Dear Mr. Kalman:

On November 21, 2000 Cimarron Corporation (Cimarron) submitted a license amendment requestproposing changes to the environmental monitoring program. Since that time, Cimarron hascollected and evaluated significant additional data from groundwater and surface waterenvironmental monitoring locations. In addition, Cimarron has committed to perform groundwaterassessments in four areas at the site:

* Burial Area #1* Waste Pond #1* Waste Pond #2* Well 1319

Evaluating historical data, in conjunction with planning assessment programs for the four above-mentioned areas, enabled Cimarron to develop and propose an enhanced Environmental MonitoringProgram. As you are aware, the current Environmental Monitoring Program reflects historicaloperations rather than current knowledge regarding groundwater conditions at the site. Theattached document:

* Presents a summary of historical environmental monitoring data,* Identifies areas in which groundwater assessment fulfills the need for monitoring,* Identifies locations that should be retained in the environmental monitoring program,* Seeks to clarify the NRC requirement for eight consecutive quarters of groundwater

samples (as stated in license condition 27.b.), and* Proposes a revised environmental monitoring program for both groundwater and surface

water.

This Environmental Monitoring Program does not conflict with the ALARA principle or thedecommissioning process. It does not conflict with requirements specifically stated in the license,and does not impair Cimarron's ability to comply with applicable NRC regulations. It does notcause a degradation in environmental commitments, adversely impact the quality of the work, doesnot alter remediation objectives, or impact health and safety. Finally, this modification does notconflict with NRC's Environmental Assessment or the Safety Evaluation Report. Based on thisanalysis Cimarron should be authorized to change the environmental monitoring program inaccordance with license condition 27(e) without NRC approval. However, license condition 27(b)requires eight quarters of sampling from "all wells". Cimarron believes it is in the interest of bothCimarron and NRC to clarify this requirement, and seeks to capture this clarification within theEnvironmental Monitoring Program. Consequently, the Environmental Monitoring Programdescribed herein is submitted as a license amendment request.

Cimarron requests that license condition 27(b) be modified to state, "Cimarron will implement theEnvironmental Monitoring Program as described in a March 19, 2003 license amendment request."

With the submittal of this license amendment request, Cimarron retracts the November, 2000submittal. Because the next annual environmental monitoring sampling event is scheduled forJune, 2003, Cimarron requests NRC review and comment as early as possible. If a licenseamendment approving this modified Environmental Monitoring Program is not issued prior to theJune sampling event, the sampling locations listed in the current program will be sampled.

REVIEW OF HISTORICAL INFORMATION AND PROPOSAL

1.0 INTRODUCTIONCimarron Corporation (Cimarron) has been sampling a specific set of environmentalgroundwater monitoring wells and surface water locations at the Cimarron facility since 1989,with numerous locations being sampled since 1985. Monitoring wells in the existingenvironmental monitoring program were installed for a variety of reasons before thehydrogeology of the entire site was well understood. In recent years, Cimarron has learned agreat deal about the site's hydrogeology and the nature and extent of radiological impact togroundwater. Consequently, Cimarron believes it is appropriate to revise the environmentalmonitoring program in light of this improved knowledge. This document:

* Presents a summary of historical environmental monitoring data,* Identifies areas in which groundwater assessment presently replaces the need for routine

environmental monitoring,* Identifies locations that should continue to be sampled on a routine basis within the

environmental monitoring program,* Proposes clarification of the NRC requirement for eight consecutive quarters of

groundwater samples (as stated in license condition 27.b.), and* Proposes a revised environmental monitoring program for both groundwater and surface

water.

License condition 27.b. states, "NRC will not terminate Radioactive Materials License SNM-928until Cimarron demonstrates that the total uranium concentrations in all wells have been belowthe groundwater release criteria for eight consecutive quarterly samples." This environmentalmonitoring program is intended to address the need for a minimum time period during whichsustained groundwater monitoring demonstrates that radionuclide concentrations are and willremain below license criteria without requiring the quarterly sampling of every well on site.

