess these records in the system, citizens must
sign up for an account with PhilGEPS.
DOCUMENTS
PhilGEPS provides three sets of lists for
users under a CSO account: Open Opportuni-
ties for open tenders, Former Opportunities for
closed tenders, and Award Notices for award-
ed contracts. These lists may be viewed by cat-
egory or by agency that posted the bid. Each
bid or award opens to a new page that con-
tains a summary of the bid or award along with
the following documents:
Bid Notices
Bid notices contain information about the
goods or services being procured, including a
general description of the project, general cri-
teria to be used for the evaluation, post-quali-
fication, and award of the bid, details on pro-
curement activities, approved budget for the
contract, contact person, and other informa-
tion.
Award Notices
Award notices contain information about
the award, including the name and address
of the winning bidder, award type, contract
amount, contract number, and reason for
award. Each award notice typically includes
related documents such as the Notice to Pro-
ceed, Bids and Awards Committee Resolution,
and a copy of Contract Agreement.

While PhilGEPS offers free public access, a
user needs to sign up for an account and pro-
vide proof of registration if he or she is part of
a CSO. By experience, the approval and valida-
tion of user registration is not automated; this
researcher had to seek help from a PhilGEPS
staff to aid the process. Logging into the sys-
tem can also take time in some instances. The
website appears to unresponsive or inactive at
certain times of the day.
Datasets made available by PhilGEPS
Contractor Records
PhilGEPS also keeps records about suppli-
ers, including contractors, when they register
with the system. These records include regis-
tration certificate, mayor’s permit or municipal
license, BIR registration certificate, tax-clear-
ance certificate, other licenses, and a docu-
ment stating they are not blacklisted, and may
also be obtained through an FOI request. But

because these documents were required from
suppliers only recently, not all suppliers would
have their pertinent documents with PhilGEPS.
DATABASES
PhilGEPS also makes available the follow-
ing databases on its website (no log-in re-
quired) or through an FOI request:
Bids and Awards Notice Databases
An agency or the procuring entity, through
its BAC Secretariat, enters bid and award no-
tice data on PhilGEPS through a form it fills up
when it is logged in the system. These data are
then scraped by PhilGEPS staff in order to gen-
erate spreadsheet files, which are uploaded on
its Open Data page.
PhilGEPS has uploaded its bids and awards
notice databases from 2000 to 2004 and
quarterly from 2005 to present. In law, all gov-
ernment contracts should be on posted on
PhilGEPS, except for public-private partner-
ships and projects worth P50,000 and below
procured through alternative mode. In law, too,
contracts included in DPWH’s civil-works con-
tracts database should appear in the PhilGEPS
database, for as long as the project is funded
by government funds where R.A. No. 9184 ap-
plies.
Uploaded quarterly since 2005, the data-
bases contain 17 data fields about the bid and
nine data fields about the awarding of proj-
ects. More data fields such as the location of
the procuring entity or area of delivery by prov-
ince are available and may be generated by
PhilGEPS through an FOI request.

PhilGEPS also makes available a List of
Registered Suppliers upon request. The list
is generated by scraping the data entered by
suppliers or all private entities doing business
with government in the system. The database
contains the profile and contact details of each
supplier. All registered suppliers, including
blacklisted ones, appear on the database.
Commonly-Used Goods
This list contains a catalogue of items com-
monly used by agencies, including data fields
such as product code, product description,
price, quantity, and availability status.

ing of civil-works projects, PhilGEPS offers the
most comprehensive set of records. Because
procurement is systematized in PhilGEPS, da-
tabases can be generated following open-data
standards. For instance, PhilGEPS employs an
ID system such that a unique ID is generated
per bid and award notice once they are en-
tered in the system. The database also follows
naming conventions such that each agency’s
and contractor’s names are uniform across all
entries.
The databases are not 100 percent com-
plete, however. While all agencies are man-
dated to enter all bid and award notices in
PhilGEPS, there is no clear indication whether
agencies post all notices. Technically, agencies
should be posting notices; otherwise they will
not be able to proceed with the procurement
process. One way to check is to get an agen-
cy’s Annual Procurement Plan and compare it
with the bid notices the agency had posted in
PhilGEPS because agencies are only allowed
to procure goods and services included in its
procurement plan. Another way to check is
through GPPB’s Agency Procurement Compli-
ance and Performance Indicators (APCPI) re-
ports.
Moreover, only winning bidders are includ-
ed in the databases. Details about other bid-
ders are available but a user has to dig further
and look at each project page in the system.
The BAC Resolution, for instance, shows all the
contractors that made a bid for a project and
their corresponding bid amounts.
The databases do not show the reasons
for failed bids. Information about this could be
good points of reference for the procuring en-
tity.
Only the procurement (tender and award)
of DPWH civil-works projects are captured in
PhilGEPS. As of this writing, PhilGEPS is set to
modernize its system supposedly to include,
among others, the posting of the Annual Pro-
curement Plan per agency and implementa-
tion reports per contract. The plan, if it pushes
through, is a step forward in publishing more
information along the contracting chain.
The Open Contracting Data Standard
(OCDS) is an open data standard created by
the Open Contracting Partnership for the pub-
lication of structured information in all stages
of the contracting process: from planning to
implementation.

