Newsletter 2015-26 July 2, 2015 PREVAILING WAGE LAW UPDATE As of June 30 at midnight, West Virginia has no prevailing wage for government construction projects. It is anticipated the state's prevailing wage rate requirement will resume when WorkForce West Virginia completes its review of current wages being paid and new 2015 prevailing wages are set. When this will occur is not certain. It could be as late as September 30. Projects that include federal funding will not be affected. Federal Davis-Bacon wage rates still apply on projects involving federal dollars. WorkForce has sent surveys to 5,200 contractors seeking actual wages paid to employees. Their plan is to tabulate the responses and develop an average annual wage. Most all CAWV members have received the survey but a copy is attached for those who have not received one. Members can fill it out and return it to WorkForce. As of today, the survey response rate is approaching 25 percent. WorkForce and legislators have noted that they believe a response rate of 75 percent will be required in order to have a truly representative sample for determining a prevailing wage. Contractors can ignore the June 26 deadline for submitting the survey. WorkForce is continuing to accept data. WorkForce will be conducting webinars July 15, 22 and 29 to answer questions about the survey. They are limited to 25 participants in each webinar. The CAWV will broadcast the webinar on July 15 at 2:00 p.m. in the CAWV conference room. Members are invited to come to the CAWV to join others members to ask questions and get feedback from one another about the future of prevailing wage in West Virginia. West Virginia has continued to rank dead last in construction employment most of 2014 and all of 2015. These figures are based on an analysis of Labor Department data by the AGC of America. ANNUAL MEETING ALMOST HERE Over 375 CAWV members and guests are attending the CAWV Annual Meeting beginning July 9 at The Greenbrier. Speakers include Senate President Bill Cole, House Speaker Tim Armstead, Transportation Secretary Paul Mattox and AGC of America President Chuck Greco. A full agenda will await members attending the Building, Highway and Utility Division meetings. A number of social networking events are planned to give members the opportunity to meet and greet with one another. Contractor members have received a ballot for 2015-2016 officers and directors. Members are asked to return them to the CAWV office by July 7. Ballots will be tabulated and new officers and directors will be installed at the President’s Banquet on Saturday evening. ATTORNEY GENERAL TO HOST TOWN HALL IN PUTNAM COUNTY ON EPA'S WATERS OF THE U.S. RULE Attorney General Patrick Morrisey announced that he is joining several state organizations to host a town hall meeting in Putnam County next week to discuss the U.S. Army Corps of Engineers and Environmental Protection Agency’s new rule regulating local waterways and his Office’s legal challenge to it. The town hall meeting will begin at 7 p.m. Tuesday, July 7, at the Putnam County Courthouse, 12093 Winfield Road, in Winfield. The public and members of the media are invited to attend. In addition to Attorney General Morrisey, several local business leaders and representatives from the Contractors Association of West Virginia, West Virginia Business and Industry Council, West Virginia Chamber of Commerce, Associated Builders and Contractors of West Virginia, West Virginia Coal Association, West Virginia Farm Bureau and West Virginia Oil and Natural Gas Association will discuss the potential effects this rule could have on local landowners.     Non-residential construction includes initial construction, reconstruction, and major renovation. Labor performed on-site in connection with material deliveries is also considered construction work. Routine maintenance work (as described below) is not included except as noted.

    Construction (Report): Construction means the initial construction of buildings and other structures, or additions thereto, and of highways and roads. Construction does not include the transportation of material or supplies to or from a construction project by employees of a construction contractor. However, labor performed on the job-site in connection with the delivery of materials is considered construction work.

    Maintenance (Exclude except as noted): General maintenance work such as sweeping, cleaning, and landscaping is not covered unless it is done as part of a construction, reconstruction, major renovation, or painting project. Maintenance work such as repairing or replacing a roof or re-carpeting part of a building is considered to be reconstruction work.

    Major Renovation (Report): Major renovation means the remodeling or alteration of buildings and other structures within the framework of an existing building or structure and the alteration of existing highways and roads.

    Residential (Exclude): Residential construction projects are projects for any building or structure used or intended to be used for residential occupancy, which contains not more than 3 distinct floors which are above grade in any structural unit regardless of whether the building or structure is designed and constructed for one or more living units. The residential project includes all incidental items associated with the project, such as site work, parking areas, utilities, streets, and sidewalks.

    Reconstruction (Report): Means highway and road resurfacing and rebuilding, the restoration of existing highways and roads, and the restoration of buildings and other structures.

    Examples of Residential Construction: Residential buildings (3 stories or less)

    Demolition (Report as noted): Demolition is included only if it is to prepare for planned construction or renovation. If no construction is planned to replace the demolished property, then do not include the hours in this survey.

    Instructions for Reporting on the Wage Data Form:

    NOTE: When working on Prevailing Wage Projects there is a Base Wage Rate and a Fringe Benefit Rate. Please separate the two rates.

    GO TO: http://www.workforcewv.org/LMI/PrevailingWageSurvey/pwrs.html to watch a tutorial that walks you through the steps for completing this survey. REVIEW ACTIVTY DURING REFERENCE WEEKS: Review the four reference weeks on the form and identify the periods where your company performed construction or construction-related services on a non-residential construction site.

    REVIEW THE JOB CLASSIFICATION BOOKLET: To identify the occupations your employees performed work in, use the Job Classification Booklet to determine the job title to use on the Wage Data Form.

    WAGE RATE REGION: Identify the region where the work took place. A map and a list of West Virginia counties and the applicable wage rate regions are provided on page 6.