Groundwater monitoring wells and surface water sampling locations included in the currentenvironmental monitoring program are listed on Table 1. Their locations can be seen in Figure 1.Table 1 presents the wells by the unit or area monitored. All the locations on this list have beensampled on an annual basis for at least 13 years, with most having been sampled for 17 years.Although the environmental monitoring program does not require quarterly sampling, Cimarronhas voluntarily sampled several of these locations on a quarterly basis for several years to gain abetter understanding of groundwater information at those locations. This document will presenthistorical data and propose continued monitoring as appropriate for certain areas.

Groundwater concentrations will be compared with license-stipulated groundwater criteria(concentration limits) of 3,790 pCi/L for Tc-99 and 180 pCi/L for total uranium. Cimarronunderstands that NRC is communicating with EPA regarding potential residual concentrations.NRC-stipulated criteria are the only criteria in license SNM-928, so these are the relevant criteriawith which to evaluate the environmental monitoring program.

2.0 URANIUM WASTE POND #1~v Historical Information

Former uranium waste pond #1 (U-Pond #1) overlies Sandstone A. Monitor wells 1311, 1312,and 1313 are the three environmental monitoring wells located in this area. All three wells arescreened in Sandstone A. Well 1311 is located upgradient of the impoundment and Wells 1312and 1313 are located downgradient. All three wells were installed in 1985 and have beensampled on an annual basis since then. Wells 1312 and 1313 have been sampled on a quarterlybasis for at least five years. Tables 2, 3, and 4 present gross alpha, gross beta, Tc-99, and totaluranium data for all sampling events for these wells.

Total uranium and Tc-99 have been detected in both downgradient wells, with total uranium atconcentrations well above background. The highest Tc-99 concentration in either downgradientwell was 3,680 pCi/L (Well 1312 - March 1997). The highest total uranium concentration ineither downgradient well was 358 pCi/L (Well 1313 - June 1990). The highest concentrations ofTc-99 and total uranium in the past two years were 1,030 pCi/L and 81.7 pCi/L, respectively(both from Well 1312). Figures 2, 3, and 4 present graphs of Tc-99 and total uranium data forWells 1311, 1312, and 1313, respectively. Tc-99 was never analyzed at concentrationsexceeding 3,790 pCi/L, although gross beta data indicates that Tc-99 analysis was not performedwhen gross beta concentrations were at their highest. Total uranium only exceeded 180 pCi/L inthe June 1990 sampling event. No other samples exceeded either limit.

Groundwater AssessmentThe U-Pond #1 area is scheduled for groundwater assessment focusing on Tc-99. Additionalinformation on the distribution of Tc-99 in groundwater will be obtained during this assessment.The groundwater assessment work plan, Technetium-99 Site Impact Evaluation and ProposedGroundwater Assessment Work Plan (Kerr-McGee, September, 2002), only addresses Tc-99because uranium has not been detected at levels near the 180 pCi/L limit since 1990. After thegroundwater assessment work, currently scheduled for spring 2003, is completed, Cimarron willpropose a groundwater monitoring program for Tc-99 in the U-Pond #1 area if continuedmonitoring is appropriate.

Environmental Monitoring ProgramTotal uranium concentrations have not exceeded 180 pCi/L in any of these wells since 1990, andhave been below 90 pCi/L since 1992. Wells 1312 and 1313 have shown over five years of suchdata on a quarterly basis. However, Figure 2 indicates an upward trend in uranium concentrationin Well 1312 over the past several years. Cimarron proposes to remove Wells 1311 and 1313from the environmental monitoring program, but to continue sampling Well 1312 annually forgross alpha, gross beta, and total uranium.

3.0 URANIUM WASTE POND #2Historical InformationFormer uranium waste pond #2 (U-Pond #2) overlies Sandstone A. Monitor wells 1320, 1321,and 1336A (formerly 1336) are the three environmental monitoring wells located in this area.Wells 1320 and 1336A are screened in Sandstone A. Well 1321 is adjacent to Well 1320 and isscreened in Sandstone C. Wells 1320 and 1321 are located within the footprint of the formerimpoundment and Well 1336A is located downgradient. All three wells were installed in 1989;

annual sampling began then. Well 1336 became nonfunctional in 1991; it was replaced by Well1336A in 1994. Wells 1320 and 1321 have been sampled annually since 1989. Well 1336A hasbeen sampled on a quarterly basis since 1995. Tables 5, 6, and 7 present gross alpha, gross beta,Tc-99, and total uranium data for all sampling events for these wells.

