Probe into fake titles ordered

GENERAL SANTOS CITY A bigtime Quezon City supplier of electrical parts and electronic gadgets and equipment is now claiming ownership of 804 hectares ofgovernment land held by the Alcantaraowned Alsons Development & Investment Corporation (Aldevinco) under an Integrated Forest Plantation ManagementAgreement (IFPMA).

This surfaced after a certain Jimmy Tang, listed as one of the owners of Avenue Electrical Supply Corporation (Avesco), wrote the office of the Land RegistrationAuthority requesting for the registration and splitting of a big parcel of land covered by “Original Certificate of Title (OCT) P2252.”

The technical description of the property, however, is the same parcel of land that has been occupied by Aldevinco since 1964 when it acquired the pasture leaseagreement (PLA) from Tuazon Enterprise.

rights over some 600 hectares for the airport construction in 1992, the same time when IFMA 21 was issued by thenPresident Corazon Aquino.

The Sarangani Agricultural Company Inc. (SACI) was left with 899 hectares but was further reduced to 804 when itceded another 95 hectares to the Department of Environment and Natural Resources (Denr).

The majority of the IFPMA 21 area is now planted with mango, pomelo, bananas, molave, mahogany and sweet corn.

SACI, which manages the area for Aldevinco, says 250 cattle are still grazing in the area.

Claimants

In 2004, Romeo Confessor surfaced to claim that he and several others were in possession of an OCT issued in 1956covering the same area of property under IFMA 21.

In August 2004, the Land Registration Administration (LRA) declared the title under names of Confessor et al as fake.

The LRA said the technical description of the Confessor et al OCT reportedly showed the airport border of the title.

The airport property was not established until 1992, when Aldevinco ceded its right to 600 hectares of the whole property in favor of the government.

In addition, the Land Management Bureau reported that the sales patents that were supposed to back the claims of Confessor and company were nowhere near theproperty now occupied by Aldevinco.

Sales patent V1776, as applied by one Domingo Gapata, was for 9.0378 hectares of land in Kiamba.

Sales patent V1777 covered 12.8756 hectares in Guianga, Davao City and was issued in the name of Wilfredo Ferrares. Sales patent V1778 was for 18.1642 hectares ofproperty in Dapitan, Zamboanga del Norte under the name of Jesus Moraza while sales patent V1779 was issued in favor of Jose Jaucan for an area of 2.6050 hectareslocated in Kidapawan, Cotabato.

The other instrument, sales patent V1780, was issued to Ambrocio Ferido for a property covering 13.0037 hectares in Tagum, Davao.

Confesor, according to retired SACI operations manager Julian Montemayor, had never been in actual possession nor had he ever occupied even a portion of thecontested property.

Confesor, who is now dead, was a former security guard who rose to become a hearing officer of the Philippine Commercial and Industrial Bank (now BDO).

Confessor laid claim to the property after showing a title to the land occupied by Aldevinco.

He alleged that a “consolidated” Original Certificate of Title (OCT) P2252 was issued on May 21, 1955 in the names of Pedro de Ramos, Exelsea Lauron, RaidencioConfesor, Julita Confesor, and to him despite the issuance of a Pasture Lease Agreement (PLA) covering 860 hectares to a certain Magno Mateo in August 1954.

Mateo sold his rights to Tuazon Enterprise who in turn sold to Aldevinco in 1955.

At the time of the alleged OCT P2252 issuance, Confesor was reportedly just 15 years old.

Backers

Confessor had reportedly sought financial backings from some prominent businessmen in the city in an effort to bankroll his claims over the property.

This is an allegation that was essentially confirmed by Rodrigo “Junjun” Rivera Jr., who in 2006 admitted issuing several checks to Confesor as payment for the property.

Rivera however backed off from the transaction, telling then Sarangani Governor Miguel Rene Dominguez that he was not aware that Aldevinco had tenurial rights overthe property.

Dominguez is now the vice president of SACI.

How the Confessor title ended up being sold to Jimmy Tang remains unexplained. But in a document Tang submitted to the Land Registration Administration, five deedsof sale covering 7,076,266 square meters or 707.63 hectares were sold separately by Pedro de Ramos, Romeo Confesor, Celestina Cuizon, Excelsea Lauron and RaldericoConfesor to Jimmy Tang for P35,381,330.

The deeds of sale were dated June 6, 2014 and were subscribed in Imus, Cavite.

All the sale instruments said the vendor were the sole heirs of Romeo Confesor who reportedly died several years ago. Yet the Deed of Sale for Romeo Confesor’s parcelof land was signed by Confesor himself on the same date the sale was executed.

Electronics king

The website of Tang’s Avesco, http://ne5thavenue.yocal.ph/, says it is an “importer, exporter, indentor, distributor, wholesaler, retailer of industrial, electrical,communication products and audio video.”

“Avesco traces its origin back to 1948, when the late Don Jose Tangconkong established a store named Avenue Electrical Supply,” the website further said.

Its listed address is 250 Roosevelt Avenue, San Francisco del Monte, Quezon City.

An independent member of the board of directors of Banco de Oro is also named Jimmy Tang, whose other business include Avesco Group of Companies.

He also served as president of the FilipinoChinese Chamber of Commerce and Industry.

Avesco owns the electronic shop chain 5th Avenue Electronic City.

Documents obtained by Rappler revealed that on 11 August 2014, Atty. Peter Armand Henares, head of the city Register of Deeds, informed Tang that he could notproceed with the issuance of Transfer Certificate of Title involving OCT No 2252, citing the annotation that “the title has been found spurious per Investigation Report ofthe Task Force Titulo Malinis.”

The task force also recommended the title expunged from the records of the LRA.

Nevertheless, Henares forwarded the petition of Tang to the head office of LRA which set a hearing on October 23.

But Tang wrote a letter on October 21, asking the LRA to excuse himself from the hearing, saying he already submitted all evidence and documents to support his claimover the vast property.

Also absent during the hearing were the other owners of the said property identified as Celestina Cuison, Excelsea Lauron, Pedro de Ramos and Relderico Confessor.

Henares likewise did not appear.

But the lawyer of SACI and Aldevinco appeared to manifest its intention to intervene.

The oral request of SACI was granted and it is now party to the LRA case.

The enormity of the case has caught the attention of Senator Aquilino "Koko" Pimentel III, who passed a resolution calling for a Senate investigation into the proliferationof alleged 6,000 fake titles in General Santos City.
