    Presentments: American Grand Jury

    July 8, 2009

    On July 8, 2009 the American Grand Jury convened and conducted itsfinal day of deliberations with regard to CRIMINAL activity,complaints and allegations presented before said Grand Jury.

    Such charges and presentments of criminal activity were handed down againstthe person(s) known as Barack Obama, aka: Barack Obama, Jr., aka: BarackHussein Obama, aka: Barry Soetoro; aka: Barry Obama; aka: Barack Obama,presumed President of the United States (hereinafter known as Obama);

    Said Grand Jury was duly organized and empowered under the laws

    of the Constitution of United States of America as follows:

    Scope and Authority of the Grand Jury

    The Constitution of the United States, Amendment 1 and Amendment5, known as portions of the Bill of Rights states:

    Amendment 1: Congress shall make no law respecting an establishment ofreligion, or prohibiting the free exercise thereof; or abridging the freedom ofspeech, or of the press; or the right of the people peaceably to assemble, and topetition the Government for a redress of grievances.

    Amendment 5: No person shall be held to answer for a capital, or otherwiseinfamous crime, unless on a presentment or indictment of a Grand Jury,

    Said Grand Jury was convened under the power and authority vested with thepeople as guaranteed under the Constitution, Amendment 5, Bill of Rights.

    The convened Grand Jury was "national" in nature, represented by people of theUnited States, said people being citizens as were sworn under Oath as toEligibility for and Service in behalf of the Grand Jury:

    Each Jury member was eligible as follows:

    1) A citizen of the United States;2) A citizen of eighteen (18) years or older;3) A resident of a State chartered within the United States of America4) Were in possession of his/her natural faculties, of ordinary intelligence,of sound judgment and of fair character;5) Possessed a sufficient knowledge of the English language;6) Were not serving as a trial juror in any court;

  • 8/3/2019 Presentments,July 8,2009

    3/16

    7) Had not been convicted of a malfeasance in office, a felony, or otherhigh crime;8) Were not serving as an elected public officer.

    Each Jury member did SWEAR or AFFIRM as follows:

    "That I (jury member) shall diligently inquire, and truepresentment make, of all such matters as may be given me beforethe jury, or shall come to my knowledge, touching such service. Ishall present no person through prejudice or ill will, nor leave anyun-presented through fear or favor, but in all my presentmentsshall endeavor to present the truth, the whole truth, and nothingbut the truth (affirmed) or so help me God (sworn)."

    Said affirmation or sworn oath was duly subscribed by appearance of each jury

    member before a notary public whereby each jury member affirmed or swore theOath of Office for service to the Grand Jury; furthermore each jury memberverbally repeated the "oath" and acknowledged their eligibility in front of saidnotary by signing their name in execution. Said notary acknowledged that saidjury member executed the "Eligibility and Oath of Office" document for thepurposes therein contained by placing their notary hand and seal upon thedocument.

    Each original jury member's "Oath of Office and Eligibility" document was sealedand recorded in a central location for purposes of empowering the Grand Jury.

    A jury foreman (moderator) and alternate jury foreman were appointed toconduct the Grand Jury hearing.

    Said Grand Jury hearing was conducted in secrecy. All evidence was sealed andprotected. All witnesses were sworn under oath. All presentments (charges) werevoted upon. Said Grand Jury was comprised of 38 regular Grand Jury members,plus 1 Jury Foremen.

    Criminal complaints were placed before the Grand Jury

    COUNT ONE:

    That Obama is NOT eligible under the laws of the Constitutionof the United States as provided for in Article II, Section 1.

    Page 2-

  • 8/3/2019 Presentments,July 8,2009

    4/16

    Said Article II, Section 1 states:

    "No person except a natural born Citizen, or a Citizen of the UnitedStates, at the time of the Adoption of this Constitution, shall be eligible tothe Office of President; neither shall any Person be eligible to that Officewho shall not have attained to the Age of thirty-five Years, and beenfourteen Years a Resident within the United States."

    Wherefore, Obama is not a "natural born Citizen" for thefollowing reasons:

    1) Obama was NOT born of mother and father who were BOTHUS Citizens.