Providing data about contracting processes in CSV
files or other structured formats makes it easier for

sistent URI improves the usability of data. Providing
APIs helps users locate the information they are look-
ing for quicker and enables third parties to build more
advanced and responsive services on the data.
Adding links to contracting data and connecting them
to other datasets on project planning, public spending,
or company registrations add further value to data,
enabling new kinds of re-use.
The Philippines is far from reaching five stars
given that documents – not even data yet – are
not all publicly available. However, there is a
bright spot and potential in the machine-read-
able data made available by PhilGEPS. Its bid
and award data may be connected to the data
published by DPWH, CIAP, and PCAB, which
cover some of the data produced during the
planning, contract, and implementation stages.
OCDS makes use of 358 data fields com-
posed of key information culled from the 35
documents recommended for publication
throughout the contracting process. These
fields also include metadata or contextual in-
formation about the data release.
The research found that 60 percent or 212
of the 358 data fields are already available or
can be pulled from existing records maintained
by PhilGEPS, DPWH, and other agencies in-
volved in the procurement of infrastructure
projects. The rest of the 143 data fields, which
are mostly contextual data (ID, language, tags,
etc.), can be also created. (Three data fields
in the OCDS may not apply in the Philippine
context as they refer to the minimum estimat-
ed value of the contract; R.A. No. 9184 requires
the Approved Budget for the Contract or the
ABC.)

data fields vis-à-vis data published by the Phil-
ippine agencies. The mapping annex identifies
the agency that produces or keeps the data,
the document that contains the data, and the
format of the document.

Apart from provisions in the Government
Procurement Reform Act that mandate agen-
cies to publish project documents, another or-
der, National Budget Circular No. 542, requires
all agencies, including local government units,
state universities and colleges, and govern-
ment-owned and -controlled corporations, to
post key records on their website.
More commonly known as the Transparen-
cy Seal circular, NBC No. 542 is the reason why
agency websites carry a “Transparency” page,
which contains an index of downloadable files.
In essence, the required documents all re-
late to contracting as they cover projects and
programs and goods and services an agency
needs to perform its mandate.
The information and documents that agen-
cies must make available are: agency man-
dates and functions, names and positions of
officials, annual reports, approved budget and
corresponding targets, major programs and
projects, program and project beneficiaries,
status of implementation and program/project
evaluation and/or assessment reports, annual
procurement plans, contracts awarded, and
the name of the contractors/suppliers/consul-
tants.
DPWH publishes nearly all the required
documents in NBC No. 542. Although not
complete, the records offer an opportunity to
track a project from planning to implementa-
tion – that is, if one is patient enough to comb
through web pages and web pages of docu-
ments and data.
DPWH records are not organized the same
way PhilGEPS records are published. Docu-
ments related to the bidding or awarding of
one project can be seen on the same page in
PhilGEPS. DPWH meanwhile uploads files fol-
lowing the list provided in NBC No. 542, miss-
ing the opportunity to link documents and data
along the contracting chain. As a result, parts
of the website serve as a dumping ground for
documents collected from various district engi-
neering offices.
For example, the Civil Works page contains
key documents such as the Abstract of Bids,
Notice of Award, Notice to Proceed, Awarded
Contracts, and Contract Agreement, in addi-
tion to the lists of Registered and Blacklisted
Contractors. To track one project from bidding
to contract, a user must check each section
and scroll through multiple web pages to find
the related documents.
The Awarded Contracts list, meanwhile, is
presented in multiple web pages, making it
difficult to see the entire data or sort through
the list. A user must click on each web page to
browse the entire list. No spreadsheet is up-
loaded on the website; the documents, except
for the lists, are all in PDF format. By experi-
ence, spreadsheet copies may be obtained
from DPWH through a public-records request.
The only machine-readable contracting
data that DPWH uploads on its website is the
Project Status data, which can be downloaded
as a CSV file.
Overall, navigating the DPWH website can
be difficult for users unfamiliar with procure-
ment. While records are categorized in gen-
eral, they do not provide a good indication of
how one document might connect to another.
It is also the same experience with the Gov-
ernment Procurement Policy Board (GPPB).

