What is the purpose of the Sectoral Determination? TheSectoralDeterminationlaysdownconditionsofemploymentforthePrivateSecuritySectorsuchashoursofwork,leave,particularsofemploymentandterminationofemployment.Italsoprescribestheminimumwageemployersarerequiredtopay.
Who is covered?EveryworkerinthePrivateSecuritySector:
• Whoguardsorprotectsfixedproperty,premises,goods,peopleorworkers, includingmonitoringandrespondingtoalarmsatpremiseswhichareguarded bypeopleorbyelectronicmeansandcarguards• Administrativestaffarealsocoveredbythissectoraldetermination;and• Independentcontractorswhoaredoingprivatesecuritywork.
Who is not covered by the Sectoral Determination?• Amanagerwhoisinchargeofsupervisingworkers;and• Anyemployerwhoiscoveredbyabargainingcouncil.
The Department of Labour has made a law which regulates the conditions of employment and minimum wages in the Private Security Sector.

NB!! It is an unfair labour practice to reduce the wages of a worker in the Private Security Sector who earns more than the prescribed wage.

Wages are calculated using ordinary hours of work• Dailywagedividedbyordinaryhoursworkedinaday=hourlywage• Weeklywagedividedbyordinaryweeklyhours=hourlywage• Monthlywagedividedby4.333=weeklywage.
Must be paid:• InSouthAfricancurrency• Incashorchequeordirectpaymentinthebankaccount• Daily,weekly,fortnightlyormonthly• Attheworkplaceduringworkinghours•Onanormalpaydayagreedtobytheworker;and• Within48hoursofterminationofemployment.
Shouldbeemployedonafulltimebasisandtheyshouldbepaidtheamountthattheywouldhaveordinarilyearnedeveniftheyhavenotbeenplacedinapost.
Every worker must receive, on payday, a payslip showing:• Employer’snameandaddress• Worker’snameandoccupation• Periodofpayment• Worker’swageandovertime• Hoursworked• Overtimeworked• HoursworkedandpayforSundayandPublicHolidays• Wage• Anyotherpay• Deductions• Netpayment.
Thepayslipisthepropertyoftheworker.

Special allowanceAworkerwhoworksasamobilesupervisor,armedsecurityofficer,armedresponseofficer,nationalkeypointofficerandcontrolcentreoperatorareentitledtothespecialallowanceorR5.50pershift.
Transfer allowanceAnemployershallpayasecurityofficeratransferallowanceofnotlessthanR100providedthat:
a) Thetransferispermanentandtheworkerisentitledtoatransferallowance foraperiodofnotlessthan12months.
b) Thetransferisforaperiodexceedingsixmonthsbutnotexceeding12months.
c) Thesiteismorethan250kilometersaway.
d) Excepttransferarisingfromalternativeemploymentbytheemployeroras aresultofaworker’srequest.

How many ordinary hours of work in the Security Industry• Asecurityofficershouldnotworkmorethan48hoursperweek• Otherworkersshouldnotworkmorethan45hoursperweek.

Who qualifies for this type of leave?• Workerswhohavebeenemployedbyanemployerforlongerthanfour months;andwhoworksonatleastfourdaysaweekforthatemployerare entitledtothreedaysfamilyresponsibilityleaveduringanannualleavecycle• FamilyresponsibilityleaveshallincreasetofourdaysinSeptember2010.
When may this leave be taken?• Thisleavemaybetakenforthebirthofachild,whenachildissickor whenaspouse,parent,adoptiveparent,grandparent,adoptivechild,child, grandchild,brotherorsisterdies.
Example:An employee works 5 days per week.Sick leave days per cycle are 5 X 6 (number of weeks) = 30 days per three-year cycle
Note: The employer may request a medical certificate when a worker is absent for more than two consecutive days, or twice during an eight-week period.