Both uranium and Tc-99 have been detected at concentrations above background in Well 1336A.The highest measured Tc-99 concentration was 2,590 pCi/L (March 1997). The highest totaluranium concentration was 112 pCi/L (February 1996). This data point seems anomalously highrelative to data both preceding and following it, and should be considered suspect.

Total uranium concentrations in Well 1320 range from 10 - 24 pCi/L, and are within the range ofbackground for Sandstone C. Tc-99 has been detected in Well 1320 at concentrations usuallyless than 2X the detection limit (approximately 15 pCi/L). The highest Tc-99 concentration forthis well was 34 pCi/L (June 1997).

Tc-99 has never been detected above the detection limit in Well 1321, primarily due to the factthat gross beta concentrations have been so low that Tc-99 analysis was not performed. Totaluranium concentrations have been in the normal range of background for this zone.

The highest concentrations of Tc-99 and total uranium in the past two years both came fromWell 1336A, and were 1,060 pCi/L and 31.1 pCiIL, respectively. Figures 5, 6, and 7 presentgraphs of Tc-99 and total uranium data for Wells 1320, 1321, and 1336A, respectively. Tc-99concentrations have not exceeded 3,790 pCiIL, although historic gross beta concentrationsindicate that higher concentrations could have been measured in 1989 and 1990. Total uraniumconcentrations have never exceeded 180 pCi/L.

Groundwater AssessmentThe U-Pond #2 area is scheduled for a groundwater assessment focusing on Tc-99. Additionalinformation on the distribution of Tc-99 in groundwater will be obtained during that assessment.The groundwater assessment work plan only addresses Tc-99 because uranium has never beendetected at levels near the 180 pCi/L limit. After the groundwater assessment work, currentlyscheduled for spring 2003, is completed, Cimarron will propose a groundwater monitoringprogram for Tc-99 in the U-Pond #2 area if continued monitoring is appropriate.

Environmental Monitoring ProgramTotal uranium concentrations have never exceeded 180 pCi/L, and have been below 35 pCi/L forthe last eight consecutive quarters. Figure 7 shows that the total uranium concentration recordedin Well 1336A peaked long ago, and concentrations continue to exhibit a declining trend.Cimarron does not believe it is necessary to continue sampling these wells, and proposes toremove Wells 1321 and 1336A from the environmental monitoring program. Well 1320 will beretained in the program to monitor the on-site disposal cell.

4.0 BURIAL AREA #1Historical InformationFormer Burial Ground Area #1 (BG #1) overlies Sandstone B. Monitor wells 1314, 1315R(formerly 1315), 1316R (formerly 1316), and TMW-13 (a replacement well for Well 1317) are

the four environmental monitoring wells located near these now-excavated burial trenches.Wells 1314, 1315R, and 1316R are screened in Sandstone B. Well TMW-13 is screened in thealluvial aquifer. Well 1314 is located upgradient of BA #1. Wells 1315R and 1316R are in closeproximity to and downgradient of BG #1. Well TMW-13 is farther downgradient from BG #1.Wells 1314, 1315, and 1316 were installed in 1985; annual sampling began at that time. Wells1315 and 1316 were both replaced with adjacent wells 1315R and 1316R in July 2002. Wells1315 (later 1315R) and 1316 (later 1316R) have been sampled quarterly since 1994. WellTMW-13 was installed in 1999 and has been sampled on a quarterly basis since December 1999.Tables 8, 9, 10, and 11 present gross alpha, gross beta, Tc-99, and total uranium data for allsampling events for these wells.

Tc-99 concentrations have never exceeded the detection limit in any of these wells. Tc-99 hasrarely been performed, because gross beta concentrations have never indicated a need for Tc-99analysis. Uranium concentrations in Well 1314 have consistently been within the range ofbackground. However, uranium in Well 1315 has consistently exceeded 180 pCi/L, and hasbeen as high as 8,000 pCi/L (March 1990). A uranium plume originating from the former burialtrenches has been delineated in accordance with Cimarron's Former Burial Area #1 GroundwaterAssessment Work Plan (Cimarron, July, 2002).