In its Monitoring page, the GPPB publishes
records submitted by procuring entities such
as the Annual Procurement Plans and Pro-
curement Monitoring Reports, as well as data
sourced from regulatory bodies such as the
List of Blacklisted Suppliers and Constructors
and Constructors Performance Evaluation
Summaries from CIAP. GPPB also publishes
Pre-Selected Suppliers and Consultants, List of
Observers, and Status of Protests.
The GPPB website thus serves as a record
repository in line with the requirements of R.A.
No. 9184. However, like PhilGEPS and DPWH,
GPPB publishes only what it receives, which
raises a question on the completeness of the
documents.
A master list of agencies that need to sub-
mit records might be helpful to ensure that all
agencies submit their Annual Procurement
Plans and Procurement Monitoring Reports.
Categorizing the agencies – executive, judi-
ciary, legislative, local government, SUCs, and
GOCCs – might also aid citizens searching for
the reports of a particular agency for a given
year. Currently, agency reports are uploaded
as-is, all in the same page by year.

At least two agencies – the Securities and
Exchange Commission and the Philippine
Contractors Accreditation Board – started
withholding contractor information, citing pro-
visions in Republic Act No. 10173 or the Data
Privacy Act of 2012.
Since the Data Privacy Act took effect, the
SEC has suspended public access to its Re-
verse Search Module, a facility that can gen-
erate a list of corporate interests of individu-
als such as shareholdings and board seats in
corporations. The Reverse Search Module is
the counterpart of SEC’s i-View, which offers
the inverse function allowing users to search
for a company (instead of a name) and down-
load the documents it has filed with SEC. Re-
cords include articles of incorporation, general
information sheets, and annual financial state-
ments.
The Reverse Search Module has been an
important tool particularly among journalists
investigating business interests and financial
connections of public officials, electoral can-
didates, or persons involved in government
deals. PCIJ, for instance, relied heavily of the
Reverse Search Module to map the business
interests of former President Joseph Estrada,
his wife, children, and mistresses. The PCIJ se-
ries of investigation on Estrada’s unexplained
wealth became bases for the impeachment
charges filed against the former president.
But the SEC has since shifted its policy
and disallowed public access to the Reverse
Search Module until it could properly ascertain
the effect of the law on the Commission in its
custody of data and its processing through the
RSM.
On two separate occasions, one in April
2015 and the other in February 2017, PCIJ
sought to challenge SEC’s decision, pointing
out Section 5 of the law’s implementing rules
and regulations that states that “(personal) in-
formation processed for journalistic, artistic or
literary purpose, in order to uphold freedom of
speech, of expression, or of the press, subject
to requirements of other applicable law or reg-
ulations” and “(personal) information that will
be processed for research purpose, intended
for a public benefit, subject to the requirements
of applicable laws, regulations, or ethical stan-
dards” are among the “special cases” that are
not be covered by the Data Privacy Act.
On Feb. 4, 2017, SEC Chairperson Teresita
J. Herbosa sent a letter to Privacy Commission-
er Raymund Liboro seeking a legal opinion on
the matter. In its Advisory Opinion No. 2017-29
dated June 23, 2017, NPC stated that the “ex-
emption from Data Privacy Act requirements
afforded to personal data being processed by
journalists may not be invoked by the latter
when insisting that the reverse search module
facility be made accessible to the public anew.”
NPC acknowledged that the law does pro-
vide for the non-applicability of the law on per-
sonal data processed for journalistic, artistic,
literary, or research purposes. This exemp-
tion is made “in order to uphold freedom of
speech, of expression, or of the press, subject
to requirements of other applicable law or reg-
ulations.”
Finding 4: The Data Privacy Act has prompted some agencies to limit access to information on businesses, including contractors.