What are the key issues relating to maternity leave?• Maternityleaveisafour-monthperiod,whichstartsfourweeksbeforethe expecteddateofbirth• Anemployermustpayafemalesecurityofficer,whohasbeenintheservice withthesameemployerforaperiodofnotlessthanthreeyears,34%ofher basicsalaryduringmaternityleaveasasupplementtoherUnemployment InsuranceFund(UIF)payment• Aworkermayonlyresumeworksixweeksafterthebirthofachild;unlessa medicalpractitionercertifiesthattheworkermaybeginwork.
Note:• Wherepossible,noticeofleaveanddateofreturntowork mustbeprovidedbeforetheleavebegins.
• Everyworkerwithaminimumofoneyearuninterruptedemploymentwiththe sameemployerisentitledtosixdayspaidstudyleaveinayear,inrespectofany studyatatertiaryestablishment.
Eachsecurityofficershalluponcompletionofthefollowinguninterruptedservicewiththesameemployer,calculatedfrom19February2007,andisentitledtoaonce-offpaymentasfollows:
a) R500afterfiveyears.b) R1000after10years.c) R5000after20years.
• Anemployermustprovidefreeofchargeanyweapon,ammunitiontool,whistle orotherequipmentwhichasecurityofficerrequirestouseforself-defenceor apprehension• Provide,freeofcharge,twosetsofdailywashableuniformitems,aswellas anyotherprotectiveclothingwhichaworkerisrequiredbyanylawtoprovidefor aworker• AnemployershallpayaworkeraR15-00cleaningallowancewhichisnot payableduringperiodofabsence.

EmployersshallabidebytheprovisionsoftheLabourRelationsAct,No.66of1995,asamended.
Noemployermayusetheserviceofatemporaryemploymentservice,labourbrokersorindependentcontractorsunlessthetemporaryemploymentservice,labourbrokerorindependentcontractorprovidestheemployerwithsatisfactoryproofthatitisincompliancewith:
a) SectoralDetermination6b) UnemploymentInsuranceActc) CompensationforOccupationalInjuriesandDiseasesActd) SouthAfricanRevenueServiceandinpossessionofanIT30taxcertificatee) TherulesofthePrivateSecurityProvidentFund.
EveryworkerinthePrivateSecuritySectorshouldbeamemberofthePrivateSecurityProvidentFund.Aworkerwillcontribute6.5%ofthebasicsalarytotheFundandtheemployerwillcontribute6.5%totheFund.InSeptember2010,bothpartiesmustcontribute7%andinSeptember2011bothpartiesshallcontribute7.5%.
• Newworkersandworkerswhohavebeenoutofthesectorformorethansix monthsofservicearesubjectedtoafour-monthwaitingperiodbeforejoining theProvidentFund• Workerswithatleastfourmonthsuninterruptedserviceinthesecurityindustry notnecessarilywiththesameemployer,shalljointhefundimmediatelyafter joiningthenewemployer.
• NopersonmayemployachildinthePrivateSecuritySectorwhoisunder15 yearsofage• Whoisundertheminimumschool-leavingage• Nopersonmayemployachildinemploymentthatisinappropriatefora personofthatage;orthatplacesatriskthechild’swell-being,education, physicalormentalhealth,orspiritual,moralorsocialdevelopment• Allforcedlabourisprohibited.

TheemployermustgivetheworkeraCertificateofServiceonterminationofemployment.

How should termination of employment be conducted?• Eitherpartymayterminatethecontractofservice.Ifaworkerworkedforsix monthsorless,oneweeks’noticemustbegiven• Iftheworkerhasbeenemployedformorethansixmonthsbutnotmorethana year,twoweeks’noticemustbegiven• Iftheworkerhasbeenemployedforoneyearormore,fourweeks’notice mustbegiven.
N.B. Notice must be given in writing, except when it is given by an illiterate worker.
On termination an employer should pay:• Alloutstandingmoniesdue• Accruedannualleave• Anytime-offnotgranted• Oneweeks’severancepayforeverycompletedyearofserviceiftheemployer terminatesserviceBASEDONOPERATIONALREQUIREMENTS.

KeepingoftheSectoralDeterminationEveryemployeronwhomthisSectoralDeterminationisbindingmustkeepacopyoftheSectoralDeterminationoranofficialsummary,availableintheworkplaceinaplacetowhichtheworkershaveaccess.