Figures 8, 9, 10 and 11 present graphs of Tc-99 and total uranium data for Wells 1314, 1315 (and1315R), 1316 (and 1316R), and TMW-13, respectively.

Groundwater AssessmentBurial Area #1 is the subject of a groundwater assessment focusing on uranium. A completereport of the assessment work has been submitted to NRC. Groundwater in this area will requireremediation, and Cimarron is developing a groundwater remediation work plan for submittal toNRC. The work plan will include a proposal for groundwater monitoring that includes in-process and post-remediation compliance monitoring. The post-remediation monitoring programwill be incorporated into the environmental monitoring program. The work plan is scheduled tobe submitted to NRC in August, 2003.

Environmental Monitoring ProgramBecause a groundwater monitoring program for this area will be established in the work plan forgroundwater remediation, Cimarron does not believe it is necessary to continue sampling thesewells, and proposes to remove Wells 1314, 1315R, 1316R, and TMW-13 from the environmentalmonitoring program.

5.0 BURLAL AREA #2Historical InformationBurial Area #2 (BA #2) overlies Sandstone A. Monitor well 1331 is the environmentalmonitoring well located in this areas. Well 1331 is screened in Sandstone A, downgradient fromBA #2. It was installed in 1989 and has been sampled annually since 1989 and quarterly sinceJune 1997. Table 12 presents gross alpha, gross beta, Tc-99, and total uranium data for allsampling events for this well.

Tc-99 has been detected at concentrations approximately 2X the detection limit in Well 1331.Total uranium concentrations in Well 1331 have been as high as 388 pCi/L (June 1990), but havebeen below 180 pCi/L since September 1998. Figure 12 presents a graph of Tc-99 and totaluranium data for Well 1331.

Groundwater AssessmentThe total uranium concentration has only exceeded 180 pCiIL one time since June, 1995, andthat one data point (288 pCi/L in June 1998) is considered to be anomalous. No groundwaterassessment is planned for this area.

Environmental Monitoring ProgramAs Figure 12 shows, groundwater concentrations from Well 1331 have approached 180 pCi/Lperiodically during the past several years of groundwater monitoring. Cimarron proposes tocontinue to sample Well 1331 as part of the environmental monitoring program to monitor thedownward trend of total uranium in groundwater. Samples will be analyzed for gross alpha,gross beta, and total uranium.

6.0 ON-SITE DISPOSAL CELLHistorical InformationBurial Area #4, the on-site disposal cell, overlies Sandstone A. Monitor wells 1320, 1324, 1325,and 1335A are the environmental monitoring wells installed around this area. All four arescreened in Sandstone A. Well 1325 is located upgradient of BA #4 and Wells 1320, 1324 and1335A are located downgradient. Wells 1320, 1324 and 1325 were installed in 1989 and havebeen sampled on an annual basis since then. Well 1335 was installed in 1989 and was sampledannually until it was removed to allow construction of the on site disposal cell after the April1996 sampling event. It was replaced with Well 1335A in June 1996, and sampled in October1996 and annually since then. Tables 13, 14, and 15 present gross alpha, gross beta, Tc-99, andtotal uranium data for all sampling events for Wells 1324, 1325, and 1335A. Table 5 presentsthe same data for Well 1320, as was discussed in the section on U-Pond #2.

Total uranium concentrations have been consistently within the range of background forSandstone A. Tc-99 analysis has never been performed, and gross beta results indicate there isno reason to suspect the presence of Tc-99.

Figures 13, 14, and 15 present graphs of total uranium data for Wells 1324, 1325, and 1335A.Figure 5 presents a graph of total uranium data for Well 1320.

Groundwater AssessmentCimarron does not plan to perform any groundwater assessment in this area.

Environmental Monitoring ProgramTotal uranium concentrations have not exceeded the range of background since the wells wereinstalled in 1989. The disposal cells received Option 2 soils beginning in 1995, so sourcematerial has been in proximity to the wells for nearly ten years. Cimarron proposes to continuesampling Wells 1320, 1324, 1325, and 1335A on an annual basis as part of its environmentalmonitoring program. Samples will be analyzed for gross alpha, gross beta, and total uranium.

