Pro Bono Aspirational StandardOregon State Bar Bylaw 13.1

Pro bono publico or pro bono service includes all uncompensated services performed by lawyers for the public good. Such service includes civic, charitableand public service activities; as well as activities that improve the law, the legalsystem and the legal profession. The direct provision of legal services to the poor,without an expectation of compensation, is one type of pro bono service.

Each lawyer in Oregon should endeavor annually to perform 80 hours of probono services. Of this total, the lawyer should endeavor to devote 20 to 40 hoursor to handle two cases involving the direct provision of legal services to the poor,without an expectation of compensation.

If a lawyer is unable to provide direct legal services to the poor, the lawyer shouldendeavor to make a comparable financial contribution to an organization thatprovides or coordinates the provision of direct legal services to the poor.

Introduction

In 1989, the members of the Oregon State Bar adopted an aspirational standard that each lawyer in Oregonshould endeavor to perform 80 hours of pro bono services annually, including 20 to 40 hours, or two cases, in direct legal services to the poor. In addition, Section 4.4 of the OSB Statement of Professionalism states that it is aprinciple of professional practice to engage in pro bono activities, and that all lawyers share an obligation to makelegal services available to all members of society.

Oregon lawyers contribute more than half a million dollars annually to the Campaign for Equal Justice to helpfund legal aid offices around the state and ensure equal access to justice regardless of economic limitations. In 2005, Oregon lawyers reported more than 37,000 hours of direct Legal representation to the Oregon State Bar ProBono Roll Call, and this was probably only a fraction of the hours provided without recognition. Yet, despite effortsby some attorneys and law firms, volunteer services meet only a small portion of the need for low-income residents.

According to the Oregon Legal Needs Study (2000), more than 470,000 low-income Oregonians cannot afford to pay for legal advice and representation in civil matters. Existing legal aid programs can help less than 20% of the need. In Multnomah County alone there are 110,000 low-income residents who simply cannot afford alawyer. The need extends not only to low-income residents but also to civic, charitable and other public-serviceorganizations.

The tremendous need for legal assistance translates into countless opportunities for Oregon lawyers. While notexhaustive, this handbook is intended to be a guide to some of the opportunities in Oregon, and a stepping-stonefor greater involvement among lawyers. Any amount of pro bono service would make a profound difference in thebar's involvement in Oregon. You can commit to pro bono representation without large time commitment. Someclients just need basic advice on how to respond to a landlord, creditor or neighbor. Many pro bono programs offer training for attorneys to gain a solid understanding of the areas of law that most affect low-income persons.Some organizations have bar-certified pro bono programs that offer Professional Liability Fund (PLF) insurance coverage to volunteers. Certified programs are denoted with a single asterisk.

The organizations in this handbook offer a variety of pro bono opportunities to match most practice areas. Each listing includes information on available training, whether volunteers must carry PLF malpractice coverage,and how much time you might expect to devote if you volunteer with a particular program. To volunteer your services, contact the organization of your choice directly.

OPPORTUNITIES: Citizen Review Board (CRB) membersvolunteer one weekday per month to conduct case reviewsfor children and youth in out of home placements in the cus-tody of the Department of Human Services and the OregonYouth Authority. Serving in the county where they live orwork, volunteers interact with parents, foster care providers,case workers, attorneys, therapists, and other legal or inter-ested parties to the child or youth's case. The CRB has a dualstatutory mandate to conduct case reviews and to make rec-ommendations on policies, procedures, and laws relating tosubstitute care. OPPORTUNITIES: The Oregon State Bar is looking formembers who are willing to volunteer their time to assistlawyers who are being investigated or prosecuted for disci-plinary violations. OPPORTUNITIES: Bankruptcy Clinic. The OSB Debtor-Creditor Section and Legal Aid Services of Oregon(“LASO”) cosponsor this clinic, which provides informa-tion and representation to low-income individuals who areconsidering bankruptcy or who have already filed as pro selitigants. The project begins with a 45 minute class taughtby a member of the bar or bench and a clinic during whichvolunteer attorneys meet with clients and assess whetherongoing representation is appropriate. The clinic is heldon the third Thursday of the month from 6:30 to 9:30 p.m.and alternates between Beaverton and Portland locations.Training materials are available. >>

Domestic Violence Project. Pro bono attorneys representvictims of domestic violence in contested Family AbusePrevention Act hearings, Elderly and Disabled AbusePrevention hearings and Stalking Protective Order hearings.The cases tend to have short timelines and limited issues andrequire a court appearance (often a single contested hear-ing). This project is an excellent volunteer opportunity foryoung lawyers, lawyers seeking litigation experience andlawyers who cannot commit to taking long-term cases.Training materials are available, and LASO coordinates aroundtable meeting every other month to share informationwith volunteers.

Pro Se Assistance Project. In this project, sponsored byLASO and the Multnomah County Family Court, attorneysprovide pro bono consultations to individuals served by theFamily Court Facilitation Program who require legal adviceor document review. Attorneys are scheduled to meet withthree clients, each for a 45 minute appointment. Clinics areheld from 2:30 to 5 p.m. at the Multnomah CountyCourthouse. Attorneys respond to discrete family law ques-tions and/or review documents prepared by unrepresentedlitigants. Attorneys are not expected to provide ongoing rep-resentation to clients, and clients sign a retainer agreementdetailing the limited scope of the attorney client relation-ship. Training materials are available.>>

Senior Law Project. Volunteer lawyers meet with clientsover age 60 (or the spouse of clients over age 60) at nine sen-ior centers in Multnomah County. Volunteer lawyers meetwith up to six clients at each clinic and provide each clientwith a 30 minute appointment. Attorneys provide continu-ing pro bono services for clients who meet LASO's financialeligibility requirements. Common legal issues include estateplanning, probate, consumer issues, contracts and insurancematters. LASO sponsors a monthly elder law discussiongroup to provide information and support on issues of inter-est to the attorney volunteers.>>

Social Security Panel. Volunteer attorneys represent dis-abled clients in Social Security administrative appeals.Training materials are available, and LASO coordinates amonthly roundtable meeting to share information with vol-unteers. >>

Stoel Rives Night Clinic. The firm of Stoel Rives, LLP spon-sors a legal clinic every other Thursday evening.