But the exemption, NPC said, is not abso-
lute. It said, “It applies only to the data and not
the entities involved in their processing (i.e.,
personal information controllers or personal
information processors). Those entities remain
to be subject to the requirements of the law,
particularly those relating to the implementa-
tion of security measures.”
Yet in the case of PCIJ, the information be-
ing withheld did not contain anything on the
entities involved in the processing of the data.
The Reverse Search document sought by
the PCIJ, and which it had used previously for
earlier reports, contains the name of the per-
son being searched, his/her birthdate, and na-
tionality, the name of company related to him,
its SEC Registration No., relationship to the
company whether stockholder, incorporator,
or board member, reference, and as of date.
These details could be subject for discussion
to identify which are considered personal in-
formation, but the SEC decided to withhold all
the information by suspending the use of the
Reverse Search Module.
The NPC, in agreement with SEC, also said
that journalists may still secure information
they require through corporate documents
that continue to be available to the public via
the SEC i-View and SEC Express System.
SEC i-View and SEC Express System,
however, are not capable of generating the
same information drawn up using the Reverse
Search Module. SEC i-View and SEC Express
System work only if the user already knows the
company name. The Reverse Search Module
meanwhile answers this particular question:
Which companies are related to an individual?
As to date, only government agencies, in-
cluding co-regulators, legislators, and law en-
forcement agencies are allowed to access the
system upon their submission of a letter-re-
quest.
Apart from discontinuing access to the Re-
verse Search Module, SEC also issued Memo-
randum Circular (MC) No. 1.6, which modifies
the General Information Sheet (GIS) and Notifi-
cation Update Forms with the goal of keeping
Tax Identification Number (TIN) and address
details from public view.
In the revised GIS, the TINs and residen-
tial addresses of the members of the board,
officers and stockholders of domestic corpo-
rations and the resident agent and officers of
foreign corporations are to be indicated in a
separate sheet, which will not be uploaded to
the SEC i-View.
NPC, in its advisory opinion, said that it
makes sense to share or provide such infor-
mation to tax authorities and other regula-
tors, whenever necessary, because policies
that require its collection are anchored on the
need to improve the government’s monitoring
mechanism for tax law compliance. But NPC
maintained that “there is little reason, if any, to
make such item available to everyone else, via
the SEC’s online and offline platforms, sans the
consent of the person it pertains to.”
In effect, the TINs and addresses of stock-
holders, directors, and officers of companies
will no longer be seen in the new GIS form.
Such information had been useful to jour-
nalists in verifying the business interests and
financial connections of public officials, elec-
toral candidates, or persons involved in gov-
ernment deals. These details can be matched
with information available in other public re-
cords to verify the identity of the subject of the
report.
Meanwhile, PCAB is no longer providing
access to copies of contractor licenses to re-
questors. This used to be available up until the
first quarter of 2017. But PCAB is maintaining
public access to its database of registered and
blacklisted contractors.
According to a PCAB official, a copy of the
license can be released only to the business

owner. The license is printed on a security pa-
per, which might be easily falsified, the official
said.
As of the research period, PCAB was craft-
ing its implementing rules and regulations for
the Data Privacy Act. The PCAB rules would
detail what information could be or could not
be disclosed to the public.
The research, however, did not find Data
Privacy Act issues with PhilGEPS and GPPB.
Both agencies said that the Republic Act No.
9184 requires agencies to publish certain sets
of documents pertaining to public procurement
and contractors, and that this will continue to
be their principal guiding law.
Nearly all agencies covered in the re-
search are either creating new or upgrading
their internal information-management sys-
tems. While agencies need to prioritize up-
dating their internal systems, this could offer
an opportunity for such bodies to standardize
data, explore linking up data following OCDS,
create more databases, and publish these on
their websites.
Linking of data is supported by Section
8.5 of R.A. No. 9184’s Implementing Rules and
Regulations, which provides that all procuring
entities already maintaining an electronic reg-
istry shall integrate the same with that of the
PhilGEPS.
Philippine Government Electronic
Procurement System
PhilGEPS is the single, centralized elec-
tronic portal that serves as the primary source
of information on government procurement.
Government agencies and suppliers and con-
tractors are mandated to register and use
the system in the conduct of procurement of
goods, civil works, and consulting services.
The system has been in existence for more
than 15 years now and has undergone several
updates.
PhilGEPS is now set to modernize its sys-
tem, which may include, among others, adding
the Annual Procurement Plan per agency and
implementation reports per contract. Only bid
and award documents are currently uploaded
and published in the system. PhilGEPS soft-
ware modernization is included in the OGP Ac-
tion Plan. Additional functionalities of current
system will be installed such as e-bidding, up-
loading of agencies’ procurement plans, and
e-payment.
The plan, if it pushes through, is a step for-
ward to publishing more information along the
contracting chain. This also offers an opportu-
nity for OCDS to be adopted.