    "These facts are not in dispute: Under the BritishNationality Act 1948, Obama's father was a British

    citizen/subject when he was born in the English colony ofKenya. Obama's father continued to be such and not a U.S.citizen when Obama was born in 1961. Under the same BNA1948, at birth, regardless of where he was born, Obamaalso became a British citizen/subject by descent from hisBritish father.

    As applicable only to a Presidential Article II 'natural bornCitizen':

    ...the individual must be born in the United States to a

    mother and father who are themselves United Statescitizens (by birth or naturalization). This is to assure that awould-be, all powerful President and Commander in Chiefof the Military has sole allegiance and loyalty to the UnitedStates from the time of birth.

    It is public knowledge that Obama has admitted in hiswritings and otherwise that when he was born, his fatherwas a British citizen/subject and not a United States citizenand that at that time he himself also became such. In fact,his father was not even a permanent resident of the United

    States, but rather only a student who would probably havebeen here only on a temporary student visa. Hence, not onlywas Obama's father not a United States citizen but Obamahimself was born a British subject/citizen. Hence, clearly,Obama is not and cannot be an Article II 'natural bornCitizen.' The operative facts are not in dispute."

    2) Obama was a British citizen 'at birth.'

    "Since Barack Obama's father was a citizen of Kenya andtherefore subject to the jurisdiction of the United Kingdomat the time of Obama's birth, then Obama was a Britishcitizen 'at birth.' "

    "The Framers of the Constitution, at the time of their birth,"Donofrio writes, "were also British citizens, and that's whythe Framers declared that, while they were citizens of theUnited States, they themselves were not 'natural borncitizens."

    "Therefore," Donofrio summarizes, "even if he were to

    produce an original birth certificate proving he were bornon U.S. soil, he still wouldn't be eligible to be president."

    Leo Donofrio, Esq.Licensed AttorneyState of New Jersey

    COUNT TWO:

    The charge of "Treason" against Obama is before the people ofthe United States of America. That such complaint is

    CRIMINAL, of high crimes, and extremely damaging against thepeople.

    Said complaint was formally brought by a Military Officer (retired) of theUnited States of America. All United States Military Officers are sworn touphold the Constitution of the United States and such complaint is valid,explicit and proper; when an Officer is aware of such malfeasance ofTreason by an offender it is that Officer's SWORN duty to come forwardand present such accusation and complaint;

    The Military Officer who filed the complaint is Lt. Commander

    Walter Fitzpatrick, III, retired, United States Navy and agraduate of the United States Naval Academy;

    Lt. Commander Fitzpatrick on March 17, 2009 did hereby make suchcriminal accusation and complaint against Obama and presented saidcomplaint before the U.S Attorney Russell Dedrick, and Assistant U.S.Attorney Edward Schmutzer, Eastern District, Tennessee;

    6/16

    An original photocopy of said complaint was submitted to the Grand Juryas evidence for immediate investigation;

    Said original photocopy of the complete criminal complaint isattached as Exhibit "A" hereto and made a part hereof;

    Lt. Commander Fitzpatrick was sworn under oath before the Grand Juryto testify as to the true nature and details regarding said criminalcomplaint filed against Obama;

    Said criminal complaint by Lt. Commander Fitzpatrick and his "accusationof Treason" is quoted in the excerpt below:

    "Now you [Obama] have broken in and entered the White Houseby force of contrivance, concealment, conceit, dissembling, anddeceit. Posing as an impostor president and commander in chiefyou have stripped civilian command and control over the militaryestablishment. Known military criminal actors-command

    racketeers-are now free in the exercise of military governmentintent upon destruction of America's constitutional government.

    We come now to this reckoning. I accuse you and yourmilitary-political criminal assistants of TREASON. I nameyou and your military criminal associates as traitors. Yourcriminal ascension manifests a clear and present danger. Youfundamentally changed our form of government. The Constitutionno longer works.

    Confident holding your silent agreement and admission, I identify

    you as a foreign born domestic enemy.

    My sworn duty Mr. Obama is to stand against what you stand for.You are not my president. You are not my commander in chief."

    Scope of Investigations and Deliberations of the Grand Juryhearing

    Wherefore, the Grand Jury conducted its session over a period of 5days. The final voting days were conducted on Sunday and Monday,July 12 through July 13, 2009.

