    BiI

    Section 2 Findings and Purpose

    A) Findings

    l) The constitution guaranteeS the right of the peopie to be secue in their person. The Deciaration

    of Independence asserts as seIevident that all men have certain inaIienab!e rights and that among

    these are Iife, iibertY, and the pusuit of happiness"

    or by imprisonment in a federal prison.

    If two or more persons vio-ate subdivision (a) when there is a temporary restraining order

    activity is not included within the meaning of 'course of conduct'

    For the purposes of this section IIedible threat means a verbal or written threat inciuding that

    perfomed through the use of a= electro=ic commuation device O a theat implied by a pattern

    of conduct or a combination of verbal Wen Or electronicaily communicated statements and

    conduct, made with the intent to place the person that is the target of the theat in reasonabie fear

    for his or he safety or the safety of his o her family or personal property or possessions and

    made with the apparent abty to cay out the threat so as to cause the person who is the target

    of the threat to reasonably fear for his or her safetY O the safety of his or her family or personal

    property or possessions. It is not necessary tO PrOVe that the defendant had the intent to actua!Iy

    carry out the threat. The present incarceration of a peson making the threat snot be a bar to

    prosecution under this section. Constitutional-y potected activity is =Ot inuded within the

    Section 4 Punishment for threats

    Any person or personS Who wuiiy threatens to commit a rime which wiIl result in death or great

    writing, Or by means of an eectroni COmmunication device is to be taken as a threat eVe= if

    there is no intent of actua!iy carrying it out Which On its face and unde the circumstances in

    which it is made, is so equivoca, unCOnditionai immediate and specifie as to convey to the

    person threatened a graVity of purpose and an immediate prospect of execution of the threat and

    thereby causes that person reasonably to be in sustained fear for his or her own safety o for his or

    he immediate famS Safety, ShalI be punished by imprisonment in a federal prison not to exceed

    misdemeanor. Nothing in this subdivision sha= appIY tO telephone ca=s or electronic co=tactS made

  • (b) Every person or PerSOnS Who makes repeated teiephone cails or makes repeated contact by

    means of an eectronic communication device with intent to annoy anOther person at his or her

    residence, is Whether or not converSation ensues from making the teIephone caiI or electronic

    contact, is guilty of a misdemeanor Nothing in this subdivision shall app!y to telephone calls or

    electonic contacts made in good faith"

    (C) Every person Or PerSOnS Who makes repeated telephone calls or makes repeated contact by

    means of an electronic communication device with the intent to annoy anOther person at his or her

    place of work is guiIty of a misdemeano punishab-e by a fine of not more than one thousand

    doliars ($ 1,000), Or by impisonment in a federal pison for not more than one yeaor bY both

    thate and imprisonment Nothing in this subdivision shall appiy to telephone calis or eiectronic

    contacts made in good faith" This subdivision appIies on!y if one or both of theowing

    spouse COhabitant former cohabitant Or PerSO= With whom the peson has a cd or has had a

    dating o engagement re-ationship or is having a dating or engagement relationship"

    (d) Any offense committed by use of a te-ephone may be deemed to have been committed where

    the telephone call or cas wee made o received. Any offense committed by =Se Of an electonic

    communication device or medium inc-uding the Internet may be deemed to have been committed

    when the electronic commication or communications were originally sent or first viewed bY the

    recipient.

    (e) Subdivision (a), (b) Or (C) is vioIated when the peson acting with intent to annoy makes a

    teIephone carequesting a retun call and performs the acts prohibited under subdivision (a) (b)

    or (C) upon receiving the return cail.

    (f) If probation is ganted Or the execution or imposition of sentence is suspended for any person

    or persons convicted under this section the court may order as a condition of probation that the

    peson participate in counseling"

    (g) For purposes of this setion the term "eletrOnic communication device:l includes but is not

    Iimited to, telephones Ceu-ar phones COmPuterS Video recorders fax machines PagerS Or

    synthetic telepathy devices.

    section 5 Assault and battey with an electonic or directed energy weapon

    Any peson or PerSOnS Who in the OurSe Of organized sta-king and harassment COmmits an assauIt

    upon the person of another with an unauthorized directed energY WeaPOn Shall be punished by

    imprisonment in a federal prison for two three Or four years or bY a fine not exceeding ten

    thousand do=ars ($10,000)"

    Fo the purposes of this section the term directed energy weapon is defined as anY device that

    directs a source Of energy (incIuding moIecu-ar o atomi energY Subatomic partie beams

    electromagnetic radiation, Pasma Or eXtreme-y !ow frequency (ELF) or uitra low frequency (ULF)

    energY adiatio=) against a peson or any Other unacknowledged or as yet undeveIoped means of

    inflicting death or injury; Or damaging or destroying a PerSOn (Or the bioIogicabodhealth

    mental health, Or Physical and economic webeing of a peson via iand-based Sea-based Or