The DPWH has at least six internal infor-
mation management systems that cover the
contracting stages from planning to implemen-
tation. This is different from PhilGEPS and is
geared more toward the facilitation of DPWH’s
core roles and tasks. But documents and data
can be extracted from these systems, which
are then be uploaded on their website. Data
may also be requested and pulled from the
system through a public-records request. Not
all records are available at the Central Office,
however, as most procurement records are left
or are kept in District or Regional Engineering
Offices, depending on which office has the lev-
el of authority on a project.
During planning stage, the department uses
the Multi-Year Planning System (MYPS, new
system) and Design Management Application
(DMA, for completion). The Civil Works Applica-
tion (CWA, existing system) meanwhile is used
during tender and award. To monitor projects
implementation, DPWH uses the Project and
Contract Management Application (PCMA, ex-
isting system). The Project Procurement Man-
agement Plan Application (new system), mean-
while, is used to monitor DPWH’s procurement
activities. Like other agencies, DPWH uses the
Electronic National Government Accounting
System (eNGAS, existing system) for tracking
stage payments.
Securities and Exchange Commission’s i-View
SEC i-View, a pay-per-use, online records
repository, is also set for a long overdue up-
grade. To view or print documents from SEC
i-View, a user must purchase prepaid credits,
which are available at the SEC Head Office in
Pasay City or through SEC’s eLoading Module.
To buy credits via the eLoading Module, a user
must have a Land Bank of the Philippines ATM
account or an account with any BancNet mem-
ber bank registered to use internet banking.
SEC Express System is another mode of
securing corporate records without having to
personally come to the SEC. Users may re-
quest for documents through a web-based in-
terface or by calling or setting an appointment
through hotline number 737-8888. Online pay-
ment and courier delivery are services includ-
ed in the system.
By experience, SEC Express System offers
a more updated set of documents. Current re-
cords usually take more time to be uploaded
on SEC i-View. But while online access is help-
ful, SEC charges fairly high fees for record ac-
cess.
SEC Express System charges a minimum
of P216.32 to P397.44 for a plain copy of a
document, depending on the type. An authen-
ticated copy meanwhile may cost between
P242.19 and P604.44. These amounts do not
yet include shipping and additional fees, which
would depend on the weight and destination
of the order.
SEC i-View charges P0.20 per page view
and P5 per page printed.
Philippine Business Registry
for the Department of Trade and Industry
The Philippines Business Registry (PBR) is
a web-based system that serves as a one-stop
shop for entrepreneurs who need to transact
with several agencies to be able to start oper-
ating a business.
In the PBR, the computerized registration
systems of agencies involved in business reg-
istration will be interlinked so that applicants
need not physically go to each agency to regis-
ter their businesses. These include the Depart-
ment of Trade and Industry, Bureau of Internal
Revenue, Social Security System, Home De-

velopment Mutual Fund, Philippine Health In-
surance Corporation, Local Government Units,
and other permit/license-issuing agencies.
Construction Industry Authority
of the Philippines and Philippine Contractors
Accreditation Board
CIAP and PCAB are working on an Informa-
tion System Strategic Plan, which could pave
the way for linking various systems and data
such as PCAB’s licensing, registration, and
blacklisting systems, as well as CIAP’s Con-
structors Performance Evaluation Summary
reports. The ISSP is being pursued as part of
the government’s computerization plan led by
the Department of Information and Communi-
cations Technology.
Audit-Related Data Information System for the
Commission on Audit
COA’s Audit-Related Data Information Sys-
tem (ARDIS) is a web-based information system
that aims to capture audit-related information

at the audit-team level to facilitate monitoring
of audit activities. It is an integration of is an
integration of several systems: Audit Resource
Management Information System, Audit En-
gagement Monitoring System, Audit Results
Monitoring System, Cash Advance Monitoring
System, and the Government Agencies Proj-
ect, Program and Activities Information Sys-
tem.
The Audit Results Monitoring System, for
instance, facilitates the monitoring of the Au-
dit Observation Memorandum, Notice of Sus-
pension, Notice of Disallowance, and Notice
of Charge issued to government agencies, of-
ficials, and employees and action taken on the
audit recommendation by the audited agen-
cies.
The Government Agencies Project, Pro-
gram, and Activities Information System main-
tains a database of agencies’ projects, pro-
grams, and activities showing the when a
project started, date of completion, and cost
per project. The system facilitates the monitor-
ing of the status of the projects and generation
of consolidated reports per audited agency.