    DO NOT SEND or INCLUDE these Instructions when serving

    FINAL DOCUMENTS for your private use only!

    Instructions for Serving Presentments

    Currently we use two methods for serving presentments, in

    person and by certified mail.

    Follow these Steps to first prepare aWorking set of serve documents:

    1. Print all the pages out from this file. This will become your originalset.

    2. At the very end of this file is the COVER PAGE. The Cover page isimportant. REPLACE my Introduction letter with yourCover Page. The Cover Page is the very LAST page locatedin this file. The Cover Page identifies to the Court or served

    person the Presentments. The Cover Page can also be used as areceipt when filing in person. The Cover Page will become yourFIRST page when the final serve documents are prepared.

    3. Sign the Cover Page it in front of a Notary. After it is notarized, youcan make as many copies as you need.

    4. Fill in the State name at the top of the Cover Page.

    5. Leave the jurisdiction blank for now. Only fill that out when youare ready to prepare final serve documents. Note: the

    jurisdiction is the name of the court, officer, judge or official youare serving.

    6. Keep ONE Working Set on hand (including the notarized CoverPage). This way you can copy the Working set to make uppresentment sets as needed.

    A Final WORKING SET for serving includes everything in this fileEXCEPT my introduction letter and the instructions: 12 pages to beexact.

    REPLACE my Introduction letter with your Cover Page.

    Hand-deliver the presentments (2 sets per serve) to any one of these offices orOfficers:

    County Court house

    State or Federal Attorney

    Judge District Attorney or Assistant District Attorney. Grand Jury empanelled by the Court (if in session) State or National Legislator, Governor or other Official

    Be polite. We cannot excuse any person for being unprofessional or rude whenserving documents. Be knowledgeable and confident. There will be times whenclerks or officials may not wish to accept your presentments. Dont argue withthem. Simply say fine, I need your reason in writing why you will not acceptservice. I will be happy to wait while you prepare the letter. And please askthem to put in the letter who the authority is above them. Explain to them thatthese documents must be served and if they cannot accept service then we needto go directly to their boss for service. Be patient and be sincere. Hand them thepresentments and ask where you can sit down while you wait for their letter.

    Additional strategies:

    Indicate to them you are making a presentment from a Grand Jury andyou want to serve the court or person as a matter of record.

    Stay away from the word file. You are not filing a lawsuit. If the court says you need a case number remind them that you are not

    filing a case or complaint. If they continue to insist on a case number tellthem to please have the court assign a case number after giving thepresentments to the court for processing.

    You are notifying the authorities of a crime. This is not a civil case. This is

    a criminal presentment authorized by the 5th

    amendment of theConstitution.

    Be firm in your information, advise them that not informing lawenforcement or the courts of a crime is an act of MISPRISION, and you(the deliverer) do not want to be guilty of that. (Misprision: Legallydefined as knowing of a crime and being responsible to act on it, butdeclining to do so).

    If they take the document, do not take it back, but insist on some kind of areceipt or service acceptance. SEE BELOW TIP.

    Leave the presentments there even if you do not get a receipt. If they havepossession of it, they MUST deal with it.

    Your individual efforts are making a difference. Everyones experience will bedifferent. In the long run the courts will have to do their job or be faced withlosing public credibility.

    Once you have some kind of receipt in hand simply thank them and leave. Donthang around to discuss anything. At that point you are deaf and dumb. The dealis closed now leave.

    15/16

    RECEIPT tip: The cover letter can be used as a receipt. It has a box at thetop where someone can sign or stamp the documents served. Take an extra copyof the Cover Letter for this purpose.

    Mailing InstructionsWhen mailing the Presentments, you will need two copies of the Cover Sheet andone copy of the presentments. The extra Cover Sheet is for a return receipt fromthe court or individual serving.

    Include a self addressed stamped envelope so the clerk can return the receipt (orCover letter) back to you.

    These types of mailings can be used:

    United States Postal Service:

    Certified mail, with Return Receipt.

    Restricted mail return receipt.

    You can use FedEx or UPS if you wish. These services are somewhat moreexpensive.

    Sending a presentment by USPS is inexpensive, about $7 to $8 per mailing.

    Save your receipts from the Post Office.

    Thank you,