7.0 LAGOONS; ' historical Information

Several lagoons were located downhill and east of the former operating facility. A "PlutoniumEmergency Pond", a "Plutonium Waste Pond', a "Uranium Emergency Pond", and two unlinedsanitary lagoons were installed when the facility was constructed. The first three ponds listedabove were never used and were backfilled in 1978. After a "new" lined sanitary lagoon wasconstructed over the area formerly occupied by the two plutonium ponds, the two sanitarylagoons were cleaned out and backfilled in 1993. All these former lagoons and ponds overlieSandstone A. Monitor wells 1332, 1333, and 1334 are the three environmental monitoring wellslocated in this area. Well 1332 is screened in Sandstone C. Wells 1333 and 1334 are screened inSandstone A. All three wells are located downgradient of the former lagoons. All three wellswere installed in 1989 and have been sampled on an annual basis since that time. Tables 16, 17,and 18 present gross alpha, gross beta, Tc-99, and total uranium data for all sampling events forthese wells.

Total uranium concentrations have always been within the range of background for Sandstone Cin Well 1332. Total uranium concentrations for Wells 1333 and 1334 have been above the rangeof background for Sandstone A, but have been below 34 pCi/L since 1991. Tc-99 has neverbeen detected in Well 1332, and has only been detected at concentrations at or below thedetection limit in Wells 1333 and 1334. The highest total uranium concentration in eitherdowngradient well was 62.1 pCiIL (Well 1334 - June 1990). The highest concentration of totaluranium from a Sandstone A downgradient well in the past two years was 16.5 pCi/L (Well1334). Figures 16, 17, and 18 present graphs of Tc-99 and total uranium data for Wells 1332,1333, and 1334, respectively.

Groundwater AssessmentCimarron does not plan to perform any groundwater assessment in this area.

Environmental Monitoring ProgramTotal uranium concentrations have never approached 180 pCi/L, and have not exceeded 37 pCiILfor over 10 years. Cimarron does not believe it is necessary to continue sampling these wells,and proposes to remove Wells 1332, 1333, and 1334 from the environmental sampling program.

8.0 URANIUM PLANT AREAHistorical InformationNumerous groundwater monitoring wells are located in and around the area formerly occupiedby the uranium processing facility. The plant area overlies Sandstone A. The plant area is ontop of a broad hill, and shallow groundwater generally mirrors topography. Consequently, it isdifficult to define locations in Sandstone A as being upgradient or downgradient. Wells 1323and 1328 are installed in Sandstone C; Well 1328 is located upgradient, and Well 1323 is locateddowngradient from the plant area. Wells 1319, 1322, 1326, 1327B, 1329, and 1330 are installedin Sandstone A; Wells 1326, 1329, and 1330 are likely located upgradient, and Wells 1319, 1322,and 1327B are likely located downgradient from portions of the plant area. Well 1319 wasinstalled as a water supply well prior to 1988, and has been sampled on an annual basis since1988. All the rest of the environmental monitoring wells were installed in 1989 and have been

sampled on an annual basis since that time. Tables 19 through 26 present gross alpha, gross beta,Tc-99, and total uranium data for all sampling events for these wells.

Total uranium concentrations in Sandstone C wells are consistently within the range ofbackground for Sandstone C. The highest total uranium concentration from a Sandstone C wellis 43.7 pCi/L (Well 1328 - October 1989). Tc-99 analysis has rarely been performed forSandstone C wells because gross beta results have indicated there is no need for Tc-99 analysis.The only Tc-99 analysis did not exceed the detection limit. Figures 21 and 24 present graphs ofTc-99 and total uranium data for Wells 1323 and 1328, respectively.

Total uranium concentrations in Sandstone A upgradient wells are within the range ofbackground for Sandstone A. The concentration of total uranium in Well 1330 has consistentlybeen between 10 and 20 pCi/L. Tc-99 has been detected at approximately two times thedetection limit in Well 1326, but the gross beta results for these samples were so low that thesedata points are suspect. The highest total uranium concentration in any upgradient well was 84.3pCi/L (Well 1329 - June 1990). Figures 22, 25, and 26 present graphs of Tc-99 and totaluranium data for Wells 1326, 1329, and 1330, respectively.