Civil-society organizations have worked
closely with the Department of Public Works
and Highways and other agencies for decades
to make procurement processes more trans-
parent, efficient, and responsive to people’s
needs.
One of the shared goals of both govern-
ment and civil society is to promote procure-
ment literacy, in addition to providing under-
standable contracting data for citizens.
The Affiliated Network for Social Account-
ability in East Asia and the Pacific (ANSA-EAP),
for instance, worked with university professors
in the past to integrate procurement literacy in
their classes.
“What we did was convince several profes-
sors to integrate the teaching of open contract-
ing in their classes,” ANSA-EAP Executive Di-
rector Redempto Parafina said. “We integrated
and connected it to their courses, to political
science, to journalism, to public administra-
tion.”
For Parafina, improving the quality of con-
tracting data is not just about the technical for-
mat of the available information, but also about
how much is available and how it is processed
and packaged in a way that is accessible to cit-
izens.
“For us, we take the perspective of the or-
dinary people because social accountability is
with the constituency,” he said. “If we can pro-
duce the same output using Excel file format
and JSON format in the front end, we do not
care what we use for as long as we can still
report [to citizens].”
Meanwhile, for Rechie Tugawin of Govern-
ment Watch (G-Watch), the more pressing con-
cern is the access and appreciation of procure-
ment data at the local level.
“We have to give more emphasis on the lo-
cal level, in the barangays, that may seem small
but concerns those in the grassroots because
it directly affects them – if they have access to
data, if they have connectivity issues in access-
ing information platforms,” Tugawin said.
Tugawin added that local agencies can do
better in being more transparent and accom-
modating to local residents requesting for con-
tracting documents.
G-Watch previously engaged with commu-
nity members in monitoring projects in their lo-
cality. This involved having the local monitors
request for documents of local projects.
G-Watch, being formerly attached with the
Ateneo de Manila University, had easier time
requesting documents from local agencies
compared to the local monitors, who are most-
ly members of the community.
“We had difficulty in getting documents in
some cases, but we had more ways in getting
records since we are linked with an academic
institution,” said Tugawin. “But as for our local
monitors, they still need the backing of an au-
thority.”
“We had a memorandum of agreement with
the central office of a government agency that
brought some ease of access,” he also said.
“But in ordinary cases, they have difficulty ask-
ing for documents and ask for help because
they cannot get what they need.”
For Jenina Joy Chavez, co-convener of the
Right to Know, Right Now! Coalition, proactive

disclosure is a must for all procuring agencies.
“Even without a request, they need to publish
the reports… That can still be improved,” she
said.
The Right to Know, Right Now! Coalition is
composed of about 150 civil-society organiza-
tions and CSO leaders pushing for the passage
of the Freedom of Information Act. Yet while
the enactment of an FOI law is not high on the
priority list of Congress right now, the Coalition
continues to push and demand for openness in
government by launching a series of FOI prac-
tice rounds, to test and challenge the imple-
mentation of the Duterte administration’s E.O.
No. 2, as well as other transparency laws. (PCIJ
is a founding member and lead co-convenor of
the Coalition.)
ANSA-EAP’s Parafina said that the govern-
ment could also do better in encouraging and
providing support for observers during bidding
processes.
In the past, the government provided some
transportation allowance for CSOs partici-
pating in government procurement activities.
However, the availability of this support is con-
sidered on a year-by-year basis.
For example, the 2016 budget included a
provision for observers to be able to reimburse
as much as P800 per day for at most four times
a month, totaling P3,200. The 2017 budget,
however, did not include the same provision,
as very few were aware of it and only a few
managed to use the allowance, Parafina said.
In 2012, the Government Procurement Pol-
icy Board recommended to the Department
of Budget and Management “the inclusion of
a provision in the General Provisions of the
2013 [General Appropriations Act] mandating
the grant of transportation allowance to NGO/
CSO Observers participating in government
procurement activities.”
GPPB cited a recommendation from the
2008 Country Procurement Assessment Re-
port to “strengthen the capacity of NGOs/
CSOs to participate in the procurement pro-
cess as well as the need for the government
to inform NGOs/CSOs of alternative sourc-
es of funding to sustain their participation in
government procurement activities” and a
“2010 Agency Procurement Compliance Per-
formance Indicators (APCPI) exercise” that the
“average rating of Observer attendance in the
procurement activities of seventeen (17) pilot
agencies is only thirty five percent (35%)” in
the resolution.
“The experience in bidding (as observer)
serves as good learning experience for organi-
zations, aside from the fact that we have seen
in the past the good effect of having observers
in the procurement process,” Parafina said.