    JOB TITLE OF EMPLOYEE: Provide the job title for all the employees listed on the line. If a single employee worked in more than one occupation or in more than one region during the required weeks, report the employee on more than one line according to the hours worked. Job Titles and Occupational Codes are on page 7.

    SKILL LEVEL: Please enter a 1 for Skilled Craftsman/Journeyman or 0 for Entry-level Craftsman/Sub-Journeyman.

    Skilled Craftsman/Journeyman: A fully skilled craftsman who can work independently in the trade or occupation. Generally, a skilled craftsman has a minimum of four years of verifiable trade-specific experience or has completed a state certified apprenticeship program in the applicable trade. Skilled craftsmen/journeymen are licensed where licensing is required.

    Entry-level Craftsman/Sub-Journeyman: A worker who cannot work independently in the trade or occupation. Generally, an entry-level craftsman/sub-journeyman has fewer than four years of trade-specific experience and has not completed a state certified apprenticeship program in the applicable trade.

    Apprentice: You are not required to submit information for the registered apprentices within your firm. If a worker does not qualify as a Skilled Craftsman/Journeyman or is not in a state approved apprenticeship program, the worker should be listed as an “Entry-level Craftsman/Sub- journeyman”.

    BASIC HOURLY RATE: Enter the rate of hourly wage paid. Include ONLY the basic worker rate.

    Exclude: ● overtime pay but include overtime hours ● supervisor differentials ● per diem ● crew leader differentials ● zone pay ● production bonuses ● fringe benefits including vacation pay Note: If you are reporting work performed on a project subject to state or federal prevailing wage laws, and have paid required fringe benefits in cash, please separate these amounts on the Wage Data Form. See Example on next page.

    GRAVITY NEVER FORGETS

    Start with a good foundation Proper ladder setup will help prevent slips and falls. Place the base on a firm, solid surface. Avoid slippery, wet or soft surfaces. If you must put the ladder on a soft surface, place a board under the ladder’s feet to provide firm footing. Make sure the top of the ladder has firm support as well. Never lean a ladder against a window pane or other unstable surface. If you’re using a straight or extension ladder, the angle of the ladder is the next critical safety factor. A straight or extension ladder should be placed 1 foot away from the surface it rests against for every 4 feet of ladder height. For example, if the ladder is 4 feet high, the bottom of the ladder should be 1 foot away from the support surface. If you use a ladder to access a roof or platform, make sure the ladder extends at least 3 feet over the roof or platform edge. Be sure to securely fasten straight and extension ladders to the upper support. If you have angled the ladder properly and still have doubts about its stability, have someone hold the ladder before climbing up. If you’re using a step ladder, be sure to open it completely before you climb. If you have to use a step ladder near a doorway, lock or barricade the door and post signs so no one will open it and knock you off the ladder.

    Climb with care When you climb, always face the ladder and grip the rungs of the ladder to climb, not the side rails. Never get on or off a ladder from the side unless it has been secured to prevent movement. Never climb with equipment in your hands. Use your pockets, equipment belt, or a tool pouch and raise heavy objects with a hand line. If you forget something, always climb down the ladder to retrieve it yourself; don’t have someone toss it up to you. And never ask someone to climb up your ladder to give you supplies. It is dangerous to exceed the weight limits that a specific ladder can handle. When you descend a ladder, practice the same safety rules. Face the ladder, keep your body square and hold on to the rungs. Lastly, step off at the bottom rung of the ladder. Never jump off of a ladder. Before you start to haul a ladder around, evaluate the area where you’ll be working. Ladders can be heavy and unwieldy. You can strike another person or object, or hit electrical power lines. Make the ladder as compact as possible before transporting it. Carry it horizontally while tilting it higher in front and lower in back. If the ladder is

    particularly long and heavy, get a co-worker to help you carry it. Ladder safety may seem simple, but injuries occur every year. Below are some ladder safety dos and don’ts:

    Use the right ladder for the job. Read all warning labels carefully and follow directions before you climb. Wear clean, dry, slip-resistant shoes and use ladders with slip resistant feet. Don’t stand any higher than the third rung from the top of the ladder. Don’t lean too far or overreach. Reposition the ladder closer to the work instead. Don’t use a ladder as a bridge or scaffold. Don’t put a ladder on a box, barrel or other object to gain additional height. Don’t use a damaged or unsafe ladder.

    WVDOH REVENUES UP $8.2 MILLION OVER PREVIOUS YEAR In some good news for a change on the funding front, the WV Division of Highways ended its Fiscal Year 2015 on June 30, 2015 with total revenues of $742.9 million. This is $47.4 million over the Governor’s FY2015 estimate and $8.3 million over 2014 actual revenues of $734.7 million. Compared to FY 2014, actual Motor Fuel tax collection was down $6.2 million. Motor Fuel collection projections for 2015 were conservative but this year’s actual collections were $9.3 million, or 2.2% above the Governor’s estimate. Registration Fees and the Privilege Tax also were above estimates and last year’s actual collections. Registration Fees were up $3.3 million over FY 2014 collections of $97.3 million. The Privilege Tax continues to surpass expectations. The tax on the sale of vehicles is also $11.5 million over last year’s actual collections and $29.3 million over the Governor’s estimate. The Privilege Tax generated this year is $206 million, or 16.6% over the Governor’s estimate of $176.6 million. A breakdown of FY 2015 collections verses estimates follows:
