The nursing home resident has the right, upon request, to access all nursing home records relating to that resident within 24 hours, and to purchase a copy of those records upon 2 business days’ notice, at no greater than the “community standard” cost.

The facility may not discharge the resident except under the following circumstances:

(1) The transfer or discharge is necessary for the resident’s welfare and the resident’s needs cannot be met in the facility;

(2) The transfer or discharge is appropriate because the resident’s health has improved sufficiently so that the resident no longer needs the services provided by the facility;

(6) The facility ceases to operate.

Federal and state rights vary widely, depending upon the type of facility (nursing home, AL facility or CCRC). Even where protections are strong “on paper,” enforcement may be difficult. Therefore, thoroughly research a facility prior to admission.