Open contracting is not yet the norm in the procurement of infrastructure proj-ects – or procurement in general – in the Philippines. But the country has a long
history of transparency initiatives and innovative reforms that have been launched and/or are being implemented to improve the integrity of contracting. It is important to situate contracting in the Philippines in this context to understand where break-throughs and barriers lie.
to curb information access, appears to pose
some unintended problems for civil society
and journalists who request and use certain
information essential in their advocacies and
reporting, respectively.
These availability and accessibility prob-
lems are basic but they are important to be
addressed for citizens who may wish to par-
ticipate in public hearings, for civil society who
may wish to monitor projects or act as observ-
ers, and journalists who may want to investi-
gate corruption and controversial deals. Avail-
ability and accessibility of contracting data are
also important for agencies to facilitate their
work and get better value for taxpayer’s mon-
ey and businesses for them to be able to better
compete in government projects.
Conclusionsand Recommendations
The contracting cycle is most transparent
only during the tender and award stages. More
document digging and agency prodding are
needed to be able to track the planning and
implementation phases. PhilGEPS makes avail-
able the bid and award data but planning and
implementation data are tucked in multiple re-
cords kept or sometimes dumped in the pro-
curing entity’s website.
If and when more documents and data
are available, these do not often come in ma-
chine-readable formats, making it difficult to
analyze or connect with other information. Ac-
cessing records from some agencies like the
Securities and Exchange Commission can also
be costly.

The following recommendations reflect lessons learned from the findings of this as-
sessment report:
1. Upload basic contracting documents online – from planning
to implementation. Agencies keep a wealth of documents internally, many of which could
help string the full contracting narrative of government projects.
Whether or not a common standard can be adopted right now, posting
contracting documents – from planning to implementation – for free
is a first key step. Apart from being considered good practice globally,
proactive disclosure of contracting documents is required by the
Transparency Seal Circular and the R.A. No. 9184. Monitoring agency
compliance with these provisions is a must as well.
2. Provide machine-readable data on contracting – from
planning to implementation. Providing data about projects in spreadsheet files or other structured
formats makes it easier for stakeholders to analyze what government
buys.
3. Consider adopting the Open Contracting Data Standard, but
first identify key things the agency wants open contracting
to achieve. Clarifying agency goals will help set clear priorities. Build a team with
police and technology skills and engage with stakeholders, including
other agencies, civil society, media, and the business sector. The
readiness of agencies to adopt OCDS might be an issue, from the
procedural and technical to policy standpoints. These concerns must
all be taken into account.
4. Strengthen the capacity of civil society and media in
using contracting data in their advocacies and reporting,
respectively. Greater transparency in procurement has to be accompanied with
activities that help citizens and civil society become better Open
Contracting advocates and journalists become better reporters of
government contracts. Agencies must work with stakeholders in
developing an environment in which contracting or procurement
becomes an expertise of the many rather than the few.

5. Advocate for the passage of the Freedom of Information law
with an Open Contracting lens. Contracting, a major role for the government, is also its biggest risk. A
Freedom of Information Act will serve as a great complement to existing
laws, rules, and orders on access to records and a great supplement
to what these laws lack in terms of transparency standards. While the
passage of an FOI law remains uncertain, citizens and CSOs must sustain
their practice of accessing information and claiming their right to know to
foster and demand greater openness in government.
6. Make Open Contracting a public commitment in the Open
Government Partnership. Promoting Open Contracting as the norm in procurement across all
agencies, from local to national levels, is an ambitious yet noble goal.
Making this a commitment in Philippines’ OGP National Action Plan might
be a good place to start. OGP commitments are not supposed to be
empty promises but principles that if achieved could offer a wide range
of benefits to agencies, business sector, and communities alike.