Total uranium concentrations in two of the Sandstone A downgradient wells (1322 and 1327B)are within the range of background for Sandstone A. Total uranium concentrations exceedbackground in Well 1319. The highest concentration of total uranium in Well 1319 was 426pCiJL (September 2003). Tc-99 has not been detected in any Sandstone A downgradient wells.Figures 19, 20, and 23 present graphs of Tc-99 and total uranium data for Wells 1319, 1322, and1327B, respectively.

Groundwater AssessmentThe area surrounding Well 1319 is the subject of a groundwater assessment focusing on uranium.Additional information on the distribution of uranium in groundwater will be obtained duringthis assessment. Well 1319 was pulled and plugged to eliminate a potential hydraulic conduitbetween Sandstones A, B, and C. New wells, screened in each aquifer, will be installed in thevicinity of Well 1319 in accordance with Assessment Work Plan for Well 1319 (Cimarron,2002). After the groundwater assessment work, currently scheduled for spring 2003, iscompleted, Cimarron will propose a groundwater monitoring program for uranium in the Well1319 area if continued monitoring is appropriate.

Environmental Monitoring ProgramCimarron does not believe it is necessary to continue sampling Sandstone C wells in itsenvironmental monitoring program. Since uranium concentrations have only been a concern inWell 1319, and Well 1319 is being replaced with a new well, Cimarron proposes to remove allcurrent plant area wells from the environmental monitoring program. However, Cimarron notesthat all the Sandstone A environmental monitoring wells in the plant area will be sampled as partof the Well 1319 groundwater assessment. In the groundwater assessment report, which isscheduled to be submitted to NRC in November 2003, Cimarron will propose that certain wellsbe added to the environmental monitoring program as appropriate.

9.0 SURFACE WATER SAMPLING LOCATIONSCimarron River - Location 1201 is immediately east of the Highway 74 bridge that crosses theCimarron River, and is the upstream sampling location. Location 1202 is at the eastern edge ofthe property, and represents the downstream sampling location. These locations have beensampled on an annual basis since 1977. Tables 27 and 28 present gross alpha, gross beta, Tc-99,and total uranium data for all sampling events for Locations 1201 and 1202, respectively.Figures 27 and 28 present graphs of Tc-99 and total uranium data for Locations 1201 and 1202,respectively.

Total uranium concentrations have always been within the normal range of background forsurface water. Tc-99 analysis has never been performed at either location because gross betaresults have indicated there is no need to analyze for Tc-99. Groundwater plumes have beenidentified on site, and sampling has been performed between those plumes and the river. Thereis no reason to suspect impact to the river, and groundwater assessment and/or remediationprograms being performed will address the movement of uranium and/or Tc-99 toward the river.There is no longer a need to monitor the river, so Cimarron proposes to remove locations 1201and 1202 from the environmental monitoring program.

Facility Reservoirs - There are three reservoirs on property owned by Cimarron. Reservoir 1 islocated west of Highway 74, and is monitored by Location 1204. Reservoir 2 is located near theeast edge of the Cimarron site, and is monitored by Location 1205. Reservoir 3 is located east ofBurial Area #4 and west of Reservoir 2, and is monitored by Location 1209. These locationshave been sampled on an annual basis since 1977. These locations have never been analyzed forTc-99 because gross beta results indicate there is no need to analyze for Tc-99. Tables 29, 30,and 31 present gross alpha, gross beta, and total uranium data for all sampling events forLocations 1204, 1205, and 1209, respectively. Figures 29, 30, and 31 present graphs of totaluranium data for Locations 1204, 1205, and 1209, respectively.

Total uranium concentrations have always been within the normal range of background forsurface water in all three reservoirs. Groundwater plumes identified on site do not discharge tothese surface water bodies. There is no longer any need to monitor the lakes, so Cimarronproposes to remove locations 1204, 1205, and 1209 from the environmental monitoring program.

Lagoons and Burial Area #3 - Location 1206 is located in a drainage way between the lagoonsand former Burial Area #3. This location has been sampled on an annual basis since 1977 andon a quarterly basis since December 1996. Table 32 presents gross alpha, gross beta, Tc-99, andtotal uranium data for all sampling events for Location 1206. Figure 32 presents a graph of Tc-99 and total uranium data for Location 1206.

