Pre-Election ReportI WATCH Domestic Observation Mission

Political Context:

Following the adoption of Tunisia’snew Constitution, domestic andinternational attention shifted to theorganization of both legislative andpresidential elections. The awaited-forelections were expected to put an end tothe current transitional period and pave theway for a longer sustainable period ofpolitical stability stretching over the nextfive years. However, politicalcomplications experienced by Tunisia,especially after the assassination ofMohamed Brahmi, made politicaldecision-making longer, though moreinclusive and consensual. Theestablishment of the “National Dialogue”allowed wider political participation forparties not represented under the NationalConstituent Assembly’s dome.Unfortunately, in spite of the newconsensual atmosphere, elections wereaffected directly by the new politicalmetamorphosis.

First, elections were affected by thedelay in the adoption of the Electoral Law.Second, the delays in the vote ofconfidence for the new ISIE members ledto an increased delay in the adoption of aclear electoral road map. In addition,political polarization played a momentousrole in the slowing down the electoralprocess. It was only by the end of May,beginning of June that a clear calendarwith exact dates for elections becameavailable. It took months for parties in theNational Dialogue to agree on whichelections to hold first: Presidential orLegislative. Moreover, as the newConstitution clearly states that all electionsare to be held by the end of 2014, the ISIEhad only 6 months left to organize threedifferent rounds of elections. Nonetheless,the fact that a new technocrat caretakergovernment replaced the partisan troikagovernment nuanced the concerns aroundthe bias of administration and/or abuse ofthe State resources.

The decision of the new ISIE not to build upon the “legacy” of the previous ISIE raised

suspicions about the ability of the current ISIE to organize three different rounds of elections

in such a short period. This haste into the organization of the elections - driven by the

inevitability to respect orthodoxly the constitution might be the reason behind the wobbling

performance of the ISIE.

ISIE and IRIE: Hovering Between Good and bad Performance

The performance of the ISIE could be described as unsteady and sometimes even

contradictory. While the ISIE could be accused of lack of transparency for not publishing -

though required by law - the minutes of its meetings, or the selection criteria used in the

recruitment of its staff or polling centers staff, the ISIE can , compared to the 2011 ISIE,

considered a law-abiding institution in terms of its compliance with public procurement

procedures.

IRIEs:

The appointment of IRIE directors and members took place amid huge disapproval

(Gafsa, and France). In terms of performance, most of the feedback that our observers

received questioned the indifference of IRIEs in the face of a number of transgressions

jeopardizing the integrity of the process. On the other hand, it is to be mentioned that all

IRIEs demonstrated a great deal of cooperation with the I WATCH long-term observers

(Nabeul 2, Sousse).

Intersection Between the Legislative and the Presidential Processes:

Despite the efforts of the ISIE to avoid any sort of intersection between both the

Legislative and the Presidential processes, the presidential process overshadowed the

legislative one. Debates prompted by/about presidential candidates got more media coverage

than candidates and lists running in the legislative race. Consequently, the focus of media

switched into the presidential elections, which created in its turn a dispersion among voters.

This dispersion in voters’ attention affected also civil society endeavors seeking to raise the

awareness of people about regional legislative elections while the attention of people was

solely attributed to nationwide presidential elections.

Popular Sponsorships:

Popular sponsorships represented a colossal turning point of the entire electoral

process. They are considered as one of the unprecedented massive documented electoral

fraud. The slow reactions of both the judiciary and the ISIE in dealing with the issue of

sponsorships shed the light once again on the issue of impunity within the political class in

general. By the time a verdict is out, a candidate (forging sponsorships) could have been

declared the winner and obtained immunity. In addition, even though the electoral law states

that the ISIE should come up with a mechanism to control the attribution of sponsorships; the

electoral body failed to 1fulfill its tasks.

As such, I WATCH decided to take the sponsorship fraud to the judiciary by providing

legal assistance to victims of such fraud. Victims can also provide a power of attorney to I

WATCH to plead in court on their behalf.

Political Parties:

The Electoral Law clearly distinguishes between the pre-campaign and the campaign

periods with a clear prohibition of campaigning in the pre-campaign period. However, an

interesting number of political parties started their campaigns ahead of other parties. I

WATCH noticed a phenomenon that we chose to refer to as “rogue political parties” i.e.

some political parties deliberately started their campaigns earlier to test ISIE’s readiness and

responsiveness. If they felt that the ISIE is not ready - and this is the impression the ISIE

gave - they started an early campaign. Consequently, other parties decided also to start

campaigning, earlier than stipulated by law.

As a result, the campaign witnessed a number of irregularities mainly related to earlier

campaigning. A large number of political parties did not also inform the ISIE about their

campaign events although they have to report these events to the ISIE 24 hours ahead of time

in conformity with the Electoral Law.

As long as voters are concerned, despite the disbursement of the first instalment of the

public funding, not all political parties conducted their campaigns. Many did not even hang

their posters in their dedicated areas.

Media:

A slight improvement was noticed in a number of private media outlets, with the use of

technology aiming to monitor the talking points (timing) of each party representative.

However, it was also noticed that other private media outlets implicitly backed certain parties

in particular. Despite the fact that only party-owned media have the right to campaign for

their parties, it was noticed that a number of private media either promoted a particular

political party’s program through incognito ads or the repetitive attendance of that

party/candidate in their political shows. Despite the vigilance of the HAICA, the media bias

remains one of the negative aspects of the elections.

Campaign Finance:

I WATCH is conducting a second election-monitoring project on Campaign Finance

Monitoring. More details about the campaign finance will be released in a separate report.

However, “dirty political money” was used by several influential figures as mentioned by the

Chairman of the ISIE Chafik Sarsar, and the Caretaker President Mohamed Moncef

Marzouki, in addition to a number of other politicians. However, there no proof of the

existence of corrupt money in politics has been advanced by the court of accounts, the

Central Bank or the ISIE

Violence:

In their endeavors to observe elections, the I WATCH team of observers was victim,

several times, to political violence while covering campaign events. Two cases of aggression

were recorded in Sousse in addition to an intimidation attempt of the family of one of our

observers in Sfax. Inter-party violence took place in areas like Gafsa as well as the existence

of suspicions of vandalism and political-driven vandalism targeting candidates in Jendouba.

International Organizations:

A strong presence of International Observers is noticed during the legislative elections

despite security alerts issued by multiple embassies. Long-term as well as short-term

observers were deployed across the country in internal and coastal areas. I WATCH has been

approached by a number of international missions either through their long-term or short-

term observers.

People with Disabilities

A lack of coordination/communication between the Ministry of Education and the ISIE

might affect the voting of disabled people. As polling centers are under the supervision of the

Ministry of Education, the ISIE faced challenges in making polling centers accessible to

people with disabilities. In the second week of the campaign, I WATCH noticed an

improvement in terms of accessibility to the polling centers for disabled people. However,

more efforts need to be done to increase such access.