Total uranium concentrations at this location have periodically exceeded 180 pCi/L, mostrecently in March 2001. The highest total uranium concentration at this location was 517 pCi/L(June 1994). Figure 32 shows a long declining trend in the concentration of uranium at thislocation. Tc-99 has been detected at this location at concentrations that range from two to fourtimes the detection limit. The highest Tc-99 concentration for this location was 54.4 pCi/L,recorded in September 1997. Cimarron proposes to continue to sample this location on anannual basis, analyzing for gross alpha, gross beta, and uranium.

U-Pond #2 - Location 1208 is a seep located immediately north of U-Pond #2, on the bluffoverlooking the alluvial floodplain. The seep is discharging from Sandstone A, which underliesU-Pond #2. This location has been sampled on an annual basis since 1977, and on a quarterlybasis since December 1996. Table 33 presents gross alpha, gross beta, Tc-99, and total uraniumdata for all sampling events for Locations 1208. Figure 33 presents a graph of Tc-99 and totaluranium data for Location 1208.

Total uranium concentrations at this location are above background concentrations for SandstoneA, but have been consistently below 60 pCi/L since April 1995. The highest total uraniumconcentration at this location was 303 pCi/L (June 1993). Because the gross alpha data does notcorrelate well with the total uranium concentration for this sampling event, Cimarron considersthis data point suspect. The next highest total uranium concentration for this location, whichcorrelates well with gross alpha data, is 88.1 pCi/L (June 1994). Tc-99 has been detected at thislocation at concentrations consistently exceeding 1,000 pCi/L, and periodically exceeding 3,790pCi/L. The highest Tc-99 concentration for this location was 4,550 pCi/L (May 1996).Cimarron proposes to continue to sample this location on an annual basis, analyzing for grossalpha, gross beta, and Tc-99.

10.0 ENVIRONMENTAL MONITORING WELL ABANDONMENTCimarron proposes to abandon the following environmental wells, which are currently beingsampled within the environmental monitoring program:

In addition, Cimarron will abandon other wells, not currently included in the environmentalmonitoring program. These include oilfield water wells, windmill wells, and other site wells thatare neither part of the proposed environmental monitoring program nor are they located in anyarea for which groundwater assessment is being performed. Cimarron is only notifying NRC ofthe intent to abandon these wells to ensure that NRC does not invoke license condition 27.b andfind Cimarron in violation of the license because of the abandonment of these wells.

11.0 EIGHT QUARTERS OF GROUNDWATER MONITORINGLicense condition 27.b states, "NRC will not terminate Radioactive Materials License SNM-928until Cimarron demonstrates that the total uranium concentrations in all wells have been belowthe groundwater release criteria for eight consecutive quarterly samples." Cimarron believes thathistorical data, consisting of numerous years of annual or more frequent analysis, for theenvironmental monitoring wells proposed for abandonment satisfy the intent of license condition27.b. Cimarron does not believe NRC intends that this license condition should be applied towells in other areas of the site, such as oilfield water supply wells, windmill water wells, andthose described in the preceding paragraph.

Cimarron proposes to continue sampling proposed environmental monitoring wells on an annualbasis until groundwater assessment and/or remediation is complete. Cimarron proposes thatlicense condition 27.b be amended to state, "NRC will not terminate Radioactive Materials

License SNM-928 until Cimarron demonstrates that the total uranium concentrations in allenvironmental monitoring wells have been below the groundwater release criteria for eightconsecutive quarterly, semiannual, or annual sampling events." This would enable Cimarronto utilize historical data, which often reflects annual sampling, in this determination.

Groundwater assessment reports have been or will be prepared for the following four areas:Burial Area #1, U-Pond #1, U-Pond #2, and Well 1319. For each area not requiring groundwaterremediation, the groundwater assessment report will propose the addition of certain wells in theenvironmental monitoring program for that area. For each area requiring groundwaterremediation, the groundwater remediation work plan will propose the addition of certain wells tothe environmental monitoring program for that area. The above-proposed license conditionprovides NRC the information needed to ensure that groundwater satisfies the release criteria.

12.0 SUMMARYCimarron proposes an environmental monitoring program that yields information needed toassess the impact of licensed material on ground or surface water outside of those areas currentlyscheduled for groundwater assessment. This environmental monitoring program proposes tocontinue sampling the following locations on an annual basis:
